Grant of Easement with Dorado Development, Inc. for Aspen Hills Apartments
GRANT OF EASEMENT
FOR VALUE RECEIVED, DORADO DEVELOPMENT, INC. ,GRANTOR
hereby grants, bargains, sells, conveys, and transfers unto CITY OF MERIDIAN, a
municipal corporation, GRANTEE, its successors and assigns, a permanent easement
and right-of-way for the purpose of locating, establishing, constructing, maintaining,
repairing and operating underground sewer and water lines and mains together with the
right to excavate and refill ditches and/or trenches for the location of said sewer and
water lines or mains, the right to remove bushes, trees, undergrowth and other
obstructions interfering with the location, construction and maintenance of said sewer
and water lines and mains and right of ingress and egress in, from, to and over said
easement for the purpose of inspecting, maintaining and repairing such sewer and water
mains and lines.
The perpetual easement and right-of-way hereby given, granted, conveyed and
transferred for maintaining, repairing and operating underground sewer and water lines
and mains is described in general language as follows:
A strip of land for the purpose of a sewer and water easement located in the
NW1/4 of the SW1/4 of Section 6, T.3N., R.1E., B.M., Ada County, Idaho, more
particularly described as follows: Commencing at the 1/4 corner common to Section 1,
T.3N., R.1W., and said section 6; thence South 00°25'30" East along the section line of
said Sections 1 and 6, 829.53 feet; thence leaving said section line North 88°34'59"
East, 196.25 feet to the REAL POINT OF BEGINNING of a strip of land lying 20 feet to
the right of the following described lines: North 00°53'02" West, 233.40 feet; North
43°49'13" East, 28.16 feet; North 73°13'40" East, 275.40 feet; North 88°48'30" East,
386.07 feet; South 46 ° 23' 13"East, 26.88 feet; South 31 ° 03'41 "East, 139.88 feet; South
01°52'39" East, 143.15 feet; South 13°24'53" East, 41.81 feet to a point on the North
right-of--way of James Court; thence 22.5 feet right of the following described line: South
88°34'59" West, 771.83 feet to the Point of Beginning and the end of said strip of land.
TO HAVE AND TO HOLD the said perpetual easement, rights, and rights-of-way
to City of Meridian, its successors and assigns forever, except the GRANTOR reserves
the right to occupy, use and cultivate the surface of said easement for all purposes not
inconsistent with the right herein granted. Further, the GRANTEE agrees and covenants
with the GRANTOR to restore the subsurface and surface of the easements and right-of-
way herein granted and conveyed, to a like condition existing prior to the grant of this
easement and right-of-way and to indemnify and save and hold harmless GRANTOR
from any and all losses, claims, actions, or judgments for damages or injuries to persons
or property arising out of or from, or caused by, the construction, operation, maintenance
and use of the aforesaid easements and rights-of-way.
