SANITARY SEWER EASEMENT THIS INDENTURE, made this 7th day of February, 1974, between Devco Incorporated, an Idaho Corporation, first party (hereinafter called the GRANTOR), and the City of Meridian, a municipal corporation, second party (hereinafter called the GRANTEE). WITNESSETH: WHEREAS the GRANTOR desires to provide a sanitary sewer right of way across the premises and property hereinafter particularly bounded and described; and WHEREAS the said sanitary sewer is to be provided for through an underground eight (8) inch poly-vinvl-chloride pipe line having been constructed at the expense of the GRANTOR; and WHEREAS it will be necessary to maintain and service this pipe line from time to time by the GRANTEE: NOW THEREFORE, in c ons iderati nn of the benefits to be secured by the GRANTOR, the4¢ ."Or, thn*r,se vPq and their successors in interest do, by these presents, give, grant and convey unto the GRANTEE a permanent easement and right of way on and across the following described real property, to -wit: Ar. Easement 20,00 feet in width lying 10.00 feet on each side of the following described centerline: Commencing at the Center of Section 79 Township 3 North, Range 1 East, Boise Meridian, Ada County, Idaho and running Ns 00 00. 00" E. 963.00 feet along the Easterly boundary of the NW 1/4 of said Section 7 to a point; thence S. 890 01' 30" W. 732.00 feet along a line parallel to and 963.00 feet Northerly from the Southerly boundary of the said NW 1/4, Section 7, said line also being the extended centerline of East Washington Avenue, to a point on the extended centerline of East Fourth Street; thence N. 00 00' 00" E. 130.00 feet along a line parallel to and 732.00 feet Westerly from the said Easterly boundary of the NW 1/4, Section 7, also being along the said extended centerline of East Fourth Street, to a point; thence N. 890 01' 30" E. 10.00 feet along a line parallel to and 1093.00 feet Northerly from the said Southerly boundary of the NW 1/4, Section 7 to the TRUE POINT OF BEGINNING OF THE EASEMENT; thence N. 00 00' 00" E. 101.00 feet along a line parallel to and 722.00 feet Westerly from the said Easterly boundary of the NW 1/4, Section 79 to a point; thence N. 890 01' 30" E. 260.00 feet along a line parallel to and 1194.00 feet Northerly from the said Southerly boundary of the NW 1/4, Section 7 to the POINT OF ENDING OF THE EASEMENT. The easement and right of way hereby granted is for the purpose of maintenance, repair and replacement at any and all tires. TO HAVE AND TO HOLD the said easement and right of way unto the said GRANTEE, its successors and assigns forever. IT IS EXPRESSLY UNDERSTOOD AND AGREED by and between the parties hereto that the GRANTEE will make future repairs or replacements of the sewer line, expediently, and replace and restore the premises, fences, or ditches to a condition comparable to that existent -prior to undertaking such installations, repairs and or replacements. And the said first party hereby covenant with the second party that they have lawfully seized and possessed of the aforementioned and described tract or parcel of land, and that they have a good and lawful right to convey said easement, and that they will warrant and forever defend the title and quiet possession therof against the lawful claims of all persons whomsoever. The GRANTEE shall not cause, suffer or permit the use of the premises and this easement for any other purpose or purposes other than the purpose for which it is granted by these presents.
