No. ~~ZS.31 ~ aax J~ ~SJ~ SANITARY SEWER EASEMENT THIS INDENTUKE, Made this 28th day of December, 1965, between MERIDIAN ATHLETIC ASSN, INC., an Idaho corporation, party of the first part, hereinafter called "Grantor," and the CITY OF MERIDIAN, a municipal corporation, party of the second part, hereinafter called "Grantee," WITNESSETH• WHEREAS, Local Improvement District No. 1 for the City of Meridian has been created to construct sanitary sewers, with the necessary manholes and appurtenances along certain sanitary sewer rights of way across the premises and property hereinafter particularly bounded and described; and WHEREAS, the sanitary sewer is to be provided for, through an underground pipeline to be constructed by the Grantee; and WHEREAS, it will be necessary to maintain and service said pipeline from time to time by the Grantee; NOW, THEK:iFORE, in consideration of the benefits to be received by the Grantor, and for the sum of One Dollar ($1.00), and other good and valuable considerations, the Grantor, does hereby give, grant and convey unto the Grantee the right of way for an easement for the construction, operation and maintenance of a sewer line over and across the following described property: A strip of lend five feet wide for a permanent easement and an additional strip of land twenty SANITARY SEWER EASEMENT, P. I ~ 52 X650 feet wide fora temporary construction easement on each side of the following described center line: Commencing at the Northwest corner of Section 18, Township 3 North, Range 1 East, Boise Meridian, Ada County, Idaho, and running North 89°20'24" East 325.01 feet along the Northerly boundary line of said Section 18 to a point; Thence South 0°49'05" Wast 356.00 feet along a line parallel to and 324.91 feet Easterly of the Westerly boundary line of said Section 18 to a point; Thence South 02°28'42" West 357.90 feet to a point which is 314.91 feet Easterly of the Westerly boundary line of said Section 18; Thence South 0°49'05" West 281.45 feet along a line parallel to and 314.91 feet Easterly of the Westerly boundary line of said Section 18 to a point; Thence South 88°43'55" East 5.00 feet to the TRUE POINT OF BEGINNING; Thence continuing South 88°43'55" East 152.13 feet to a point on the Westerly boundary of East First Street, said point being the ending of the easement. The easements hereby granted are for the purpose of construction and operation of a sanitary sewer line and allied facilities, together with their maintenance, repair, and replacement at the convenience of the Grantee, with the free right of access to such facilities at any and all times. TO HAVE AND TO HOLD, the said easements and rights of way unto the said Grantee, its successors and assigns forever. IT IS EXPRESSLY UNDERSTOOD AND AGREED, by and between the parties hereto that the Grantee will timely complete the work of laying the sanitary sewer line and restore the premises used therefor to a condition comparable with that existing prior to exercising the easements; that in making future repairs the Grantee will expediently replace and SANITARY SEWER EASENII:NT, P. 2 aa,~ 5~ eaec6~~1 restore the premises to a condition comparable to that existent prior to undertaking such repairs and replacements. The Grantor hereby covenants and agrees that it will not place or allow to be placed any permanent structures on the area described for the easements which would inter- fere with the use oz the described easements for the purposes stated herein. The Grantor does hereby covenant with the Grantee that it is lawfully seised and possessed of the aforementioned and described tract of land, and that it has a good and lawful right to convey said easements, and it will warrant and forever defend the title and quiet possession thereof against the lawful claims of all persons whomsoever.
