SANITAKY SEWER EASEMENT
THIS INDENTUKE, Made this 28th day of December, 1965,
between MERIDIAN HOWLING LANES, INC., an Idaho corporation,
party of the first part, hereinafter called "Grantor," and
the CITY OF MERIDIAN, a municipal corporation, party of the
second part, hereinafter called "Grantee,"
WITNESSETH•
WHEREAS, Local Improvement District No. 1 for the City
of Meridian has been created to construct sanitary sewers,
with the necessary manholes and appurtenances along certain
sanitary sewer rights of way across the premises and property
hereinafter particularly bounded and described; and
WHEREAS, the sanitary sewer is to be provided for,
through an underground pipeline to be constructed by the
Grantee; and
W1iEKEA~, it will be necessary to maintain and service
said pipeline from time to time by the Grantee;
NOW, THEKEFOi:E, in consideration of the benefits to be
received by the Grantor, and for the sum of One Dollar ($1.U0),
and other good and valuable considerations, the Grantor does
hereby give, grant and convey unto the Grantee the right of
way for an easement for the construction, operation and
maintenance of a sewer line over and across the following
described property:
A strip of land five feet wide fora permanent
easement and an additional strip of land twenty
feet wide for a temporary construction easement

on each side of the following described center
line:
Commencing at the Northwest corner, Section 18,
Township 3 North, Range 1 East, Boise Meridian,
Ada County, Idaho, and running North 89°20'24"
West 325.01 feet along the Northerly boundary line
of said Section 18;
Thence South 0°49'05" Weat 356.00 feet along a
line parallel to and 324.91 feet 8asterly of the
Westerly boundary line of said Section 18 to a
point;
Thence South 02°28'42" West 357.90 feet to a point
which is 314.91 feet 8ssterly of the Westerly boundary
line of said Section 18;
Thence South 0°49'05" West 227.59 feet along a
line parallel to and 314.91 feet 8asterly of the
Westerly boundary line of the said Section 18 to
a point, said point being the true point of
beginning;
Thence continuing South 0°49'05" Weat 295.00
feet along a line parallel to and 314.91 feet
Easterly of the Westerly boundary line of the
said Section 18 to a point on the Northerly road
right-of-way line, said point being the point of
ending of the easement.
The easements hereby granted are for the purpose of
construction and operation of a sanitary sewer line and
allied facilities, together with their maintenance, repair,
and replacement at the convenience of the Grantee, with the
free right of access to such facilities at any and all times.
TO HAVE AND TO HOLD, the said easements and rights of
way unto the said Grantee, its successors and assigns forever.
IT IS EXPRESSLY UNDEKSTOOD AND AGREED by and between
the parties hereto that the Grantee will timely complete
the work of laying the sanitary sewer line and restore the
premises used therefor to a condition comparable with that

existing prior to exercising the easements; that in making
future repairs the Grantee will expediently replace and
restore the premises to a condition comparable to that
existent prior to undertaking such repairs and replacements.
The Grantor hereby covenants and agrees that it will
not place or allow to be placed any permanent structures
on the area described for the easements which would inter-
fere with the use of the described easements for the purposes
stated herein.
The Grantor does hereby covenant with the Grantee that
it is lawfully seised and possessed of the aforementioned
and described tract of land, and that it has a good and
lawful right to convey said easements, and it will warrant
and forever defend the title and quiet possession thereof
against the lawful claims of all persons whomsoever.
IN WITNESS LJIIEREOF, the said party of the first part
has hereunto caused its corporate name to be subscribed
by its duly authorized officers on the day and year first
hereinabove written.

Re: Local Improvement District No. 1, Sewer Extension Project
City of Meridian, Idaho
Pursuant to contract documents and cited provisions thereof, you are
notified to proceed with the work covered by the above-referenced contract.
The date of February 14, 1966, will be the effective date from which com-
pletion time will be computed.
Specialty Construction Co. also agrees to commence work on or before
the date of February 24, 1866, and to fully complete the project within
30 calendar days of the effective date stated above.
The firm of Johnson, Underkofler ~ Briggs, Consulting Engineers, will
serve as the City of Meridian's representative in matters pertaining to
the construction under this project.
