second part, and hereinafter called Grantee;

WASI2B~8, Local Improvement District No. 1 for the City of
Meridian has been created to coaetruet sanitary sewers, with the
necessary manholes and appurtenances along certain sanitary sewer
rights of way across the premises and property hereinafter
particularly bounded and described; sad
WHTREAB, the sanitary sewer is to be .provided for through
sa underground pipe line to be constructed by the Grantee; and
Wf~;REAS, it will•be necessary to maintain and service said
pipe line from time to time by the Grantee;
NOW, THEREFORE, in consideration of the benefits to be
received by the Grantors, and for the sum of one (51.00) dollar,
and other good and valuable considerations, the Grantors, do
hereby give, grant end convey unto the Grantee the right of way
for an easement for the construction, operation and maintenance
of a sewer line over and across the following described property:
A strip of land 5 ft. wide for a permanent easement and an
additional strip of land 20 ft, wide for a temporary construction
easement on each side of the following described center line:
Commencing at the Northwest'corner, Section 18, Township 3 North,
Range 1 East, Boise Meridian, Ada County, Idaho, and running
North 89°20'24" East 325.01 feat along the Northerly boundary line
of said Section 18;
thence South 0°49'05" Weet 30.00 feet along a line parallel to and
324.91 feet Easterly of the Westerly boundary line of said
Section 18 to a point on the Southerly road right-of-way line
U.S. Highway 30, said point being the TRUE POINT OF BEGINNING;
thence continuing South 0°4g'05" West 326.00 feet along a line
parallel to and 324.91 feet Easterly of the Westerly boundary line
of said Section 18 to a point;
thence South 2°28'42" Weat 357.90 feet to a point which is 314.91
feet Easterly of the Westerly boundary line of said Section 18.

Range 1 East, Boise Meridian, Ada County, Idaho, and running
North 89°20'24" East 325.01 feet along the Northerly boundary line
of said Section 18;
thence South 0°49'05" West 388.8 feet along a line parallel to and
324.91 feet Easterly of the Westerly boundary line o£ said
Section 18 to a point, said point being the TRUE POINT OF BEGINNIN
thence South 89°20'24" West 149.91 feet to a point which is
15.0 feet Easterly of the Westerly boundary line of said
Section 18.
The easements hereby granted are for the purpose of construc-
tion and operation of a sanitary sewer line and allied facilities,
together with their maintenance, repair, and replacement at the
convenience of the Grantee, with the free right of access to such
facilities at any and all time a.
TO HAVE AND TO HOLD, the said easements and rights of way unto
the said Grantee, its successors and assigns forever.
IT IS EXPRESSLY UNDERSTOOD AND AGREED, by and between the
parties hereto that the Grantee, will timely complete the work
of laying the sanitary sewer line and restore the premises used
therefor to a condition comparable with that existing prior to
I exercising the easements; that in making future repairs the
Grantee will expediently replace and restore the premises to a
condition comparable to that existent prior to undertaking such
repairs and replacements.
THE GRANTORS hereby covenant and agree that they will not
place or allow to be placed any permanent structures on the area

lawful claims of all persons whomsoever.

The date of February 14, 1966, will be the effective date from which com-
pletion time will be computed.
Specialty Construction Co. also agrees to commence work on or before
the date of February 24, 1866, and to fully complete the project within
30 calendar days of the effective date stated above.
The firm of Johnson, Underkof1er & Briggs, Consulting Engineers, tNill
serve as the c;ty of Meridian's representative in matters pertaining to
the construction under this project.
