RIGHT OF WAY EASEMENT
THIS INDENTURE, Made and entered into this ~ day of May,
1965, by and between M. S. KLINE~and LILLIAN KLINE, husband and
wife, of Meridian, Idaho, as Grantors, and the CITY OF MERIDIAN,
Ada County, Idaho, a municipal corporation, as Grantee, WITNESSETH:
WHEREAS, the said Grantors are the owners in fee simple of a.
parcel of land lying and being within the corporate limits of said
City of Meridian, Ada County, Idaho, particularly described as
follows:
Beginning at the center of Section 7, Township 3 North, Range 1
East, B.M., and running thence North on the East line of the E2
of the NW~ of said Section 7, a distance of 632 feet to a point;
thence West 150 feet; thence North 331 feet; theme West 582 feet
to a point, which is the real place of beginning; thence North
336 1/8 feet to a point; thence West 259.2 feet to a point; thence
South 336 1/8 feet to a point; thence East 259.2 feet to the
place of beginning, containing 2 acres, more or less.
AND WHEREAS, the Grantee herein desires to construct a pipe
line and lift station for conveying sewage upon and across the above
described land in connection with additional sewer lines, the des-
cription of the easement across said land being described as
follows:
The easement to be acquired shall include 5 feet for a permanent
easement and an additional 15 feet for a tem„porar~ constr,~,ction
easement on each side of the following described center line:
Commencing at the center line intersection of Washington Avenue
and the extended center line of East 4th Street and running North
177 feet along the extended center line of East 4th Street to the
TRUE POINT OF BEGINNING of the easement; thence West 245 feet on
a line parallel and 177 feet North of the center line of Washington
Avenue to a point in the existing 8 inch sewer line, said point
being the point of ending of the easement.
THEREFORE

give and grant the City of Meridian, its successors, and assigns,
forever, the right to lay, maintain, operate, use, repair and remove
a certain pipe line for conveying sewage through, over and across
the above described real property for the purpose aforesaid.
Said pipe and pipe line shall be laid under the surface of the
ground and the soil around the-same shall be packed reasonably
level with the surface of the ground.
The Grantee shall at all times have full and free access to
the right of way for said pipe line for any necessary purpose
connected with the use, operation, repair and enjoyment of said
pipe line, and shall have full and free access at all times through
its agents, servants and employees, to and across the above des-
cribed lands of the Grantors for all purposes connected with this
easement.
As further consideration for this easement the Grantee has
covenanted to repair and restore any damage and to perform the
necessary cleaning up after the laying of said line provided,
however, that Grantors agree that the existence of the lines or
lift station as provided herein shall not constitute damage to the
property.
