R-8_(nonconforming -see anal) Comments: Conditions of Approval: Project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site. The issuance of this permit does not release the applicant from any previous requirements of the other permits issued for this site. Because the site is partially zoned residential, the Meridian Planning Department has determined the use as non-conforming. Including but not limited to, the parking area, the retail store, signage, and site improvements. UDC 11-1B-4 states non-conforming uses may continue as long as the use remains lawful and is not expanded orextended. Anon-conforming use may be extended to occupy additional land area only through the approval of a conditional use permit. Furthermore, no existing structure containing a nonconforming use may be enlarged, extended, constructed, reconstructed, moved or structurally altered except through the approval of a conditional use permit or the use of the structure is changed to a conforming use. The applicant is proposing a facade improvement and is not proposing any expansions, enlargements, etcetera. Any future expansions of the site shall be subject to the requirements of the Unified Development Code (UDC). Certificate of Occupancy: All required improvements must be complete prior to obtaining a Certificate of Occupancy. All changes in occupancyneed to comply with the requirements of the Building Department. It is unlawful to use or occupy any building or structure until the Building Official has issued a certificate of occupancy. A certificate of occupancy or temporary certificate of occupancy is obtained from the Building Department (208) 887-2211 after inspections are complete and the field inspection record is returned to the Building Department. Site Plan: Site improvements are not proposed at this time. At such time improvements are proposed, the applicant shall meet all applicable zoning standards for the City of Meridian. The existing site is not to be altered without prior written approval of the Planning Department. Landscaping: Landscaping on the site currently exists and changes are not proposed with this CZC application. Further, the applicant is NOT proposing an addition to the existing structure with this approval. Per UDC 11-3B-2D the site does not need to comply with the standards set forth in UDC 11-3B. However, when future additions are proposed the site shall comply with the standards set forth in the Unified Development Code. All structure additions shall be cumulative. Design Review: The site design and building elevations are found to be consistent with the Meridian Design Manual and UDC 11-3A-19; stamped "Approved" on May 11, 2009. Elevations: The Elevations submitted for design review, prepared by Glancey Rockwell & Associates dated April 16, 2009, labeled A-1.1 and A-1.2, are approved (stamped "Approved" on May 11, 2009) with no changes from the Planning Department Protection of Existing Trees: Any existing trees on site must be protected or mitigated for in accordance with the Tree Preservation section of the City's Landscape. Ordinance. Per UDC 11-3B- 10, coordinate with the Parks Department Arborist (Elroy Huff, 888-3579) for approval of protection/relocationrneasures for the existing trees prior to construction. Any severely damaged tree must be replaced in compliance with UDC 11-3B-10-C.5. Drainage: Storm water drainage swales shall not have a slope steeper than 3:1, shall be fully vegetated, and shall be designed in compliance with UDC 11-3B-11 and UDC 11-3A-18. Li hting: Lighting shall not cause glare or impact the traveling public or neighboring development and comply with lighting standards as defined in UDC 11-3A-11. ~. Signag_e: No signs are approved with this CZC. All business signs will require a separate sign permit in compliance with UDC 11-3D. Handicap-Accessibility: The structure, site improvements and parking areas must be incompliance with all federal handicap-accessibility requirements. ACRD Acce tp ance: All impact fees, if any, shall be paid prior to the issuance of a building permit. If any changes must be made to the site plan to accommodate the ACRD requirements, a new site plan shall be submitted to the City of Meridian Planning staff for approval prior to the issuance of a building permit. fi Plan Modifications: Except for the changes mentioned above, the approved Site Plan, Landscape Plan stamped "Approved" on May 11, 2009, and Elevations, and are not to be altered without prior written approval of the Planning Department. No significant field changes to the site or landscape plans are permitted; prior written approval of all changes is required.
