RIGHT OF WAY EASEMENT
THIS INDENTURE, made and entered into this „~_~~y of
August, 195'7, by and between A. W. WELKER and ETHEL WELKER, husban
and wife, as Grantors, and the CITY OF MERIDIAN, Ada County, Idaho
a municipal corporation, as Grantee, WITNESSETH:-
WHEREAS, the said Grantors are the owners in fee simple of
a partial of land lying and being in Ada County, State of Idaho,
particularly described as follows: i
Lot 2 Block 6 of Welker Subdivision in the W~ E~ of Section 12, I
Township 3 North, Range 1 West, Boise Meridian, as shown on the
official plat now of record in the office of the. County Recorder
of Ada County, Idaho.
ARID WHEREAS, the Grantors have heretofore given permission
to Class A School District No. 2 of Ada and Canyon Counties,
Idaho, to construct a pipeline across the above described property
from east to west for the purpose of conveying domestic water to
be furnished by the city of Meridian, which pipeline terminates at
the west end of the above described property adjacent to property
owned by said school districts and
WHEREAS, the grantors desire that the City of Meridian have
the exclusive jurisdiction over and the ownership of said pipeline
and the land upon which said pipeline is constructed.
NOW THEREFORE, in consideration of the sum of one dollar
($1.00), lawful money ~ the United States, and other good and valu~
able consideration in hand paid, the receipt for which is hereby
acknowledged, the under signed, A. W. Welker and Ethel TAelker, do
hereby give and grant the City of Meridian, its successors and __

.,. gns forever, the exclusive jurisdiction over said pipeline and
a permanent easement across the above described property for the
purpose of conveying domestic water through said pipeline. And
said City is hereby granted the permanent right to come upon said
land for the purpose of free access to repair, use, operate and
enjoy the use of said psppline at all times through its agents,
