Grant of Easement with Hon, William A. for Dairy Queen Drive-In GRANT OF EASEMENT FOR VALUE RECEIVED, WILLIAM A. HON ,GRANTOR, hereby grants, bargains, sells, conveys, and transfers urno CITY OF MERIDIAN, a municipal corporation, GRANTEE, its successors and assigns, a permanern easemern and right-of-way for the purpose of locating, establishing, constructing, maintaining, repairing and operating underground sewer lines and mains together with the rgrn to excavate and refill ditches and/or trenches for the location of said sewer lines or mains, the right to remove bushes, trees, undergrowth and other obsfructions interfering with the location, construction and maintenance of said sewer lines and mains and the right of ingress and egress in, from, to and over said easement for the purpose of inspecting, maintaining and repairing such sewer mains and tines. Inconsideration of grarnirg this easement and right-of-way, the GRANTOR has the right to connect to said sewer line when developmem of GRANTOR'S property occurs. The perpetual easement and right-of-way hereby given, conveyed and transferred for mairnaining, repairing and operating underground sewer lines and mains is described in general language as fellows: AN EASEMENT LOCATED IN THE NW 1 /4 OF SECTI~t 18, TOWNSHIP 3 NORTH, RANGE 1 EAST OF THE BOISE MERIDIAN, MERIDIAN, IDAHO, BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: COMMENCING AT THE CENTER 1/4 CORNER OF SECTION 18, T.3 N., R.1 E., B.M., THENCE ALONG THE BOUNDARY OF CENTRAL VALLEY CORPORATE PARK NO. 1 (BOOK 57, PAGE 5332, ADA COUNTY RECORDERS OFFICE) THE FOLLOWING COURSES AND DISTANCES; S 89°42'15" W 50.01 FEET; N 0°2T58" E 818.42 FEET; S 89°31'22" W 626.39 FEET; THENCE N 0°28'28" E 504.01 FEET TO THE CENTER OF AN EXISTING SEWER LINE MANHOLE, THE REAL POINT OF BEGINNING OF THIS EASEMENT; THENCE ALONG THE CENTERLINE OF A 20 FOOT WIDE EASEMENT, BEING THE 10 FEET ADJACENT TO EACH SIDE OF SAID CENTERLWE THE FOLLOWING COURSES AND DISTANCES; S 0°31'02" W 227.03 FEET; S 89°31'22" W 295.29 FEET; N 83°57'27" W 352.28 FEET; S 89°31'22" W 324.95 FEET TO THE END POINT OF THIS EASEMENT, SAID END POINT BEING 25.00 FEET NORTHERLY OF THE NORTHEAST CORNER OF THE DAIRY QUEEN PROPERTY. TO HAVE AND TO HOLD the said perpetual easement, right, and rights-of-way to City of Meridian City, its successors and assigns forever, except the GRANTOR reserves the right to occupy, use and curtivate the surface of said easement for all purposes not inconsistent wRh the rghts herein granted. Further, the GRANTEE agrees and covenants with the GRANTOR to restore the subsurtace and surface of the easements and rights-of-way herein granted and conveyed, to a like condition existing prior to the grant of this easement and right-of-way and to indemnify and save and hold harmless GRANTOR from any and all losses, claims, actions or judgments for damages or injuries to parsons or property arising out of or from, or caused by, the construction, operating, maintenance and use of the aforesaid easements and rights-of-way.
