Landscaping: The Landscape Plan prepared by Tomlinson Designs, in August 24, 2007, labeled Sheet L1, is approved (stamped "Approved" on September 26, 2007 by the Meridian Planning Department) with the following changes/notes: 1) Replace the Golden Desert Ash, which is a prohibited tree due to disease and die -back, with a Deborah Norway Maple per UDC 11-3B-5. 2) Landscaped areas shall be at least seventy percent (70%) covered with vegetation at maturity (UDC 11 -3B -51t). 3) Provide a 5 foot wide landscape buffer with 1 tree on the east side of the parking area (UDC 11 -3B - 8C). Elevations: The Elevations prepared by Tomlinson Designs, labeled Sheets A3 and A4, are approved with no changes from the Planning Department. Irri ag tion: An underground, pressurized irrigation system must be installed to all landscape areas per the approved specifications and in accordance with UDC 11-3A-15. Protection of Existing Trees: Any existing trees on site must be protected or mitigated for in accordance with the Tree Preservation section of the City's Landscape Ordinance. Per UDC 11-3B-10, coordinate with the Parks Department Arborist (Elroy Huff, 888-3579) for approval of protection/relocation measures for the existing trees prior to construction. Any severely damaged tree must be replaced in compliance with UDC 11- 3B -10-C.5. Parking: The proposed parking areas shall be paved and striped in accordance with UDC 11-313. Project engineer/architect shall certify that the number and size of handicap -accessible spaces conforms to the Americans with Disabilities Act (ADA). Handicap accessible stalls must have signage in accordance per ADA and signed accessible. Curbing: Per UDC 11-313-5I, all landscape areas adjacent to driveways, parking lots, or other vehicle use areas, must be protected by curbing, wheel stops, or other approved protective devices. Curbing may be cut to allow for storm water runoff. Sidewalks: All sidewalks shall be constructed in accordance with 11-3A-17. Sidewalks shall be constructed prior to occupancy. Drainage: Storm water drainage swales shall not have a slope steeper than 3:1, shall be fully vegetated, and shall be designed in compliance with UDC 11-3B-11 and UDC 11-3A-18. Lim: Lighting shall not cause glare or impact the traveling public or neighboring development and comply with lighting standards as defined in UDC 11-3A-11. Signage: No signs are approved with this CZC. All business signs will require a separate sign permit in compliance with UDC 11-3D. Trash Enclosure: All dumpster(s) must be screened in accordance with UDC -11-3A-12. Trash enclosures must be built in the location and to the size approved by SSC. Handicap -Accessibility: The structure, site improvements and parking areas must be in compliance with all federal handicap -accessibility requirements. ACHD Acceptance: All impact fees, if any, shall be paid prior to the issuance of a building permit. If any changes must be made to the site plan to accommodate the ACRD requirements, a new site plan shall be submitted to the City of Meridian Planning staff for approval prior to the issuance of a building permit. This can be classified as -a vertically integrated residential project. Primary Residence The living quarters will occupy the second floor of the building. This is to be the primary residence for Nathan Barnes. The space will include a single bedroom, single bathroom, living room, and kitchen covering an area of 1045 square feet. Direct access to the second floor residence is available from a separate entrance at the front of the building. Access is also available from the other entrances to the business mentioned below. Trash collection for the building will be handled with standard sized 35 gallon bins kept in a fenced area at the east side of the garage. Recording studio A recording studio makes up the business use of the building. The recording studio will occupy the first floor and covers an area of 1583 square feet. The studio is comprised of four soundproof recording rooms, lounge, and restroom facilities for clients. The primary access point to the business is located at the front of the building facing Ada Street, with secondary access points located on the east and south sides of the building. Because of its proximity to the parking area, the southern access point will be used to transport equipment to and from vehicles, in and out of the building. The front and east entrances will be used for general traffic in and out of the business. The primary use of the recording studio will be to record the music of bands and artists, and provide the client with a final copy of their recorded material. This process typically begins with transporting musical equipment into the building and setting u'p the equipment in each of the soundproof rooms in the recording studio. Once setup, the clients will perform their material until we have captured a satisfactory performance. The process of performing and reviewing material will repeat itself until either the client has reached the end of their scheduled time, or has finished performing all of their material. At this time, a CD copy of the day's work is created for review. If the client is scheduled to return to the studio, their equipmerrit,may be left securely in the building. If the client has reached the end of their scheduled time, then they will transport their equipment to their vehicles, and leave the premises. Secondary business uses include the transfer of audio material from one format to another (i.e. tape to CD), or voiceover work for commercial or film. The process for this is much the same as those outlined above. Once the recording process begins, it is unusual to have much traffic in and out of the building. Clients are usually busy performing their material, or providing their input on other's material. Because of this, the business is very much self-contained. The total number of clients making use of the recording studio each day is quite small. Given that the average band will have four or five members, and an entourage of two or three people, volumes greater than eight people per day are rare. Current hours of operation for the business are from Monday through Friday from 6pm to 10pm, and Saturday through Sunday from 10am to 10pm. If special arrangements are made, the studio can be available on Monday through Friday from 10am to 10pm. Design Review Specifications Barnes Home Business Architectural Character a. Facades — From Ada Street, there will be a six foot wide, six foot deep alcove at the front of the building for the entrance and a second floor balcony. Belt coursing will create a visual break between the first and second floors. Window coverage will be 50% for the first floor, and 20% for the second floor. b. Primary public entrance — The main entrance is located at the front of the building, facing Ada Street. It is identified by a six foot wide, six foot deep recess under the 2" d floor balcony. c. Roof lines — The flat roof will have a six foot recess along the balcony. The parapet will extend two feet above the main roof line, and will contain a decorative cornice. A smaller parapet detail will be placed over the balcony. d. Pattern variations — Alternating colors between the main building and belt coursing will provide for a change in building color, creating a visual break between the first and second floors. Window trim, awnings, and decorative elements in the parapet and belt coursing will provide a third color and additional detail. e. Mechanical equipment — The mechanical equipment will be located at the back of the building between the parking lot and garage. A small wooden fence will be built to cover the equipment and provide an area for garbage can storage. Color and Materials — The exterior walls will be clad in stucco. The stucco colors include: Kelly Moore "Tuscan Tan" for the main building, Kelly Moore "Rustic Charm" for the belt coursing and parapet, and Kelly Moore "Santa Fe Cream" for the window trim and accent pieces. An iron rail will surround the second floor balcony. The frame of the awning will be made of metal, and covered with Royal Blue fabric. Parking Lots — An attached garage will provide the single space required for the residence, with a 10'x8' drive path. An asphalt parking pad will provide the required parking spaces for the business. Pedestrian Walkways — An eight foot wide concrete walk will be provided from Ada Street to the primary front entrance, with a smaller walkway branching out to the secondary entrance. Another walkway will be provided from the parking area at the back of the property, along the east side of the building, to the front entrance. Pavers or stamped concrete will be used to identify this walkway. Weather protection is provided by an awning along the front and side of the building, and the balcony covering the entrance. Arnold, Commissioner City of Meridian City Clerk Office The Ada County Highway District has reviewed your application for the above referenced development and determined the following FINDINGS OF FACT: • Ada Street is currently improved with 2 travel lanes, paved shoulders, and no curb, gutter, or sidewalk abutting the site. • Ada Street currently has 54 -feet of right-of-way abutting the site. Listed below are the site specific requirements that the applicant will need to complete for approval. Included is the District Policies relevant to the conditions. SITE SPECIFIC CONDITIONS OF APPROVAL: • Construct a minimum 5 -foot concrete sidewalk abutting the site within the right-of-way (or outside of the right-of-way within an easement) with curb and gutter following District policies below: - District policy requires 5 -foot wide (minimum) concrete sidewalk on all local streets, except those in rural developments with net densities of one dwelling unit per acre or less (7204.4.7). - District policy 7204.4.1 and Figure 72-F1A requires 50 -feet of right-of-way on local streets. This right-of-way allows for the construction of a 2 -lane roadway with curb, gutter and 5 -foot wide concrete sidewalks. • Applicant will be required to pave the alley its entire width to the nearest street section which is Meridian Road. - District Policy 7204. 10.1 states if the proposed development is not a single family detached residence and it takes access from an alley, the developer will be required to pave the entire width of the right-of-way from the nearest public street to and abutting the development. - Parking in alley is not allowed (District policy 7204.10.3). - Access is allowed to and from a fully improved alley (District policy 7204.10.2). Parking shall be designed so the minimum clear distance from the back of the parking stall to the opposite side of the alley is 22 -feet for perpendicular parking. An access to an alley shall be located a minimum of 25 -feet from the nearest public street. STANDARD CONDITIONS OF APPROVAL: • Any existing irrigation facilities shall be relocated outside of the right-of-way. • Private sewer or water systems are prohibited from being located within any ACHD roadway or right-of-way. • All utility relocation costs associated with improving street frontages abutting the site shall be borne by the developer. • Replace any existing damaged curb, gutter and sidewalk and any that may be damaged during the construction of the proposed development. Contact the District's Utility Coordinator at 387-6258 (with file numbers) for details. • All design and construction shall be in accordance with the Ada County Highway District Policy Manual, ISPWC Standards and approved supplements, Construction Services procedures and all applicable ACHD Ordinances unless specifically waived herein. An engineer registered in the State of Idaho shall prepare and certify all improvement plans. • The applicant shall submit revised plans for staff approval, prior to issuance of building permit (or other required permits), which incorporates any required design changes. • Construction, use and property development shall be in conformance with all applicable requirements of the Ada County Highway District prior to District approval for occupancy. • Payment of applicable road impact fees are required prior to building construction in accordance with Ordinance #200, also known as Ada County Highway District Road Impact Fee Ordinance. • It is the responsibility of the applicant to verify all existing utilities within the right-of-way. The applicant at no cost to ACHD shall repair existing utilities damaged by the applicant. The applicant shall be required to call DIGLINE (1-800-342-1585) at least two full business days prior to breaking ground within ACHD right-of-way. The applicant shall contact ACHD Traffic Operations 387-6190 in the event any ACHD conduits (spare or filled) are compromised during any phase of construction. • No change in the terms and conditions of this approval shall be valid unless they are in writing and signed by the applicant or the applicant's authorized representative and an authorized representative of the Ada County Highway District. The burden shall be upon the applicant to obtain written confirmation of any change from the Ada County Highway District. • Any change by the applicant in the planned use of the property which is the subject of this application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant or its successors in interest advises the Highway District of its intent to change the planned use of the subject property unless a waiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought. CONCLUSIONS OF LAW: • The proposed site plan is approved, if all of the Site Specific and Standard Conditions of Approval are satisfied. • ACHD requirements are intended to assure that the proposed use/development will not place an undue burden on the existing vehicular transportation system within the vicinity impacted by the proposed development.
