Alternative Compliance: The alternative compliance application is .
buffer along the northern property line adjacent to Permwood Street (approximately 15 5 ft) to maintain the 24 ft drive
aisle adjacent to the existing building'. The applicant is proposing to mitigate this requirement by adding an additional
415 sq ft circular planter located in the center of the new parking area and increase the perimeter landscaping along
the western property line from the UDC requirement of 5 feet to 9 feet. A total of 957 sq ft of additional landscaping
is being proposed to replace the 796 sq ft of landscaping being reduced due to the 5 foot landscape buffer reduction
along the northern property line. The Planning Director has reviewed the applicant's request and approved the
request as submitted on July 24, 2007.
Site/Landscape Plan: The Site/Landscape Plan prepared by Dale Binning Architect, on June 6,2007, labeled S -la, is
approved (stamped "Approved" on July 24, 2007 by the Meridian Planning Department) with the following
changes/notes (see redline changes on landscape plan): 1) When a bumper overhan2s onto a sidewalk or
landscape area, the ParkinLy stall dimensions may be reduced two feet (21) in len2th if two feet (2') is added to
the width of the sidewalk or landscaped area planted in uound cover. Increase the width of the perimeter
landscapina alonii the south side of the new parkina area to 7 ft wide or leave the landscaping width 5 ft and
provide wheel stops per UDC 11 -3C -B3. 2) Provide wheel stops to the 6 existin2 parking stalls located along
the south side of the property. 3) Provide' one bicycle parking space per UDC 11 -3C -6G. 4) The six foot
decorative fence shall be installed per approved plan and shall not be altered without modif int! CZC-07-143.
The approved site/landscape plan is not to be altered without prior written approval of the Planning Department. No
field changes to the site/landscape plan permitted; prior written approval of all material changes is required. Prior to
final inspection and sign off for this project, a written certific.1te of completion shall be submitted to the
Planning Department, prepared by a landscape architect, landscape designer or qualified nurseryman

responsible for the landscape plan upon completion of the landscape installation. The Certificate of
Completion shall verify that all landscape improvements, including plant materials and sprinkler installation,
are in substantial compliance with the approved landscape plan.
Elevations: The Elevations prepared by Dale Binning Architect, dated June 6, 2007, are approved with no changes
from the Planning Department.
hTigation: An underground, pressurized irrigation system must be installed to all landscape areas per the approved
specifications and in accordance with UDC 11 -3 A- 15.
Protection of Existing Trees: Any existing t�ees on site must be protected or mitigated for in accordance with the Tree
Preservation section of the City's Landscape,, Ordinance. Per UDC 1 1;-3B-1 0, coordinate with the Parks Department
Arborist (Elroy Huff, 888-3579) for appro'va'l of protection/relocation measures for the existing trees prior to
construction. Any severely damaged tree must be replaced in compliance with UDC I I -3B- 1 O -C. 5.
Parking: The proposed parking areas shall be paved and striped in accordance with UDC 11-3B. Project
engineer/architect shall certify that the number and size of handicap -accessible spaces conforms to the Americans
with Disabilities Act (ADA). Handicap accessible stalls must have signage in accordance per ADA and signed
accessible.
Curbing: Per UDC 11-3B-51, all landscape areas adjacent to driveways, parking lots, or other vehicle use areas, must
be protected by curbing, wheel stops, or other approved protective devices. Curbing may be cut to allow for storm
water runoff.
Sidewalks: All sidewalks shall be constructed in accordance with 11 -3A- 17. Sidewalks shall be constructed prior to
occupancy.
Drainage: Storm water drainage swales shall not have a slope steeper than 3: 1, shall be fully vegetated, and shall be
designed in compliance with UDC 11 -3B- I I and UDC 11 -3A- 18.
Lightin : Lighting shall not cause glare or impact the traveling public or neighboring development and
comply with lighting standards as defined in UDC 11-3A-11.
Signage: No signs are approved with this CZC. All business signs will require a separate sign permit in compliance
with UDC 11-3D.
TrashEnclosure: All dumpster(s) must be screened in accordance with UDC -1 1-3A-12. Trash enclosures must be
built in the location and to the size approved by SSC.
Handicgp-Accessibili : The structure, site improvements and parking areas must be in compliance with all federal
handicap -accessibility requirements.
ACHD Acceptance: All impact fees, if any,! shall be paid prior to the, issuance of a building permit. If any changes
must be made to the site plan to accommodate the ACHD requirements, a new site plan shall be submitted to
the City of Meridian Planning staff for approval prior to the issuance of a building permit.
Certificate of Occupanc : All required improvements must be complete prior to obtaining a Certificate of Occupancy.
All changes in occupancy need to comply with the requirements of the Building Department. It is unlawful to use or
occupy any building or structure until the Building Official has issued a certificate of occupancy. A certificate of
occupancy or temporary certificate of occupancy is obtained from the Building Department (208) 887-2211 after
inspections are complete and the field inspection record is returned to the Building Department.
Plan Modifications: Except for the changes mentioned above, the approved Site Plan, Landscape Plan and Elevations
stamped "Approved" on July 24, 2007 are not to be altered without prior written approval of the Planning
Department. No significant field changes to the site or landscape plans are permitted; prior written approval of all
changes is required.

NARRATIVE:
This CZC Application is for approval of a 6,600 sf addition to John's Auto Care Center.
The addition will consist of service bays, repair bays, large vehicle repair bays, and a storage bay.
Site Character:
The Site is a single large parcel with approximately 45% already developed with paving, landscaping,
and site drainage. The remaining 55% of the site is currently undeveloped. The Site has 116' of frontage
on Meridian Road, and 503' of frontage on Pennwood Street. The street improvements have been
completed on Meridian Road. This application provides the street improvements and landscaping for the
full length of the property along Pennwood Street.
Architectural Character:
The building addition will be of concrete block construction in natural gray with charcoal banding, and
will match the existing building. The existing building faces Meridian Road and the proposed addition
faces Pennwood Street.

NARRATIVE:
This Alternative Compliance Application is for allow an existing 5' landscape strip and curb along
Pennwood Street remain unchanged. This landscape strip is required to be 10' in width. Additional trees
and new lawn will be installed in this strip to serve as part of our alternative compliance.
A 5' landscape strip was required along the north property line when the project was submitted in 2000.
This was before Pennwood Street was created. The building location was planned based on this 5' strip
plus a 24'wide 2 -way drive next to the building.
increasing this landscaping to the required 10'width would reduce the driveway width to less than 19'.
This driveway must remain full width for two-way traffic, so we are seeking an alternative compliance.
Additional landscaping is being proposed in other areas of the site as part of our alternative compliance
request A circular planter has been located in center of the the new parking area which contains 415 SF.
The landscape strip along the west property line has been increased from the required 5'to 9' in width
and contains an additional 542 SF.

Meridian Road is currently improved with 2 travel lanes, a center turn lane, and vertical curb,
gutter and 5 -foot concrete sidewalk abutting the site. Meridian Road currently has 60 -feet of
right-of-way.
Pennwood Street is currently improved with 2 travel lanes and no curb, gutter, or sidewalk
abutting the site. Pennwood Street currently has between 48 and 56 -feet of right-of-way.
There is vertical curb, gutter, and sidewalk on the north side of Pennwood Street
4. Existing Access: There is currently one curb return driveway accessing the site from Meridian
Road located approximately 50 -feet south of Pennwood Street (measured
near edge to near edge); as well as on unpaved rural approach off of
Pennwood Street located approximately 25 -feet east of the west property line
(measured near edge to property line).
5. Site History: This site has not been previously reviewed for a development application.
Development Impacts
Trip Generation: This development is estimated to generate approximately 220 additional
vehicle trips per day based on the Institute of Transportation Engineers Trip
Generation Manual, automobile care center land use designation.
2. Impact Fees: There will be an impact fee that is assessed and due prior to issuance of any
building permits. The assessed impact fee will be based on the impact fee
ordinance that is in effect at that time.

ACHD is currently preserving for the Meridian Split Corridor Roadway Project affecting Meridian
Road and Main Street. Meridian Road will be constructed to a 3 -lane one way (southbound) arterial
standard abutting the site in 2009.

B. Findings for Consideration
Commission Hearing and Action
This item was originally scheduled on the October 17, 2007 Commission agenda because the
applicant appealed the staff level recommendation regarding the existing driveway on Meridian
Road. The original staff report provided the following two options regarding the access to Meridian
Road:
Option 1: Retain the location of the existing driveway on Meridian Road, but restrict it to an "exit -
only" driveway AND allow a driveway on Pennwood Street near the Meridian Road intersection for
entering vehicles. This option could potentially require some reconstruction of the driveway to
create the proper channelization as well as signage and informing customers and employees of the
driveway's use. By restricting to an "exit -only" driveway, there is a reduction in the potential turning
conflicts on Meridian Road. This would also require that the applicant inform the RV customers to
enter from one of the westerly driveways on Pennwood Street.
Option 2: Shift the driveway on Meridian Road to the south property line to create a greater
separation between Pennwood Street and the driveway (approximately 90 -feet of separation). This
driveway could remain full -access until the Meridian Split Corridor Project (which would make the
driveway right-in/right-out). With this option, staff would also support a driveway on Pennwood
Street near the Meridian Road intersection (as shown on the revised site plan prepared by the
applicant).
The applicant appealed the staff recommendation, and at the hearing on October 17, 2007, the
Commission deferred the item for 3 weeks to give staff and the applicant an opportunity to provide
additional information and to potentially reach a compromise. The applicant provided the requested
information regarding the estimated driveway relocation costs (approximately $60,000), and staff
found that there were no accidents on record related to this driveway.
The item was scheduled back before the Commission on November 7, 2007, and the Commission
approved the following compromise regarding the access to Meridian Road:
• Allow the driveway to remain in its current location as a full access driveway.
• The driveway on Meridian Road will become right-in/right-out with the implementation of
the Meridian Road Split Corridor Phase 1 project.
• If the driveway becomes a safety hazard, based on actual accident data, in the future the
District will close the driveway.
• If the District closes the driveway, the applicant could reconstruct at his own expense a
driveway located at the south property line.
• This compromise will be formalized by ACHD and the applicant in the form of a
development agreement.
2. Tree Planter Policy
Tree Planter Policy: The applicant should also comply with the District's Tree Planter Width Interim
Policy which prohibits all trees in planters less than 6 -feet in width. In addition to prohibiting trees in
planters less than 6 -feet in width, the policy requires a minimum planter width of 6 -feet for class 11
tress with the installation of root barriers on both sides of the planter strip or a minimum planter
width of 8 -feet without the installation of a root barrier. The policy also requires Class I and Class III
trees to provide a minimum planter width of 1 0 -feet.

3. Pennwood Street
Right-of-Way/Street Section Policy: District policy requires 54 -feet of right-of-way on
industrial/commercial roadways (Figure 72 -Fl B). This right-of-way allows for the construction of a
3 -lane roadway with curb, gutter and 5 -foot wide concrete sidewalks.
Applicant Proposal: The applicant is proposing to construct Pennwood Street with curb, gutter,
and sidewalk abutting the site.
Staff Recommendation: With a previous application on the north side of Pennwood Street
(Commercial Tire project), the District had allowed a 36 -foot street section as a modification of
policy. The applicant for this site will be required to complete that street section abutting this site.
The applicant will be required to construct Pennwood Street abutting the site as a complete 36 -foot
section with vertical curb, gutter, and 5 -foot concrete sidewalk (as measured from the existing back
of curb on the north side of the street). At a minimum, the back of curb shall be located within the
existing right-of-way; and the applicant shall provide ACHD with a public easement for any portion
of the sidewalk located outside of the right-of-way. At the intersection with Meridian Road, Penwood
Street shall retain a minimum 36 -foot street section around the radius, compliant with ACHD design
and policy requirements. If the existing irrigation box conflicts with any aforementioned
improvements, then the applicant shall relocate the box, at no cost to ACHD.
4. Meridian Road
Right -of -Way Policy: District policy requires 96 -feet of right-of-way on arterial roadways (Figure
72 -Fl B). This right-of-way allows for the construction of a 5 -lane roadway with curb, gutter, 5 -foot
concrete detached sidewalks and bike lanes.
Sidewalk Policy: District policy requires 7 -foot wide attached (or 5 -foot detached) concrete
sidewalk on all collector roadways and arterial roadways (7204.7.2).
Applicant Proposal: The applicant is not proposing to construct any improvements for Meridian
Road with this application.
Staff Recommendation: ACHD has acquired all necessary right-of-way for the Meridian Split
Corridor roadway project. The applicant is not required to construct any improvements or dedicate
any additional right-of-way with this application for Meridian Road.
5. Driveways
Access Management Policy: District policy 7207.8 states that direct access to arterials and
collectors is normally restricted. The developer shall try to use combined access points. If the
developer can show that the use of a combined access point to a collector or arterial street is
impractical, the District may consider direct access points. Access points for proposed
developments at intersections should be located as far from the intersection as practical, and in no
case closer than as illustrated on Figure 72-174, unless a waiver for the access point has been
approved by the District Commission.
Driveway Offset Policy: District policy 72-F5, requires driveways located on collector or arterial
roadways with a speed limit of 35 to align or offset a minimum of 150 -feet from any existing or
proposed driveway.
District policy 72-F4 (1) and 72-F4 (2), requires driveways located on commercial/industrial
roadways to offset a controlled and/or uncontrolled intersection a minimum of 50 -feet (measured
near edge to near edge).

Driveway Width Policy: District policy 7207.9.3 restricts commercial driveways with daily traffic
volumes over 1,000 vehicles to a maximum width of 36 -feet. Most commercial driveways will be
constructed as curb -cut type facilities if located on local streets. Curb return type driveways with 15 -
foot radii will be required for driveways accessing collector and arterial roadways.
Gravel Tracking Policy: Graveled driveways abutting public streets create maintenance problems
due to gravel being tracked onto the roadway. In accordance with District policy, 7207.9.1, the
applicant should be required to pave the driveway its full width and at least 30 -feet into the site
beyond the edge of pavement of the roadway and install pavement tapers with 15 -foot radii abutting
the existing roadway edge.
Applicant Proposal: The applicant is proposing to retain the existing 30 -foot wide curb return
driveway approach intersecting Meridian Road approximately 50 -feet south of the north property
line; AND construct two additional curb return driveways intersecting Pennwood Street
approximately 285 and 450 -feet west of Meridian Road (measured near edge to near edge).
Staff Comment/Recommendation: The proposed driveways on Pennwood Street meet District
policy and should be approved with this application.
The applicant and staff have met several times to discuss the existing driveway on Meridian Road
and possible access options for the site. The existing driveway on Meridian Road was previously
constructed by the District as part of a roadway project for Meridian Road. The driveway was
planned prior to the extension and construction of Pennwood Street. The current location of the
driveway on Meridian Road does not meet the District's access management policy or the driveway
offset policy. The current offset from Pennwood Street is approximately 50 -feet, and the required
offset is 150 -feet. The site does not have sufficient frontage to meet the required 150 -foot offset.
The concern with the limited driveway offset is the potential turning conflicts between the existing
driveway on Meridian Road and the Pennwood Street intersection with Meridian Road (left turn
conflicts, rear -end collisions, etc.) Therefore, District staff originally recommended that the
applicant close the existing driveway on Meridian Road and take all access to the local street,
Pennwood Street. However, as identified in Finding #1, the applicant provided additional
information, and staff modified their original recommendation.
The existing building and business is oriented towards Meridian Road, and there is an existing
specialty RV service bay at the north end of the building. This bay, as well, as the other existing
service bays operate as pull through bays with the option to enter or exit from either the east or the
west. The applicant provided turning radius information to demonstrate that a driveway located on
Pennwood Street approximately 35 -feet from Meridian Road would not allow for an RV to enter the
site and turn into the specialty service bay located at the north end of the building.
The final solution approved by the Commission on November 7, 2007 is as follows:
• Allow the driveway to remain in its current location as a full access driveway.
• The driveway on Meridian Road will become right-in/right-out with the implementation of
the Meridian Road Split Corridor Phase 1 project.
• If the driveway becomes a safety hazard, based on actual accident data, in the future the
District will close the driveway.
• If the District closes the driveway, the applicant could reconstruct at his own expense a
driveway located at the south property line.
• This compromise will be formalized by ACHD and the applicant in the form of a
development agreement.

C. Site Specific Conditions of Approval
Construct Pennwood Street abutting the site as a complete 36 -foot section with vertical curb, gutter,
and 5 -foot concrete sidewalk (as measured from the existing back of curb on the north side of the
street). At a minimum, the back of curb shall be located within the existing right-of-way; and the
applicant shall provide ACHD with a public easement for any portion of the sidewalk located outside
of the right-of-way, At the intersection with Meridian Road, Penwood Street shall retain a minimum
36 -foot street section around the radius, compliant with ACHD design and policy requirements. If
the existing irrigation box conflicts with any aforementioned improvements, then the applicant shall
relocate the box, at no cost to ACHD.
2. Construct the two proposed 30 -foot wide curb return type driveways on Pennwood Street located
approximately 285 and 450 -feet west of Meridian Road (measured near edge to near edge).
3. Retain the location of the existing driveway on Meridian Road as a full access driveway. The
driveway will become right-in/right-out with the Meridian Road Split Corridor Phase 1 project. If the
driveway becomes a safety hazard, based on actual accident data, in the future the District will
close the driveway. If the District closes the driveway, the applicant could reconstruct, at his own
expense, a driveway located at the south property line. Enter into a development agreement with
the District to formalize the above statements regarding access to Meridian Road.
4. Comply with all Standard Conditions of Approval.
D. Standard Conditions of Approval
Any existing irrigation facilities shall be relocated outside of the right-of-way.
2. Private sewer or water systems are prohibited from being located within any ACHD roadway or
right-of-way.
3. All utility relocation costs associated with improving street frontages abutting the site shall be borne
by the developer.
4. Replace any existing damaged curb, gutter and sidewalk and any that may be damaged during the
construction of the proposed development.. Contact Construction Services at 387-6280 (with file
number) for details.
5. Comply with the District's Tree Planter Width Interim Policy.
6. Utility street cuts in pavement less than five years old are not allowed unless approved in writing by
the District. Contact the District's Utility Coordinator at 387-6258 (with file numbers) for details.
7. All design and construction shall be in accordance with the Ada County Highway District Policy
Manual, ISPWC Standards and approved supplements, Construction Services procedures and all
applicable ACHD Ordinances unless specifically waived herein. An engineer registered in the State
of Idaho shall prepare and certify all improvement plans.
8. The applicant shall submit revised plans for staff approval, prior to issuance of building permit (or
other required permits), which incorporates any required design changes.
9. Construction, use and property development shall be in conformance with all applicable
requirements of the Ada County Highway District prior to District approval for occupancy.

10. Payment of applicable road impact fees are required prior to building construction. The assessed
impact fee will be based on the impact fee ordinance that is in effect at that time.
11. It is the responsibility of the applicant to verify all existing utilities within the right-of-way. The
applicant at no cost to ACHD shall repair existing utilities damaged by the applicant. The applicant
shall be required to call DIGLINE (1-800-342-1585) at least two full business days prior to breaking
ground within ACHD right-of-way. The applicant shall contact ACHD Traffic Operations 387-6190 in
the event any ACHD conduits (spare or filled) are compromised during any phase of construction.
12. No change in the terms and conditions of this approval shall be valid unless they are in writing and
signed by the applicant or the applicant's authorized representative and an authorized
representative of the Ada County Highway District. The burden shall be upon the applicant to
obtain written confirmation of any change from the Ada County Highway District.
13. Any change by the applicant in the planned use of the property which is the subject of this
application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or
other regulatory and legal restrictions in force at the time the applicant or its successors in interest
advises the Highway District of its intent to change the planned use of the subject property unless a
waiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at
the time the change in use is sought.
E. Conclusions of Law
The proposed site plan is approved, if all of the Site Specific and Standard Conditions of Approval
are satisfied.
2. ACHD requirements are intended to assure that the proposed use/development will not place an
undue burden on the existing vehicular transportation system within the vicinity impacted by the
proposed development.

Request for Reconsideration of Commission Action
Request for Reconsideration of Commission Action: A Commissioner, a member of ACHD
staff or any other person objecting to any final action taken by the Commission may request
reconsideration of that action, provided the request is not for a reconsideration of an action
previously requested to be reconsidered, an action whose provisions have been partly and
materially carried out, or an action that has created a contractual relationship with third parties.
a. Only a Commission member who voted with the prevailing side can move for
reconsideration, but the motion may be seconded by any Commissioner and is voted on by
all Commissioners present.
If a motion to reconsider is made and seconded it is subject to a motion to postpone to a
certain time.
b. The request must be in writing and delivered to the Secretary of the Highway District no later
than 3:00 p.m. on the day prior to the Commission's next scheduled regular meeting
following the meeting at which the action to be reconsidered was taken. Upon receipt of the
request, the Secretary shall cause the same to be placed on the agenda for that next
scheduled regular Commission meeting.
c. The request for reconsideration must be supported by written documentation setting forth
new facts and information not presented at the earlier meeting, or a changed situation that
has developed since the taking of the earlier vote, or information establishing an error of fact
or law in the earlier action. The request may also be supported by oral testimony at the
meeting.
d. If a motion to reconsider passes, the effect is the original matter is in the exact position it
occupied the moment before it was voted on originally. It will normally be returned to ACHID
staff for further review. The Commission may set the date of the meeting at which the
matter is to be returned. The Commission shall only take action on the original matter at a
meeting where the agenda notice so provides.
e. At the meeting where the original matter is again on the agenda for Commission action,
interested persons and ACHD staff may present such written and oral testimony as the
President of the Co-mmission determines to be appropriate, and the Commission may take
any action the majority of the Commission deems advisable.
f. If a motion to reconsider passes, the applicant may be charged a reasonable fee, to cover
administrative costs, as established by the Commission.

by ACHD, then architectural plans may be submitted for purposes of impact fee calculation.)
• The applicant is required to get a permit from Construction Services (ACHD) for ANY work in the right-of-way,
including, but not limited to, driveway approaches, street improvements and utility cuts.
E]Pay Impact Fees prior to issuance of building permit. Impact fees cannot be paid prior to plan review approval.
