release the applicant from any previous requirements of the approved Annexation & Zoning, Preliminary Plats,
Final Plats and Conditional Use Permits. -
Site (& Lgqdscapg) Plan- The Site Plan prepared by The Architects Office on July 6,2007, is approved (stamped
"Approved" on August 23, 2007, by the Meridian Planning Department) with the following changes (see red -line
changes on plan): 1) As Proposed, there are entryw#1 covers on the north and w!nt sides of the building,
These enUMay covers encroach into platted easements. Vertical construction is not allowed within
easements. The plans shaff be revised to remove any vertical construction within easements on this lot 2
Per UDC 11 -3C -5C and UDC 11 -3C-6G, provide a bicycle rack on this site, 3) Per UDC 11 -3C -5B3. instafl
wheel restraints adjacent to the sidewalk to vrevent cars from overhaneine onto the sidewalk (or I widen the
sidewalk to 7 feet and reduce the len2th of the parldng xtall to 19 feet). Other than the above-mentioned
changes, the approved plan is not to be altered without prior written approval' of the Planning De partment. No
field changes to the plan are permitted; prior written approval of all material changes is required.
Irrigation: An underground, pressurized irrigation system must be installed to all landscape areas per the
approved specifications and in accordance with UDC I I -3A- 15.
Protection of Existing Trees: Any existing trees on site must be protected or mitigated for in accmdance with the
Tree Preservation section of the City's Landscape Ordinance. Per UDC 11 -313- 10, coordinate with the Parks
Departinent Arborist Elroy Huff (8 8 8-3579) for approval of protection/relocation measures for the existing trees
prior to construction. Any severely damaged tree must be replaced in compliance with UDC I I -3B- I O -C. 5.
Parking: The proposed parking areas shall be paved and striped in accordance with UDC 11-3B. Project
engineer/architect shall certify that the number and size of handicap -accessible spaces conforms to the Americans
with Disabilities Act (ADA). Handicap accessible stalls must have signage in accordance per ADA and signed
appropriately.
Curbing: Per UDC I I -3B-5L all landscape areas adjacent to driveways, parking lots, or other vehicle use areas,
must be protected by curbing, wheel stops, or other approved protective devices. Curbing may be cut to allow for
storm water runoff.
Sidewalks: All sidewalks shall be constructed in accordance with I 1-3A- 17. Sidewalks shall be constructed prior
to occupancy.
Drainage: Storm water drainage swales shall not have a slope steeper than 3: 1 . shall be fully vegetated, and shall
be designed in compliance with LJDC 11-313-11 and UDC 11-3A-18.
Li"t R: Lighting shall not cause glare or impact the traveling public or neighboring development.
Comply with all lighting standards as defined in UDC 11-3A-1 1.
Sigpage: No signs are approved with this CZC. All business signs win require aseparate sign permit in
compliance with UDC 11-3D.
Trash Enclosure: All dumpster(s) must be screened in accordance with UDC- I 1-3A- 12. Trash enclosures must
be built in the location and to the size approved by SSC. The Meridian Fire Department requires a minimum five
foot (5') separation between any building and the dumpster enclosure.
Handicgp-Accessibilfty: The structure, site improvements and parking areas must be in compl iance with all
federal handicap -accessibility requirements.
ACHD AqcWtance: The applicant shall receive approval from ACHD for all access to / from the subject site. If
any changes must be made to the site plan to accommodate the ACHD requirements, a new site plan shall be
submitted to the 'City of Meridian Planning staff for approval prior to the issuance of a building pe�niit. All
impact fees, if any, shall be paid prior to the issuance of a building permit.
Certificate of Cg=letion: A written certificate of completion shall be prepared by the landscape architect,
landscape designer, or qualified nurseryman responsible for the landscape plan upon completion of the
landscape installation. The Certificate of Completion shall verify that all landscape improvements,
including plant materials and sprinkler installation, are in substantial I compliance with the approved plan.
Plan Modifications: The approved Site Plan stamped "Approved" on August 23, 2007, is not to be altered
without prior written approval of thePlanning Departnaent. No significaut field changes to the site or landscape

Please accept the attached application for "Certificate of Zoning Compliance" for a new 3,195 S.F. single
story office building located at the Carol Professional Center. The office building is for lot 10,
Stokesberry Subdivision No. 2.
The office park subdivision was constructed under the approval of CUPOO-020 with drawings prepared by
J -U-13 Engineers dated 3-22-04. The road improvements, asphalt parking lot, concrete sidewalks, trash
enclosure, site lighting, site utilities, site drainage, perimeter landscaping and irrigation system have all
been approved and constructed. The scope of this project is the office building, the 3,146 s.f. of
landscaping around the office building and two concrete walks from existing sidewalks to the front doors.
The office building is 3,195 s.f. which is the maximum size office building allowed on this pad site per
CUPOO-020. The parking ratio was established under that submittal and this office building design does
not exceed the allowed parking requirements.

RE: Denial of Carol Professional Center [Lot 10] Certificate of Zoning Compliance
Dear W Rhoes:
This letter is in response to your application for Certificate of zoning Compliance
(CZC) for the construction of a 3,195 square -foot office building at 2456 N.
Stokesberry Place. The, subject property is currently zoned L-0. Per the Unified
Development Code, Table 11-2B-3, the building setbacks for the L-0 zone are as
follows: Rear — 20 feet; Front — 20 feet, and Side — 10 feet. The proposed rear
building setback of 10 feet shown on the site plan does not meet the requirement of
20 feet for structures in the L-0 zone. For this reason, Staff is denying your CZC
application as submitted.
At the time the Stokesberry Nos, I and 2 applications were submitted, reviewed, and
approved by the City, a 20 -foot rear setback was the standard. To date, this standard
in the L-0 district has not changed. (See Attachment A)
Staff researched the previous approvals for this development, Stokesberry
Subdivisions Nos. I and 2, to see if a reduced setback had been previously requested
or approved. Staff did not find as such for the property in question, Lot 10, Block 1,
Stokesberry Subdivision No. 2.
Lots 6, 7, and 8, Block 1, of Stokesberry Subdivision No. I (the lots adjacent to the
school on the west side of N. Stokesberry Place) were approved for a 10 -foot rear
setback through the planned development process, CUP -00-020. (See Attachment B)
This modification to the standard rear setback. does not apply to any of the lots in
Stokesberry No. 2. Excepting the rear setback on Lots 6, 7, and 8, Block 1, no other
dimensional standards were modified with the approval of Stokesberry No. 1.
In 2003, a preliminary plat application was filed with the City to re -subdivide Lots I
through 4, Block 1, of Stokesberry Subdivision No. I . This application was
processed as Stokesberry Subdivision No. 2. No development applications were
submitted concurrently with the preliminary plat for this subdivision.
The City can not evaluate or approve reductions in building setbacks with
preliminary plat applications. This must be accomplished with a supplementary
application such as variance, planned development, or zoning text amendment. And,
as previously stated, no such application was submitted concurrently with platting of
Stokesberry No. 2.
Please note the attached application and narrative submitted with the application for
platting of Stokesberry No. 2. In the narrative, Jim Coslett, J -U -B Engineers, Inc.,
states, "All of the lots are designed to comply with the standards of the [Meridian]
Zoning Ordinance and Comprehensive Plan and no variances are sought or
required," (See Attachment Q
Additionally, Staff has examined the recorded minutes for the Planning & Zoning
and City Council hearings for Stokesberry Subdivision No. 2, where no mention of
reductions in setbacks for any of the proposed lots was made. In fact, the
Applicant's Representative, Daren Fluke, is quoted as saying, 'We meet all the
[City's] standards with these lots." Said minutes can be made available to you for
review, if requested,
The final plat for Stokesberry No. 2 was recorded in November 2004 (Instrument
No. 104143338). Further, Note 1, as it appears on the final plat for Stokesberry
Subdivision No. 2, reads, "Building setbacks and dimensional standards in this
subdivision shall be in compliance with the applicable zoning regulations of the City
of Meridian, Idaho, or as allowed by conditional use." (See Attachment D) As stated
above, no application for variance or planned development was submitted with
preliminary plat. lberefore, all lots within Stokesberry are meant to conform to the
established 20 -foot rear setback for the L-0 district,
It is true that four buildings within Stokesberry No. 2 were previously approved by
the City with 10 foot rear setbacks. However, this was a City error. And, although
Staff has erred in the past, we can not perpetuate this and approve the CZC for Lot
10, Block 1, as currently proposed. Therefore, Staff is denying the CZC application
for the Carol Professional Office.
In accordance with UDC 11 -5A -3F and UDC 11-5A-6, you have the option to
appeal this decision to the City Council. All City Council Review applications
(appeals) shall be filed in writing with the Planning Department within fifteen (15)
days after the date of this letter. The appeal will be forwarded to the City Council to
conduct a public hearing. The appeal should specify the grounds upon which the
appeal is filed. I have attached the City Council Review application and checklist to
this letter, should you decide to file an appeal of the Director's determination. (See
Attachment E)

Just thought I would pass on some information concerning Carol Professional Center.
I have submitted a "Certificate of Zoning Compliance" application to the City of Meridian for Lot 10. 1 have been
informed that since this is a "L -O" zone that the building requires a 20' rear setback. The Subdivision drawings
and the conditional use application that accompanied the development of this office subdivision clearly indicate
lots 9, 10, 11, 12, 22 and 23 are to be developed with only 10' rear setbacks. It should be noted. that several
buildings have already been approved and constructed with a 10'rear setback.
Currently, the planning staff at The City of Meridian are taking the position that these office lots now require a 20'
rear setback and that the City of Meridian was previously incorrect in allowing the other office buildings to be
constructed with a 10' rear setback.
I would recommend that you contact J -U-13 Engineers and any other design and legal consultants that were
involved in the original office park development and see if they can shed any light on this issue to keep our project
and any other project on schedule. As you are probably aware, my client is under a tight timeline.
