Site Plan: The Site Plan prepared by Destiny Design, LLC, and revised on July 21, 2007, labeled sheets a-1 through a- 4, is approved (stamped "Approved" on November 20, 2007, by the Meridian Planning Department) with the following changes (see redline changes on plan): 1) Per UDC 11-4-3-43I, the setback requirement for the proposed monopole is, at minimum, ten feet (101) from all property lines Please account for this at the time of construction. The approved site plan is not to be altered without prior written approval of the Planning Department. No field changes to the plan are permitted; prior written approval of all material changes is required. Specific Use Standards for Wireless Communication Facilities: The following provisions shall apply to any construction, installation, addition to or increase in the height of any wireless communications tower. 1) No part of any antenna, disk, array, or other such item attached to a communications tower shall be permitted to overhang any part of richt-of-way or property line; 2) The base of all towers shall be surrounded by a sight -obscuring security fence. Install 8 -foot vinyl fencing around the monopole, as proposed; 3) All climbing pegs within the bottom twenty feet (201) of the tower shall be removed except when the tower is being serviced; 4) All lighting on the tower, other than may be required by the FAA, shall be prohibited; 5) No tower shall have constructed thereon, or attached thereto, any platform, catwalk, crow's nest, or like structure, excepting during periods of construction or repair; and 6) No signs or banners shall be attached to any portion of a wireless communications tower at anytime. Alternative Compliance: Per UDC 11-4-3-43H.5, the requirement for landscaping buffers surrounding a towerfacility may be waived in situations where the visual impact of the tower is minimal. The Planning Department finds the Applicant's request to waive said landscaping standard at this location reasonable, as no residential properties appear to be affected by the construction of the monopole; the subject property where the monopole is to be sited is designated "Light Industrial," and is located adjacent to the Union Pacific Railroad and other properties zoned "Light Industrial." Additionally, Staff believes the 8 -foot tall sight -obscuring fencing to surround the facility is sufficient to lessen the visual impact of the tower. Protection of Existing Trees: Any existing trees on site must be protected or mitigated for in accordance with the Tree Preservation section of the City's Landscape Ordinance, per UDC 11-3B-10. Coordinate with the Parks Department Arborist (Elroy Huff, 888-3579) for approval ofprotection/relocation measures forthe existingtrees prior to construction. Any severely damaged tree must be replaced in compliance with UDC 11-313-10-C.5. Li tin : Any lighting shall not cause glare or impact the traveling public or neighboring development and comply with lighting standards as defined in UDC 11-3A-11. Certificate of Occupancy: All required improvements must be complete prior to obtaining a Certificate ofOccupancy. A Temporary Certificate of Occupancy may be obtained by providing surety to the City in the form of a Letter of Credit or cash in the amount of 110% of the cost of the remaining improvements. If the property is located next to a residential district, the setback requirements shall be one hundred twenty five percent (125%) of the height of the tower. a. If the tower exceeds the maximum height allowance for the district, the setback requirements shall be one foot (1') for every ten feet (10') of tower height, in addition to the district's setback requirements. b. If the tower is not constructed to meet the standards set forth in the Telecommunications Industry Association/Electronic Industries Association (TIA/EIA) 222 revision F standards entitled "Structural Standards For Steel Antenna Supporting Structures" the setback requirement shall be one foot (1') for every foot in height of the tower. This shall be measured from all property lines and shall be referred to as the "fall zone". Existing or approved towers cannot accommodate the planned equipment at a height necessary to function reasonably as documented by a qualified and licensed engineer. 3. All proposed communication towers shall be designed (structurally, electrically, and in all respects) to accommodate both the applicant's antennas and comparable antennas for at least two (2) additional users if the tower is over one hundred ten feet (110') in height and for at least one additional user if the tower is over fifty feet (50') in height. K. Abandoned Or Unused Towers Or Portions Of Towers: All abandoned or unused towers and associated facilities shall be required to be removed within sixty (60) days of cessation of use as a wireless communication facility, unless a time extension is granted by the city council.
