Findings of Fact Existing Conditions 1 2 Site Information: The site is currently occupied by a rural residential structure. Description of Adjacent Surrounding Area: Direction Land Use Zonin North Commercial L-O South Residential R-4 East Industrial I-L 1 r. West Residential R-1 3. Existing Roadway Improvements & Right-of-Way Franklin Road is currently improved with 4-travel lanes, a center turn lane, paved shoulders, and vertical curb, gutter and 5-foot concrete sidewalk abutting the site. Franklin Road currently has 70-feet of right-of-way (30-feet from centerline). The sidewalk abutting the site is outside of the right-of-way. 4. Existing Access: There is currently one rural approach accessing the site from Franklin Road located approximately 140-feet west of the east property line (measured near edge to property line). 5. Site History: This site was previously reviewed with the Northwoods Subdivision rezone in October of 2005. Development Impacts Trip Generation: This development is estimated to generate approximately 2291 additional vehicle trips per day (10 existing) based on the Institute of Transportation Engineers Trip Generation Manual, General Office (844 trips)/Light Industrial (1457 trips) land use designation. 2. Impact Fees: There will be an impact fee that is assessed and due prior to issuance of any building permits. The assessed impact fee will be based on the impact fee ordinance that is in effect at that time: 3. Traffic Impact Study: A traffic impact study was not required with this application. 4. Capital Improvements Plan/Five Year Work Program There are currently no roadways, bridges or intersections in the general vicinity of the project that are currently in the Capital Improvements Plan. Franklin Road is slated for widening to 5-lanes from Ten Mile to Linder Road with some additional improvements to the intersection on the eastern leg (should not affect the site; see below). B. Findings for Consideration 1. Tree Planter Policy Tree Planter Policy: The applicant should also comply with the District's Tree Planter Width Interim Policy which prohibits all trees in planters less than 6-feet in width. In addition to prohibiting trees in planters less than 6-feet in width, the policy requires a minimum planter width of 6-feet for class II tress with the installation of root barriers on both sides of the planter strip or a minimum planter 2 width of 8-feet without the installation of a root barrier. The policy also requires Class I and Class III trees to provide a minimum planter width of 10-feet. 2. Franklin Road Right-of-Way Policy: District policy requires 96-feet of right-of-way on arterial roadways (Figure 72-F1 B). This right-of-way allows for the construction of a 5-lane roadway with curb, gutter, 5-foot concrete detached sidewalks and bike lanes. Sidewalk Policy: District policy requires 7-foot wide attached (or 5-foot detached) concrete sidewalk on all collector roadways and arterial roadways (7204.7.2). Applicant Proposal: The applicant has not proposed to construct any improvements or dedicate any additional right-of-way with this application. Staff Recommendation: Due to the fact that Franklin Road is built out, the applicant should not be required to construct any additional improvements or dedicate Any additional right-of-way with this application. The applicant should be required to provide an easement for the existing sidewalk if one does not already exist. Also worth noting is the planned rebuild of the intersection of Franklin and Linder noted in the FYWP. The south side of the fronting section of Franklin Road is slated for an additional turn lane (although this addition should not directly impact the site). Contact Tim Morgan, Project Manager for additional information (208)387-6260. 3. Driveways Driveway Offset Policy: District policy 72-F5, requires driveways located on collector or arterial roadways with a speed limit of 35 to align or offset a minimum of 150-feet from any existing or proposed driveway. Access Policy: District Policy 7204.7.3 states that direct access to arterials and collectors is normally restricted. The developer shall try to use combined access points. Gravel Tracking Policy: Graveled driveways abutting public streets create maintenance problems due to gravel being tracked onto the roadway. In accordance with District policy, 7207.9.1, the applicant should be required to pave the driveway its full width and at least 30-feet into the site beyond the edge of pavement of the roadway and install pavement tapers with 15-foot radii abutting the existing roadway edge. Width Policy: District policy 7207.9.3 restricts industrial driveways to a maximum width of 40-feet. Most industrial driveways will be constructed as curb-cut type facilities if located on local streets. Curb return type driveways with 15-foot radii will be required for driveways accessing collector and arterial roadways; District policy 7207.9.3 restricts commercial driveways with daily traffic volumes over 1,000 vehicles to a maximum width of 36-feet. Most commercial driveways will be constructed as curb-cut type facilities if located on local streets. Curb return type driveways with 15-foot radii will be required for driveways accessing collector and arterial roadways. Applicant Proposal: The applicant is proposing to construct two driveways intersecting Franklin Road approximately 95-feet east of the west property line, and 10-feet west of the east property line. The remaining 8-lots are proposed to take access from NW 13th Avenue. Staff Recommendation: The applicant should be required to relocate the westerly (closest to the intersection with Linder Road) driveway to take access from NW 13t" Avenue; OR construct a shared right-in/right-out driveway at the west property line with a 6-inch raised median installed in the middle of Franklin Road to restrict turning movements. The easterly driveway intersecting Franklin Road should be relocated to NW 13th Avenue; OR be shifted to align with 12th Avenue to 3 the south and providing a shared access for the parcel to the east. All other lot access should come from NW 13tH Avenue. Driveway access to NW 13tH Avenue should be located a minimum of 50-feet (measured near edge to near edge) from the intersection with Franklin Road, be paved the entire width, and at least 30-feet intro the site. Commercial Driveways should be no greater than 36-feet wide, and industrial driveways should be no greater than 40-feet wide. 4. Internal Street Right-of-Way Policy: District policy requires 54-feet of right-of-way on industrial/commercial roadways (Figure 72-F1 B). This right-of-way allows for the construction of a 3-lane roadway with curb, gutter and 5-foot wide concrete sidewalks. Street Section Policy: District policy 7202.8 and 72-F1A, requires roadways abutting commercial developments to be constructed as a 40-foot street section with curb, gutter and 5-foot concrete sidewalk within 54-feet of right-of-way. Roadway Offset Policy: District policy 7204.11.6, requires local roadways to align or offset a minimum of 300-feet from an arterial roadway (measured centerline to centerline). Turnaround Policy: District policy 7205.2.1 requires turnarounds to be constructed to provide a minimum turning radius of 45-feet. The applicant should also be required to provide a minimum of a 29-foot street section on either side of any proposed center islands within the turnarounds. The medians should be constructed a minimum of 4-feet wide to total a minimum of a 100-square foot area. Applicant Proposal: The applicant is proposing to construct the internal street, NW 13tH Avenue, approximately 400-feet east of the west property line as a 41-foot street section with vertical curb, gutter, and 5-foot attached concrete sidewalk, within 54-feet of right-of-way. NW 13tH Avenue terminates in a cul-de-sac approximately 400-feet north of the south property line. Staff Recommendation: The applicant should be required to construct the internal street, NW 13tH Avenue, as a 41-foot street section with vertical curb, gutter, and 5-foot attached concrete sidewalk, within 54-feet of right-of-way, where proposed. The cul-de-sac at the northern terminus of NW 13tH Avenue should be constructed with a minimum turning radius of 45-feet. C. Site Specific Conditions of Approval Construct the internal street, NW 13tH Avenue, as a 41-foot street section with vertical curb, gutter, and 5-foot attached concrete sidewalk, within 54-feet of right-of-way, located approximately 400- feet east of the west property line. 2. Construct a standard cul-de-sac turnaround at the terminus of NW 13tH Avenue with a minimum turning radius of 45-feet. 3. Driveway access to NW 13tH Avenue should be located a minimum of 50-feet (measured near edge to near edge) from the intersection with Franklin Road, be paved the entire width, and at least 30- feet intro the site. Commercial Driveways should be no greater than 36-feet wide, and industrial driveways should be no greater than 40-feet wide. 4. Relocate the westerly (closest to the intersection with Linder Road) driveway to take access from NW 13tH Avenue; OR construct a shared right-in/right-out ONLY driveway at the west property line with a 6-inch raised median installed to restrict turning movements as such. 4 5. Relocate the proposed easterly driveway on Franklin Road to NW 13th Avenue, in compliance with District policy requirements; OR shift the driveway to align with 12t" Avenue to the south thereby providing a shared access for the parcel to the east. 6. Provide an easement for the existing sidewalk on Franklin Road, if one does not already exist. 7. Keller Supply To Whom It May Concern: 3084 EAST LANARK MERIDIAN, IDAHO 83642 Please find attached a Certificate of Zoning Compliance Application for the above mentioned project. This new facility is going to be constructed at 152 N. West 13a` Place in the new Creamline Park Subdivision. The owner is proposing to construct an industrial building in an IL zone. The building will be used for wazehousing, wholesale sales and associated office and showroom for HVAC equipment. The building will be concrete tilt-up 28'- 4" to 32'- 4" above finish grade. There will be 43 parking stalls as shown on the plans. The building is 30,000 sq. ft. and is on 143,531 sq .ft. (3.30) acres of land. We have proposed 9,221 sq .ft. of landscaping along the street, sides of the asphalt areas, along the front of the building, and the office azea. The landscaping selected will provide variety and these plant materials will survive well in this climate and match the existing landscaping in the area. There is a loading dock on the North side of the building facing the Union Pacific Rail Road. We hope that this project will meet with your approval. Mix of materials: All buffer areas shall be comprised of, but not limited to, a mix of evergreen and deciduous trees, shrubs, lawn, or other vegetative groundcover. Fences, walls and berms may also be incorporated into the buffer area. b. Barrier effectiveness: The required buffer area shall result in a barrier that allows trees to touch at the time of the tree maturity. c. Buffer wall and/or fence: Where existing or proposed adjacent land uses cannot be adequately buffered with plant material(s), the City may require inclusion of a wall, fence, or other type of screen that mitigates noise and/or unsightly uses. If a wall or fence at least six feet (ti') tall is provided, the planting requirement may be reduced to at least one tree per 35 lineal feet, plus shrubs, lawn, or other vegetative. groundcover. d. Chainlink Fencing: Chainlink fencing with or without slats does not qualify as a screening material. Except in the I-L and I-H districts, Chainlink or cyclone fencing is prohibited within required buffers between different land uses. Chainlink may be used beyond the required buffer. Franklin Road: De Weerd: Okay. Item 9 is FP 07-006. Anna. Canning: Sony, ma'am. I'm still having problems with these two monitors, getting something up there for you to see tonight. On -- this is the Creamline Park project. The applicant did raise some questions about the conditions in the final plat. We have resolved four of -- actually, we have resolved all of the issues, but I do need to have Council read in some changes. One would be to site specific condition number 17. The applicant is in agreement with the wording I have in your presentation notes and that would be to remove the existing conditions A through C and adopt one that reads: Depict either fencing per UDC 11-3-Ati-B3 or the landscaping as an amenity per UDC 11-3-A6-B2, adjacent to the Eight Mile Lateral on the plan. Include fencing details, f.e., construction materials and a picture slash sketch on the plan. The fencing shall be installed with the final plat. The other item that needs to be read into the record is with regard to general requirement number two. The applicant has asked to be allowed to have one building permit prior to the final plat being recorded. Actually, they asked for all of them to be released, but we have compromised on one. If that meets Council's approval, the change that would need to be done to general requirement number two is to add a sentence stating one building permit may be requested prior to reconiing the final plat and, then, adding the word additional toward the end of that sentence before building permits. The wording is up on the screen. Sony. De Weerd: Thank you, Anna. Canning: The first one was In your notes, but this one is up just on the screen. Sorry about that. De Weerd: Okay. Council, any questions? Meritlian City CounGl Merck 27, 2007 Page 74 of 66 Bird: I have none. Zaremba: Madam Mayor, I have one comment. De Weerd: Mr. Zaremba. Zaremba: Director Canning, the -- oh. Not speaking loud enough. Okay. In our packet we had a letter from Intermountain Gas Company asking that their easement continue on through the private road and do we need to add that someplace? I'm thinking that's appropriate somewhere around site specific 15. Or is that something that's understood without adding it? Canning: Madam Mayor, Members of the Council, that would be appropriate as stated to add it to item number -- to go ahead and add it to item number 15, I believe. Zaremba: Okay. Just a reference to the letter is good enough or do we need to specify how the easement continues?
