The issuance of this permit does not release the applicant from any previous requirements of the other permits issued for this site. NOTE: This is not a Building Permit. Prior to anv construction, you should contact the Building the Meridian Building Department. Site/Landscape Plan: The Site/Landscape Plan prepared by Karen Anderson (ACRD), dated December 23, 2006, is approved (stamped "Approved" on December 26, 2006 by the Meridian Planning Department) with the. following changes: 1) UDC 11-313-7 requires one tree per 35 lineal feet of street frontage within the required street landscape buffer. One additional tree shall be placed in the required street buffer to meet this standard (see redlines). 2) UDC 11-313-8C requires one tree per 35 lineal feet within the required perimeter landscape buffer (located on the southern property line). One additional tree shall be placed in the required perimeter buffer to meet this standard (see redlines). The approved landscape plan is not to be altered without prior written approval of the Planning Department Alternative Compliance: The applicant has requested alternative compliance from UDC standard 11 -3B -8C 1 a, which requires a five foot perimeter landscape buffer along all interior lot lines that are adjacent to paved vehicular use areas. Due to the location of the existing structure and the area available for parking, the required buffer along the southern property line would eliminate an existing parking space on the site. The applicant is proposing to construct the required five foot buffer along all of the southern property line except for the area adjacent to the existing parking space. In lieu of the five foot buffer that would be required, the applicant has proposed a six foot solid fence to be along the entire southern property line. This fence will help to screen the residential property to the south and enhance the perimeter buffer. Therefore, the Director has approved the applicant's alternative compliance request per UDC 11-513-5B3 a. Day Care standards: UDC 11-4-3.9 lists specific criteria for day care facilities that serve children. The applicant shall comply with the following: • In determining the type of day care facility, the total number of children cared for during the day and not the number of children at the facility at one time, is the determining factor. The operator's children are excluded from the number. • On-site vehicle pickup, parking and turnaround areas shall be provided to ensure safe discharge and pickup of clients. • The decision-making body shall specify the maximum number of allowable clients and hours of operation as conditions of approval. • The applicant or owner shall secure and maintain a Basic Day Care License from the State of Idaho Department of Health and Welfare—Family and Children's Services Division. • In residential districts or uses adjoining an adjacent residence, the hours of operation shall be between 6:00 a.m. to 11:00 p.m. This standard may be modified through approval of a Conditional Use Permit. • All outdoor play areas shall be completely enclosed by minimum six-foot (6') non -scalable fence to secure against exit/entry by small children and to screen abutting properties. The fencing material shall meet the swimming pool fence requirements of the Building Code in accord with Title 10 of the Meridian City Municipal Code. • Outdoor play equipment over six feet (61) high shall not be located in a front yard or within any required yard. • Outdoor play areas in residential districts adjacent to an existing residence shall not be used after dusk. Irri ag tion: An underground, pressurized irrigation system must be installed to all landscape areas per the approved specifications and in accordance with UDC 11-3A-15. Curbing: Per UDC 11-311-5I, all landscape areas adjacent to driveways, parking lots, or other vehicle use areas, must be protected by curbing, wheel stops, or other approved protective devices. Curbing may be cut to allow for storm water runoff. Protection of Existing Trees: Any existing trees on site must be protected or mitigated for in accordance with the Tree Preservation section of the City's Landscape Ordinance. Per UDC 11-3B-10, coordinate with the Parks Department Arborist (Elroy Huff, 888-3579) for approval of protection/relocation measures for the existing trees prior to construction. Any severely damaged tree must be replaced in compliance with UDC 11- 3B -10-C.5. Parking: The proposed parking areas shall be paved and striped in accordance with UDC 11-3B. Project engineer/architect shall certify that the number and size of handicap -accessible spaces conforms to the Americans with Disabilities Act (ADA). Handicap accessible stalls must have signage in accordance per ADA and signed "Van Accessible". Sidewalks: All sidewalks shall be constructed in accordance with 11-3A-17. Sidewalks shall be constructed prior to occupancy. Drainage: Storm water drainage swales shall not have a slope steeper than 3:1, shall be fully vegetated, and shall be designed in compliance with UDC 11-3B-11 and UDC 11-3A-18. Fencing: Any required or proposed fencing shall be installed with current fencing standards as defined in UDC 11-3A-7. Furthermore, all outdoor play areas shall be completely enclosed by minimum six-foot (6') non -scalable fence to secure against exit/entry by small children and to screen abutting properties. Li htin : Lighting shall not cause glare or impact the traveling public or neighboring development and comply with lighting standards as defined in UDC 11-3A-11 Signage: No signs are approved with this CZC. All business signs will require a separate sign permit in compliance with UDC 11-3D. Trash Enclosure: Any dumpster(s) must be screened in accordance with UDC -11-3A-12. Trash enclosures must be built in the location and to the size approved by SSC. Handicap -Accessibility: The structure, site improvements and parking must be in compliance with all federal handicap -accessibility requirements. ACHD Acceptance: All impact fees, if any, shall be paid prior to the issuance of a building permit. If any changes must be made to the site plan to accommodate the ACHD requirements, a new site plan shall be submitted to the City of Meridian Planning Department staff for approval prior to the issuance of a building permit. Certificate of Occupancy: All required improvements must be complete prior to obtaining a Certificate of Occupancy. All changes in occupancy need to comply with the requirements of the Building Department. It is unlawful to use or occupy any building or structure until the Building Official has issued a certificate of occupancy. A certificate of occupancy or temporary certificate of occupancy is obtained from the Building Department (208) 887-2211 after inspections are complete and the field inspection record is returned to the building department. Plan Modifications: Except for the changes mentioned above, the approved Site /Landscape Plan stamped "Approved" on December 26, 2006, is not to be altered without prior written approval of the Planning Department. No significant field changes to the site or landscape plans are permitted; pri written approval of all changes is required. Request: Alternative Compliance to a portion of the 5 -foot buffer on the south property line adjacent to 1900 Linder Road. Due to the requirement of 4 parking spaces for the site it is necessary to use the existing parking space located along side the garage (no longer used as a garage). The existing space is 10 -feet X 25 -feet. If the 5 -foot buffer is required to extend the full length of the south property line it will eliminate the use of this parking space. The operator's children are excluded from the number. • On-site vehicle pickup, parking and turnaround areas shall be provided to ensure safe discharge and pickup of clients. • The decision -malting body shall specify the maximum number of allowable clients and hours of operation as conditions of approval. • The applicant or owner shall secure and maintain a Basic Day Care License from the State of Idaho Department of Health and Welfare—Family and Children's Services Division. • In residential districts or uses adjoining an adjacent residence, the hours of operation shall be between 6:00 a.m. to 11:00 p.m. This standard may be modified through approval of a Conditional Use Permit. • All outdoor play areas shall be completely enclosed by minimum six-foot (6') non -scalable fence to secure against exit/entry by small children and to screen abutting properties. The fencing material shall meet the swimming pool fence requirements of the Building Code in accord with Title 10 of the Meridian City Municipal Code. • Outdoor play equipment over six feet (6') high shall not be located in a front yard or within any required yard. • Outdoor play areas in residential districts adjacent to an existing residence shall not be used after dusk. Irrigation: An underground, pressurized irrigation system must be installed to all landscape areas per the approved specifications and in accordance with UDC 11-3A-15. Curbing: Per UDC l l -3B -5I, all landscape areas adjacentto driveways, parking lots, or other vehicle use areas, must be protected by curbing, wheel stops, or other approved protective devices. Curbing may be cut to allow for storm water runoff. Protection of Existing Trees: Any existing trees on site must be protected or mitigated for in accordance with the Tree Preservation section of the City's Landscape Ordinance. Per UDC 11-313- 10, coordinate with the Parks Department Arborist (Elroy Huff, 888-3579) for approval of protection/relocation measures for the existing trees prior to construction. Any severely damaged tree must be replaced in compliance with UDC 11-313-1 O-C.S. Parking: The proposed parking areas shall be paved and striped in accordance with UDC 11-313. Project engineer/architect shall certify that the number and size of handicap -accessible spaces conforms to the Americans with Disabilities Act (ADA).
