Prior to any construction, you should contact the Building Department at (208) 887-2211 to verify if any additional permits and/or inspections will be required by the Meridian Building Department. Site/Landscape Plan: The Site/Landscape Plan prepared by Chris Klein, dated 11/16/06 is approved (stamped "Approved" on December 8, 2006 by the Meridian Planning Department) with the following notes: 1) UDC 11-3B-8c All parking lot and perimeter landscape planters shall have a minimum width of five feet, measured from the inside of curb; 2) UDC 11-3B-1 All proposed trees shall be a minimum two inch caliper (shade or ornamental) or a minimum of six feet tall (evergreen); 3) Along with the proposed trees, all parking lot planters shall include low shrubs or other vegetative ground cover; 4) Due to sidewalk construction plans by ACHD (see email from ACHD, dated 12/8/06) the applicant is not required to install the sidewalk along W First Street with this project. The approved site plan is not to be altered without prior written approval of the Planning Department. Elevations: The Elevations prepared by Chris Klein, labeled Sheet 1, no date, are approved with no changes from the Planning Department. The elevations are in compliance with the Downtown Meridian Design Guidelines and shall not be altered without prior approval from the Planning Department. Protection of Existing Trees: Any existing trees on site must be protected or mitigated for in accordance with the Tree Preservation section of the City's Landscape Ordinance. Per UDC 11-3B-10, coordinate with the Parks Department Arborist (Elroy Huff, 888-3579) for approval of protection/relocation measures for the existing trees prior to construction. Any severely damaged tree must be replaced in compliance with UDC 11- 3B-10-C.5. Parkin :The proposed parking areas shall be paved and striped in accordance with UDC 11-3B. Project engineer/architect shall certify that the number and size of handicap-accessible spaces conforms to the Americans with Disabilities Act (ADA). Handicap accessible stalls must have signage in accordance per ADA and signed accessible. See redline parking changes/notes on the site plan. Curbin :Per UDC 11-3B-SI, all landscape areas adjacent to driveways, parking lots, or other vehicle use areas, must be protected by curbing, wheel stops, or other approved protective devices. Curbing may be cut to allow for storm water runoff.. Sidewalks: All sidewalks shall be constructed in accordance with 11-3A-17. Drainage: Storm water drainage swales shall not have a slope steeper than 3:1, shall be fully vegetated, and shall be designed in compliance with UDC 11-3B-11 and UDC 11-3A-18. Lighting: Lighting shall not cause glare or impact the traveling public or neighboring development and comply with lighting standards as defined in UDC 11-3A-11. Signage: No signs are approved with this CZC. All business signs will require, a separate sign permit in compliance with UDC 11-3D. Trash Enclosure: All dumpster(s) must be screened in accordance with UDC-11-3A-12. Trash enclosures must be built in the location and to the size approved by SSC. Handicap-Accessibility: The structure, site improvements and parking areas must be in compliance with all federal handicap-accessibility requirements. ACHD Acceptance: All impact fees, if any, shall be paid prior to the issuance of a building permit. If any changes must be made to the site plan to accommodate the ACHD requirements, a new site plan shall be submitted to the City of Meridian Planning staff for approval prior to the issuance of a building permit. Certificate of Occupancy: All required improvements must be complete prior to obtaining a Certificate of Occupancy. All changes in occupancy need to comply with the requirements of the Building Department. It is unlawful to use or occupy any building or structure .until the Building Official has issued a certificate of occupancy. A certificate of occupancy or temporary certificate of occupancy is obtained from the Building Department (208) 887-2211 after inspections are complete and the field inspection record is returned to the building department. This is currently zoned OT. At this time a 1950's residence is on this approximately 1/3 acre lot. Scope of work: Permit Requested for movement of ONE WALL. It is requested of the planning committee to allow the modification and improvement of this 1950's home, into a SINGLE TENANT, PROFESSIONAL OFFICE, single story building. The interior, and exterior will be 100% upgraded including, plumbing, electrical, windows, doors, walls, exterior finishes, and roof. 1. Architectural Character This 1950's house already has much character and is being improved through tying in the single garage into the house itself. We are adding windows and bringing the recessed entry way to the front with sidelight accents and a full window door. The entry way shall be covered. 100% new exterior and Roof Roof shall incorporate multiple roof planes, overhanging eaves, and be a sloped roof design. 2. Color and materials The new exterior will be a "STUCCO" finish with NEW WINDOWS in all existing window locations. The pattern variations will consist of two colors, stucco material, and some stone. Exterior Colors will be TWO TONE, Light colored TanBrown stucco finish. Roof will be ARCHITECTURAL SHINGLE design of a DARK Grey/black tone. Dimensional Improvements will be made to the exterior around windows and doors to achieve a more attractive, commercial appearance. IN ADDITION, LARGE, WINDOWS will be ADDED to the FRONT and SIDE's of the STREET FACING Walls. No mirror or tinted windows will be used. It is our intent to place as large of windows as appropriate for the design and function of the building to remain useable. In some cases this will exceed the design standards of old town, and on some existing walls, this will not meet the standards. The building will have an "office/professional" look and design while retaining an old town/downtown feel. 3. Parking Lots Parking is limited due to the use of the existing structure of the old house. We have maximized parking while keeping 2/3 of the existing landscaping. Per code, no additional landscaping is required, as we are not adding more than 25% of the buildings original size. We will however, improve the existing grass areas and it is our intent to over time create a very manicured, park like open space around the office. It is not our intent to pave the entire lot. We are open to other suggestions from the committee. As shown in the drawings, we will be landscaping around the building, and adding three trees between Cherry Lane and the building. While this isn't a requirement based on the percentage of addition to the property, we feel it will better represent the desired look of the old town area and offset some of our limitations on adding windows to existing walls on the structure. Parking will be accommodated on the east side of the building, no parking will be designated in the "front" or the North side facing Cherry Lane. Parking will be accessed from West lst, no access is requested from Cherry Lane at this time. 4. Pedestrian walkways An existing eight foot walkway is currently installed along the Cherry Lane side of the property. It is understood the City will be installing the W. 1St sidewalks early 2007. This will fully wrap the property with the desired pedestrian walkways. This is a very expensive investment to bring a 1950's home up to the downtown/old town standards. It was the initial intent to paint the house and install a ramp on this existing home to bring it to the minimum commercial occupancy requirements. My involvement with the city and community led us to fully renovate this structure into what we believe is representative of desirable old town professional use. I would ask your understanding and flexibility in some areas that do not meet your intentions of new construction, drawing your attention to areas where we far exceed the minimum requirements to have simply occupied the old structure. A contractor is not involved with the renovation and I am significantly challenged as an individual to submit the in depth requirements asked for in the design review application and tenant improvement application. I ask your understanding and patients in reviewing the documents submitted. Anything you can do to facilitate the process and speed the issuance of my building permit would be greatly appreciated. It has been determined by the Right-of-Way and Development Services Department that due to the fact that all desired road improvements currently exist; a complete staff report is not needed for this application. However ACRD Staff does wish comment on two site specific issues. 1. The proposed emergency access located on Meridian road should be barricaded in a manner acceptable to the Meridian Fire Department. 2. The propose driveway located on Sedgewick Dr. should comply with district policy 72-F4 (1) and 72-F4 (2), which requires driveways located on local residential roadways to offset a controlled and/or uncontrolled intersection a minimum of 50- feet (measured near edge to near edge). If the site plan or use should change in the future, ACRD will review the site plan and may require improvements to the transportation system at that time. Prior to final approval you will need to submit plans to the ACRD Development Review Department. A traffic impact fee may be assessed by ACRD and will be due prior to the issuance of a building permit. An ACHD community sidewalk project on First Street that will construct curb, gutter and 5-foot. attached concrete sidewalk along both sides of First Street from Washington Street to Cherry Lane. 6. Findings for Consideration Cherry Lane District Right-of-Way Policy: District policy requires 114-feet of right-of-way on arterial roadways (Figure 72-F1 B). This right-of- way allows for the construction of a 7-lane roadway with vertical curb, gutter and 5-foot detached concrete sidewalks. District Roadway Offset Policy: District policy 7204.11.6, requires local roadways to align or offset a minimum of 300-feet from an arterial roadway (measured centerline to centerline). Applicant Proposal: The applicant has not proposed to dedicate additional right-of-way on Cherry Lane and proposes to utilize the existing roadway improvements on Cherry lane. Staff Comment/Recommendation: The applicant is required to dedicate right-of-way to total 57-feet from the centerline of Cherry Lane. 40-feet of right-of-way currently exists. The District will purchase the additional 17-feet of right-of- way from the applicant from available funds. A sidewalk will eventually be constructed approximately 48-feet from the centerline of Cherry Lane; the applicant is not required to construct that sidewalk at this time. Dedicate right-of-way to total 57-feet from the centerline of Cherry Lane abutting the parcel, an additional 17-feet of right-of-way. The right-of-way purchase and sale agreement and deed must be completed and signed by the applicant prior to scheduling the final plat for signature by the ACHD Commission or prior to issuance of a building permit (or other required permits), whichever occurs first. Allow up to 30 business days to process the right-of-way dedication after receipt of all requested material. The District will purchase the right-of-way which is in addition to existing right- of-way from available Corridor Preservation Funds. 2. First Street District Right-of-Way Policy: District policy 7204.4.2 states, "developments with any buildable lot that is less that 1-acre in size will typically provide streets having a minimum pavement width of 32-feet with curb, gutter and sidewalks. The total street width shall be 36-feet from back-of-curb to back-of-curb. Variations of this width may be allowed, depending on traffic volumes forecast to be generated by the development. Concrete sidewalks shall be a minimum of 5-feet in width unless they are separated from the curb 5-feet or more; in which case, the sidewalk shall be a minimum of 4-feet in width. Applicant Proposal: The applicant has not proposed to construct roadway improvements to First Street. Staff Comment/Recommendation: 3 MCZC-06-196 The applicant is required to either construct West 1St Street as one half of a 36-foot street section to include pavement widening curb, gutter and 5-foot attached concrete sidewalk or enter into a road trust for the improvements planned to be constructed as a part of the community project. The road trust amount will be approximately 6,825.00 Dollars. 3. Driveways District Driveway Policy: Graveled driveways abutting public streets create maintenance problems due to gravel being tracked onto the roadway. In accordance with District policy, 7207.9.1, the applicant should be required to pave the driveway its full width and at least 30-feet into the site beyond the edge of pavement of the roadway and install pavement tapers with 15-foot radii abutting the existing roadway edge. District Driveway Width Policy: District policy 7207.9.3 restricts commercial driveways with daily traffic volumes over 1,000 vehicles to a maximum width of 36-feet. Most commercial driveways will be constructed as curb-cut type facilities if located on local streets. Curb return type driveways with 15-foot radii will be required for driveways accessing collector and arterial roadways. Standard Conditions of Approval Any existing irrigation facilities shall be relocated outside of the right-of-way. 2. Private sewer or water systems are prohibited from being located within any ACHD roadway or right-of-way. 3. All utility relocation costs associated with improving street frontages abutting the site shall be borne by the developer. 4. Replace any existing damaged curb, gutter and sidewalk and any that may be damaged during the construction of the proposed development. The applicant shall submit revised plans for staff approval, prior to issuance of building permit (or other required permits), which incorporates any required design changes. 9. Construction, use and property development shall be in conformance with all applicable requirements of the Ada County Highway District prior to District approval for occupancy. 10. Filing Fee: The Commission may, from time to time, set reasonable fees to be charged the applicant for the processing of appeals, to cover administrative costs. b. Initiation: An appeal is initiated by the filing of a written notice of appeal with the Secretary of Highway Systems, which must be filed within ten .(10) working days from the date of the decision that is the subject of the appeal. The notice of appeal shall refer to the decision being appealed, identify the appellant by name, address and telephone number and state the grounds for the appeal. The grounds shall include a written summary of the provisions of the policy relevant to the appeal and/or the facts and law relied upon and shall include a written argument in support of the appeal. The Commission shall not consider a notice of appeal that does not comply with the provisions of this subsection. c. Time to Reply: The ROWDS Manager shall have ten (10) working days from the date of the filing of the notice of appeal to reply to the notice of the appeal, and may during such time meet with the appellant to discuss the matter, and may also consider and/or modify the decision that is being appealed. A copy of the reply and any modifications to the decision being appealed will be provided to the appellant prior to the Commission hearing on the appeal. d. Notice of Hearing: Unless otherwise agreed to by the appellant, the hearing of the appeal will be noticed and scheduled on the Commission agenda at a regular meeting to be held within thirty (30) days following the delivery to the appellant of the ROWDS Manager's reply to the notice of appeal. A copy of the decision being appealed, the notice of appeal and the reply shall be delivered to the Commission at least one (1) week prior to the hearing. e.
