No field changes to landscape plan permitted; prior written approval of all material changes is required. Site Plan: The Site Plan prepared by Hale Home Design, dated August 23, 2006, is approved (stamped "Approved" on October 3, 2006 by the Meridian Planning Department) with no changes. The approved site plan is not to be altered without prior written approval of the Planning Department. Alternative Compliance: The applicant, Joni West has requested alternative compliance from UDC standard 11-2B-3, which requires a 25 foot landscape buffer along arterial streets (Cherry Lane). The required buffer would encroach one foot into the existing building. ACHD is requiring the applicant to close the access to Cherry Lane and take access from 11th Avenue. The applicant is removing the concrete entrance and landscaping the area as part of the required buffer. In lieu of the one foot of required buffer width, the applicant has proposed an additional tree in the buffer landscape. Staff believes that additional landscaping and an attractive sign (separate sign permit in process) will enhance the appeal of the front yard of the property. Therefore, the Director has approved the applicant's alternative compliance request per UDC 11-SB-SB3a. Elevations: The Elevations submitted by Hale Home Design, are approved with no changes from the Planning Department. Da~Care standards: UDC 11-4-3.91ists specific criteria for day care facilities that serve children. The applicant shall comply with the following: • In determining the type of day care facility, the total number of children cared for during the day and not the number of children at the facility at one time, is the determining factor. The operator's children are excluded from the number. • On-site vehicle pickup, parking and turnaround areas shall be provided to ensure safe discharge and pickup of clients. • The decision-making body shall specify the maximum number of allowable clients and hours of operation as conditions of approval. • The applicant or owner shall secure and maintain a Basic Day Care License from the State of Idaho Department of Health and Welfare-Family and Children's Services Division. • In residential districts or uses adjoining an adjacent residence, the hours of operation shall be between 6:00 a.m. to 11:00 p.m. This standard may be modified through approval of a Conditional Use Permit. • All outdoor play areas shall be completely enclosed by minimum six-foot (6')non-scalable fence to secure against exit/entry by small children and to screen abutting properties. The fencing material shall meet the swimming pool fence requirements of the Building Code in accord with Title 10 of the Meridian City Municipal Code. • Outdoor play equipment over six feet (6') high shall not be located in a front yard or within any required yard. • Outdoor play areas in residential districts adjacent to an existing residence shall not be used after dusk. Irri ag_tion: An underground, pressurized irrigation system must be installed to all landscape areas per the approved specifications and in accordance with UDC 11-3A-15. Curbin :Per UDC 11-3B-SI, all landscape areas adjacent to driveways, parking lots, or other vehicle use areas, must be protected by curbing, wheel stops, or other approved protective devices. Curbing may be cut to allow for storm water runoff. Protection of Existing Trees: Any existing trees on site must be protected or mitigated for in accordance with the Tree Preservation section of the City's Landscape Ordinance. Per UDC 11-3B- 10, coordinate with the Parks Department Arborist (Elroy Huff, 888-3579) for approval of protection/relocation measures for the existing trees prior to construction. Any severely damaged tree must be replaced in compliance with UDC 11-3B-10-C.5. Parkin: The proposed parking areas shall be paved and striped in accordance with UDC 11-3B. Project engineer/architect shall certify that the number and size of handicap-accessible spaces conforms to the Americans with Disabilities Act (ADA). Handicap accessible stalls must have signage in accordance per ADA and signed "Van Accessible". Sidewalks: All sidewalks shall be constructed in accordance with 11-3A-17. Sidewalks shall be constructed prior to occupancy. Drainage: Storm water drainage swales shall not have a slope steeper than 3:1, shall be fully vegetated, and shall be designed in compliance with UDC 11-3B-11 and UDC 11-3A-18. Fencing: Any required or proposed fencing shall be installed with current fencing standards as defined in UDC 11-3A-7. Furthermore all outdoor play areas shall be completely enclosed by abutting_properties. The fencing material shall meet the swimming pool fence requirements of the Building Code in accord with Title 10 of the Meridian City Municipal Code (UDC 11-4-3.9B1). Lighting: Lighting shall not cause glare or impact the traveling public or neighboring development and comply with lighting standards as defined in UDC 11-3A-11 Si rg_iage: No signs are approved with this CZC. All business signs will require a separate sign permit in compliance with UDC 11-3D. Trash Enclosure: Any dumpster(s) must be screened in accordance with UDC-11-3A-12. Trash enclosures must be built in the location and to the size approved by SSC. Handicap-Accessibility: The structure, site improvements and parking must be incompliance with all federal handicap-accessibilityrequirements. ACHD Acceptance: All impact fees, if any, shall be paid prior to the issuance of a building permit. If any changes must be made to the site plan to accommodate the ACHD requirements, a new site plan shall be submitted to the City of Meridian Planning Department staff for approval prior to the issuance of a building permit. Certificate of Occupancy: All required improvements must be complete prior to obtaining a Certificate of Occupancy. A written certificate of completion shall be prepared by the landscape architect, landscape designer or qualified nurseryman responsible for the landscape plan upon completion of the landscape installation. The Certificate of Completion shall verify that all landscape improvements, including plant materials and sprinkler installation, are insubstantial compliance with the approved landscape plan. A Temporary Certificate of Occupancy maybe obtained by providing surety to the City in the form of a Letter of Credit or cash in the amount of 110% of the cost of the remaining improvements. A bid must accompany any request for Temporary Occupancy. Plan Modifications: Except for the changes mentioned above, the approved Site Plan, Landscape Plan stamped "Approved" on October 3, 2006, and Elevations, and are not to be altered without prior written approval of the Planning Department. Cherry Lane is approximately 114'x77'. The present building is approximately 1400 sq. feet and we are adding a new addition of an additiona1590 sq. feet. We currently have 4 parking spaces. Each of the spaces are roughly 11'x 23'. The addition would be set back 10' from the property line on the west side and 29' on the north side. The zoning for this district is Light Office. The current landscaping consists of one large Pine tree roughly 20" in diameter that will remain in place. The tree is located about 40' back from the center of Cherry Lane in front of the building. Another Pine tree about 20' away has been removed and will be replaced with a Maple tree approximately 2" in diameter. No major construction will be done around these trees so no additional protection for the trees will be needed. The existing planter in front of the building currently contains 21 plants and shrubs. Two berms will be added to the existing landscape, The berm on the east side will be approximately 21'x 24' .Maximum height is 3' and tapers down to ground level on the front side facing Cherry Lane and on the east side facing 11 ~' st. This planter will contain Two - 5 gallon ornamental grass, four 2-gallon ornamental grass, 6 day lilies, 6 flowing plants and one tree 2" in diameter. The second berm will be added to the west side of the front yard. This berm will be in the shape of a triangle and at the mid section will be 13' wide and 3' tall. Each side will taper down to ground level. This planter will contain 6 flowering plants, 6 day lilies, 2 - 5gallon ornamental grass, 4 -2 gallon ornamental grass and one tree 2" in diameter. In the middle of the planter will be a sign reading "Fantasyland Daycare 1131 W. Cherry lane." (Refer to sign permit for details.} All berms and planters will be lined with a cement boarder and covered with weed blocker and permanent bark. The front yard should have been marked at 24' but was mistakenly input at 18' .This is were the confusion on the buffers had come in. I was told at the pre-application meeting that I would not need to change anything on the west side of the yard because it was close enough to the required 25'. The plans have now been changed to the correct footage of 24 feet, which I hope will eliminate the need for buffers. I would only like to request one free standing $ign. That would be the one on the west side of the property. It would read Fantasyland Daycare 1131 W. Cherry Lane. The other is a piece of a log that has the words "Fantasyland Daycare" carved in it. The log would be on the ground between some plants and flowers. It would just be a decorative ornament like rocks or a fountain. This would be in the planter on the east side where we are removing the driveway and adding the landscaping. Please let me know if I can be of any more assistance. The ACHD Commission will not hear this item unless the site plan is changed in such a manner as to require Commission review. However, ACHD receives many calls from neighbors of day care centers concerning the volume of traffic and the number of parked vehicles near existing day care centers. Each parent typically makes two round trips per day (i.e. four one-way trips). The Institute of Transportation Engineers (ITE) data shows that a typical day cares created 4.52 vehicle trips per day per student. The proposed 41 student facility can be expected to generate 185.32 total vehicle trips per day. No traffic impact fees will be required by the day care. All future design plans and construction shall be in accordance with the Ada County Highway District Policy Manual, ISPWC Standards and approved supplements, Construction Services procedures and all applicable ACRD Ordinances unless specifically waived in writing by the District.
