Landscaping_ The Landscape/Site Plan prepared by Bill Sandrus on September 3, 2006 is approved (stamped "Approved" on September 26, 2006 by the Meridian Planning Department) with the following changes/notes (see . redlines on the plan): 1.) The parking stalls shown off the alley must be 9'w. x 19'1.; handicap stall should be 16'w. x 19' 1. (scale was slightly oto. 2.) The tree shown in the front yard within the required sidewalk area needs to be relocated a minimum of 5 -feet from the edge of the sidewalk location. The applicant requested Alternative Compliance for waiver of the 5 -foot wide landscape buffer adjacent to parking areas. For mitigation, the applicant has proposed to plant two trees within the front yard. The Planning Department has approved this request. All landscape materials shall comply with City Code. Other than the above-mentioned changes, the approved landscape/site plan is not to be altered without prior written approval of the Planning Department. No field changes to landscape plan permitted; prior written approval of all material changes is required. Elevations: The photo elevations of the existing building submitted by Andrea Sandrus are approved by the Meridian Planning Department as submitted. No changes or improvements to the existing building facade are being proposed or approved at this time. Day Care standards: UDC 114-3.9 lists specific criteria for day care facilities that serve children. The applicant shall comply with the following: • In determining the type of day care facility, the total number of children cared for during the day and not the number of children at the facility at one time, is the determining factor. The operator's children are excluded from the number. • On-site vehicle pickup, parking and turnaround areas shall be provided to ensure safe discharge and pickup of clients. • The decision-making body shall specify the maximum number of allowable clients and hours of operation as conditions of approval. • The applicant or owner shall secure and maintain a Basic Day Care License from the State of Idaho Department of Health and Welfare—Family and Children's Services Division. • In residential districts or uses adjoining an adjacent residence, the hours of operation shall be between 6:00 a.m. to 11:00 p.m. This standard may be modified through approval of a Conditional Use Permit. • All outdoor play areas shall be completely enclosed by minimum six-foot (6) non -scalable fence to secure against exit/entry by small children and to screen abutting properties. The fencing material shall meet the swimming pool fence requirements of the Building Code in accord with Title 10 of the Meridian City Municipal Code. • Outdoor play equipment over six feet (6') high shall not be located in a front yard or within any required yard. • Outdoor play areas in residential districts adjacent to an existing residence shall not be used after dusk. Irrigation: An underground, pressurized irrigation system must be installed to all landscape areas per the approved specifications and in accordance with UDC 11-3A-15. Protection of Existing Trees: Any existing trees on site must be protected or mitigated for in accordance with the Tree Preservation section of the City's Landscape Ordinance. Per UDC 11-3B-10, coordinate with the Parks Department Arborist (Elroy Huff; 888-3579) for approval ofprotection/reloc ation measures for the existing trees prior to construction. Any severely damaged tree must be replaced in compliance with UDC 11 -3B -10-C.5. Parking: The proposed parking areas shall be paved and striped in accordance with UDC 11-3B. Project engineer/architect shall certify that the number and size of handicap -accessible spaces conforms to the Americans with Disabilities Act (ADA). Handicap accessible stalls must have signage in accordance per ADA. See redline parking changes/notes on the site plan. Curbing: Per UDC 11 -3B -5I, all landscape areas adjacent to driveways, parking lots, or other vehicle use areas, must be protected by curbing, wheel stops, or other approved protective devices. Curbing maybe cut to allow for storm water runoff. Sidewalks: All sidewalks shall be constructed in accordance with 11-3A-17. Sidewalks shall be constructed prior to occupancy. A 5 -foot wide attached sidewalk is required along E. Ada Street per UDC 11-3A-17 in accordance with ACFID standards. Drainage: _Storm water drainage swales shall not have a slope steeper than 3:1, shall be fully vegetated, and shall be designed in compliance with UDC 11-313-11 and UDC 11-3A-18. Signage: No signs are approved with this CZC. All business signs will require a separate sign permit in compliance with UDC 11-31). Trash Enclosure: All dumpster(s) must be screened in accordance with UDC -11-3A-12. Trash enclosures must be built in the location and to the size approved by SSC: Handicap -Accessibility: The structure, site improvements and parking areas must be in compliance with all federal handicap -accessibility requirements. N ACHD Acceptance: All impact fees, if any, shall be paid prior to the issuance of a building permit. If any changes must be made to the site plan to accommodate the ACHD requirements, a new site plan shall be submitted to the City of Meridian Planning staff for approval prior to the issuance of a building permit. Certificate of Occupancy: All required improvements must be complete prior to obtaining a Certificate of Occupancy. A written certificate of completion shall be prepared by the landscape architect, landscape designer or qualified nurseryman responsible for the landscape plan upon completion of the landscape installation. The Certificate of Completion shall verify that all landscape improvements, including plant materials and sprinkler installation, are in substantial compliance with the approved landscape plan. A Temporary Certificate of Occupancy may be obtained by providing surety to the City in the form of a Letter of Credit or cash in the amount of 110% of the cost of the remaining improvements. A bid must accompany any request for Temporary Occupancy. Plan Modifications: Except for the changes mentioned above, the approved Landscape/Site Plan and Elevations stamped "Approved" on September 27, 2006, are not to be altered without prior written approval of the Planning Department. Ada St. According to the guidelines set forth by the Planning and Zoning Department in the City of Meridian, and in order to fulfill the requirements necessary for an educational facility to obtain a Certificate of Zoning Compliance, a narrative explaining the use of the property is requested. Therefore, the following is this explanation. SSMS facilitates a learning environment for approximately 12 students per day and currently operates Monday through Friday between the hours of 7:00 am to 6:00 pm. The school employs one licensed teacher and two teacher aids and carries a ratio of 8:1. There are two classes conducted a day between the hours of 9:00 am and 11:30 am and again at 1:00 pm to 3:30 pm. Therefore, the possibility of having all 12 children in the building at one time is unlikely. As of this date there are not any plans to add outside lighting nor are there any plans to construct new facilities on any part of the property. The plans are to excavate the ground and remove the older landscape barriers. Further removal of dead trees, dead grass, weeds, and the old broken down shed in the back yard will take place; and the six foot cedar fence will be repaired in several places to maintain the original structure. The improvements that will be made to the property include bringing in top -soil, installing a sprinkler system and re -seeding new foliage. Newer, more appealing landscape barriers will be installed, shrubs and bushes will be planted, and a sandbox with a swing -set will be provided for the children to play during breaks and lunch. The owners of Smaller Scholar Montessori School would like to request alternative compliance for the five foot wide landscape buffer on the West Boundary adjacent to the parking area. We will provide two trees in the front yard as noted on the landscape plan as mitigation. Our new landlords have observed our school and feel that our business is significant in the education of our young children and an asset to the community here in Meridian. SSMS has strived over the years to maintain a solid organization and dependable place for children to learn and play. I am sure that Smaller Scholar Montessori School will be found to meet the needs that have outlined by Planning and Zoning and would like to take this opportunity to ask that the Certificate of Zoning Compliance be granted so the teaching and developing of our youth can be continued. City Ordinance (UDC 11-3A-7CS) requires rear fences adjacent to alleys to be set back a minimum of five feet from the alley, measured from the property line. Further, UDC 11-4-3.9 Daycare Facility specific use standards state that "All outdoor play areas shall be completely enclosed by minimum six-foot non -scalable fence to secure against exit/entry by small chinldren and to screen abutting properties." For the CZC I will require you to move your existing fence 5 -feet from the alley measured from your rear property line. However, I want you to be aware that with the Conditional Use Permit, the Planning Commission may require additional fencing requirements such as possibly an "open -vision" fence. I know that the Police Department will probably request this for safety reasons and the Commission may require it. To keep you from having to relocate your fence now with the CZC and then possibly being required by the Commission to construct another type of fence entirely with the CUP, I would suggest that you wait to move the fence until after the Commission has approve your CUP. To accomplish this and obtain temporary occupancy for the CZC, you would submit a Letter of Credit from your bank or cash surety for 110% of the bid amount for the cost of constructing a 6 -foot chain link (open -vision) fence on the rear property boundary. Also, if you haven't already, you should contact Joe Silva asap regarding fire requirements for exiting bedrooms since it's an older house. He indicated to me that sometimes there are problems with older homes meeting the criteria set forth by the State Fire Marshall. To recap our meeting last week, in order to process the CZC I need a revised site/landscape plan showing the 3 required parking stalls (including 1 handicap accessible stall) located perpendicular to the alley, improved with a dustless surface (i.e. asphalt, concrete, pavers, bricks or recycled asphalt) (indicate on the plan which type of surface you're proposing), two trees in the front, relocation of the rear fence and removal of the "parking" label on the 2 stalls in front & the garage area as these will not be counted toward your required spaces. After checking the alley width I noticed that it's only 15 -feet wide; City Code requires that you have a 25 -foot wide drive aisle adjacent to parking. In order to comply with this requirement you will need to extend the parking area north 10 -feet and pave this area. Also, submit a request (letter) for Alternative Compliance for the 5 -foot wide landscape buffer on the west boundary adjacent to the parking area and note that you will provide two trees in front as mitigation. Ada Sonya We have no problem with the proposed fence. However we have had problems with some of these older homes meeting the exiting requirements for the bedrooms. The building must pass the inspection criteria as set forth by the State Fire Marshal. The typical problem is that the windows must be a minimum of 5.7 square feet, min 24" in height and a min of 20" in width, and maximum finished sill height not over 44" inches.
