The issuance of this permit does not release the applicant from any previous requirements of the other permits issued for this site. The gazebo and associated landscaping received temporary CZC (CZC-06-023) approval March 15, 2006 and did not allow for permanent occupancy of the gazebo structure and additional CZC approval was required. Therefore, the approval of this CZC (CZC-06-143) will allow for the gazebo structure to receive permanent occupancy when all landscaping and site improvements associated with this approval are complete. This approval does not include: future basketball & field hockey court, future structure over picnic area, future maintenance building, and future sidewalks. Site Plan: The Site Plan prepared by BRS Architects on September 27, 2006, sheet SDl.l, and is approved (stamped "Approved" on October 2, 2006 by the Meridian Planning Department) with no changes. The approved site plan is not to be altered without prior written approval of the Planning Department. No field changes to site plan permitted; prior written approval of all material changes is required. Landscape Plan: The Landscape Plan prepared by BRS Architects on July 21, 2006, sheet Ll.l, and is approved (stamped "Approved" on October 2, 2006 by the Meridian Planning Department) with no changes. The approved landscape plan is not to be altered without prior written approval of the Planning Department. No field changes to landscape plan permitted; prior written approval of all material changes is required. • 1 Irri ag tion: An underground,. pressurized irrigation system must be installed to all landscape areas per the approved specifications and in accordance with UDC 11-3A-15. Curbing: Per UDC 11-3B-SI, all landscape areas adjacent to driveways, parking lots, or other vehicle use areas, must be protected by curbing, wheel stops, or other approved protective devices. Curbing may be cut to allow for storm water runoff. Protection of Existing Trees: Any existing trees on site must be protected or mitigated for in accordance with the Tree Preservation section of the City's Landscape Ordinance. Per UDC 11-3B- 10, coordinate with the Parks Department Arborist (Elroy Huff, 888-3579) for approval of protection/relocation measures for the existing trees prior to construction. Any severely damaged tree must be replaced in compliance with UDC 11-3B-10-C.5. Parkin: The proposed parking areas shall be paved and striped in accordance with UDC 11-3B. Project engineer/architect shall certify that the number and size of handicap-accessible spaces conforms to the Americans with Disabilities Act (ADA). Handicap accessible stalls must have signage in accordance per ADA and signed "Van Accessible". Sidewalks: All sidewalks shall be constructed in accordance with 11-3A-17. Sidewalks shall be constructed prior to occupancy. Drainage: Storm water drainage swales shall not have a slope steeper than 3:1, shall be fully vegetated, and shall be designed in compliance with UDC 11-3B-11 and UDC 11-3A-18. Fencing: Any required or proposed fencing shall be installed with current fencing standards as defined in UDC 11-3A-7 Lighting: Lighting shall not cause glare or impact the traveling public or neighboring development and comply with lighting standards as defined in UDC 11-3A-11 Signage: No signs are approved with this CZC. All business signs will require a separate sign permit in compliance with UDC 11-3D. Trash Enclosure: Any dumpster(s) must be screened in accordance with UDC-11-3A-12. Trash enclosures must be built in the location and to the size approved by SSC. Handicap-Accessibility: The structure, site improvements and parking must be in compliance with all federal handicap-accessibility requirements. ACHD Acceptance: All impact fees, if any, shall be paid prior to the issuance of a building permit. If any changes must be made to the site plan to accommodate the ACHD requirements, a new site plan shall be submitted to the City of Meridian Planning Department staff for approval prior to the issuance of a building permit. Certificate of Occupancy: All required improvements must be complete prior to obtaining a Certificate of Occupancy. A written certificate of completion shall be prepared by the landscape architect, landscape designer or qualified nurseryman responsible for the landscape plan- upon completion of the landscape installation. The Certificate of Completion shall verify that all landscape improvements, including plant materials and sprinkler installation, are in substantial compliance with the approved landscape plan. A Temporary Certificate of Occupancy may be obtained by providing surety to the City in the form of a Letter of Credit or cash in the amount of 110% of the cost of the remaining improvements. A bid must accompany any request for Temporary Occupancy. The existing Phase One part of the project contains a memorial rose garden with walking paths, a gazebo, landscaping and other site amenities such as tables and benches. The proposed Phase Two construction will include relocating an existing house, constructing a garage and driveway for the proposed house. Other site improvements will include a 34 stall parking lot to service the existing and future park with two drive aisle/access points off of Ten Mile Road. A proposed culvert bridge crossing will be built over Ten Mile Creek and will include associated ADA ramps, stairs and handrails. A pump station to the southwest of the site across Ten Mile Creek will also be developed to serve the Pocket Park site. Also in the proposed Phase Two development, there is construction which will be built in the near future, the remaining property will be developed with connecting walkways, a children's playground, a basketball court, Pavilion, fencing, a restroom facility and a Shop/Maintenance Facility for supporting the larger church site to the south. The improvements include lawn, landscaping, a paved rose garden path and Gazebo structure on approximately 1 acre of land. These improvements are intended to serve as a limited scope improvement for a specific event function, and celebration of the Cherry Lane Christian Churches' 100th year anniversary to occur on June 6, 2006. The 100 year anniversary event would include a ceremonial ground breaking and picnic to officially kick off the beginning of the design process and construction of the larger church project . ~, across 10 mile creek. As this is intended to be a single event use, it is the request of CLCC to be allowed this limited scope of improvement without providing at this time a paved connection, or parking lot adjacent 10 mile road in lieu of the ACRD design and specifics of the right of way still being concluded. A future connection of asphalt paving, parking lot, and bathroom facilities would be provided in the next phase of construction as ACHD's plans, and CLCC's funding becomes available. As you prepare the necessary paperwork to change the current development Agreement relative to the small pocket park on the East side of Ten Mile Creek, you might keep in mind the following points: 1. The 3 acre pocket park is a triangular piece of land that will primarily encompass the following: a. A Gazebo and memorial rose garden (completed under a temp. authorization) b. A relocation of our existing house to provide caretaker and security- to the entire church property. The relocation is of some urgency now because of the widening of Ten Mile Rood by ACND which takes the church property up to the front door step and a spate of vandalism at the new park. Mouse is moved but we need the foundation permit) c. A 30 space parking lot for park users. d. Eventually an outdoor basketball court, covered picnic sheltelr, restrooms, and a maintenance building. 3. C)ur plan is to get the caretaker building completed on its new foundation this Fall before work begins in earnest on the main church facility on the west side of Ten Mile Creek next springy. 4. The church is in the process of contracting with a major general contractor to build the main church sanctuary and a youth center beginning next spring and completing the project in the summer of 2008. I was heartened by the cooperation shown to us yesterday by the Planning Department so we can amend the current Development Agreement and get the pocket park issues clarified once and for all. As you recall, we agreed to hold a public meeting about the park projects and Kristy Vigil's suggestion we hotel it in the new gazebo is one we will follow. Since we are still in an undeveloped part of the county, I am dubious as to whether neighbors will show up. We have made cross access agreements with Silver Oaks to our West and will share an access road off of Franklin with them. Our plans allow for an access point for emergency vehicles to the north into AVEST storage properties. We have also made a verbal agreement with Meridian Public Works for cross access to their well lot on the NE corner of the pocket park, prom very early on, we have reserved a tot for the City of Meridian for a community well site. Although a test well has shown promise for nn extensive source of water, the final well has not been campteted and thus in our discussions with them yesterday, it seemed too early for them to consider changing their cross access route for fire services to the relocated caretaker house when they were unsure about the well house location. The last remaining issue raised by Vigil and Canning was a concern from Joe Silva about fire truck access to the relocated house. We met yesterday afternoon with Joe and worked out a very easy solution to his concern so fire trucks have a way of turning around if they have to engage a structure fire. 6y last night, you had already redesigned the roads to the caretaker house to meet Joe's concern. I think with n request for a hearing before Council on this amendment scheduled for Sept. 12, 200b we should be able to get the house on a new foundation by the end of September, and hopefully have it ready for occupancy sometime in early November. I discussed the access points for the Cherry Lane Christian Church with BRS. If the City wants to reduce the access points, ACHD would prefer the City well lot take access from the church parking lot. If the City needs a driveway of their own ACHD would prefer that it not connect to the church parking lot. As proposed it was acting as a second driveway for the parking area. The southern driveway to serve the bus storage area is proposed to be gated and not connect to the parking area according to my conversation with Steve Pardue of BRS. If that is the case ACHD would not object to this driveway being constructed as originally approved by ACHD with the condition that it be gated and the gate located 50-feet behind the future curb of Ten Mile Road.
