Landscaping: The Landscape Plan prepared by New West Landscape, on May 11, 2006, labeled Sheet LS -1, is approved (stamped "Approved" on June 13, 2006 by the Meridian Planning Department) with the,.following changes/notes (see redline changes on plan): 1) UDC 11 -3B -8C2 requires internal landscape planters to contain at least 50 square feet and be improved with at least 1 tree and other groundcover. All landscape planters on the site shall comply with UDC 11-313-80; ensure trees are planted within planters; and 2) UDC 11-313-1 requires all non -evergreen trees to have a minimum 2" caliper at planting and all shrubs to be from a minimum 2 gallon pot. Ensure that all landscape materials comply with City Code. Except for the above-mentioned change, the approved landscape plan is not to be altered without prior written approval of the Planning Department. No field changes to landscape plan permitted; prior written approval of all material changes is required. Site Plan: The Site Plan prepared by Dave Evans Construction on May 10 2006, labeled Page 1, is approved (stamped "Approved" on June 13, 2006 by the Meridian Planning Department) with the following changes, (see redline changes on plan): 1) UDC Table 11-3C-1 requires a 25 -foot wide drive aisle width adjacent to 90- degree parking stalls that are 19 -feet long by 9 -feet wide. The drive aisle widths appear to be substandard, while the parking stalls appear to exceed the minimum; and 2) All building setbacks shall comply with tAe ;L -O zoning standards and not be in conflict with the proposed preliffi nary plat for Sundance Commercial Addition. Except for these changes, the approved site plan is not to bd altered without prior written approval of the Planning Department. Elevations: The Elevations prepared by Dave Evans Construction on May 10, 2006, labeled Page 5 and 6, are approved with no changes from the Planning Department. Irrigation: An underground, pressurized irrigation system must be installed to all landscape areas per the approved specifications and in accordance with UDC 11-3A-15. Protection of Existing Trees: Any existing trees on site must be protected or mitigated for in accordance with the Tree Preservation section of the City's Landscape Ordinance. Per UDC 11-3B-10, coordinate with the Parks Department Arborist (Elroy Huff, 888-3579) for approval of protection/relocationmeasures for the existing trees prior to construction. Any severely damaged tree must be replaced in compliance with UDC 11-3B-10-C.5. Parking: The proposed parking areas shall be paved and striped in accordance with UDC 11-313. Project engineer/architect shall certify that the number and size of handicap-accessible spaces conforms to the Americans with Disabilities Act (ADA). Handicap accessible stalls must have signage in accordance per ADA and signed appropriately. Curbing: Per UDC 11-313-5I, all landscape areas adjacent to driveways, parking lots, or other vehicle use areas, must be protected by curbing, wheel stops, or other approved protective devices. Curbing maybe cut to allow for storm water runoff. Sidewalks: All sidewalks shall be constructed in accordance with 11-3A-17. Sidewalks shall be constructed prior to occupancy. Drainage: Storm water drainage swales shall not have a slope steeper than 3:1, shall be fully vegetated, and shall be designed in compliance with UDC 11-38-11 and UDC 11-3A-18. Fencing: Any required or proposed fencing shall be installed with current fencing standards as defined in UDC 11-3A-7. Li tin : Lighting shall not cause glare or impact the traveling public or neighboring development and comply with lighting standards as defined in UDC 11-3A-11. Si a e: No signs are approved with this CZC. All business signs will require a separate sign permit in compliance with UDC 11-3D. Trash Enclosure: All dumpster(s) must be screened in accordance with UDC-11-3A-12. Trash enclosures must be built in the location and to the size approved by SSC. Handicap-Accessibility: The structure, site improvements and parking areas must be in compliance with all federal handicap-accessibility requirements. ACHD Acce tance: All impact fees, if any, shall be paid prior to the issuance of a building permit. If any changes must be made to the site plan to accommodate the ACHD requirements, a new site plan shall be submitted to the City of Meridian Planning staff for approval prior to the issuance of a building permit. Certificate of Occupancy: All required improvements must be complete prior to obtaining a Certificate of Occupancy. A written certificate of completion shall be prepared by the landscape architect, landscape designer or qualified nurseryman responsible for the landscape plan upon completion of the landscape installation. The Certificate of Completion shall verify that all landscape improvements, including plant materials and sprinkler installation, are in substantial compliance with the approved landscape plan. A Temporary Certificate of Occupancy may be obtained by providing surety to the City in the form of a Letter of Credit or cash in the amount of 110% of the cost of the remaining improvements. A bid must accompany any request for Temporary Occupancy. This project will not have any lighting with a maximum output of 1,800 lumens or more. Abutting the north property line is a 10 -foot wide strip of land that exists from Meridian Road beyond the east property line of this site. If this stub street is to be extended in the future, the 10 - foot wide strip of land would have to be acquired. Q. The applicant is proposing to construct a stub street to the east property line between Lot 13, Block 5, and Lot 48, Block 10. District Staff supports location of the stub street. The applicant should not be required to provide a paved temporary turnaround at the end of the stub street because the stub is only one lot in depth. The applicant should be required to install a sign at the terminus of the roadway stating that, "THIS ROAD WILL BE EXTENDED IN THE FUTURE". Coordinate the sign plan for the stub street with District staff. R. The traffic study submitted with the Cedar Springs Subdivision indicated that full build -out of that subdivision, and this subdivision, should occur by 2005, and that traffic at the Ustick Road/Meridian Road intersection will warrant a signal by the year 2005. A traffic signal will cost approximately $120,000. The southwest corner and the southeast comer have been developed. The northwest comer is vacant land, and the Commission has reviewed and approved a 333 -lot residential subdivision. Full build -out of that subdivision, as well as the current application, is expected by 2005. Staff recommends that this applicant contribute one-quarter of the cost of a traffic signal, $30,000 to the Public Rights -of -Way Trust Fund. The District will also require the same deposit from the developer at the northwest corner. S. Any proposed landscape islands/medians within the public right-of-way dedicated by this plat should be owned and maintained by a homeowners association. Notes of this should be required on the final plat. T. Graveled driveways abutting public streets create maintenance problems due to gravel being tracked onto the roadway. In accordance with past action by the District the applicant should be required to pave the driveways their full width and at least 30 -feet into the site beyond the edge Of pavement of Ustick Road and Meridian Road and install pavement tapers with 15 -foot radii abutting the existing roadway edge. U. Any irrigation facilities or utilities should be relocated outside of the new right-of-way on Ustick Road or Meridian Road. V. Based on development patterns in this area and the resulting traffic generation, staff anticipates that the transportation system will be adequate to accommodate additional traffic generated by this proposed development with the requirements outlined within this report. Lot access restrictions, as required with this application, shall be stated on the final plat. Standard Requirements: 1. A request for modification, variance or waiver of any requirement or policy outlined herein shall be made in writing to the ACHD Planning and Development Supervisor. The request shall specifically identify each requirement to be reconsidered and include a written explanation of why such a requirement would result in a substantial hardship or inequity. The written request shall be submitted to the District no later than 9:00 a.m. on the day scheduled for ACHD Commission action. Those items shall be rescheduled for discussion with the Commission on the next available meeting agenda. Requests submitted to the District after 9:00 a.m. on the day scheduled for Commission action do not provide sufficient time for District staff to remove the item from the consent agenda and report to the Commission regarding the requested modification, variance or waiver. Those items will be acted on by the Commission unless removed from the agenda by the Commission. 2. After ACHD Commission action, any request for reconsideration of the Commission's action shall be made in writing to the Planning and Development Supervisor within six days of the action and shall include a minimum fee of $110.00. The request for reconsideration shall specifically identify each requirement to be reconsidered and include written documentation of data that was not available to the Commission at the time of its original decision. The request for reconsideration will be heard by the District Commission at the next regular meeting of the Commission. If the Commission agrees to reconsider the action, the applicant will be notified of the date and time of the Commission meeting at which the reconsideration will be heard. 3. Payment of applicable road impact fees are required prior to building construction in accordance with Ordinance #193, also known as Ada County Highway District Road Impact Fee Ordinance. 4. The ACHD Commission will not hear this item unless the site plan is changed in such a manner as to require Commission review. However, ACHD receives many calls from neighbors of day care centers concerning the volume of traffic and the number of parked vehicles near existing day care centers. Each parent typically makes two round trips per day (i.e. four one-way trips). The Institute of Transportation Engineers (ITE) data shows that typical day cares created 4.52 vehicle trips per day per student. The proposed 135 student facility can be expected to generate 610 total vehicle trips per day. The ACHD Commission will not hear this item unless the site plan is changed in such a manner as to require Commission review. However, ACHD receives many calls from neighbors of day care centers concerning the volume of traffic and the number of parked vehicles near existing day care centers. Each parent typically makes two round trips per day (i.e. four one-way trips). The Institute of Transportation Engineers (ITE) data shows that typical day cares created 4.52 vehicle trips per day per student. The proposed 12 student facility can be expected to generate 54 total vehicle trips per day.
