Conditions of Approval: Project is subject to all current City of Meridian ordinances and conditions of
approval for the Silver Oaks Subdivision (AZ -05-016 and PP -05-023) and Conditional Use Permit (CUP -05-
026) and Development Agreement. NOTE: 1) The applicant is proposing to develop 24 of the 77 units at
this time. Phase 1 does include the dedication of Silver Oaks Drive and Silver Oaks Circle. These are
public streets which have yet to receive Final Plat approval, Final Plat recordation and right of way
dedication must occur prior to issuance of a building permit 2) The applicant shall submit for a detailed
CZC for the pool, playground, sport courts, and internal landscaping of the recreation area (including
clubhouse, pool, and fitness center) as the detail of the site plan AS1.0 does NOT show the proper
landscaping, fencing, and lighting plans. With the recreation unit CZC the applicant shall submit a
photometric test.
Landscaping: The Landscape Plan prepared by Insight Architects dated 1-30-01, labeled L1.0-1.5, is approved
(stamped "Approved" on April 28, 2006 by the Meridian Planning Department) with no changes. The
approved landscape plan is not to be altered without prior written approval of the Planning Department. No
field changes to landscape plan permitted; prior written approval of all material changes is required.
Site Plan: The Site Plan prepared by Insight Architects, on January 27, 2006, is approved (stamped
"Approved" on April 28, 2006 by the Meridian Planning Department) with no changes The approved site plan
is not to be altered without prior written approval of the Planning Department.
Elevations: The Elevations prepared by Insight Architects, on January 27, 2006, Sheet A3.0, are approved with
no changes from the Planning Department and meet the standards defined by prior approvals.
Irrigation: An underground, pressurized irrigation system must be installed to all landscape areas per the
approved specifications and in accordance with UDC 11-3A-15.
Parking: The proposed parking areas shall be paved and striped in accordance with UDC 11-3B. Project
engineer/architect shall certify that the number and size of handicap -accessible spaces conforms to the
Americans with Disabilities Act (ADA). Handicap accessible stalls must have signage in accordance per ADA
and signed accessible.
Curbing: Per UDC 11-313-5I, all landscape areas adjacent to driveways and the parking lot must be protected
by curbing, wheel stops, or other approved protective devices. Curbing may be cut to allow for storm water
runoff.
Sidewalks: All sidewalks shall be constructed in accordance with 11-3A-17. Sidewalks shall be constructed
prior to occupancy.
Drainajze: Storm water drainage swales shall not have a slope steeper than 3:1, shall be fully vegetated, and
shall be designed in compliance with UDC 11-3B-11 and UDC 11-3A-18.
Fencing: Any required or proposed fencing shall be installed with current fencing standards as defined in
UDC 11-3A-7. Construct an 8 -foot tall block wall along ht entire north and west sides of the property.
Construct fencing along the south and east side of the site with a combination chain-link with slats and
8 -foot block wall, as shown on the site plan.
Lighting: Lighting shall not cause glare or impact the traveling public or neighboring development and
comply with lighting standards as defined in UDC 11-3A-11. The applicant has not submitted a
photometric test, prior to occupancy a Photometric test for phase 1 shall be submitted.
Signage: No signs are approved with this CZC. All business signs will require a separate sign permit in
compliance with UDC 11-3D.
Trash Enclosure: All dumpster(s) must be screened in accordance with UDC -11-3A-12. Trash enclosures
must be built in the location and to the size approved by SSC.
Handicap -Accessibility: The structure, site improvements and parking areas must be in compliance with all
federal handicap -accessibility requirements.
ACHD Acceptance: All impact fees, if any, shall be paid prior to the issuance of a building permit. If any
changes must be made to the site plan to accommodate the ACHD requirements, a new site plan shall be
submitted to the City of Meridian Planning staff for approval prior to the issuance of a building permit.
Certificate of Occupancy: All required improvements must be complete prior to obtaining a Certificate of
Occupancy. A written certificate of completion shall be prepared by the landscape architect, landscape designer
or qualified nurseryman responsible for the landscape plan upon completion of the landscape installation. The
Certificate of Completion shall verify that all landscape improvements, including plant materials and sprinkler
installation, are in substantial compliance with the approved landscape plan. A Temporary Certificate of
Occupancy may be obtained by providing surety to the City in the form of a Letter of Credit or cash in the
amount of 110% of the cost of the remaining improvements. A bid must accompany any request for Temporary
Occupancy.
Plan Modifications: Except for any changes mentioned above, the approved Site Plan, Landscape Plan
stamped "Approved" on April 28, 2006, and Elevations, and are not to be altered without prior written
approval of the Planning Department. No significant field changes to the site or landscape plans are permitted;
prior written approval of all changes is required.

Dear Mr. Hood,
Please accept the attached application for the Certificate of Zoning Compliance (CZC)
for Phase One of the Umbria (Silver Oaks Development). As you know, we submitted a
phasing plan with the Final Plat application for this project and we are now requesting
approval of the first phase of the plan. This project was approved of as a Conditional Use
permit for multiple buildings on a single lot. At this time the property is still a single
buildable lot and the final plat has not yet been recorded to split the property into the
residential and office portions of the subdivision. We are asking for approval of the CZC
for Phase One of the residential portion of the Subdivision prior to the recordation of the
plat. We are working to get the plat recorded as soon as possible, and it will be recorded
prior to occupancy (we are happy to have this included as a condition of the CZC) of any
of the residential buildings.
The first phase of the project includes 24 four-plexes, and the central clubhouse, pool and
play area. All of the fencing for the subdivision will be included as a part of the first
phase of the project per the final plat approval requirement.
We have attached the required number of copies of the phasing plan, master site plan,
building elevations and landscaping plans to this application. We look forward to
working with you as we move forward on this new project. If you have any questions

Request for a time extension for Umbria Subdivision, by David McKinnon
(File# TE -07-004).
We have reviewed this submittal and offer the following comments and conditions of approval:
APPLICATION SUMMARY
The applicant, David McKinnon, has requested approval of a twelve (12) month time extension to record
the final plat and commence the conditional use approved for Umbria Subdivision. The approved
preliminary plat for Umbria Subdivision consists of 1 multi -family building lot and 1 commercial office
lot on 28.65 acres in the L -O and R-15 zones. The approved conditional use permit for a planned
development consists of 70 multi -family structures on a single lot with a private clubhouse/park and
multi -use pathways zoned R-15, and commercial daycare/office'buildings zoned L=O. The annexation
(AZ -05-016), preliminary plat (PP -05-023), and conditional use permit (CUP -05-024) applications for
Umbria (flea - Silver Oaks) Subdivision were approved by the Meridian City Council on October 11,
2005. Approval of this project is set to expire on April 11, 2007, if the final plat is not recorded or a time
extension is not obtained.
The applicant states the reason for the delay is due to site constraints making it take longer to construct
the sewer and water lines. Therefore, the applicant is unable to meet the time requirements specified in
Unified Development Code (UDC) 11-5B-6 and 11-6B-7.
The City of Meridian's Unified Development Code (UDC 11-513-6 and 11-613-7) allows the Director to
authorize a single extension of time to record the final plat and commence the conditional use, not to
exceed 18 months, when the applicant files a written request for an extension prior to the expiration of the
Conditional Use Permit and Preliminary Plat; which the applicant has done. As mentioned above, the
applicant is requesting a 12 -month time extension. Additional time extensions up to 18 months as
determined and approved by the Council may be granted.
With all time extensions, the City may require compliance with the current provisions of the UDC
as a condition for granting a time extension (11-511-04 and 11-611-7). This project was reviewed
and approved under previous City Code. Staff believes that there are two additional conditions that
should be added to those previously approved by the City Council for this project. In addition toP-06-011, which are
the conditions of approval for AZ -05-016, PP -05-023, CUP -05-024 and F
attached in Exhibits Aand B, staff is requiring compliance with UDC 11-3F-4 (Private Street
Standards) and UDC 11 -3C -6A (Parking) as conditions for the subject time extension approval.
LOCATION
The property is located on the north side of W. Franklin Road, approximately'/4 mile west of N. Ten Mile
Road, in the south half of Section 10, T.3N. R.1 W.
STAFF ANALYSIS
As mentioned above, this project was approved under the City's previous development standards (Titles
11 and 12). Since the approval, new standards regarding multi -family projects have been established. To

comply with current city code, the applicant shall be required to provide two (2) parking spaces, per
dwelling unit, that are in a carport or garage (UDC 11-3C-6). Open-air, surface parking was previously
approved. Further, the Fire Marshall has commented that as a condition of approval for the subject time
extension, the proposed drive aisles serving the multi -family units shall be converted to private streets
(UDC 11-3F-4). This requirement includes: submitting an application and fees to the Planning
Department; review and approval of the private street names from the Ada County street name
committee; installation of private street signs at intersections throughout the development; and, posting
the private streets as fire lanes.
STAFF RECOMMENDATION
Staff recommends approval of a 12 -month time extension to record the final plat, satisfy the applicable
requirements set forth in the conditions of approval, and acquire building permits and commence
construction of permanent footings or structures, for Umbria Subdivision to expire on April 11, 2008.
CONDITIONS OF APPROVAL
1. Applicant is to meet all terms of the approved annexation (AZ -05-016), development agreement
(Inst. #106002636), preliminary plat (PP -05-023), conditional use permit (CUP -05-024), and final
plat (FP -06-011) for this development (attached in Exhibits A and B). Further, the applicant shall
comply with the elevations and site plan approved with CZC-06-046, subject to the changes listed
herein.
2. The applicant shall provide two (2) parking spaces, per dwelling unit, that are in a carport or
garage (see UDC 11-3C-6).
Per the Fire Marshal, the Applicant shall submit a Private Street application and fees to the
Planning Department; obtain approval of the private street names from the Ada County street
name committee; install private street signs at intersections throughout the development, at
locations required by the Fire Marshal; and, post the private streets as fire lanes, as required by
the Fire Marshal.
4. The Applicant shall have an additional 12 months, until April 11, 2008, to record the final plat,
satisfy the applicable requirements set forth in the conditions of approval, and _acquire building
permits and commence construction of permanent footings or structures.

We are getting close to submitting building permits for the Silver Oaks Development (Umbria Subdivision) and we
have been looking at improving the architectural appearance of the exterior of the four-plex units. In lieu of all
stucco exteriors (excluding required wainscoting) we would like to utilize masonite siding to give additional relief to
the buildings. Appearance of the proposed structures was at the foremost of all discussions regarding this project
and we believe that this change will help to improve the appearance of the buildings. We have reviewed the
conditions of approval and cannot find a requirement to use stucco, however there is a conditions that
requires the buildings be built to match the elevations proposed with the project. No other changes to the
buildings are being requested. I have talked to Sonya about this request and she said that she has mentioned it to
you; it is our hope that this is a small enough design change that it can be handled at a staff level. We can
prepare new elevations, if needed, detailing the change in exterior finish.

area for the multi -family portion of the development.
8. Provide each multi -family dwelling unit with at least one hundred square feet of
useable private open space.
Reduced standards: As stated earlier, the applicant is requesting modifications

C. Key Commission Changes to Staff Recommendation:
The Commission made several minor changes to the staff report at staff's recommendation.
• That the park's department conditions of approval 1-3 be removed. Conditions 1-3
were applied to the staff report but do not apply to this site.
• The planning commission also required a revised preliminary plat/ CUP to provide
a connection across the Kennedy Lateral as agreed to by the applicant and set forth
as a condition within ACHD conditions of approval.
• There were some minor clarifications made to the landscaping conditions under
the preliminary plat site specific conditions.
• Public Works asked for a clarification condition in the Development Agreement
that the applicant agree to pay for all sewer main line extensions to the property in
addition to service extensions on the property.

D. Key Council Changes to Commission Recommendation:
The Council made several minor changes to the staff report and Cormnission
recommendation at the September 20, 2005 meeting. Staff has prepared findings to
address the modifications made to the Conditional Use site plan dated August 17, 2005 as
attached in Exhibit C with the comments rnade during the Council hearings. The revised
site plan includes a request amendment to change the number of units from Seventy-seven
(77) to Seventy (70).
The following conditions of approval were included with the findings and Exhibits D and
F as attached.
The applicant shall provide construction materials similar to wainscoting, brick, or
cultured stone to provide architectural appeal to the front of the buildings.
The applicant shall provide additional modulation to the buildings to provide
additional building relief.

5. Time Extension Conditions of Approval (TE -07-004)
1. Applicant is to meet all terms of the approved annexation (AZ -05-016), development
agreement (Inst. #106002636), preliminary plat (PP -05-023), conditional use permit
(CUP -05-024), and final plat (FP -06-011) for this development (attached in Exhibits A
and 13). Further, the applicant shall comply with the elevations and site plan approved
with CZC-06-046, subject to the changes listed herein.
2. The applicant shall provide two (2) parking spaces, per dwelling unit, that are in a carport
or garage (see UDC 11-3C-6).
3. Per the Fire Marshal, the Applicant shall submit a Private Street application and fees to
the Planning Department; obtain approval of the private street names from the Ada
County street name committee; install private street signs at intersections throughout the
development, at locations required by the Fire Marshal; and, post the private streets as
fire lanes, as required by the Fire Marshal.
4. The Applicant shall have an additional 12 months, until April 11, 2008, to record the final
plat, satisfy the applicable requirements set forth in the conditions of approval, and
acquire building permits and commence construction of permanent footings or structures.
