The issuance of this permit does not release the applicant from any previous requirements of the other permits issued for this site. NOTE: Originally a drive-through was proposed on the east side of the proposed building. Due to the proposed location of the drive-through a Conditional Use Permit (CUP) is required. The issuance of the subject CZC does not approve a drive-through on this site. If CUP approval is granted by the City, a subsequent CZC shall be submitted for the addition of a drive-through to the subject building. Landscaping: The Landscape Plan prepared by Rudeen & Associates on September 28, 2005, Sheet L1.00, is approved (stamped "Approved" on November 30, 2005 by the Meridian Planning Department) with the following change (see redline change on plan): 1) UDC 11 -3B -8.C.1 requires a 5 -foot wide perimeter landscape strip adjacent to all vehicular use areas. Further, one (1) tree is required for ever 35 lineal feet within said landscape strip. Ten (10) trees are required within the landscape buffer area adjacent to the south landscape buffer; four (4) trees are proposed on the landscape plan. Add six (6) additional trees (10 total trees) to the south landscape buffer area. Other than the above-mentioned change, the approved landscape plan is not to be altered without prior written approval of the Planning Department. No field changes to landscape plan permitted; prior written approval of all material changes is required. Site Plan: The Site Plan labeled A1.01, prepared by Rudeen & Associates on October 5, 2005, is approved with the following changes (stamped "Approved" on November 30, 2005 by the Meridian Planning Department): 1) UDC 11 -3A -19.C.4 requires a continuous internal pedestrian walkway that is a minimum of eight feet in width from the perimeter sidewalk to the main entrance. Said internal pedestrian walkway shall be distinguished from vehicular driving surfaces through the use of pavers, colored or scored concrete or bricks. Provide a minimum 8 -foot wide pedestrian walkway from Overland Road to the front entrance of the building. 2) UDC 11 -3C -6.G requires 1 bicycle parking space for every 25 vehicle parking spaces. Provide an on-site bike rack with at least 5 bike parks. The approved site plan is not to be altered without prior written approval ofthe Planning Department. NOTE: A new property line is shown on the subject site plan. This new property line is not approved with the issuance of this permit. A Record of Survey submitted to the City shall be recorded for any property boundary adjustments. Elevations: The Elevations labeled A2.0, prepared by Rudeen & Associates, are approved with no changes by the Planning Department. Irrigation: An underground, pressurized irrigation system must be installed to all landscape areas per the approved specifications and in accordance with UDC 11-3A-15. Curbing: Per UDC 11 -3B -5I, all landscape areas adjacent to driveways, parking lots, or other vehicle use areas, must be protected by curbing, wheel stops, or other approved protective devices. Curbing may be cut to allow for storm water runoff. Protection of Existing Trees: Any existing trees on site must be protected or mitigated for in accordance with the Tree Preservation section of the City's Landscape Ordinance. Per UDC 11-3B- 10, coordinate with the Parks Department Arborist (Elroy Huff, 888-3579) for approval of protection/relocation measures for the existing trees prior to construction. Any severely damaged tree must be replaced in compliance with UDC 11 -3B -10-C.5. Parking: The proposed parking areas shall be paved and striped in accordance with UDC 11-313. Project engineer/architect shall certify that the number and size of handicap -accessible spaces conforms to the Americans with Disabilities Act (ADA). Handicap accessible stalls must have signage in accordance per ADA and signed "Van Accessible". Sidewalks: All sidewalks shall be constructed in accordance with 11-3A-17. Sidewalks shall be constructed prior to occupancy. Drainage: Storm water drainage swales shall not have a slope steeper than 3:1, shall be fully vegetated, and shall be designed in compliance with UDC 11-3B-11 and UDC 11-3A-18. Fencing: Any required or proposed fencing shall be installed with current fencing standards as defined in UDC 11-3A-7 Lighting: Lighting shall not cause glare or impact the traveling public or neighboring development and comply with lighting standards as defined in UDC 11-3A-11 Si"a e: No signs are approved with this CZC. All business signs will require a separate sign permit in compliance with UDC 11-3D. Trash Enclosure: Any dumpster(s) must be screened in accordance with UDC -11-3A-12. Trash enclosures must be built in the location and to the size approved by SSC. Handicap -Accessibility: The structure, site improvements and parking must be in compliance with all federal handicap -accessibility requirements. ACHD Acceptance: All impact fees, if any, shall be paid prior to the issuance of a building permit. If any changes must be made to the site plan to accommodate the ACHD requirements, a new site plan shall be submitted to the City of Meridian Planning Department staff for approval prior to the issuance of a building permit. Certificate of Occupancy: All required improvements must be complete prior to obtaining a Certificate of Occupancy. A written certificate of completion shall be prepared by the landscape architect, landscape designer or qualified nurseryman responsible for the landscape plan upon completion of the landscape installation. The Certificate of Completion shall verify that all landscape improvements, including plant materials and sprinkler installation, are in substantial compliance with the approved landscape plan. A Temporary Certificate of Occupancy may be obtained by providing surety to the City in the form of a Letter of Credit or cash in the amount of 110% of the cost of the remaining improvements. A bid must accompany any request for Temporary Occupancy, Plan Modifications: Except for the changes mentioned above, the approved Site Plan, Landscape Plan stamped "Approved" on November 30, 2005, and Elevations, and are not to be altered without prior written approval of the Planning Department. A drive-through establishment shall be an accessory use where the drive-through facility (including stacking lanes, speaker and/or order area, pick up windows, and exit lanes)is not within three hundred feet . 300' of another drive-through facilit ora residential district or n existing rest encePIFR�erwise a Conditional Use Permit is required. All establishments providing drive-through service shall identify the stacking lane, menu and speaker location (if applicable), and window location on the certificate of zoning compliance or the Conditional Use Permit. At a minimum the plan shall demonstrate compliance with the following standards: 1. Stacking lanes shall have sufficient capacity to prevent obstruction of the public right-of-way by patrons; 2. The stacking lane shall be a separate lane from the circulation lanes needed for access and parking; 3. The stacking lane shall not be located within ten feet (10') of any residential district or existing residence; 4. Any stacking lane greater than one hundred .feet (100') in.length'shall provide for an escape lane. 5. A letter from the Transportation Authority indicating the site plan is in compliance with the authority's standards and policies shall be required. A. One secondary dwelling unit is permitted on the same property in conjunction with and clearly subordinate to a single-family dwelling. 4 Chapter 4 SPECIFIC USE STANDARDS 8/26/2005 E: =The minimum width of`parkways planted with Class Il trees shall be'eight feet (8'). The width can be measured from the back of curb where there is no likely expansion of the street section within the right-of-way; the parkway width shall exclude the width of the sidewalk. Class II trees are the preferred parkway trees. 1. Class -I- and Class 111 trees may be considered for -parkway planters during the landscape plan review. The Director shall evaluate such trees for their suitability as parkway planter trees based on. ,ultimate.tree canopy, root characteristics, and branching height. The minimum parkway planter for Class I and Class III trees shall be ten feet (10'). 2. The planter width for Class II trees may be reduced to six feet (6) if there are root barriers that are a minimum of eighteen inches (18") below sub - grade adjacent to the sidewalk and a minimum of twenty-four inches (24") below sub -grade adjacent to the curb. The root barriers shall extend two inches (2") above grade. 11-3A-18: STORM DRAINAGE: An adequate storm drainage system shall be required in all developments in accord with the City's adopted standards, specifications and ordinances. Design and construction shall follow best management practice as adopted by the City. 11-3A-19: STRUCTURES SUBJECT TO DESIGN STANDARDS: A. Purpose: 1. To create unique character and quality architectural design in the development of large structures. 2. To minimize the impact of the scale, bulk and color of large structures on surrounding properties. 3. To encourage high-quality materials and longevity in large structures. 4. To protect the safety and convenience of pedestrian access to large structures, and create attractive pedestrian amenities. 5. To provide greater attention to the design and location of large structures in relationship to the surrounding street. 6. To locate noise -generating activities away from any adjacent residential uses. 7. To create attractive and quality designed structures reflecting the unique character of Meridian along the City's entryway corridors. 7 Chapter 3 Article A.
