The Administrator shall review the facts and circumstances of each fence waiver application to determine whether that evidence supports the following findings: a. Granting the fence waiver will not result in any obstruction of the clear vision triangle at the intersections of streets; b. Granting the fence waiver will not compromise any public safety standards; and c. Granting the fence waiver will not result in conditions that will, more probably than not, place the public or emergency response personnel in potentially injurious situations. 2. Contents Of Application For Waiver, Fee: The owner or applicant shall file an application for a fence waiver with the Planning and Zoning Department, with a copy sent to the City Clerk, which application shall state the following, and be accompanied by: ~. Address of subject property. Name, address and phone number of applicant. '~, Name, address and phone number of owners of the subject property. Proof of ownership and of owner's consent Legal description of subject property ~~ Present use of subject property. Zoning of the subject property. `~ Schematic drawl-ng of the building and proposed fence. ~/ List of the mailing addresses of all property owners (from authentic tax records of Ada County) within two hundred feet (200') of the external boundaries of the land being considered. jib Minimum requirements of this Title that need to be reduced to permit /~~ the proposed fence and the need for the proposed fence waiver. An application fee established by resolution of the Council. (Ord. 524, 4-3-1990; amd. Ord. 557, 10-1-1991) 3. Notice: Upon receipt of the fence waiver application, the Zoning Administrator shall see that notice is mailed by first class mail to all owners of property within two hundred feet (200') of the radius of the subject property. The notice shall indicate the substance of the application, the waiver sought by the owner or applicant, and shall include a copy of the schematic drawing of the building and proposed fence. The notice shall also state that any person to whom notice was sent, and any person affected by the proposed waiver, may file a written objection to the requested waiver which objection must be filed with the Administrator no later than fifteen (15) days after the date of mailing. 4. If the Administrator receives pertinent and compelling objections related to the fence waiver, at his/her discretion, the Administrator may schedule a hearing on the application. When a hearing is scheduled, notice of such the hearing shall. be mailed to the applicant a~ any person who has filed an objection, not later than seven (7} days prior to the hearing. A representative from the Police Department and Public Works Department shall attend the hearing or shall otherwise provide comment on the waiver application. 5. Action by Administrator. Upon reviewing the request for the fence waiver after the time for filing objections has expired, or after hearing, whichever is applicable, the Administrator or his/her designee shall either approve approve with conditions, or deny, the application. No written findings of fact shall be required but a written decision shall be sent to the applicant and to any party requesting written notification of the decision. 6. Watertower Lane, Ste. 202 Meridian, ID 83642 Dear Planning & Zoning Department: We would like to apply for a waiver or variance to the City of Meridian fence regulations. We purchased our home at 2459 E Challis Street, Packard Estates, Meridian on September 26, 2003. When we purchased our home, a six foot cedar fence was included as a perimeter fence. In June 2004, we had a swimming pool added to our back yard. We were happy with our six foot fence until May 19, 2005. On or about the morning of Thursday, May 19'~ 2005, our neighbor, directly behind us, at 2462 East Meadowgrass put up a patio deck in their backyard. The height of their deck is approximately 2 feet. The effect of adding the deck, was that our 6 foot fence was no longer adequate. We no longer had the privacy that we had enjoyed for almost 2 years. We used to see the tops of our neighbors heads. Now we were seeing them from the waist up. You can't imagine the sickening feeling we had. Our neighbors were looking directly into our back yard. And we were looking at the upper torso of our neighbors. We were devastated. We were ill. We could no longer enjoy our lovely backyard. Our right to enjoy our home had ended. What were we to do? One rather drastic option was to sell the house. Another less drastic option was to add a privacy barrier to the existing fence to compensate for the added elevation of the deck in our neighbors yard. So we decided to add a 2 foot extension to our existing fence. This barrier is only between our backyard at 2459 East Challis Street and the backyard of our neighbor at 2462 East Meadowgrass. The addition of the privacy extension gave us back the privacy that we had previously enjoyed. T'he extension that we added affects only ourselves and the neighbor directly behind us. We have talked with our neighbor at 2462 East Meadowgrass to ask if they object to the privacy extension to our fence. They have assured us that they have no objection to the addition. Jce Venneman, a Code Enforcement Officer, from the Meridian Police Department, recently visited us. He said that someone had complained about our fence. We were informed that Meridian does not allow for a fence over Six feet in height. We want a waiver to the 6 foot fence restriction. The reason we want a waiver, is that the six foot fence that we had does not provide for the privacy that we desire. When our neighbor elevated their back yard by two feet by adding a deck in their back yard, we were left with no alternative but to increase the height of our fence. If you were in our position, you would have done the same thing. Attached is a picture of our fence addition. As you can see, it is done in the same style and material as the original fencing. All replacement mailboxes and stands will be of consistent design, material, and coloration and shall be located on or adjoining Building Lot lines at places designated by Grantor or the Architectural Committee. 4.1.7 Fencin Fence designs shall not extend into any common green space within the subdivision. All fencing and boundary walls constructed on any Building Lot shall be of compatible style and material to that of other fencing constructed adjacent to or abutting Common Areas, public and private streets, and shall otherwise be as approved by the Architectural Committee. Fencing shall not extend higher than six (6) feet above the finished grade surface of the Building Lot or extend past the front setback of the home. All fencing must meet the setback requirements of City ordinance. Certain entryway, corner and view lots are restricted from fencing. 4.1.8 Liahtintr. Exterior lighting, including flood lighting, shall be part of the architectural concept of the Improvements on a Building Lot. Fixtures, standards, and all exposed accessories shall be harmonious with building design, and shall be as approved by the applicable Architectural Committee. Lighting shall be restrained in design, and excessive brightness shall be avoided. 4.2 Antennae. No exterior radio antenna, television antenna or other antenna of any type shall be erected or maintained on the property unless it is approved by the Architectural Committee of the Association per Article V and located or screened in a manner acceptable to said Architectural Committee. No satellite dishes shall be allowed on the Property; provided, however, that small dishes of approximately three (3) feet or less diameter may be placed in an appropriate portion of a Lot not visible from the street if allowed by the Architectural Committee, and subject to all terms and conditions, including screening, which may be imposed in the sole discretion of the Architectural Committee. 4.3 Insurance Rates. Nothing shall be done or kept on any Building Lot which will increase the rate of insurance on any other portion of the Property without the approval of the Owner of such other portion, nor shall anything be done or kept on the Property or a Building Lot which would result in the cancellation of insurance on any property owned or managed by any such Association or which would be in violation of any law. 4.4 No Further Subdivision. No Building Lot maybe further subdivided, nor may any easement or other interest therein, unless such subdivision complies with all applicable laws. 4.5 S_ gns.
