Dear Stacie:
The Fence Variance Committee of the City of Meridian met in your presence on Apri129, 1996 in
City Hall to consider this request.
After due consideration, the Committee decided that the existing fence located 8 feet from the
edge of sidewalk; in the side street setback area of N.W. 5th Ave., needs to be moved to 10 feet
from the edge of sidewalk. This location will then be in conformance with the committee's policy
of allowing some fences within the setback area. It will also be in agreement with the variance we
recently allowed for 10 feet from the sidewalk on another corner lot in your subdivision who had
requested 8 feet from the sidewalk because of your fence location.
The City of Meridian has no jurisdiction in the enforcement of the provisions of your subdivisions
Protective Covenants. Since this is a variance to a provision of your covenants we suggest you
also contact your Homeowners Association
You had not obtained a fence building permit prior to building your fence so when the fence in
relocated please obtain a permit from City Hall.

NOTICE OF HEARING
NOTICE IS HEREBY GIVEN pursuant to 11-9-605 J. 10. of the Revised and
Compiled Ordinances of the City of Meridian, that the Fence Variance Committee of the
City of Meridian will hold a public hearing at the Meridian City Hall, 33 East Idaho Street,
Meridian, Idaho, at the hour of 4:30 o'clock P M., on Monday, April 29. 1996, for the
purpose of reviewing and considering the Application of Stacie Irish for a variance from
the Meridian Fence Ordinance at the property legally described as follows: Lot 18, Block
3 Applegate Subdivision No. 2 and known by the address 548 W. Criterion. Meridian
Idaho 83642. The Applicant proposed to reduce the required distance from 20 feet to 8

The public is welcome, Testimony, objections, and comments will be heard and
considered by the Committee.
A written decision of the Committee will be issued to the Applicant and any person
requesting in writing a copy of the decision will be furnished one.
Any aggrieved party may appeal the decision of the Committee directly to the
Meridian City Council pursuant to Section 11-2-416 G. 1.

Dear Stacie,
On April 30, 1996, you were informed by~ City Engineer Gary Smith that the existing fence
which is located 8 feet from the edge of the sidewalk on your property needs to be moved 10
feet from the sidewalk. A copy of this letter is attached hereto.
It is your prerogative to appeal the fence committee's decision to City Council. To do so you
must submit a letter to the city clerk requesting such an appeal. The letter should request that
the issue be placed on the agenda and should outline why Council should consider the appeal.
The. City respectfully requests that the fence be relocated or that you request an appeal of the
