The Fence Variance Committee of the City of Meridian met in your presence at 4:30, p.m. April
4, 1996 in City Hall to consider this request.
After due consideration the Committee decided: to allow placement of a 6 foot tall wooden fence
in the side street setback area of N.W. 7th. Street.
1. The face of the fence shall be set ten (10) feet from back edge of sidewalk.
2. The area between the fence and the sidewalk shall be landscaped and maintained by you.
3. The board side of the fence shall face N.W. 7th. Street and Applegate Street.
4. The City of Meridian has no jurisdiction in the enforcement of the provisions of your
subdivisions Protective Covenants. Since this is a variance to a provision of your covenants
we suggest you also contact your Homeowners Association. The unsigned letter you
provided to us, dated May 15, 1995, is from the developer of the subdivision who may have
had control of the Homeowners Association at that time. No protests were received from
property owners within 200 feet of your property.
5. Please obtain a fence building permit from City Hall prior to beginning construction.
Thank you for complying with the City ordinance in requesting this variance.

The description of the ordinance that needs to be reduced to permit the proposed
fence is as follows: We are in need of a fence around the backyard to the middle of the
house. We would like to put a shed there next to the house and the fence would hide it
and keep others out from it. The best reason is that we have a 2 year old that loves to go
outside and play. She loves to be in the street and the fence would keep her in so we don't
have to watch her so much. We also have a dog that needs to be kept in as well.
I know that the meridian ordinance states that the fence needs to be 20 ft. from the
sidewalk, If we did this it would cut out a large area of the backyard for the kids to play
in. We have a trampoline which takes some room and with the fence this close there
would not be much room. We would like to get Meridian City's permission to have our
fence 8 .feet from the side walk. We have cleared the fence with Capitol Development in
Boise and they said to run this through you as they didn't have a problem with it. The
fence would be a 1x6x6 dogeared cedar fence with two gates. As we live on a corner lot
there is still plenty of room to see around the house before the intersection of Applegate
and N.W. 7th street. There is grass planted in the yard that would be maintained on the
other side of the fence to have it look as good and the rest of the yard does.
There is a person that lives at 548 west Criterion that has a nice looking fence that is
also on a corner lot. The distance she has is 7 ft 7 in from the side walk and we would like
the same consideration that she has. It would be a great benefit for our family if we could
have your permission to built the fence there.
We have parents coming out of state to visit us April 4th and I would appreciate it if
the committee could act on this decision quickly as my father would be helping me put the
fence in at that time.

NOTICE IS HEREBY GIVEN pursuant to 11-9-605 J. 10. of the Revised and
Compiled Ordinances of the City of Meridian, that the Fence Variance Committee of the
City of Meridian will hold a public hearing at the Meridian City Hall, 33 East Idaho Street,
Meridian, Idaho, at the hour of 4:30 o'clock P M., on Thursday, April 4, 1996, for the
purpose of reviewing and considering the Application of Brent & Jackie McBride for a
variance from the Meridian Fence Ordinance at the property legally described as follows:
Lot 9. Block 3 Applegate Subdivision and known by the address 685 W. Applegate St.
Meridian, Idaho 83642. The Applicant proposed to reduce the required distance from 20
feet to 8 feet from the sidewalk.
The public is welcome. Testimony, objections, and comments will be heard and
considered by the Committee.
A written decision of the Committee will be issued to the Applicant and any person
requesting in writing a copy of the decision will be furnished one.
Any aggrieved party may appeal the decision of the Committee directly to the
Meridian City Council pursuant to Section 11-2-416 G. 1.
