In reference to your request for a variance to waive the l OX10X10 foot setback around the transformer, we can not find any reference or requirement in the CCR's for such a setback. We recommend that you contact the utility company involved and request permission from them for any variance to setback requirements. This variance does not give you authorization to modify any city covenants or fence setback requirements. We recommend that you obtain a variance from the City of Meridian prior to the installation of any fence less than that which the city ordinance allows. After some discussion it was decided that the Fence Variance Committee did not have authority to allow a backyazd fence for this lot to be located closer than twenty (20) feet to the rear property line. The reason for this decision is the language of Note 19 on the recorded plat of The Landing No. 7 Subdivision. This note states "Fences along the West Waltman Drive frontage of Lot 2 Block 10 shall be set back twenty (20) feet from the West Waltman Drive right of way." It is my understanding that if you wish to pursue a rear yard fence location for this lot, other than what is described by the above referenced Note 19, you will need to file an application for an "Amended Plat" with the City of Meridian Planning and Zoning Administrator to delete Note 19. At this point the Fence Variance Committee is evenly divided as to whether they would allow a fence to be built closer than 20 feet to the street right of way even if the City Council approved of an amended plat. He advises me that the note could be removed and/or modified by the "vacation" process provided by State Statute 50-1306 A "Vacation of Plats- Procedure" (copy attached). This process requires a public hearing with the City Planning and Zoning Commission and City Council including notifications to all property owners within 300 feet of the subject parcel. Also included with this letter is a copy of the City ordinance concerning the vacation process. The vacation process starts with filing an application with the Planning & Zoning Administrator.
