Comments:
This application only approves the parking and internal landscaping for lots 14, 15, 16 and 17 of
Southeast Marketplace No. 2. This CZC does not approve the subdivision landscape buffers adjacent
to Eagle and Ustick road. Each building will be required to go through the certificate of zoning
compliance process as well as design review. Sidewalks adjacent to parking and future buildings
need to be seven -feet wide to ensure that the 17 feet long parking stalls meet code (see UDC 11-3 C -
5B4).
Conditions of Approval: Project is subject to all current City of Meridian ordinances and previous
development applications associated with this site, including but not limited to, annexation (AZ -03-
018), development agreement (instrument # 104107406), preliminary plat (PP -06-022), final plat
(FP -07-020), variance (VAR -06-002 and VAR -07-010), and development agreement modification
(MI -07-008) applications associated with this site, if applicable. The issuance of this CZC does not
release the applicant from any previous requirements of the other permits issued for this site.
Landscaping_ The Landscape Plan prepared by The Land Group, Inc., dated 01/05/2009 and labeled
Sheets L1.0 — L1.4, are approved (stamped "Approved" on January 9, 2009 by the Meridian
Planning Department) with the following changes (see redlines on pians).
Four interior lot parking islands located on the east boundary do not meet code because
they fail to have the required trees. Per UDC 11-313-8C2d, add additional trees in
parking island so that each interior planter island that serves one row of parking will
have at least one deciduous tree. Each interior planter that serves a double row of
parking is required to have two deciduous trees.
The landscaping adjacent to Eagle and Ustick Road was approved with the final plat application (FP -
07 -020) and the landscaping for each individual building shall be approved with each individual
building pad CZC. The approved landscape plan is not to be altered without prior written approval of
the Planning Department. No field changes to landscape plan permitted; prior written approval of all
material changes is required. Prior to final inspection and sign off for this project, a written
certificate of completion shall be submitted to the Planning Department, prepared by a
landscape architect, landscape designer or qualified nurseryman responsible for the landscape
plan upon completion of the landscape installation. The Certificate of Completion shall verify
that all landscape improvements, including plant materials and sprinkler installation, are in
substantial compliance with the approved landscape plan.
Site Plan: The Site Plan prepared by The Land Group, Inc., dated 01/05/2009 and labeled sheet
C1.10, is approved (stamped "Approved" on January 9, 2009 by the Meridian Planning Department)
with the following changes/notes (see redline changes on site plan):
- Ensure the four compact stalls are labeled and marked accordingly.
The approved site plan is not to be altered without prior written approval of the Planning
Department.
Parking: The proposed parking areas shall be paved and striped in accordance with UDC 11-3C and
11-3B. Project engineer/architect shall certify that the number and size of handicap -accessible spaces
conforms to the Americans with Disabilities Act (ADA). Handicap accessible stalls must have
signage in accordance per ADA and signed accessible.
Trash Enclosure: The trash enclosures depicted on the site plan are NOT approved with this
CZC and shall be approved with each individual building pad CZC.
Lighting: Lighting shall not cause glare or impact the traveling public or neighboring
development and comply with lighting standards as defined in UDC 11-3A-11.
Signage: No signs are approved with this CZC. All business signs will require a separate sign
permit in compliance with UDC 11-3D.
Irrigation: An underground, pressurized irrigation system must be installed to all landscape areas per
the approved specifications and in accordance with UDC 11-3A-15.
Protection of Existing Trees: Any existing trees on site must be protected or mitigated for in
accordance with the Tree Preservation section of the City's Landscape Ordinance. Per UDC 11-3B-
10, coordinate with the Parks Department Arborist (Elroy Huff, 888-3579) for approval of
protection/relocation measures for the existing trees prior to construction. Any severely damaged tree
must be replaced in compliance with UDC 11 -3B -10-C.5.
Curbing: Per UDC 11 -3B -5I, all landscape areas adjacent to driveways, parking lots, or other vehicle
use areas, must be protected by curbing, wheel stops, or other approved protective devices. Curbing
may be cut to allow for storm water runoff.
Sidewalks: All sidewalks shall be constructed in accordance with 11-3A-17. Sidewalks shall be
constructed prior to occupancy.
Drainage: Storm water drainage swales shall not have a slope steeper than 3:1, shall be fully
vegetated, and shall be designed in compliance with UDC 11-313-11 and UDC 11-3A-18.
Handicap -Accessibility: The structure, site improvements and parking areas must be in compliance
with all federal handicap -accessibility requirements.
ACHD Acceptance: All impact fees, if any, shall be paid prior to the issuance of a building permit.
If any changes must be made to the site plan to accommodate the ACHD requirements, a new site
plan shall be submitted to the City of Meridian Planning staff for approval prior to the issuance of a
building permit.
Certificate of Occupancy: All required improvements must be complete prior to obtaining a
Certificate of Occupancy. All changes in occupancy need to comply with the requirements of the
Building Department. It is unlawful to use or occupy any building or structure until the Building
Official has issued a certificate of occupancy. A certificate of occupancy or temporary certificate of
occupancy is obtained from the Building Department (208) 887-2211 after inspections are complete
and the field inspection record is returned to the Building Department.
Plan Modifications: Except for the changes mentioned above, the approved Site Plan and Landscape
Plan stamped "Approved" on January 9, 2009, is not to be altered without prior written approval of
the Planning Department. No significant field changes to the site or landscape plans are permitted;
prior written approval of all changes is required.

17 of the Southeast Corner Marketplace No. 2
The site is located at the southeast corner of the Eagle Road and Ustick Road intersection. More
specifically located in a portion of the northwest quarter of Section 4, Township 3 north, Range 1 east,
Boise Meridian, Meridian, Ada county, Idaho.
ACHD has constructed offsite improvements including two drive way approaches on Ustick road. One
right -in, right -out approach to this phase of the development has been constructed along Eagle road at
approximately 800 feet south of the Eagle and Ustick intersection.
This development is approximately 17.3 acres consisting of 16 buildable lots and 1 non Buildable lot. On
April 24, 2008 CZC-07-198 approved the main driveway aisles and the overall building pad layout. The
main driveway aisles have been constructed per the approved plan. The pressure irrigation, sewer, water
and storm drain utilities for the entire phase have been constructed and approved by the City of Meridian
Public Works department and each of the lots has been provided with service.
This CZC application is for the common area landscaping, parking, site lighting and building layout for
lots 14, 15, 16 and 17 of the Southeast Corner Marketplace No. 2 Subdivision. Each of the proposed
buildings for these lots will be required to submit a CZC application for the building, sidewalks and
landscaping around each proposed building (curb -in). Areas have been designated for trash enclosures;
however each trash enclosure shall be annrove with the individual buildinL pad CZC. The remaining
undeveloped portions of this site will be constructed in the future and separate CZC applications will be
submitted.
