Salaiz 2458 North Archery Way Meridian, ID 83642 887-1366 Fence Variance Committee Meridian City Hall 33 East Idaho Avenue Meridian, ID 83642 Dear Committee Members: My husband and I request a variance to build a 6 ft high cedaz fence ten feet from the sidewalk on the East Hunter Drive side of our property (at the intersection of North Archery Way and East Hunter Dr.: Lot 7 in Block 2 of TRACT SUBDIVISION No. 1). The fence would start at the reaz of our house and go to the adjacent property on East Hunter Drive. Please see the enclosed plan/ site description. In order to keep the view of the roads and oncoming intersections cleaz, the city fence regulation requires a 20 ft setback (Hunter Pointe Subdivision covenant requires a 15 ft distance) from the property-line adjacent to a street. In our case, however, view of the street and intersection as one moves along East Hunter Drive towards North Archery Way is not restricted because the fence starting point at the rear of the house is 64 feet from the front of the property and the intersection. Because of this 64 ft distance from the intersection and the front of the property to the start of the fence, and because of the location of our house and the curve of the street; the view of the street and the intersection would not change. The intersection would still be seen as if the fence was not there. Our neighbors adjacent to us at 1482 East Hunter Drive, David and Kathleen Graves, agree with the location of the proposed fence. We will place a river rock strip and xeriscaped/wildflower area between the sidewalk and the fence. This azea would be tasteful, tidy and easily maintained, whereas a larger, 20 ft border would be more difficult to maintain in a neat manner. We would like to enjoy our house and property in as full a manner as possible. Placing the fence 10 ft from the sidewalk would allow us room for many things such as vegetable, herb and flower gazdens. A 20 ft distance would close off this sunny area, restrict our gazden/yazd plans and reduce our private yazd area tremendously. We would be grateful for this 10 ft setback variance from you and look forward to the possibilities that the variance would give us. We understand that you will be setting a hearing date and mailing notice to the property owners within 200 ft of our property line. We travel extensively due to our jobs and will both be gone July 23 -August 03 and again August 19-25. We would really appreciate a hearing date at some time other than when we will be away from Meridian. Enclosed, please find the fence variance application, a schematic drawing showing our house, the streets and the proposed fence, a copy of the deed, a letter from the Hunter Pointe Architectural committee stating allowance fora 10 ft setback and a list of the addresses of homeowners within 200 ft of the radius of our property. Salaiz 2458 North Archery Way Meridian, ID 83642 RE: Fence Variance Clarification Dear Dr. Hutchinson and Mr. Salaiz: After reviewing your request. for a variance of five feet for your six ft. high cedar fence, the committee feels at this time that a five foot set back is not acceptable. The committee agreed to a "ten foot" set back. We feel that this would be an acceptable compromise in that it would give you an additional ten feet of yard area and would still leave enough area between the sidewalk and the fence to allow for an acceptable landscaped area. This variance is granted with the stipulation that you will agree to landscape and maintain the area between the fence and the sidewalk; and with the understanding that you must still apply to the City of Meridian for a variance. Idaho Meridian, ID 83642 July 8, 1994 Dear Fence Variance Committee: I understand that you are meeting on July 21st to discuss the "10 feet" fence setback of Pamela Hutchinson. I hope you will not allow this exception. A fence this close to the sidewalk gives the axea a less welcome, closed feeling. This will be the only fence in the ~ ' neighborhood this close to the sidewalk - I think it will stand out and look odd. I understand the Hutchinson's desire for a larger backyard, but I think that their need for a larger backyard is less important than the need to preserve the visual integrity of the neighborhood. As past experience for the last 18 months, a personal or company truck has been persistently parked on East Hunter Drive; accompanied by the possibility of a fence closer than 20 feet to the sidewalk further restricts a clear and unobstructed view from our driveway down the street to the corner. Therefore; for the record we do not approve of this applied variance. Thank you for your consideration in this matter.
