Inspector • • DESCRIPTION OF REQUIREMENTS OF THE ORDINANCE THAT NEED TO BE REDUCED TO PERMIT THE PROPOSED FENCE The restriction which we are requesting reduction of is the restriction that forbids fences within 20' of the street on a comer lot. When we purchased the house, it was our understanding from both realtors that we could put a fence at our property line. We have a boat which we wanted to enclose behind the fence (as required in the covenants) so we assumed that a comer lot would be most appropriate. We have since decided to park the boat on the opposite side of the house, but still want to be able to enjoy our yard. We have compromised wanting a 6' fence, the length of the house at the property line to the following: We are requesting permission to put our fence at the edge of the sidewalk from the back property line up the side towards the front 57'6" at which point we would graduate the fence to a 3' fence over the adjoining 9' (2" per 6" picket). At the point of 66'6", we would then continue our 3' fence for 23' and then turn to the house for the remaining 28'2" . (PLEASE SEE DRAWING) PLEASE NOTE: Our covenants clearly state: No fence, wall, hedge or shrub planting which obstructs sight lines at elevation between 3 and 8 feet above roadways shall be placed or permitted to remain on any corner lot within the triangular area formed by the street property line and a line connecting them at points 25 feet from the intersection of the street property lines extended. ** Our 3' fence would be over 42 feet from the intersection of the street property lines extended. No fence, wall, hedge or shrub planting which obstructs view shall be placed nearer to front lot line than twenty (20) feet nor to the street side yard of fifteen (15) feet, but in no case closer to street than building setback line. ** Our attached drawing clearly shows that the fence will not obstruct view due to its placement. That is why we opted fora 3' to 6' grade. Our covenants further state: No dwelling unit or other structure (exclusive of fences and similar structures) shall be placed nearer to the building lot lines than permitted by the plat for the property or applicable zoning laws. Amendment of the Declaration of Protective Restrictions and Covenants requires at least two:thirds (2/3) vote of~the lot ,/ owners. Any amendment must be recorded and the same shall become effective upon the filing of such instrument or instruments in the office of the County Recorder of Ada County, Idaho. ARTICLE III PROPERTY USE RESTRICTIONS A. Building Restrictions. All lots in said subdivision shall be known and described as residential lots and restricted to residential use as allowed by current applicable zoning regulations and no structure shall be erected upon building site therein other than one detached single family dwelling with none of the dwellings erected to exceed two (2> stories in height. B. Type of Building. All buildings shall be of frame, stone or brick and shall be maintained in a good state of repair and if other than brick or stone shall be finished and painted and such finish to be kept in good repair. All buildings shall be required to have some stone, brick or stucco on front of. building. Said property shall be used in such manner as to be inoffensive to any other property -owner thereof. Architectural Asphalt shingles, equivalent to PASCO HO-25 CLASS A SLIT or wood shingles or_ as approved by the Architectural Control Committee are required. The roof pitch for all buildings shall be six-twelve (6/12) pitch or greater. C. Hini~us Huildinq Size. Any residential building erected upon. said property shall have a floor area required under provisions set by the Architectural Control Committee. In no event shall the required area be less than 1,350 square feet of ground floor area of a one-story house or 800 square feet of first floor area in the case of two-story.. Ho tree shall be permitted to remain within such distances of such intersection unless the foliage line is maintained at sufficient height to prevent obstruction of such sight lines. Ho fence, wall, hedge, or shrub planting which obstructs view shall be placed nearer to front lot line than w ee nor to street side yard of fifteen (15) feet, but in no case closer to `^~~" street than building setback line. Within thirty (30) days after the completion of construction of the building on a building lot (unless such time is extended by the Architectural Committee for good cause), the Grantee of such lot shall install the landscaping. Landscaping must include the following: 1, Sod for-front and side yards of corner lots 2. Sod for front yards of interior lots 3, All front yards to have at least one (1) approved tree having a diameter of at least two (2) inches. A grantee shall maintain the landscaping on his building lot in a neat and attractive condition, including all necessary gardening to properly maintain and periodically replace when necessary the trees, plants, grass and other vegetation.
