108100423). The issuance of this CZC does not release the applicant from any previous requirements of the other

Landscaping_ The Landscape Plan prepared by James Gipson Associates. on 10/29/2007, labeled Sheet L6.0 and
L7.0, is approved (stamped "Approved" on 10/28/2008 by the Meridian Planning Department) with no additional
changes. The approved landscape plan is not to be altered without prior written approval of the Planning
Department. No field changes to landscape plan permitted; prior written approval of all material changes is
required. Prior to final inspection and sign off for this project, a written certificate of completion shall be
submitted to the Planning Department, prepared by a landscape architect, landscape designer or qualified
nurseryman responsible for the landscape plan upon completion of the landscape installation. The
Certificate of Completion shall verify that all landscape improvements, including plant materials and
sprinkler installation, are in substantial compliance with the approved landscape plan.
Site Plan: The Site Plan prepared by James Gipson Associates, on 10/29/2007, labeled Sheet L2.0 and L3.0, is
approved (stamped "Approved" on 10/28/2008 by the Meridian Planning Department) with no additional changes.
The approved site plan is not to be altered without prior written approval of the Planning Department.
Elevations: Elevations prepared by James Gipson Associates on 10/27/2008, labeled Sheet A6 and A7, are
approved with no changes from the Planning Department.
Irrigation: An underground, pressurized irrigation system must be installed to all landscape areas per the approved
specifications and in accordance with UDC 11-3A-15.
Protection of Existing Trees: Any existing trees on site must be protected or mitigated for in accordance with the
Tree Preservation section of the City's Landscape Ordinance. Per UDC 11-3B-10, coordinate with the Parks
Department Arborist (Elroy Huff, 888-3579) for approval of protection/relocation measures for the existing trees
prior to construction. Any severely damaged tree must be replaced in compliance with UDC 11 -3B -10-C.5.
Parking: The proposed parking areas shall be paved and striped in accordance with UDC 11-3C and 11-3B. Project
engineer/architect shall certify that the number and size of handicap -accessible spaces conforms to the Americans
with Disabilities Act (ADA). Handicap accessible stalls must have signage in accordance per ADA and signed
accessible.
Curbing: Per UDC 11 -3B -5I, all landscape areas adjacent to driveways, parking lots, or other vehicle use areas,
must be protected by curbing, wheel stops, or other approved protective devices. Curbing may be cut to allow for
storm water runoff.
Sidewalks: All sidewalks shall be constructed in accordance with 11-3A-17. Sidewalks shall be constructed prior
to occupancy.
Drainage: Storm water drainage swales shall not have a slope steeper than 3:1, shall be fully vegetated, and shall
be designed in compliance with UDC 11-3B-11 and UDC 11-3A-18.
Li tin : Lighting shall not cause glare or impact the traveling public or neighboring development and
comply with lighting standards as defined in UDC 11-3A-11.
Signage: No signs are approved with this CZC. All business signs will require a separate sign permit in
compliance with UDC 11-3D.
Trash Enclosure: All dumpster(s) must be screened in accordance with UDC -11-3A-12. Trash enclosures must be
built in the location and to the size approved by SSC. Applicant indicates trash will be taken to curb.
Handicap -Accessibility: The structure, site improvements and parking areas must be in compliance with all federal
handicap -accessibility requirements.
ACHD Acceptance: All impact fees, if any, shall be paid prior to the issuance of a building permit. If any changes
must be made to the site plan to accommodate the ACHD requirements, a new site plan shall be submitted to the
City of Meridian Planning staff for approval prior to the issuance of a building permit.
Certificate of Occupancy: All required improvements must be complete prior to obtaining a Certificate of
Occupancy. All changes in occupancy need to comply with the requirements of the Building Department. It is
unlawful to use or occupy any building or structure until the Building Official has issued a certificate of occupancy.
A certificate of occupancy or temporary certificate of occupancy is obtained from the Building Department (208)
887-2211 after inspections are complete and the field inspection record is returned to the Building Department.
Plan Modifications: The approved Site Plan, Landscape Plan, and Elevations, stamped "Approved" on 10/28/2008,
are not to be altered without prior written approval of the Planning Department. No significant field changes to the

This will explain our request forroval to allow development of this
site for the proposed Meridian Eye Care Building.
The site, located at 125 West Cherry Avenue, Meridian, Idaho, is approximately 0.34
acres in size, and is zoned O -T (Old Town). The proposed use is permitted, but a
Conditional Use permit is required. Because the site is located at the very Northwest
extreme limit of the Old Town zone, we believe that some practical consideration should
be given to the design requirements; full compliance with the Old Town design
guidelines is not feasible, and would result in a very awkward development of the
property.
We propose a two-story building, located as close as possible to Cherry Avenue, with
parking behind (South of) the proposed building, and vehicular access only from 2nd
Street. The building is to be "contemporary" is character and design, compatible with
other development in the area. The building is to be relatively small, about 3,500 sf. total.
Exterior materials are to be stucco wall finish with stone wainscot and accent, and
architectural fiberglass shingle roof; soffit, fascia, and trim are to be stucco.
The site development complies as closely as possible with the Old Town design
guidelines, with the building placed at the front (North) of the property, parking behind
(South). Because there are existing trees on the property, a significant effort is made to
retain as many of the trees as possible, and this has influenced the site design.
Two of the existing trees on the West (2nd Street) side of the property are to be removed,
while one (1) on the West side and one (1) near the Northeast corner of the property are to
be retained. We understand that there will be a "mitigation" cost to allow removal of the
existing trees, and have consulted with Mr. Elroy Huff regarding which trees are of
greatest value to save.
The site landscaping is designed to provide the required number of trees, and appropriate
screening of the drive/parking area. Trees and other planting material are selected to
provide appropriate growth pattern and size, and to require relatively little irrigation
water.
The proposed parking exceeds the minimum number (1/500 sf of building) of car parking
spaces required, and there is to be a bicycle parking area in a convenient location. Wheel
restraints may be used to control the location of parked vehicles with respect to the
adjacent pedestrian walk. In addition to the on-site parking to be provided, there is
considerable business -hour parking available directly across 2nd Street, at the existing
LDS Church; signs are presently posted suggesting that parking there is allowed.
We have explored the possibility of a cross -access agreement to property to the East, but
the proposed site development of the property to the East (retaining the existing building)
does not appear to lend itself well to this idea. However, if the adjacent properties to
either the South or East are developed in a manner that will make cross -access mutually
beneficial, the applicant is receptive to this.
This project will not generate noise, fumes, odors, glare, or excessive vehicular traffic
which would damage adjacent or nearby properties. The Neighborhood Meeting, held on
September 26, 2007, was attended by several interested neighbors, who have indicated
their support for the project; no objections were noted.
We believe that the proposed project fully meets the intent of the zoning requirements,
and can be developed in a manner that will be as asset to the neighborhood and to the
community as a whole. We thank you for your consideration of this application, and

the building was attractive, and that the material for the fascia should be other than stucco, and in an accent
color contracting with the body of the stucco walls. No fiuther review was requested by this commission.

I left a message on your phone, but I also wanted to shoot you an email and let you know what is
happening. I am reviewing the CZC for the Meridian Eye Care and comparing it with the CUP, which was
approved in April and I am going to need revised plans depicting the following:
- First off, I do not have any of the plans with the callout details for the trash enclosure, bike rack,
etc. I will need to review these to ensure they comply with the CUP. Along those lines I wanted to
make sure that the screen material for the A/C unit on the east side of the building is stucco and/or
cultured stone (per condition I.Id of the CUP). My concern is that the note on the site plan stated
that it was a 6' tall chain link fence which would not be acceptable.
- Second, the site plan needs to have wheel restraints on the parking. That was a condition in the
CUP, but they are not shown on the site plan that I currently have.
- Third, the site plans depicts part of the sidewalk just west of the building to be 45, Meridian code
requires sidewalks to be at least 5', please revise accordingly.
- Fourth, Meridian code requires developments to have at least one tree in the parking planters in
addition to shrubbery. Please add 1 tree to each of the entrance planters and 1 tree to the planter
island on the east end of the row of parking on the north side.
- Fifth, regarding the south elevation. The approved CUP plan had a window on the South side of the
first level; the elevations submitted with the CZC do not show the window there. Please submit
revised elevations showing the window.
- Sixth, and I am a little confused at this one myself, the conditions in the CUP stated that applicant
needed to "work with staff and the historic preservation commission to determine architectural
alterations that are compatible with design features required in the Old Town District." However,
the elevations were approved at City Council. Did you work with the historic preservation
committee to adjust anything on the building, if so, please indicate.
