I'm sorry for the delay in getting you information for placement
of your fence but I wanted everyone involved to physically look
at your house/lot arrangement. Three of the four people on the
fence committee agree that your situation is unique and you don't
have much of a choice because of the berm.
Two concerns raised were the placement of the fence along the
sidewalk being in the road right of way and any adverse reactions
your adjacent neighbors may have to the fence.
The Highway District looked at your fence and made some
measurements to conclude that they didn't have a particular
concern at this time. If however, the roadway is ever widened,
which you and I may never see, it would be the property owners
responsibility to remove the fence.
The information you have given us concerning your adjacent
neighborts> reaction to the fence doesn't indicate much of a
problew since one is contributing to it financially and the other
didn't seem to have an opinion.
With these things in mind and an informal 3 to 4 vote of the
fence Committee your fence can be constructed as proposed. The
berm situation, in general, will be studied to head off future
problems such as what you have experienced. Thanks for your
