Meeting called to order by Acting Chairperson, Annette Hinrichs at
8:04 P.M.
Members present: Ken Tewksbury; Lee Mitchell; Rick Orton; Don Sharp

Minutes of the previous meeting approved as read.
Agenda
1 KBBK Radio Station Hearing for Conditional Use - located at 1114 Meridian St.
Dave Williams and Burt H. Oliphant, owner, were present, representing
Conditional Use request.
Williams explained that the office complex is being used by Ed Jones who
has a Conditional Use Permit. The parkina lot is paved and adequate for
16 spaces; the staff will be aoproximately 13 employees, but parking at
any one time would be needed for 5 to 8 vehicles; very little traffic
in and out; no huge antennas, approximately 12 feet high; no noise; 35
signatures of neighbors with no objections.
Hinrichs asked for comments for hearing.
Pitchell asked if there would be a Sion.
Oliphant described the KBBK letter light - approximately 2 feet each. No
flashing lights.
The Plotion was made by Mitchell and seconded by Tewksbury that KBBK Radio
Station, located at 1114 Meridian St be granted a Conditional Use Permit.
Motion Carried: All yea.

2 Cherry Lane Village !lest Preliminary Plat - located in Lampe Annexation.
Marilyn Olmstead, J-U-B Engineers Inc., was representing Leavitt-Nu Pacific Co.
Olmstead stated that this Tentative Plat fits in with Cherry Lane Village
Master Plan - 77.4 acres, density of 3.4 lots per acre; 268 lots and does
not have a possible school site, Block 8. The lots are roughly designed
if there is not a school site picked up by the School District. If the
School District Dicks this site up, they will resubmit a revised tentative
at that time. Olmstead stated they will have a wet line sewer. There is
a 18" trunk line that will eventually tie in sewer extension on Ustick.
A lift station will be pumping back over to Cherry lane for this first phase.
A thorough design of location of lift station has not been done yet, but
approximately Block 11.
Orton stated that he could see a conflict with what was presented earlier
on Cherry Lane Village development. There was a promise to develop lots
and the last nine holes for golf course in a timely manner. Orton questioned
if there is a schedule developed to come through with the second nine holes.
Olmstead stated that the schedule of the existing nine holes has always
been that when we begin the 200 lots around the second nine hole, or first
phase 200 lots, the second nine will be constructed.. Olmstead stated that
Leavitt will stand by his oblication to put in the second nine as soon as
the first lots are ready to go in around the second nine. The main reason
they are coming today with the Lampe Property Tentative Plat is because
the schedule on the way this property has to be picked up, the option has
to be exercised this December. The Leavitt-Nu Pacific Company does not pick
up options, except in rare occasions, if the Tentative Plat has not been
approved.
Orton stated that he felt Leavitt could push the second nine back with just
this kind of monopoly. In his estimation, it could be as riuch as seven years.

Olmstead stated that this proposal now was for economic reasons. It is
not even necessary that it be final platted next.
Orton pointed out how important it is to ask Mr. Leavitt and Company to
produce a schedule for developing the rest of that area in an orderly
manner before he comes to the outlying areas. They have changed the
concept by bringing this ldst annexation in first. Orton stated if
Mr. Leavitt would commit to a schedule of three years, as far as he was
concerned, this issue would be solved.
Olmstead stated they have not changed the Concept Plan of Cherry Lane
Village.
Orton stated the Change is in the timing, they have added so much new land,
Leavitt could push the nine hole back. He felt Leavitt was making the
City a second rate municipal golf course. We want a first rate golf
course and to culture clientele, it can't be done with nine holes.
Olmstead stated Leavitt has promised a first class golf course, but
the developer should not be rushed into the second nine holes and would be
better to let the economic climate develop to get the additional nine holes.
Orton maintained the economic climate can be controlled for a long time
out there to low frontend cost projects unless the City put some incentive
in this. The City should have a date committment.
Mitchell stated Leavitt's options are not the Planning and Zoning's problem.
He felt the Tentative Plat was coming in for the wrong reason. Mitchell
was not in favor with the pumping station.
The Motion was made by Orton and seconded by Tewksbury to table Cherry Lane
Village West Preliminary Plat until the scheduling and phasing for the second
nine holes of the golf course and the lots around that are defined and
confirmed commitment from Leavitt-Nu Pacific Company.

Marilyn Olmstead requested to be put on the October 15, 1979 City Council
agenda.

3 Marty Igo was present to represent both the LOS Church Conditional IJse and
the Winston Moore Rezone located in Thomas Annexation, East Overland.
Igo stated that the Winston Moore Rezone involved 22 acres north of Overland
Rd. and east of Kuna-Meridian Rd. The request was to rezone to General
Commercial District to allow retail and service commercial such as motel,
office, theatre, restaurant and certain limitations.
Igo distributed signed petitions for the LDS Church Conditional Use and
Winston Moore's Rezone by homeowners in favor. Upon displaying a map, Igo
pointed out the original 10 acre site for the LD5 Welfare Service Complex.
This was approved by Council, December 18, 1978. The purpose of this request
is to ask the City to grant a similar use on a different parcel of land
located approximately 208 feet east of the land parcel now owned by the
church. All of the property is within the City Limits. This move would
allow Winston Moore to request about 22 acres, now Agriculture zone, be
rezoned to General Commercial to allow retail and service commercial.
Igo stated the plan before them is conceptional as Mr. Moore now has a
tenant, the buildings are architectural concept. Moving the LDS complex
to the east allows Moore to do a Planned Commercial Development. The
development would be compatible to the Church's development. He stated
Moore proposed different kinds of businesses that would lend well to the
shopping centers of Waha's and Mar-Mon.
The access or exits onto Kuna-Meridian Rd. are not planned at this time.
Igo pointed out that Moore has limited his request for rezone and specific
uses would be brought in for approval. He had tried to design according
to the new Ordinance.

Hinrichs commented that the new zoning ordinance will have several
Commercial categories. In each of those Commercial areas, planned
unit developments, whether residential or Commercial, are listed under
Conditional Use. That means they must come in for public hearing review
and approval.
The Chairman asked for public comment on the Winston Moore Rezone.
Laura Conner asked if property was in City. The answer was yes, annexed
in October, 1977.
Connor asked about sewer and water.
Hinrichs stated they may not develop

Paul Buskey, a homeowner across from the Winston Moore and LDS property,
presented a prepared statement in favor of both developments, but with
reservations listed for consideration:
1. A deceleration lane in front of the LDS property (Note: this was
agreed to by the church at last November's City Council meeting).
2. A greenbelt of grass, trees, shrubs, and hedges about 50 feet in
width on the LDS property (Note: future bldg. expansion on the
blueprint goes south toward Overland Rd.).
3. Entrances/exits to/from the t.OS property on Overland Rd. should be
at the extreme East and West ends of the property as currently
shown on the blueprint.
NOTE: All of the above currently appear or are planned on the
blueprint. Our concern is greenbelt width and unmarked
exits or entrances on Overland Rd.
4. A speed limit of 30 m.p.h. on Overland Rd. in front of the
developments and our residences. (Mr. Frank Capshaw of the Highway
District Traffic Office at my request last year performed a traffic
flow study and concluded that we need a lower speed limit and
more enforcement of it. A copy was sent to the Sheriff's Department.
Nothing has been done.).
5. A concrete median road divider that will reouire persons exiting
onto Overland from both properties/developments, under consideration
to drive west (i. e. turn right) upon entering onto Overland. This
will direct traffic away from Country Terrace and our residences
located directly on Overland Rd.
Buskey verbally added item 6. If the large narking lot could be fenced
or chained at night to prevent recklessness, they would appreciate the
consideration. Statement is on file.
Glen Scott, on of the owners of Meridian Greens, spoke in favor of the
acceptance of proposal as presented by Winston Moore.
Mitchell questioned property that is "L" shaped and almost land locked.
Igo stated that the layout of buildings are just architectural concept
and that traffic flow would have to work for the City as well as the
development.
Orton commented that there may be access worked out with Rainey-Kuhl (Time-
for-Two) as there is parking lot in their proposal, off of Highway 69.
Tewksbury stated that some access into or from the "L" shaped area could
be a problem. The right-of-way on Overland was discussed. It was thought
to be a 80 foot right-of-way.
The Motion was made by Tewksbury and seconded by Orton to recommend to the
City Council, approval of Winston Moore Rezone from Agricultural to Commercial
with the compliance of water and sewer requirements, design review, landscaping,
construction of acceleration-deceleration lanes, subject to Fire and Police
approval, and subject to the proposed zoning ordinance.

4 Clyde Weber, Architect for the LDS Church, spoke concerning the high
water table level, referring to Central District Health's requirements
on test holes for septic system. Weber stated they have every intention
of tying into and using Central sewer service. The Church has been
working with property owners on both sides of Overland to bring the
sewer across.
lJeber. also stated that there will be a small car storage at the Welfare
service. A carport structure in the back would be used as part of the
complex, but would be enlosed and locked at night.
Weber stated the differences of previous plan and present complex plan.
Now the center will be up to the front six acres and delete the Church
Chapel, back four acres will be landscaped or grass area. They now
have two entries, greenbelt, birms, trees and shurbs instead of Chapel
lawn.
Hinrichs asked for comments from the public on the LDS Conditional Use.
Cecil Thomas stated he wanted to mention the plan fora boy scout complex
to share some parking at the East, and will be coming to this Commission
with the proposed development.
Weber stated that the silos have been deleted.
Orton commented that the 4 acres in back of complex, next to the Interstate,
should have landscaping commitment upon design review.
The Motion was made by Mitchell and seconded by Tewksbury to recommend approval
of LDS Church Conditional Use, subject to sewer and water before occupancy,
widening of Overland for acceleration and deceleration, landscaping plan and
design review.

The Motion was made by Tewksbury and seconded by Mitchell that the Meeting
be adjourned at 9:30 P. M.
