JOHNSON: (FINDINGS TO BE PREPARED) MERIDIAN PLANNING & ZONING OCTOBER 13, 1987 Regular Meeting of the Meridian Planning and Zoning Commission called to order by Chairman Walt Morrow at 7:30 p.m.: Members Present: Moe Alidjani, Jim Johnson, Jim Shearer: Others Present: Opal & Dean Merrell, Bessie Matcham, Trixie & Raymond Grosso, Steve Wherry, Wayne Crookston: The Motion was made by Alidjani and seconded by Shearer to approve the minutes of the previous meeting held September 8, 1987 as written: Motion Carried: All Yea: Item $1: Public Hearing; Rezone request by W. R. Johnson: Chairman Morrow: We would ask Commissioner Johnson to abstain from the discussion as he has a conflict of interest. Mr. Johnson would you like to tell us about what you have in mind? Johnson was sworn by the City Attorney: Johnson: I am requesting the property I own at 1103 East First be rezoned to Community Commercial, this property has been used off and on for commercial purposes with Conditional Use Permits for several years. With the attitude of the City of Meridian to Condit- ional Use Permits and the problem of every time the use changes having to obtain another Conditional Use Permit I have decided to apply for the rezone. At this time my plans are to probably turn this property into an office, this is not concrete at this time but what- ever I do with it it would adhere to the regulations that the zoning allows with respect to Community Commercial. Another reason I am applying is that recently there were four properties along this street rezoned to Community Commercial and think this street will be comm- ercial some time in the future. Chairman Morrow: Are there any questions of the Commission? There were none, We will now open the Public Hearing. Is there anyone in the audience who wishes to testify on this request? Dean Merrell, 28 East Carlton, I have a question, what is the scope of the Commercial that will be on this property? Chairman Morrow: I will allow you Mr. Johnson to answer this question. Johnson: In other word what would be allowed under the Ordinances on this property with this type of .zoning, it probably would be better if someone were to read you out of the Ordinance what would be all- owed with this zoning. Chairman Morrow read the allowed uses for this zoning but emphasized that several of these uses would never come about because of the size of the property. MERIDIAN P & Z • OCTOBER 13, 19 Page #2 Johnson: I have had this property since 1980 and planned on using it for my insurance office, I have not done this yet as it has not been economically feasible as yet. I paid to much for the property I bought it when the price of real estate was up, I paid more for it than it is worth now and if I do make it into my office I want to do it right, do the proper landscaping and remodeling and parking. Raymond Grosso, 36 East Carlton, if they want to build something there do we have any jurisdiction as to what they can build? Chairman Morrow; No you would not, other than it would have to be something that would be allowed under the Ordinances in that zone and they would have to meet all the requirements of the Ordinances. Grosso: Would it increase our taxes? Chairman Morrow: No it would not effect your property at all, it would impact the taxes for that property only. Being no other comments or testimony we will close the Public Hearing. Are there any comments or questions of the Commission? Shearer: The only comment I have is that in regard to Ada County Highway District recommendations is that they would fit in if this was going to be a new building and unless he does extensive remodel- ing, I do not think it would be fair to make him meet these requir- ements until the property is upgraded. The Motion was made by Shearer and seconded by Alidjani to have the City Attorney prepare Findings of Fact and Conclusions on this request. Motion Carried: Alidjani, Yea: Shearer, Yea: Morrow, Yea: Johnson, Abstain: The Motion was made by Shearer and seconded by Alidjani to have the Findings of Fact and Conclusions show a recommendation of approval to the City Council based on the fact that other properties in that area have been rezoned and that the recommendations of Ada County Highway District would only be required upon complete redevelopment of the property.
