Regular meeting called to order by Chairman, Annette Hinrichs

Minutes of the previous meeting Held September 14, 1981 were approved as written
Agenda PUBLIC HEARING for Re-zone 540 West Cherry Lane, Jerry 0. Mortensen, CLU

Annette Hinrichs: "The public hearing is now open for an application of re-zone
from "A" Residential to "C" Commercial Limited Office for Jerry Mortensen
located at 540 West Cherry Lane."
Jerry Mortensen: "I purchased the property at 540 West Cherry Lane with the intent
of remodeling into a professional insurance office. The property on the west, half
of the lot behind and across the street to the east is the Circle K - all zoned
Commercial. I have been officed in Peridian for several years, about eight years,
and would like to get into an ownership equity position. I have made contact with
the owners around the property and have the necessary signatures. This is a small
home and would accommodate an one man insurance office very well - I have two other
employees, two secretaries, and changes are that is as large as I will ever get."
Bob Spencer: "What do you think of the Highway Department's recommendation?"
Mortensen: "I think that it is an unreasonable request. I met with them and talked
with them about it, I expressed myself of willingness to participate but I would
like to wait until theyrare ready to widen and to improve before they require the
deposit As I understand, in their five year plan, it is not on the five year plan
to expand or improve Cherry Lane. I would prefer waiting until then to make a
deposit because of the tightness of money."
Mitchell: "Isn't that what we had on this other one out here?" (Refers to
Century 21 Office on the corner of West Cherry and North Linder) Wasn't that
the condition made with them that when they (ACRD) were ready Century 21 Realty
would deposit?"
It was the feeling. of the Chairman and City Clerk that this was the stipulation
presented at the time of approval of Century 21 Realty Conditional Use.
Mortensen: "I have written a letter to the Highway Department, put it in writing
over my signature, that I am willing to participate in the improvement when the
time comes."
Hinrichs: "The ACRD seems to be somewhat adamant - I'm assuming you got this letter?"
Mortensen: "Yes, I did. The interesting thing about that is that they haven't
collected that from anyone else There have been other changes on Cherry Lane but
by what I have been told it was not collected from Circle K Corporation, Roberts
property or C cia Cherry property. They have never collected it. I understand
it but I just~~nft them to start with me particularly. Another point is that
if you made a deposit there was no guarantee that was going to cover the expense
of it when the time would come - it's just a deposit and when the time comes it
could be over three times or triple that. Until that time comes they have the
access to your money -.whatever length of time, it may be five or fifteen years."
Hinrichs: "I would like to open the hearing to the public. Are there any comments
on the re-zone of the Mortensen property at 540 ldest Cherry Lane?" No response
"Public Hearing is now closed."
There was discussion concerning the benefit of Limited Office restriction.
It was determined all the property surrounding is strict Commercial.

The Motion was made by Lee Mitchell and seconded by Bob Spencer to recommend to
the City Council that the Re-zone from "A" Residential to "C" Commercial Limited
Office be allowed Jerry 0. Mortensen, CLU, for property located at 540 West Cherry
Lane, with the condition that this property hookup to City sewer and water and Mortensen
be ready, willing and able to participate with the Highway Improvement Program
when this improvement occurs.

Agenda PUBLIC NEARING for Replat, Reynold Schenck, 431 and 435 East State

Bob Spencer: Madam Chairman I request to abstain from this hearing because of
my business relationship with Mr. Schenck."
Annette Hinrichs: "Granted" "The Public Hearing is now open for the Replat of
Lots 11 and 12, Block 2, Cottage Home Addition, 431 and 435 East State, Reynold Schenck"
Reynold Schenck: "There is an old stucco house located on the property - sitting
right in the middle of two lots. It is facing at this time,State Street. Number one,
the property is old, it is pretty well run down, to 9o in and redo the electrical
and the plumbing - things like this is expensive. The cost to fix up the place in
a manner that it could be rented, is rather expensive and I won't rent it in the
condition it is in now. The reason we went in with a "Townhouse" project - four
units- you have the plot plan and the size of the units - vae want to sell these units.
We didn't want to go in and put a duplex or a fourplex and rent it. We want to sell
the properties so that the people will actually own them. This would give pride in
ownership and we wouldn't have to maintain them. The way we have it designed right
now is that the units will be facing East 5th Street. (Schenck displays large
plot plan showing design and landscaping) There are a few old trees there and by
the way it looks should be able to save all of them unless they are rotten and need
to be destroyed. These properties will be two and three bedroom, roughly 1400 sq.
feet apiece, selling at an estimated $55,000 to $65,000. The power of ownership
seems to keep the places looking a lot nicer far a longer period of time than if we
just rent them. Basically, the neighbors don't care to have anymore rentals around
there either."
Lee Mitchell: "have you read the comments from the Comment Sheet?"
Schenck: "Yes Sir"
Pitchell: "About the sewer hookups and all other requirements?"
Schenck: "There's no problem at this point in time. Ada County Highway has indicated
that we need to repair the sidewalks, we were planning on that anyway as they are
breaking up, they want pavement on 5th Street up to the existing street line - we have
no problem with that; there need's to right-of-ways for the sewer and water - there is
no problem there. There is an alley through there, to the South side."
Mitchell: "Sewer is in that alley?"
Schenck: "I believe it is. PJampa (Meridian Irrigation Dist) has a question about
the drainage, etc. - we really don't want to irrigate out of that ditch because of
the high vaater level - we feel it would be better if we just sprinkle them. 6•Je were
in there for several years, about eight years, and everytime we irrigate we would
have to put our swimming suits on. There will not be any basements because of the
high water table."
f•1itchell: "There will be a crawl space?"
Schenck: "Yes Sir." "The City wants four separate hookups for the sewer and how
ever they want those easements will have to be taken care of. They can come down the
back of the property on the lots."
Tom Eddy: "It's going to be a two story?"
Schenck: "Yes sir. The plans indicate how we are going to have the bottom and the
top story also."
Mitchell: "It looks like what I would call a story and a half."
Schenck: "Yes, it's a low profile. That's a six-twelve pitch on that roof. There
is a little more slope on it so it won't be quite so high."
Hinrichs: "Are there windows on tYie back side of this too?"
Schenck: "Yes ma'm. The garage is in the front side, patios coming out the back.
There was discussion concerning the floor plan, plot plan. Tape on file
Schenck: "There is individual fencing and it will be fenced all the way around (back)
There is a question on the State Street side - I don't know what the criteria is there"
Fencing was discussed. "There are two fire hydrants just on each corner one block
away."
Chairman Hinrichs questioned the fencing in behalf of fire truck access. Schenck
stated that with the alley on one side and E. State and E. 5th there would be good
fire fighting access.

Hinrichs: "I will now open the hearing up to public comment."
Ray Pethtel: "I live just west of this proposal. How close is this house supposed
to be to State Street? "
Hinrichs: "The plan shows 20 feet"
Pethtel: "In line with the other houses?" "It would have to be in line with the
other houses."
Hinrichs: "It would have to be set back the required amount of setback."
Schenck: "Do you know how far back your's is sir?"
Pethtel: "I don't know - I've been there too long. I'm with everybody on that street."
Maude Pethtel: "But still - the side of that house can't come out any farther than
the side of the house further west." We had a house on 4th Street, they are spacing for
it but they are even with ours."
Earl Plackett: "Mr. Schenck, you mentioned you wouldn't be irrigating there - you
wanted to sprinkle. Will this mean a disruption in that irrigation ditch and let
that water come north ?"
Schenck: "No sir". There Cannot be and shall not be any disruption."
Plackett: "Thank you"
Pi. Pethtel: "You cannot come with the fence within two foot of the ditch because
we need room to get to our headgates" "One ditch is at the back and one is on the
west. The one on the South was supposed to be torn down and you were supposed to
keep that ditch clean - we have had to always do that."
Schenck: "Is that a requirement? If it is we will do it."
Hinrichs: "I'm sure that Nampa-Peridian Irrigation requires this."
There was discussion concerning tiling the ditch. Schenck stated that tiling would
probably be the best .
P4. Pethtel: "Ply headgates are there (South side) and Vera Scott's are on the west
and she irrigates out of that ditch."
More discussion concerning location of headgates. It was determined that there has
to be access to Scott's property for irrigation along the west side. Scott has four
headgates and a sump pump along the west side.
Ray Pethtel: "How close are those fences going to come to that ditch?"
Schenck: "I can't answer that because I don't know where the setback is - whatever
the requirements are up to that ditch it will have to be."
M. Pethtel: "We have to have ways to get in and out of that ditch."
Annette Hinrichs: "Mr. Schenck,when you are checking with everyone you had best
check with the Fire Chief on the fences."
Schenck: "Right"
M. Pethtel: "We don't want anything smaller than a 16 inch the through there
to carry all that water."
Hinrichs: "Are there any other comments?" No response
"Public Hearing is closed."
Schenck: "Madam Chairman, I would like to request to have this proposal tabled until
I can take care of these problems and get back to you next time."
Hinrichs: "Otherwise you are going to get a Motion with a list that 1ong."
Schenck: "I would like to take care of these two particular problems. Now, do we
have any other problems while I'm here?" PJo response from Public.
Hinrichs: "You need to check with the Nampa-Meridian Irrigation District -"
Schenck: "I've got the ditch, the fences and the setback on State Street - any other
questions?" No response
Pethtel"s were given the layout of the plans for the Townhouse proposal.

Schenck Townhouse Proposal to be located at 431 and 435 East State be tabled
until Mr. Schenck's convenience.

Agenda Donald Minegar and Howard Jenkins Input - West Pine Street (Navarro property)

Minegar and Jenkins came before the Planning and Zoning Commission regarding
the 5 acres adjoining John Navarro's property and 3.7 acres in back of Shuyler';s
property - acres touch. Shuyler has two duplexes on his property and they were
aware that 11th Street was to come through Shuyler's to Pine Street.
Plinegar: "Navarro and Jenkins would like to get the zone changed to do a PUD,
approximately 18 acres, for some townhouses, single family dwellings with the idea
of bringing these streets through to lend with the idea of a PUD. Shuyler's duplexes
would be tied into this back property. Ede have checked with the Fire Dept. and they
have looked to that access as well as this other area."
Hinrichs: "We are going to be very tough about putting any "two-story" anything
behind there. As you are planning that is what you should consider."
Minegar: "We will, that's why we are here for input. LJe haven't drawn a plan yet.
The Pine Street is not deep enough for us to hook m to (must bring from Linder) so
with the cost of running this sewer line in here, to make this available for future
homebuilding, we have got to put more than one house or three and a half house per
acre, And, with the cost of construction going up families can't buy homes.
tde want to get your input on a PUD and change of zoning there."
Mitchell: "hJow,J PUD tells me that there is going to be a little Commercial go in
there."
Minegar: "No Commercial - strictly Residential"
Chairman Hinrichs stated that they needed to come up with the plan and that the City
want's to fill these areas in with such a plan.
There being no other business to come before the Planning and Zoning Commission
the meeting was adjourned at 9:10 P.M.
