Enclosed herein is a preliminary application and drawings of
the proposed Gregory Subdivision No. 2, located in a portion
of the N 1/2, SE 1/4, Nil 1/4, Section 12, T3N, R11,11 B.M., Ada
County, Idaho.
The proposed development is an Urban Residential Subdivision,
developed with pavement, curbs,sidewalks in accordance with Ada
County standards. It will be serviced by Meridian city water
and by public sewers, as well as power and telephone.
It would be appreciated therefor., if you would review this app-
lication in light of your jurisdictional interests, or as the
case may be, right-of-way requirements, and advise this office
at your earliest convenience of your recommendations.

utes of the Ada County Planning and Zoning Commission of the
meeting of December 23, 1968, with reference to Mr. Huskey's
application.
It was noted that his application had failed to include precise
information as to the manner in which his road problems, drain-
age, sewerage and water problems would be solved.
His application was tabled pending information received as a
result of his consultation with the Meridian City Council.

A meeting of the Ada County Planning., and 7onina Commission was
held T?onday, December 23, 1968 at 2 p.m. in the office of the Ada
County Planning and Zoning Commission.
Those members present mere: Parley P. Stanger, Chairman; T.H.
Eberle; Sam Barton; H.S. GThillock; Fred Kopke, Sr.; C. F. Rummell,
George Davis..Also present were: Director Lynn M. P,ogers; Director
Elect; Joseph R. Conner; Barton ti. Ballantyne, planner; and David S.
Shurtleff, Zoning Administrator. Also present was David Zarkin,
representing, the Statesman.
The first order of business c,Yas consideration of Request No.
PC -68 -XI -4 -CUP being a request by C. Ed Trout for Katherine G. And-
erson, for a Conditional Use Permit to develop, maintain and oper-
ate an automobile shopping center under a planned development auth-
ority as provided for in the Ada County Zoning Ordinance and also
in the Ada County Subdivision Ordinance for the following described
property. See description i'_oh-tained in Application File PC -68 -XI -4
CUP.
The Director then read a copy of the staff report to the Comm-
ission, which report and findings and recommendations are attached
hereto and made a part hereof. Present, representing the applicant,
were C. Ed Trout and Bob Ennis. Also James Hessing and Norm Bishop.
After answering questions from members of the Commission, a
motion alas made by C.F. Hummel, and seconded by Fred Kopke, and
unanimously approved by those present approving the application,
subject to compliance with all the conditions set forth in the staff
report.
The second order of business was a request by "rs. Vicki Hart-
well of 2720 S. Maple Grove Road, Boise, Idaho, for a Conditional
Use Permit to operate a nursery school (kindergarten) as defined in
Section 2.087 in accordance with Section 9.409 applicable to prop-
erty lying in a Suburban Residential Zone. Section 24.242 being in
accordance with Section and Subsections 24.1 and 24.2 of the Ada
County Zoning Ordinance. Applicable to the following described
property: See description'in'Agplication File PC -68 -XII -I -CUP.
The Director then read a report of the staff to the Commission
which set forth staff findings and recommendations and which report
is attached and hereto made a prt of these minutes.
A motion was made by Mr. "hillock and seconded by Mr. Hummel,
and unanimously approved that the petition be approved by the Ada
County Planning and Zoning Commission.
The third order of business was PC -68 -XI -2 -SC which waas a re-
quest by Aubrey Robertson for R 8 V Construction, Bruce McRae for
Continental Oil Co., and Dr. Claude L. Brown, owner, for a Zone
change from the classification of Suburban District (D-2) to a
Highway Commercial Zone (C-2) for part of the NGT 1/4 of flection 19
T V , R2E, B.M., lying North of I -80-N Interstate, South of Overland
Road and East of Cole Roade of Ada County, Idaho, the portion there-
of as particularly described, now on file in the office of the Ada
County Planning and Zoning Commission.
The Director then read the staff report to the Commission cov-
ering request, staff findings and staff recommendations, r.hich are
made a part of said minutes and attached hereto. After a series
of questions by the members of the Commission, a motion was made
by Mr. Kopke and seconded by PIr. ?'hillock, and anproved by all mem-
bers of the Commission *with the Exception of Mr. Hummel who voted
no, recommending, that the Board of Ada County Commissioners approve
the request of a zone change from Suburban District (D-2) to a High-
way Commercial Zone (c-2).

The next order of business was an application "To. PC-68-X-2-ZC
being a request by James Stone for a zone change from Suburban
District (D-2) to a Neighborhood Commercial Zone (C-1) for the prop-
erty described as follows: A tract of land consisting of a portion
of LOt 7, Section 6, T31,11 RIE, R.'%, Ada County, Idaho lying North
of U. S. Highway "301 East of Kuna-lieridian Road being as more par-
ticularly described by Metes and Bounds in legal furnished by Johh-
son, Underkofler and Briggs, and now on file with the Ada County
Planning, and Zoning Commission.'
The Director then read the staff report to the Commission, inc-
luding the staff findings and recommendations. In the staff find-
ings it was noted that insufficient information had been presented
to the Commission with respect to the specific area to be developed
in the first stage, and detailed information required in the matter
of irrigation ditches, filling depressed area of the property up to
grade and making other required improvements in respect to drainage,
water for domestic use and fire protection, as well as problems
raised in Sections 23.1,23.2,23.3,23.4 and 23.5 and in sub -sections
thereof as recited in the Ada County Zoning Ordinance. Further
that the applicant hadn't submitted any further information as to
what consideration the City of 'feridian has made as to extending
water and sewer facilities.
A motion was made by Mr. Hummel, and seconded by Mr. Whillock,
and unanimously approved by those present, that this application be
tabled pending information requested for reasons stated in the
staff report.
_,_The next order of business was request No. PC -68 XI-3-ZC by
O.. E. Huskey in behalf of,_himself. and other owners,,,to secure a
request for zone change from Suburban District (D-2) to Limited
Industrual Zone (M-1) for the construction and operation of a
trailer manufacturing plant located on property described as foll-
ows: A tract of land lying in the NW 1/4 of the SE 1/4 of Section
7, T3N, R1W, B.M., Ada County, Idaho more particularly described
as beinm a portion of.Lots 5 6 6 of the Onwiler Subdivision as fur-
ther described in the legal description thereof on file in the
office of the Ada County Planning and Zoning Commission.
The Director read a staff report of said application, said re-
port being made a part of these minutes. In the staff findings it
was pointed out that the site lies adjacent to existing Limited
Industrual Zone (M-1) to the West, and lies in the path of futube
expansion of this area in accordance with the Comprehensive Plan.
However, the applicant has not furnished proof that access is avail-
able to the area from any major arterial, nor has he furnished any
evidence to availability of adequate public utilities services for
health, sanitation and fire suppression.
A motion was made by Hummel, and seconded by Mr. �-?hillock, and
unanimously approved by those present that the application be tabled
pending receipt of further information required.
The next order of business was request No. PC-68-XI-1-ZC being
a request by Paul E. White and Lois 11hite2 husband and wife, owners
of record and contract purchasers, at 3921 N. 36th Street for a req-
uest for a zone change from Urban Residential Zone (R-2) to Highway -
Commercial Zone (C-2) for the property designated as Parcels 1 8 2
being described as follows: ''talo parcels of land lying in the SE 1/4
of the NE 1/4 of Section 29, T4N9 R2E, B.M., Ada County, Idaho being
described as Parcels 1 8 2 respectively and being, more particularly
described iR the certain legal description now on file in the office
of the Ada County Planning and Zoning Commission.
The Director read the staff report to the Commission which was
made a part of said minutes. In the report the staff made note
that subject premises has already been improved by a fine brick
residence. The area is predominately developed by residences in the
Urban Residential Zone (R-2) Subject premises is located on a strip
in an irregular parcel on the Northwest corner. That Hillside Jun-
ior High is adjacent on the East. Subject premises is now consid-
erably below street grade. It is questionable if structural arrange-
ment will permit off-street parking.

Moores Auto and Cycle Shop to the North is a non -conforming
use. That immediately across the road is a vacant residential
property of the Feltwell Subdivision, likewise zoned Suburband Res-
idential (R-2) and that immediately South is Millstead Floral which
is an accessory use in Suburban District (D-2).
The so called Intermountain Delivery merely parks his truck
and has his gas pump on a vacant lot in a Urban Residential Zone
(R-2), but is not using said lot for commercial use. Further,
that subject premises is not located contiguous to Highway Commer-
cial (C-2). Further, that the site is not well located or improved
to service contemplated traffic. That the site is in an area pre-
dominately residential, that the site as zoned would not be an ex-
tension of an existing zone, and any benefits from said zone would
be granting a trade monopoly to subject premises along.
A motion was made by Mr. Barton and seconded by Mr. Hummel,
and unanimously approved by all present, denying request for the
reasons stated in the staff report.
The next order of business was PC-XII-I-ZC being a request for
a zone change by Robert J. Stout, contract buyer, from a Suburban
District (D-2) to a Highway Commercial Zone (C-2) for the property
herein described as being part of S 1/2 of the N[7 1/4 and part of the
N 1/2 of the SW 1/4 of Section 27, T3N, R2E, B.M., Ada County, Idaho.
The particular description thereof being on file at the office of
the Ada County Planning and Zoning, Commission.
The Director read the staff report to theCommission, which re-
port is made a part of said minutes. Mr. Hummel raised a question
pertaining, to lack of control of signs fronting freeways and lack
of information relating, to development pertaining to sewer, water
drainage and adequacy of road to said premises.
A motion was made by Mr. Barton and seconded by Mr. Hummel, and
approved by all present, except Mr. Kopke, who abstained, that the
request be tabled. That the applicant be required to furnish more
exact detailed information as covered in planned development pro-
cedure.
The next order of business was consideration of request Ido.
PC-68-XII-3-ZC by t^r. Arlo Nelson in behalf of American Realty Co.
for a change of zone from Suburban District (D-2) to Suburban Res-
idential Zone (R-4) for a tract of land described as the NTI 1/4 of
Section 22, T3N, RlE, B.M., Ada County, Idaho.
The Director read the staff report and findings pertinent to
said request. Said report being made a part of said minutes. A
motion was made by Mr. Hummel and seconded by Mr. Whillock and unan-
imously approved recommending that the Board of Ada County Commiss-
ioners approved the request for a zone change from a Suburban Dist-
rict (D-2) to a Suburban Residential zone (R-4)
The next order of business was PC-68-XII-2-ZC being a request
by Edward Johnson for Skyline Corporation for a change of zone from
Suburban District (D-2) to Suburban Residential Zone (R-4) for the
following described property: A portion of the SI -7 1/4 of the NT'] 1/4
of Section 26, T4N, RZE, B.TT., Ada County, Idaho being, as particular-
ly described in the Lawyers Title Insurance Corp. Policy No.x733-091
a copy of �,Yhich is on file in the office of the Ada County Planning
and Zoning Commission.
The director read the staff report to the Commission, including
the staff findings and staff recommendations. Said report being made
a part of these minutes. Mr. Johnson in behalf of the developer
indicated that their original desire to pave and curb streets had to
be tabled due to lack of costs and they wish that that part of the
staff report (Paragraph 5) be deleted.
A motion was made by Mr. Hummel, and seconded by Mr. Barton and
unanimously approved by all present recommending that the Board of
Ada County Commissioners approve the request for a change of zone
from Suburban District (D-2) to a Suburban Residential Zone (R-4).
The next order of business was the consideration of Preliminary Plats.

The first item under this order of business being Whispering
Cliffs Sub-0Ndmber�,>2, a. Suburban Residential Subdivision in part of
SW 1/4, Ml 1/4, Section 26, T4Ni R1E, B.ii., Ada County, Idaho.
It was noted that the first stage of proposed development lies
in Suburban Residential District (D-2) requireing a zone change to
Suburban Residential (R-4). That the property fronts Five.Mile
Road, which has been set up on the Major Throughfares Plan as a
major rural arterial and reauires and additional 15' dedication.
Interior street is a 50' minor street. Lots to be a minimum of one
acre. Set -backs as follows: Front - 301, Side 7-1/2', Rear 25'.
Water will be furnished by Private wells. Individual sewage dis-
posal systems, being septic tanks. That the utilities have set
forth their desires in the matter of easements, that should they'
desire to run underground service lines for power, that the poTaer
company would require covenants to meet minimum requirements to run
service lines to each lot on private property. The the State Rec=
clamation had requested a pre -plan for mater and septic tanks. That
the Ada County Engineer had approved preliminary layout for first
stage of development.
A motion was made by Mr. Hummel, and seconded by Mr. Barton
and unanimously approved by those present that preliminary plans
as submitted be approved, and that applicants be required to fur-
nishe information for City -County Health, a street profile plan as
required by the County Engineer and a preliminary title report,
tracings, three prints thereof. Also $25.00 payable to Ada County
for checking said plat. Prior construction of said road or suff-
icient surety to assure such construction. $25.00 for erection of
street sign payable to Ada County Road Department.
The Planning Director submitted a request by J. H. Wise and Son,
Inc., and Dallas Harris for the dedication of a road being 510' long,
50' wide, being designated as Wise Way Road, located partially in
Sections 19 & 30 of T31I, R3E5 R.M., Ada County, Idaho, extending,
from State Highway #21, Southtrest across the U.P.R.R. to the Harris
Truact and being designated as Wise ??ay Road.
The Director noted that he had inspected the road and that Elmer E.
Soniville, P.E., Ada County Engineer, had approved the street pro-
file plan and road as constructed.
A motion was made by Mr. Barton and seconded by Mr. Kopke, and
unanimously approved the Board of Ada County Commissioners accept
said road, and that it be placed on the Ada County Road System.
The next order of business was a letter from Mr. Sumner Johnson,
P.E. of J.U.B. Engineering Consultants for the Star Se�-7er District.
The letter recited the fact that I1r. Seth Redford, County Supervisor
for the Farm Home Administration was demanding a statement from the
Ada County Planning and Zoning Commission setting forth their Com-
prehensive Sewer Plans for rural areas in Ada County or institute
a study and include same in the Master Plan by October 1, 1971.
A motion was made by Mr. 'Jhillock and seconded by Mr. Kopke,
and unanimously approved that the Administrator write a letter to
Mr. Johnson outlining_ study and policy with reference to water pol-
lution problems in urban areas in rural districts for transmittal
to the Farmer's Home Administration.
The next order of business was the review of a request by Chet
Moulton, Director of the Idaho Department of Aeronautics to erect
an equipment storage warehouse on p -wt of Lots 2 and part of Lots
1 6 9 of Block 1 of Country Club Sub. Mo. 4 as said lots are desig-
nated and shown on the official plat thereof now on file in Book 9
Page 436 of plats, Ada County, Idaho.
It was noted that subject premises was in the inner approach
Zone "B" and that such use was not a normal permitted use, and any
further consideration would require a public hearing, and the issu-
ance of a special permit.

A motion was made by Mr. 11hillock, seconded by mr. Hummel, and
unanimously approved that the Administrator send forms for a request
for a special permit and follow the ordinance in the matter of
notification and hearing.
The final item of the meeting was the consideration of the
1969 budget for the Ada County Planning and Zoning Commission.
Many members commented on the fact that the budget was too
conservative with respect to comparative salaries being paid of
which the Director's salary was used as an illustration.
A motion was made by 11r. tdhillock, seconded by Mr. Kopke, and
unanimously approved that the sum of $5,000.00 be added to the
budget and be included under the category of extra help.
A further motion was made by 11r. Barton and seconded by Por.
Kopke, and unanimously approved expressing appreciation of a job
well done by retiring Director, Lynn M. Rogers.
There being no further business, the meeting was adjourned.

REQUEST BY: Mr. 0. E. Huskey, Sr., owner of record in behalf of

PROPERTY DESCRIPTION: A tract of land lying in the NW 1/4 of the
o ec on, 3N, RIE, H.M., Ada County, Idaho, more partic-
ularly described as being a portion of Lots 5 and 6 of the Onwiler
Subdivision as further described in the legal description thereof
on file in the office of the Ada County Planning and Zoning, Commis-
sion.
REQUEST.: The applicant requests a change from Suburban Residential
(R -u) to a Limited Industrial Zone (M-1) for the construction and
operation of a trailer manufacturing plant.
REASON FOR REQUEST: A. This property is in an area where limited
in3usfzial uses are growing. Its proximity to the railroad and
interstate makes it ideal and diminishes its residential value.
B. More industrial zones are needed adjacent
to major transportation facilities.
C. Most properties in similar locations and
surrounding areas are developing for Limited Industrial.
STAFF FINDINGS: 1. An examination of the application, property
ansuppor Ing data shows the request to be in order.
2. The site lies adjacent to an existing, limited
industrial zone (M-1) to the West and lies in the path of future
expansion of this area in accordance with the comprehensive plan.
However, the applicant has furnished no evidence that adequate acc-
ess is available to the area from any major arterial nor has he fur-
nished any evidence as to the availability of adequate public util-
ities services for health, sanitation and fire supression.
STAFF RECOMMENDATIONS: It is suggested that this application for a
zone change beta e y the Commission until the requestor shows
evidence that the items in Paragraph 2 above have been secured.

Enclosed herein is an economic report, together with descrip-
tions of property, map of property, zoning map of the area,
staff findings and minutes of the Ada County Planning and
Zoning Commission meeting pertaining to said request.
It being noted that the applicant had failed to supply the
Commission with full information as pertaining to road pat-
terns, land fills, drainage, stage construction and water
facilities, as well as the ratios of areas allowed for mar-
keting facilities and parking facilities.
In view of the lack of such information, the Commission tabled
said request and have referred said matters to you and directed

PROPERTY DESCRIPTION: A tract of land consisting of a portion of
Lot 7, Section 6, T3N, R1E, B.M., Ada County, Idaho; lying North
of U.S. Highway 30 and East of the Kuna Meridian Road, being as
particularly described by metes and hounds in legal description
furnished by the firm of Johnson, Underkofler and Bri.gvs, now on
file in the office of the Ada County Planning and Zoning Commiss-
ion.
REQUEST FOR ZONE CHANGE: By applicant for change of classification
of subject premises from Suburban District (D-2) to a Neighborhood
Commercial Zone (C-1), as defined in Section 2.038 and in accord-
ance with Section 23.1, and Sections 23.2, 23.3, 23.4 and 23.5 and
Subsection thereunder as recited in the Ada County Zoning Ordinance.
REASON FOR REQUEST: A. It has the size or area needed to meet
the requirements of a shopping center as per the marketing survey.
It adjoins the present City of 'Meridian, a main hioliway arterial
and is in the general vicinity of future growth, both commercial
and residential.
B. There is no area such as this in Meridian
properly zoned as needed. (see remarks as per marketing, survey re-
port.)
C. It will assist the surrounding area due
to its general service nature to the public; both of Meridian and
the rural area.
STAFF FINDINGS: An examination of the documents submitted and of
subject premises and adjacent area reveals the following: (1) That
the applicant is an owner of record. (2) That the 1960 census
for Meridian was 2,081, and including the Meridian County Census
Division 3,180. A house count in 1965 projected the 1965 populat-
ion for Meridian to be 2,142 and including the r?eridian County Cen-
sus Division to be 3,292. (3) That subject premises is strate-
gically located to existing, arterials and to the future residential
growth of Meridian. (4) That it is possible that the rate of res-
idential growth in Tleridian will be accelarated by the opening of
the Freeway I-80-14 between ".levidian and Boise. (5) That the pre-
sent commercial facilities have demonstrated a proven ability to
serve the commercial needs of r-leridian and the environs up-to-date.
(6) That subject premises will require a very substantial sum to
take care of irrigation ditches, and a five foot fill to bring the
level of a large area up to grade and make other required improve-
ments -with respect to sewage, paving, drainage, water for domestic
use and fire protection.
That the applicant has not included evidence of a solution to prob-
lems raised in Section 23.1, and Sections 23.2, 23.3, 23.4 and 23.5
and Subsections thereunder as recited in the Ada County Zoning, Ord-
inance. That applicant hasn't submitted any information as to what
consideration the City of Meridian has given to the matter of ex-
tending water and sewer facilities.
STAFF RECOTMMENDATIONS: That application be tabled pending, receipt of
more definite in ormation to questions raised.
