Spencer; Wayne Crookston Jr.; The Minutes of the previous meeting held October 18, 1982, were approved as written. Agenda 1 MERIDIAN PARK, FINDINGS OF FACT AND CONCLUSIONS: Minimum Sq. Footage Housing The Motion was made by Kingsford and seconded by Brewer to approve the Findings of Fact and Conclusions,; of Law concerning the Meridian Park Subdivision request fora variance on the minimum square footage housing. Motion Carried: Kingsford, yea; Tolsma; yea; Brewer, yea; Orton, yea The Motion was made by Kingsford and seconded by Brewer to deny the request fora variance on the minimum square footage housing requirements by Meridian Park Subdivision. Motion Carried: Kingsford, yea; Tolsma, yea; Brewer, yea; Orton, yea Alan Anderson representing Pleridian Park Subdivison questioned the Council on the possibility of exchanging the square footage requirements on two of the lots. City Attorney, Wayne Crookston explained that in order to do this, they (Meridian Park Sub.) would have to ~o through the hearing process. This would be considered a change to the Plat. Agenda 2 MERLE LARSEN, FINDINGS OF FACTS, CONCLUSIONS OF LAW: Conditional Use Permit for Beauty Salon 1 Full-time, 2 Part-time Operators The Motion was made by Kingsford and seconded by Tolsma to approve the Findings of Fact and Conclusions of Law concerning Merle Larsen's request fora conditional use permit for a beauty salon with two full time operators. Motion Carried: Kingsford, yea; Tolsma, yea; Brewer, yea; Orton, yea The Motion was made by Kingsford and seconded by Orton to approve the request for a Conditional Use Permit by Merle Larsen for a Beauty Salon with 1 full time operator, Two Part-time operators, with no.more than 2 operators working at one time. Motion Carried Kingsford, yea; Tolsma, yea; Brewer, yea; Orton, yea Agenda 3 PUBLIC HEARTNG: Brooklawn Farm Estates Mobile Home Park Subdivision Dick Johnson Surveyor for Brooklawn Farm Estates was present representing. Johnson: "What we are proposing is a two phase Mobile Home Park Subdivison." "The main questions and concerns up to now has been the access off of Linder." "We have talked to Gus Hein, and he stated he would want an ane access off of Pine Street, and no access off of Linder."~ Dean Rule also representing Brooklawn Farm Estates stated that this will be an adult park, basically a retirement park. Rule stated that it would be about one year between phase one and phase two. "There are alot of people interested in it." Councilman Tolsma stated his fears on the one way access into the Park in case of fire. "There almost has to be a loop or someway to get in and out of there." • • Meridian City Council 2• November 1, 1982 Agenda 3 - PUBLIC HEARING: Brooklawn Farm Estates Mobile Home Park Sub. Cont'd . The r4ayor called for comments from the Department heads. Gary Smith, City Engineer stated that he had several concerns after reviewing the Prelimary Plat. Smiti~: "I would like my comments read into the minutes." "1 .. Direction of street drainage - How is runoff to be handled? 2.; Right of Way requirement by Ordinance is 60', 3. Cul-de-sac or dead end street shall be no longer than 400', 4. direction of sanitary sewer and domestic water service and connection to City Lines, 5. Ordinance also requires the tiling or fencing of irrigation ditches, later~~s, or canals, 6. Front yaxd setback 25', 7. Owner of land adjoining to the East, 8. Nampa=Meridian Land Use Change and Drainage Resoi:ution adopted March 17, 1980, that should be gone over." Rdger Welker; Fire Chief stated that he has the same comments that he had listed on the comment sheet before. "Too many Mobile Home Parks now. Loop water main. Two entrys, one off Linder. Fire Hydrants shown. Size and placement of water mains. No parking in Culdesacs & entrances. Street names for culdesacs." (Comment sheet on file, City Clerk's Office, Brooklawn Farm Estates File) Councilman Tolsma questioned the possibly of a temporary turn-a-round at the end of the street until the loop coufid be completed. Dean Rule stated that it could be done that way. Mr. Johnson question the possiblity of a variance on the 5' sidewalk requirement to 4'' Kingsford stated that the Council had :adopted a policy several years ago, to no longer grant a variance on the 5' requirement. There was discussion concerning the sidewalk requirements. (Tape on File, City Clerk's Office) Councilman Brewer stated that he felt as if the City Engineer, Gary Smith, had several questions that he would liked answered. Smith stated that several of these things could be remedied by a variance to the Ordinances. "There are some~.things that are lacking from the preliminary Plat, that I would like to see answered." Mayor Glaisyer: "This is a Public Hearing, I will now open the Public Hearing for Brookl~.wn Farms Estates Mobile Home Park. Is there anyone present that wishes to make a comment pro or con?" There was no response. Glaisyer: "Being there no Public comment, I will now close the Public Hearing on Brooklawn Farms Estates Mobile Home Park." The Motion was made by Brewer and seconded by Kingsford that the Council table the request by Brooklawn Farm Estates Mobile Home Park until the next stated meeting which is November 15th, 1982. Motion Carried: Kingsford, yea; Tolsma, yea; Orton, yea; Brewer, yea; Agenda 4 PUBLIC HEARING.- Conditional Use Permit for Insurance Office; Lee Sells, 1323 E. 1st Street Lee Sells was present representing his request for an Insurance Office to be located at 1323 E. 1st Street. Sells stated that they will be living in the house immediately and wish to remodet the existing barn in the back into an insurance Office. Sells also stated that there is an existing circular drive, to be used as an exit and entrance, and that there is ample parking in the back. Sells explained that the area behind the office is to be landscaped into a park, and that the existing trees now located in the parkway would be moved to that area. Vernon Schoen, Building Inspectmr stated that the remodeling of the barn must meet all city codes. There was discussion concerning the remodeling of the barn. Kingsford questioned Sells on the number of signatures received. Sells stated that he had 100% of the signatures of neighbors. Earl Ward, Wastewater Supt questioned if there would be any changes in the existing sewer lines. Sells explained that it will be used as it now exists. There will be seperate lines to the new structure. Bruce Stuart, Water Supt stated that there will be an additional hook-up charge on the back building. Mayor Glaisyer: "I will now open the Public Hearing on the request fora Conditional Use Permit for an Insurance Office by Lee Sells, at 1323 E. 1st Street." "Is there anyone in the audience that wishes to make comment either pro or con?" There was no response. Glaisyer: "Being no comment, I will close the Public Hearing." The Motion was made by Brewer and seconded by Orton to approve the Findings of Fact and Conclusions of Law for an Insurance Office for Lee Sells at 1323 E. 1st Street.' Ptotion Carried: Kingsford, yea; Tolsma, yea; Orton, yea; Brewer, yea; The Motion was made by Brewer-and seconded by Orton that the Council approve the request for Conditional Use Permit for an Insurance Office by Lee Sells, providing that all City Codes be met on the remodel of the Office building, and that the architectural design of the area be maintained; the removal of the trees in the parkway in front of the residence; that the sign ordinance be followed, and that any and all changes to the property meet City Ordinances. Motion Carried; Kingsford, yea; Tolsma, yea; Orton, yea; Brewer, yea Agenda 5 ENGINEERING REPORT - City Engineer; Gary Smith Gary Smith presented to the Council the request from EPA=for reimbursement of $5,116.00 which was disallowed on the HUD Grant.- Smith explained that the Corp of Engineers had aduited all of the Grant material submitted for payment and had disallowed some items.that were not grant eligable. Smith stated that they are requesting this amount be paid within 30 days from the date of the letter, which was October 12, 1982. Smith went on to explain that part of this amount was a power bill that was not eligable. There was much discussion. (Tape on File; City Clerk's Office) Smith explained that he had pursued payment for several of the disallowed items, bJt they were still disallowed. Councilman Orton questioned the authority of EPA to pay the items presented and then to disallowed the payment of them and ask the City for reimbursement of the payment. (Tape on File; City Clerk's Office) There was more discussion concerning the items disallowed. (Tape on File; City Clerk's) The Motion was made by Orton and seconded by Tolsma to request a time extension on the payment of the $5,116.00, and to request item by item documentation on the disallowed items, and an explaination as to why these items were disallowed. November 1,`1982 Agenda 6 NOTICE OF PUBLIC HEARING Mayor Glayiser announced Notice of Public Hearing for Second Public Hearing on the Comprehensive Plan, and First Hearing for Quong-Watkins Properties Annexation, was set for November 22, 1982. Mayor Glaisyer requested that the Council Members check their calendars fora date that would convenient for the Area of Impact Hearing. Agenda 7 BILLS The bills were read. The Motion .was made by Kingsford and seconded by Tolsma that the bills be approved. Motion Carried: Kingsford, yea; Tolsma, yea; Orton, yea; Brewer, yea; Agenda 8 Council. Reports Councilman Brewer questioned as to if the Council was planning to set up a workshop at some point in time to go over the Hearing Officer's and the recorder's minutes concerning the Quong-Watkins Properties Annexation, and the Comprehensive Plan. Mayor Glaisyer: "Yes." Councilman Brewer also reported that he had attended the regular meeting of the Senior Citizens, and had expressed the regret of the Council and Mayor on their getting passed over on their grant request for a Senior Citizens Center. "I believe that they took it very well. They are sti11 flying high, and ready to go." Councilman Brewer: "Ts it still the City Clerk's wish to resign as of the 1st of Dec.?" City Clerk, LaWana Niemann: "Yes-Sir." Councilman Orton: "Does the Council want me to go any further on this joint powers agreement for street lighting?" Kingsford: "T would like to see you work with Mr. Grant. (Jim Grant, Idaho Power) and get whatever information he may have concering that." 7~here was discussion. (Tape on File; City Clerk's Office) Councilman Tolsma.announced the QRU Auction to be held on November 4, 1982 at the Creamery Building. Councilman Kingsford asked Attorney Crookston to check into any problems concerning the leasing of the excess land at the .Sewer Treatment Plant. Crookston stated that he would .take a look at it. °I don't forsee any problems." Agenda 9 Engineering Statement No. 9 The Motion was made by Kingsford and seconded by Tolsma to approve payment of J-U-B Engineering Statement No. 9 in the amount of $1,713.93.
