Minutes of the previous meeting held December 6, 1982 were approved as written. Agenda 1 Bid Opening on Van for QRU Mayor Glaisyer announced that there had been 3 bids received for the QRU Van. Mayor Glaisyer opened the first bid from Meridian Ford in the amount of $9,667.00. Meridian Ford included a Cashiers Check for their bid bond. Mayor Glaisyer opened the second bid received from Bob Rice Ford. The bid amount was $9,311.47. A bid bond was included. The Third bid that was opened was from Edmark Chevrolet in the bid amount of $9,560.00. Bid bond was included. Mayor Glaisyer: The low bid is apparently Bob Rice Ford. I would ask that the Council takes this under advisement, and we can present the bids to Roger Welker (Fire Chief) which he can review before the Council adjourns tonight, before the final decision is made in accepting these bids." The Motion was made by Orton and seconded by Tolsma to take.~the 3 bids on the QRU Van under advisement and have Roger Welker report back on the acceptability of the bids to the Council later in the meeting. Motion Carried: Tolsma, yea; Orton, yea; Brewer,yea Agenda 2 Floyd Ayers - Kirshner Moore & Company; Imput Floyd Ayers ot€ Kirshner Moore & Company and Lyman Belnap attorney for Kirshner Moore & Company were present fora question-answer session concerning the Economic Development Corporation of the City of Pleridian. Mayor Glaisyer's comments were that the Mayor should be the President pith one Council- Member on the board, and that the Mayor should appoint two members from the Community at large, that would be confirmed by the Council. There was discussion. (Tape on File City Clerks' Office) Ayers answered several questions concerning the Corporation given by Attorney Crookston. (Tape on File City Clerks' 'Office) It was concluded that Ayers would have new documents drawn up with the changes discussed and that Attorney Crookston would work with him. Attorney Crookston stated that he would ~r~efer more time to go over the documents for any other changes he felt were needed. Councilman Orton suggested that the name be changed to Meridian Economic Development Corporation if there were no conflicts with other Corporations. The. Council was in agreement with Orton. • L' Meridian City Council 2. .December 20, 1982 Agenda 1 Contd. - Bid Opening QRU Van Roger Welker reported back to the Council on the Bids for the QRU Van. Welker: "Edmark Chevrolet did not meet specifications." "Both of the other bids (Meridian Ford & Bob Rice Ford) meet the bid specifications." Mayor.Glaisyer: "City Council Members, the bid from.Ed~na~rk ChevroTet~~has°been disc qualified. We have two bids one from Bob Rice Ford in the amount of $9,311.47, and Meridian Ford is $9,667.00 Councilman Orton: "We are required to take the low responsive bid." The Motion was made by Orton and seconded by Tolsma to accept the low bid from Bob Rice Ford in the amount of $9,311.47 for the QRU Van. Motion Carried: Tolsma, yea; Orton, yea; Brewer, yea Agenda 3 Emmett Bridge: Imput on Eonverting Home to Tri-Plea Emmett Bridge was present to receive approval from the Council to convert the home at 103 West Washington into a Tri-plex. Bridge presented the Council with the signatures of the neighbors in the immediate area showing that there was no objection to the conversion. Bridge also presented a diagram showing the off street parking. Vern Schoen, Building Inspector, explained that there were no variances required for the conversion, and that the home was properly zoned. Schoen stated that he felt this should have Council approval however, since there would be a change in the density~in the Comprehensive Plan. The Motion was made by Brewer and seconded by Orton to approve the request by Emmett Bridge for the conversion of the home at 103 W. Washington into a tri-plex. Motion Carried: Tolsma, yea; Orton, yea; Brewer, yea Agenda 4 Pre-Termination Hearing Water/Sever/Trash Delinquencies Mayor Glaisyer read: "This is to inform you in writing, if you choose to, you have the right to a pre-termination hearing, at 7:30 p.m., December 20, 1982, before the Mayor and Council, to appear in person to be fudged on facts and defend the claim made by the City that your water, sewer-and trash bill is delinquent. You may retain Counsel. This service will be discontinued December 28, 1982, unless payment is received in FULL." Mayor Glaisyer: "I there anyone present that wishes to have a pre-termination hearing before the Mayor and Council at this time?" Wilma Blair, was present to request'ahat she be allowed to pay l/2 of her billing on December 23, 1982 and the other 1/2 on January 3rd, 1.983. The Motion was made by Orton and seconded by Tolsma that Mrs. Blair be allowed to pay 1/2 of her billing on December 23, 1982 and the second half on January 3, 1983, to bring her current. Motion Carried: Tolsma, yea; Orton, yea; Brewer, yea Mayor Glaisyer: Due to their failure to pay their water bill or to present any valid reason why the bill has not been paid, their water shall be turned off on Dec. 28, 1982. In order to have their water turned back on, there will be an additional fee of $10.00. They are hereby informed that they .may appeal or have the decision of the City Council reviewed by the Fourth Judicial District Court, pursuant to Idaho Code. Even though they appeal, the water will be .shut off. The Motion was made by Brewer and seconded by Tolsma to approve of the termination of Water/Sewer/Trash delinquencies on December 28, 7982. December 20, 1982 Agenda 5 Ordinance 316A Mayor Glaisyer read Ordinance 316A "An ordinance annexing and zoning certian real property which is described as being located in Section 11, T. 3N., R.1W., B.M., Ada County, Idaho, to the City of Meridian which property is adjacent and contiguous to the City of Meridian, Ada County, Idaho." Glaisyer: "Is there anyone present that wishes Ordinance 316A read in its entirety?" There was no response.. The Mot ion was made by Brewer and seconded by Tolsma that the rules and provisions of 50-9002 and all rules and provisions requiring that Ordinances be read on three different days be dispensed with and that Ordinance Number 316A as read be passed and approved. Motion Carried: Tolsma, yea; Orton, yea; Brewer, yea Agenda 6 Ordinance 418 Mayor Glaisyer read Ordinance 418 entitled: "An ordinance amending Title VII, Chapter 5, or the revised and compiled ordinances of the City of Meridian, Entitled Health and Sanitation, Sewer, Use, by amending sub-sections (A) and (B) of Chapter 5, Section 7-533 to show and increase effective January 15, 1983, in the minimum sewer use charge and in the charge for use 'in excess of four thousand gallons per month." Glaisyer: "Is there anyone present that wishes Ordinance 418 read in its entirety?" There was no response. Glaisyer Mayor Glaisyer presented the biY1 from Western World Insurance Company i'n the amount of $500.00. This is for the clam of Quong-Watkins Properties against Mayor Glaisyer. This is the retention due on the claim. The Motion was made by Brewer and seconded by Tolsma to approve of payment of the retention in the amount of $500.00 to Western World Insurance Company, due to the claim against Mayor Glaisyer as the Mayor of the City of Meridian. Motion Carried: Tolsma, yea; Orton, yea; Brewer, yea Agenda 8 Gary Smith, City Engineer - Water Rehabilition Project HUD Grant Gary Smith, City Engineer presented the Council a recommendation of.~payment to the Contractor in the amount of $16,319.84. This figure includes two change orders for a reduction in cost. The Motion was made by Brewer and seconded by Tolsma to approve of Change Order 3 in the amount of (-).$485.14 reduction in cost. That Title VII, Chapter 5, Section 7-533, shall be amended by increasing the minimum sewer use charge and the charge for use in excess of four thousand gallons per month as set forth in sub-sections (A) and~(B) of said Section 7-533, as follows: 7-533: SEWER USER CHARGES AND CONNECTION FEES: (A) The minumum sewer user charge shall be seven dollars thirty cents ($7.30) per month, .based on .a use of four thousand (4,000) gallons. (B) The charge for use in excess of four thousand (4,000) gallons per month, shall be the minimum amount o~f seven dollars thirty cents ($7.30), plus an additional. charge of one dollar twenty cents ($1.20) per one thousand (1,000) gallons or portion thereof above the four thousand (4,000) gallon minimum.
