I~iayor Glaisyer: "Public Hearing for Elr. Reynold Schenck's Replat is now open."
Reynold Schenck: "Basically what we are trying to do is remove the old house which
is sitting right in the middle. The property at the current time is two (2) lots
it's split on the State Street side, making it too small to build or put another piece
of property on it. We are trying to utilize the ground to an optimum and put a four
unit townhouse, which we will sell, rather than having them as rental units. We feel
if we sell each unit they will take better care of them than if they were rentals.
Ode are requesting having the property facing, the units facing, the 5th Street side.
These units are right around 1400 feet, ? and 3 bedrooms units and will se}1 for
right around X57,000 each. Plow because being able to put the four of them on there,
the bedrooms being upstairs,so we will be able to get for sq. footage for the money.
People can get started into a house fora half-way decent price."
Mayor Glaisyer: "Any questions from the Council?"
Councilman Orton: "I am wondering about the Pdotion made by Planning & Zoning -
"setbacks be proper, irrigation ditches be tiled or screened; that a reserve be
established to cover the cost of exterior maintenance, that the agreement include
some means of arbitration to settle disputes" - what is that business about "settle
disputes?"
Schenck: "What I understand from the gentlemen that brought that up, he was worried
that we would have one person, let's say in there, that they decide they need to do an
exterior maintenance - everybody's agreed to it except one person. He may say he
can't pay for it or they want the exterior to be painted orange - so what he is trying
to say is that something be set up in order that everybody has to agree to this and
it will all be one color, the exterior, the maintenance and everybody will have the
money in there to provide for maintenance."
Orton: "That's on the attached buildings?"
Schenck: "They are all one unit - so what they're saying is to keep them all basically
the same. Each person will own his separate unit but they can't have one orange and
the other brown, whatever the case may be."
Councilman Orton: "You are in what is called "Cottage home Addition"
Schenck: "Yes"
Orton: "Are there any restrictive covenants on Cottage Home Addition that would
preclude this type of development?"
Schenck: "To my knowledge, no. From what I understand is that everything must flow
with the rest of the Subdivision - the setbacks must be in a good line. Across the
street we have a tri-plex, just kitty-cornered on the other side of the road, which
is single leveled."
Orton: "What density does this development result in? ~;Jhat is the density in terms
of units per acre?"
Schenck: "I don't know to calculate out to you. It's just under 15 (upa)"
Councilman Tolsma: "You're prepared to conform with Ada County Highway District?"
Schenck: "I have no problem with that one, sir."
Councilman Iingsford: "Hova do you stand with the Highway District in regard to
the Franklin project?"

Schenck: "I made them an offer on the last one which basically, beings they had
bought the triangle from the neighbors, and they are going to put in a turn signal
in there eventually - I made the offer that I would give them the triangle, I had
no problem with giving them the triangle because they are going to put in a turn
signal - if they would back up on the rest of it because they don't need it until
they widen the road. They told me all or nothing, so I was easy to get along with-
I told him nothing. And that's where we stand at this point. I made an offer to
give them that property on the corner but I wouldn't give them the rest of it until
widening of the road later - that is where that ended."
Mayor: "Are there any other questions of this gentlemen at this time?" Plo response
"If not, 1~1r. Schenck, please have a seat and I will ask for public comment from
the audience. Is there anybody from the audience that wishes to make comment?"

Mayor Glaisyer: "I will close the Public Hearing."
There was discussion concerning the filing of the Final Plat.
Councilman Orton called the filing requirement to Mr. Schencks' attention.
lie stated that this would require some surveying, mapping, drawings on certain type
of materials, signed by people of the City and County and filed with the Ada County
Recorder. So, if we made a Motion tonight we would be simply approving the concept
through some later date."
The Motion was made by Kingsford that Schenck Replat be tabled until the actual plat
has been looked at.
Councilman Orton: "lie could have a conceptual approval - we've done that before -
but we can't approve Replat. I think the gentlemen would hate the position of going
to the work of the Plat now, which will be substantial work and then for some reason
have it denied."
Gary Smith, City Engineer: "Let me read the definition of Subdivision from the
Ordinance: "The word Subdivision shall mean the division of the developed, or un-
developed tract, or partial,planned in three or more parts for the purpose vahether
immediate or future of sale or a building development." So, this constitutes a Plat."
Schenck: "There are already two parts there - does that make any difference?"
Councilman Crton: "That's a tract and you are dividing that into four pieces."
Attorney Crookston: "He has to file a Replat. Not only is it in our Ordinance but
when you break a parcel into three or more, subdivide or break into any parcels of
ground three or more - the County is two or more - and the reason that they want you
to do it is because you have a real tax problem in taxing those parcels of ground
where they are resold without having, as Grant said, a separate description for each
one. Even though those two lots are part of Cottage Home Addition, he has to file
in plat, or a re plat, of those two lots showing further breakdown."
Councilman Orton: "I would riove that we except the concept as submitted this evening
under the same conditions as the Planning and Zoning Commission recommended for
approval."

Agenda Playor Glaisyer presented a bill from Layne of Idaho, Inc. for the purchase of
'' a complete well, pump, pump house and wiring as Der agreement and partial payment
of $10,000 12.18.81. Purchase price was $30,203.00 balance owed $20,203.00.
Piayor: "The balance was pending interest rates and terms between the City and
Layne of Idaho - I have met with them and we could not come to terms and I would
recommend that the City go ahead and nay this off.. The City can make more money
investing that working with them."
CounciLnan Orton: "Do we dray: this money from Capital Reserve Fund that we have
set up over the years through our water and sewer?"

The [lotion was made by Rick Orton and seconded by Grant Kingsford to finalize the
bill from Layne of Idaho, Inc. in the amount of $20,203.00 for complete well, Dump,
pump house and wiring as per agreement for the purchase of well located in
Locust Grove Industrial Park.

Mayor Glaisyer presented an Idaho Power bill forwarded to the City for the period
since partial payment of $}0,000.00 December 13, 1981. Power bill in the amount
of $31.60 for Locust Grove Industrial Park well.
The Plotion was made by Kingsford and seconded by Orton that the Council approve
payment of Idaho Power bill for Domestic blell located in Locust Grove Industrial
Park, power charge due since purchase of the well in the amount of $31.60.

5 Department Reports:
Vern Schoen, Building Inspector, presented the Mayor and Council with copies of
ADMI[JISTRATIVE, Part I, 1979 Edition of the "Uniform Building Code"
Scheon: "You have all read my letter - there are certain State regulations that
must be followed in the "Bible" as Councilman Brewer called it. Councilman Brewer,
no way am I educated or qualified to do your job as a F1ortician. I'm sure your
regulations which by lay: you must follow as I do. I sincerely doubt that you can
get by, by using water in place of embalrn~t fluid. Councilman Orton, I'm not an
Engineer but I do have check some engineering p9ans I would like to point out
sori:ething that happened in this City, several years ago - another Council and
another Mayor. Schoen demonstrated by diagram an~Ennineer's request fora breakaway
from Code standards,"in regard to a trench in place of a foundation. It's fine on
paper but was a proven fact-that out on the job it would not work. These are some
of the problems that Schoen arrives at - you have Engineering approval to be
satisfactory but in the field - it will not work. The Playor and the Council at that
time stood behind him. "Councilman Tolsma, I'm not qualified to make decisions
on auto mechanics as you are." "Councilman Kingsford, I'm not qualified to teach
school either, however, I could conduct a class on the Building Code and Life
Safety Code." "Mayor Glaisyer, [•Jeither am I qualified for your position in finances,
but what I'm trying to point out is, I am a qualified Class A Building Inspector,
licensed in the State of Idaho, which I feel should have some merit in my being able
to perform my job in a fair and impartial manner." "In one place in the Code Book
it speaks of the "Board of Appeals" - "there shall be, and hereby created, a Board
of Appeals consisting of members who are qualified by experience and training to
.pass upon matters pertaining to building and construction." "I feel that the Council
should either appoint somebody in this body, with this as a guide rule - to answer
some of these things so that they do not have to come to Council except on final
decisions. The other thing I would say is that if the Council wishes to - to answer
decisions - I think the first part of this Code that is redlined and I think the

Council should read these so they can understand what they are answering. That is

Mayor Glaisyer: "Thank you, Vern."
Earl Ward, Wastewater Supt.: "I have a reward'I would like to present. Dan Grogg,
would you please come forward? Dan Grogg is one of my operators and he has been
selected by his peers and the Southwestern State of Idaho as Operator of the Year."
Ward presented a plaque to Grogg and there was applaud of appreciation.
Sewer Commissioner Grant Kingsford: "Dan, it gives me great pleasure to present your
Class II Operators Certificate. I know you have spent a great deal of time and effort
and at the same time the Chairman of Idahd's Chairman - Earl Ward - is in our audience
tonight - the City of Meridian is honored to have this man's certification also."
Gary Smith, City Engineer, presented a bill for Council's approval fora measuring
device purchased by Earl Ward for the Wastewater Treatment Plant in regard to the
HUD Grant, Sewer Rehabilitation Program. Smith stated that this is used for field
measurements for locations of service stubs for Engineer preparation of contract
documents.

bill from Idaho Blueprint & Supply Co., in the amount of $73.95, HUD Grant eligible
Sewer Rehabilitation Project PJo. B-81-DN-16-0001.

City Engineer, Smith presented a form from the United States Department of Interior
for an easement across their property in order to get sewer line from Bethavin Sub.
into the Interceptor along fJine Mile Creek. These form have been reviewed by
City Attorney Crookston and there did not seem to be any problem with them.
The Motion was made by Kingsford and seconded by Tolsma that the Mayor be authorized
to sign the documents of the United States Department of Interior for an easement
across their property for sewer line from Bethavin Subdivision into the Interceptor
along Nine Mine Creek.

Orton, abstained
City Engineer reported on a letter received by the City from the State of Idaho
Highway Department concerning any possible participation of the City for
Federal-aid Urban Highway Funds. Smith reported that"in the same letter the City
has a project, designed and approved, for Cherry Lane Road. The City receives
$63,000 from the State for Fiscal Year Apportionment - if the City has a project.
The Cherry Lane project is scheduled for the later part of 1982 - Fiscal Vear 1983.
Smith stated that part of the project would have to do with storm drain construction.
About $270,000. The local share would be $24,0004 "If the City doesn't participate
the project most probably will go back on the shelf and re-distribute the money
again. The $240,000 cost is more than the Federal Aid amount that the City will have
accumulated by that time and what it does is put the City as a deficit - the City
cannot enter into another Federal Aid program until that deficit is cleared up."
"It would take until 1986 to erase that deficit on this particular part of the program."
Mayor Glaisyer stated that Mr. Sacht had stated that Meridian could expect no more
funds of this type, because of the North curve improvement, until the City came out
of deficit. "Our portion goes directly to the Ada County Highway District,"so it
would be their (ACRD) contribution - not the City of Meridian's."
Smith stated that the State of Idaho Highway Department should have addressed this
letter to the Ada County highway District and would contact Gary Funkhouser, ACRD.

When I entered the Meridian City Council doom on the
evening of Jan. 25th little did I realize that I would be
subjected to a barrage of questions with little or no time
for an adequate response.
The statement by Mr. Sewald that the city was "dragging
their feet" by not granting a permit is not true. In fact
any delay may be due to Mr .. Sewald's failure to inform the
architects of the scope of his-plan of operation, so that
complete plans and drawings could be submitted to the various
city departments.-
On Jan 7th, I met with Mr. Sewald architects Brynn r3mith
and Larry Sundell~ Fire Inspector Ray Voss and State Electrical
Inspector Von Srehorst tG~work with and ad rise Mr. Sewald on
ways tar, upgrade his operation with the least cost to hima
The next time that 1 saw anyone connected with Mr. Sewald
was on Jan..l8th when Larry Sundall came to the office to Rive
me the last set of plans. One sst went to each of the follow-
ing departments: Fire Department, Public Works Department,
and Sewer Department.
Although the last set of plans were very inadequate,

I received a letter from Fire Inspector Ray Voss stating
their requests.. Since then I have received letters from
Earl Wards Supt.. of Sewer Dept., and Bruce atuart~ Supt, of
Public Works Dept. both stating they needed more information
and drawings on the plans before they could finish their
cost sheets.. This revenue is collected at the same time a
building permit is issued.
I feel a- Temporary Certificate of Uccupancy should not
have been issued especially where there are so many loose-
ends~ such as lack of heats watery sewer or even an appli-
cation for a building permit.
Rarely can a Temporary Certificate of Uccupancy be
given Before a building permit is issued and then only where
a very small amount of re-modeling is needed.
Zn recent months many variences from Meridian City Codes
and Ordinances have been allowed. What can you suggest that
would be fair to everyone (cost-wise) and still adhere to the
safety and welfare of tk,e public in commercial and industrial
buildilJ@s?

ORDINANCE N0. 403 •
AN ORDINANCE AMENDING TITLE 3, CHAPTER 16, OF THE REVISED AND
COMPILED ORDINANCES OF THE CITY OF MERIDIAN, ENTITLED WINE, BY
ELIMINATING THE PROVISION FOR REDUCED FEE WHEN A LICENSE IS ISSUED
DURING A LICENSE YEAR.
WHEREAS, the City Council and the Mayor of the City of
Meridian have concluded that it is in the best interest of said
City to amend Title 3, Chapter 16, Section 3-1605, Wine,
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO:
Section 1. That Title 3, Chapter 16, Section 3-1605, Wine,
shall be and the same is hereby amended by eliminating the provision
for reduced fee when a license is issued during a license year, and
Section 3-1605 shall read as follows:
3-1605 LICENSE FEE: The license fee imposed and collected
shall be the sum of Two Hundred Dollars (5200.00) per
year. Such license year shall be from 12:01 A.M. January 1 through
12:00 P.M. December 31; that the license fee of 5200.00 per year
shall be paid in full regardless of the date of application for the
license.
Section 2. WHEREAS, there is an emergency therefor, which
emergency is declared to exist, this ordinance shall take effect and
be in force from and after its passage, approval and publication as
required by law.
PASSED by the City Council and approved by the Mayor of the
City of Meridian, Ada County, Idaho, this 1st day of February, 1982.
