Scout Leader, Alden Carpender, stated they were attending the City meeting to learn rnore about citizenship and communications for merit badge reouirements. t9ayor Glaisyer commended the City/Rural Fire Department on the "excellent job they did with the fire at Storey's Feed and Seed". "It was a fire that we wish we had never had but it was beneficial with the response that they had and the type of job they carried out. I know the other fire departments, that are manned full time, were extremely satisfied with our performance. So - to you Roger (!•Ielker), to Skip (Voss) and to all the Meridian Volunteer Firemen, I extend great words of commendation. It is a credit to the community to have you." Fire thief Welker: "Thank you, we appreciate this." P~iayor Glaisyer: "I would also like to extend gratitude and thanks to the Meridian Chamber of Commerce, especially Terry Smith who was the Chairman for the Eagle Road Interchange on the Transportation Department Committee of the Chamber. Terry did an outstanding job - he was fully dedicated to this cause and I think the representation that the Chamber had at the two public hearings is, again, a credit to our community. Bill (Brewer, would you please convey these words to your Chamber and to Terry Smith?" Councilman Brewer: "Thank you, Mayor Joe." Agenda p•1eridian Family Practice Clinic 1 Dr. Jud Miller was present to make known that the Family Practice Clinic was coning to Meridian. Ur. Miller stated that they are affiliated with the University of Washington and St. Alphonsus Hospital. They are a family practice training program where family doctors, M.D.'s coming out of medical school, come to this program for three years and receive extra training in the area that family doctors need to know about - such as internal medicine, pediatrics; obstetrics, etc. They differ from a general practioner in such that a general practioner out of medical school goes through a year of internship and goes into practice. They go two years beyond that in this special training. They are fully licensed to practice in the State of Idaho and until recently have been largely funded by the State - but now the bull: of their funds come from St. Alphonsus Hospital, and small portion from St. Lukes Hospital. There are to be six residents in each year of training - the first year residents the first ones out of medical school. The Meridian Clinic will be almost completely staffed by the third year residents. The purpose is to gain more experience in a small ccr°,; :unity medicine. Their address is 925 East First Street and will be receiving pa tie:rr~~s the following week. Dr. Miller announced there would be open house 3:00 P. hl. to 8:00 P. M. Agenda 2 Fire Truck - bid Approval and Documentation for Lease Agreement The Motion was made by Councilman Ron Tolsma and seconded by Councilran Grant Kingsford that 9layor Glaisyer's recommendation of the following be approved: One (1) Pierce 1500 GPM Custom Pumper with 750 Gallon Booster Tank, powered by Detroit 2V92TA Diesel Engine, F.O.B. Meridian, Idaho be purchased from STARLIfJE EQIJIPMEiVT COMPANY, Boise, Idaho, Cost total $134,335.00 (GPJE HUNDRED THIRTY-FOUR THOUSAfJD, THREE HUNDRED THIRTY- FIVE DOLLARS AfJD NO CENTS) (Meridian City Hall March 1. 1982 (Agenda 2 (Cont'd) Fire Truck - Bid Approval and Documentation for Lease Agreement............ The lease will commence upon acceptance of the equipment by the City of h1eridian and the Meridian Rural Fire District. and continue for five (5) years beyond such date of acceptance; Lessee will make five (5) consecutive annual payments, one (1) at $33,585.00 each, and four (4) at $31,955.86 each, payable in advance. Annual percentage rate of 10.25%; and those authorized to sign the agreements are Joseph L. Glaisyer, P~1ayor and Ed Davis, Chairman of the Rural Fire District; and .the Dealer Vendor would be Starline Equipment Company with THE IDAHO FIRST NATIONAL BANK as the financing entity. Motion Carried: Kingsford, yea; Tolsma, yea; Brewer, yea; Orton, yea Agenda 1980-1981 Fiscal Year Audit 3 The Motion was made by Grant Kingsford and seconded by Bill Brewer to adopt the 1980/1981 Fiscal Year Audit conducted by RIPLEY, DOORN & CO., CPA's. Plotion Carried: Tolsma, yea; Orton, yea; Brewer, yea; Kingsford, yea Agenda 1{EARIhdG - Water/Sewer/Trash Delinquencies 4 Mayor Glaisyer read the TURN OFF PJOTICE to the public: "This is to inform you in writing, if you choose to, you have the right to a pre-termination hearing, at 7:30 p.m March 1st before the Mayor and Council, to appear in person to be judged on facts and defend the claim made by the city that your water, sewer and trash bill is delinquent. You may retain counsel. This service will be discontinued Thurs. 4th, 1982 unless payment is received in full." Mayor Glaisyer: "Is there anyone here tonight that wishes to appear regarding your water, sewer and trash bill?" Steve Minnis, 730 West Broadway: "The reason I have chosen to appear rather than pay this bill, is because I have tried to go through the proper channels. I think there has been an error with my bill. I live in a condominium complex at the end of Broadway - used to be an apartment complex and has been converted. I assume when it was converted the water was individually metered. My bill was fairly consistent throughout the first two years I lived there and through circumstances of employment I have moved to northern Idaho for approximately a year and a half. I still own the house and was locked up unoccupied. There was a 90,000 gallon error that was due to some leakage - I guess that was corrected. Since then there has been problems of sedimentation, I've come here - I've called and I was told to take care of that on my own. There has been an odor problem off and on, sulfur - onions - I don't know what really it is - it's been a continual problem. Ply bill has increased from 33.00 per month for the water to $22.00 per month. 11.15.81 the bill was $71.00 - I came down and paid $30.00 toward that because that was in my average water bill and at that time I asked if a possibility of an error could be investigated - I don't know if that $30.00 was even credited to my bill because the next month it was $90.00 - I am here to find out what I can do." Councilman Orton: "It sounds like most of this is water related problem. Bruce, were you request to look at this meter?" Public Work"s Supt Bruce Stuart: "Off the top of my head - I don't remember." Minnis: "I was told to contact that water Department and handle it myself." Orton: "Did you contact Bruce?" h1innis: "No, I didn't because I felt I was payiny the City Clerk - I didn't feel that I should have to contact the water department - I didn't feel that was my responsibility." Councilman Orton: "I believe we should probably hold this bill in obeisance until Bruce can check the meter. There are procedures we can go through as a matter of course. Check the meter and then we can also see what cash is recorded - and sir, if your meter is leaking, your internal works leaking - our authority and I Meridi .3. (Agenda 4 (Cont'd) Water/Sewer/Trash Delinquencies ................ responsibility does stop at the meter. We will probably be able to tell you if it is leaking as those are some of the tests that Bruce can run. If it was leaking beyond the meter it wouldn't show on your bill." A meeting was set for the next day and Orton asked that this particular bill be held back until further investigation Mayor Glaisyer: "Is there anyone else in the audience tYiat wishes to contest their water sewer and trash billing?" There was no response. Mayor Glaisyer: "Due to their failure to pay their water bill or to present any valid reason why the bill has not been paid, their water shall be turned off on March 4th, 1982. In order to have their water turned back on, there will be an additional fee of $10.00. They are hereby informed that they may apoeal or have the decision of the City reviewed by ghe Fourth Judicial District Court, pursuant to Idaho Code. Even though they appeal, the water will be shut off." Agenda 5 Community Block Grant (HL'D) - Sewer Rehabilitation Project City Engineer Gary Smith: "On the 22nd of February, there was a bid opening held at the City liall for the 1982 Residential Wasteldater Rehabilitation. There were eight (8) bidders, seven (7) were responsive. One was not responsive as one of the papers WdS not signed. The low bid was submitted by Nays Construction of Nampa for the total bid of $25,555.00, for fifty-three (53) service line replacements. All of h1r. Nay's requirements were in order. I checked the licensing division of the Public Work's and he is a "Triple A" contractor. J-U-B Engineers Inc. has had experience with the gentlemen who will act as his superintendent on this job on several other jobs, and he has reported that Nay's has done a very good job on the work he has done. I spoke with PJays and he has indicated if he was awarded the contract tonight it would be the first of next week that he would be starting on the project. It would take him that long to get his performance and payment bonds back to the City. City Engineer Smith read the following bids to the public: 1. Nay's Construction Co. - Yampa $25,555.00 2. Rogers Plubing - fJampa 32,737.00 3. James Paul Backhoe Ser vice - Meridian 43,000.00 4. Stamper Construction - Kuna 46,800.00 5. L.S.R. Construction - Boise 49,704.00 6. Horizon Corporation - Idaho Falls 51,000.00 7. Harvey's Excavation - Kuna 57,025.20 8. The U-Save Company - B oise hlo~-Responsive Smith stated that Mr. gays had indicated that he had no problems with his bid and he recommended that the Contract be awarded to iJAYS CONSTRUCTION for $25,555.00 The Motion was made by Orton and seconded by Brewer that the Council award the low responsive bidder, Nay's Construction Company, the construction of the residential sewer line rehabilitation project, HUD Grant Plumber B-81-DN-16-0001, and authorize I+iayor Glaisyer to sign the documentation necessary. Motion Carried: Orton, yea; Brewer, yea; Kingsford, yea; Tolsma, yea Agenda Cecil Cherry and Son - Inout 7 Kim Cherry spoke in behalf of Cecil Cherry and Sons for consideration of making some changes in their office building located at 309 Cherry Lane. Cherry stated they are zoned Residential with a Conditional Use-Limited Office and wish to propose putting a coin operated laundry service in this building. Basically they are suggesting a small operation but a very good one. Cherry stated he was aware of the Meridian Citv Hall Agenda 7 (Cont'd) Cherry 9 Sons .............. required changes and additional service charges and would work closely with the City Departments. Cherry questioned the feeling of the Council. Councilman Brewer felt it may tend to take away from the professional attitude of the complex .and then complimented the Cherry's on the job they had done completiny their building. He felt it may be more up to the tennants than the Council. Kim Cherry stated they had researched several and had seen many examples where it could be negative if not handled right but they are aware of these problems and will be maintaining this themselves. They could always convert back and their hope is to still develop the remainder of that property. They have a need. to put this building on a self-sustaining level. They felt if the Washteria was put in and properly maintained, this would be a successful location being near to the mobile home parks. Councilman Kingsford expressed concern that it might distract from the atmosphere of the complex since this does not have any retail area surrounding it. Cherry stated they had a need to utilize the building and felt the outcome would be good and clean - and be aself-supporting situation. Councilman Brewer recommended that Cherry and Sons go before the Meridian Planning and Zoning and work out the details and that the Council receive their recommendation. He stated that the Cluncil has been trying very hard to work with these people. Councilman Kingsford stated that he would prefer that this area remain as a Limited Office and should require a Conditional Use Permit rather than be zoned to allow it. Cherry stated that they prefer to have a Conditional Permit so that the area would be maintained with control and protection in that area. There was discussion concerning the lease agreements, transition back to office space. Tape on file. Kim Cherry stated that they would be talking to Planning and Zoning and thanked the Council. Agenda DEPARTPiENT REPORTS: 3 Attorney Wayne Crookston reported that the Open Meeting Bill S6 1304, sponsored by Attorney General Dave Leroy, provides a $100 fine for officials who intentionally violate the open meeting law. Ne had not read indepth as they have amendments. This fine would apply to anybody that "moved" into Executive session. Voting "No" to movement into Executive Session would exempt from fine. There must be a lawful reason for going into Executive Session. Lawful reason remains Personnel, Pending Litigation - Crookston did not recall the remaining reasons. Councilman Kingsford requested that Attorney Crookston inform the Council of the Attorney General's opinion as to what constitutes a "Secret Meeting" etc. Agenda Minutes of the Special Meeting held January 25, 1982 9 The Motion was made by Kingsford and seconded by Orton that the minutes of the Special h9eeting held January 25, 1982 be approved in coordination and referring to the recorded tape on file and with recognition that the City Clerk was not present to record the minutes.
