Howard Minutes of the previous meeting were approved as written. Agenda 1 Lee Stucker - Bethavin Subdivision Lee Stucker was present to request a time extension before construction of Bethavin Subdivision. Final Plat was approved one year ago. The motion was made by Kingsford and seconded by Tolsma that Lee Stucker, Bethavin Subdivision, be granted a one year time extension. Motion Carried: Tolsma, yea; Orton, yea; Brewer, yea; Kingsford, yea Agenda 2 Hearing - Catherine Park Subdivision Danny Green was present representing Potter & Associates for developer Tom Marks. Green: "I'm representing the preliminary plat for Catherine Park an area off the end of E. State and E. Washington, between Five Mile and the proposed 6th Street extension. This is the third or forth ,proposal for that area, and due to the shape of the area it is pretty hard to come up with a feasible plan. We think that this is a good plan for that area. Mayor Glaisyer: "Have you seen the recommendations by Ada County Highway District?" Green stated that Mr. Potter had reviewed these recommendations and would be handing them. Mayor Glaisyer: "Can you comply with all these requests?" Green: "I'm not sure." Tom Marks: "We can't comply with all the requests by the Ada County Highway District. We are going to negotiate with them and come up with a reasonable solution agreeable with them and with the developer. Basically the reason we can not comply is that we don't have control of the property that they want us to put streets through." Orton: "Of the conditions in the Ada County Highway District requirements which ones in particular do you have trouble with at this point?" Marks: "One is the Northern half of Catherine Lane the easement that shows on the map is actually not a designated easement." "The other half is not my property". Green: "The ownership of the property is actually deeded to the unplatted portion." Orton: "There is no recorded ingress egress?" Marks: "Right" "The other thing that we are going to talk to them about is the extension of State Street to the canal, barcades at the canal." "I believe that any extension would be on Washington Street." Marks displayed position of proposed culdesac. He stated that he does not control the South half of State Street either and ACHD had a requirement on this also. "We will be putting in an easement for Washington, and we will be a road to half road standards." "At the point where the road does go all the way through then they will develop the other half." Tolsma questioned the private lane. Marks: "ACHD stated that this section could stay as a private lane, but there on out they wanted a half street." Orton: "What if they (ACHD) would ask you for the dedication of that half road?" Marks: "I have no problem with that at all." 1 __Page 2 March 15 Agenda 2 (Cont'd) Nearing - Catherine Park Subdivision . Brewer: "Are you going to allow parking?" Marks: "No street parking." Chief Doug Nichols stated that we have no control over street parking on private property. Mayor Glaisyer: "Are you conducting negotiations with ACRD?" Marks: "Not yet." Orton: "Where you hook up to water and sewer?" Marks: "Water is on State, and sewer is directly North." "No lift station necessary." Kingsford: "And there is no problem with the easement through Crow's property?" Marks: "No, She has agreed to that easement." Orton: "This is not an annexation." Marks: "This is all ready in the City." Brewer: "About the only problem that I can see is that the property be deeded over to ACRD, so that the City has control over the parking situation." "Something no wider than that, it would be impossible to get emergency vehicles of any kind down there." "That is one requirement that we should probably have at this time." Mayor Glaisyer: "Gary, do you have any problem with the culdesac at the end of E. State Street?" Gary Smith: "It depends on what the concept East of Five Mile Creek is going to be." There was discussion concerning the OLD TOWNE concept. Green: "Mr. Potter indicated that the only proposed crossing would be at Washington Street,in any future development." Kingsford questioned the static of Ruth Crow's property, and what might happen to E. Washington. Marks stated that to his knowledge, She indicates developing some day. Mayor Glaisyer: "Who will pay for the bridge crossing on East Washington?" Green: "Hopefully, OLD TOWNE development, at that time of developing." Brewer question turn-a-round. Marks stated that he had talked to the Fire Marshall about a temporary turn-a-round. This street would eventually be graveled, and used as overflow parking. They would not have to park on the street, and would give the Fire Trucks access to the rear of the lots also. There was more discussion on parking. (Tape on File) Orton: "Have you got good off-street parking everywhere?" Marks: "Yes." Orton stated that this a very difficult piece of property to develop, and so far there has been no concept that has been able to meet all the requirements. It is either going to be something like this concept or a permanent weed patch. There was discussion on the lot sizes. (Tape on File) Mayor Glaisyer: "Are these going to be stick built houses?" Marks: "Either stick built or manufacured housing." Mayor Glaisyer: "Vern, how does manufacured housing relate to our Ordinances?" Vern Schoen: "Like Boise Cascade, Fine." Marks: "What about double wide Mobile dwellings?" Vern Schoen: "Then you have to go to our City Mobile Home Ordinance." Schoen explained the construction codes. (Tape on file) It was determined that these would be manufactured homes brought in and put down on foundations. Marks: "The homes that could possibly go in would be manufactured like Fleetwood, or something like that, or Boise Cascade. It would meet the Ada County Ordinance, stick construction,wood exterior, asphalt roof, it would be set down on a permanent foundation. Mayor Glaisyer stated that the City of Meridian has not adopted that Ordinance. 'Meridian City Hall Page 3 March 15, 1982 Agenda 2 (Cont'd) Hearing - Catherine Park Subdivision . Orton: "Do we have a problem with our building codes, or its just our Ordinance or both?" Schoen: "If it's just a mobile home, metal outside, then it does not meet code requirements." "It's classified as a mobile home." Marks: "These are all wood, no metal in them." Orton: "If it meets the electrical, fire codes, then we would only be talking about our Ordinance that requires houses on wheels be placed in a mobile home park?" Schoen: "When a unit comes out of Boise Cascade, as an example, if it's a mobile home, it will be inspected and stamped as a mobile home. If it's a house, it will be inspected by an inspector, same as I am, and states that right on the building." "A modular home depends on how it is manufactured - there is still a difference." Brewer: "Modular, to me, could go either way, like Boise Homes even though they build in the modular concept - they are manufactured homes. But yet they are on wheels - they are transported on wheels." Orton: "I think that would meet City Code." Kingsford: "The things they talk about, the pitch of the roof, the kind of construction, those kind of things will differentiate the insignia difference between those two." Schoen: "The house by Boise Cascade are inspected by certain individuals - the others are not and do not meet the code standards." Marks: "How do they not meet the standards?" Schoen: "Generally the studs, the floor--" Marks: "Stick construction is not adequate?" Schoen: "They do not have plywood on the outside - all they have is sheetmetal." Marks: "This is a T-11 Cedar Siding - the roof is asphalt shingles 312 pitch." Schoen: "It is possible that it meets the codes." Orton: "If the house has the housing insignia then we would not be talking about anything but a stick built house." Schoen: "They have to be inspected by the Labor Department." Marks: "I have no idea what kind of insignia would be on these houses." Tolsma: "Would this modular house have to meet VHA and FHA specifications - could it be approved here - or is it still a mobile home?" Schoen: "Basically it could meet code specification like siding, roof, rafters, pitch, and so forth - wiring and plumbing are two different things not items in a mobile home. In a regular modular home it would be like a pre-built house all your mobile home manufactures do manufacture a very similar type to a house. But, I think that if they are stamped mobile homes,then you're putting them in a place that belongs in a mobile home park." Mayor Glaisyer: "Tom, can you get a description of the materials that go inside that?" Marks: "I am sure that I can get it. I do know that the homes that we have been talking about do meet FHA and VA standards, and are financed by VA and FHA loans." Mayor: "So are mobile homes." Kingsford: "This is something that you should check." Mayor: "When do you go before the ACHD?" Marks: "Next Thursday." Mayor: "I think you should come back after you clear these things with ACHD. Give these descriptions to Vern, and see if it constitutes a mobile home subdivision - if it does you have a new ball game. If it doesn't then you are set to go as long as you comply with ACHD." Marks stated that there would be a minimum cost of approximately $50,000 for home and foundation." Vern: "The home then, would probably be in the neighborhood of $30,000." City Engineer Gary Smith: "Did you check with the County Engineer to see what the flood plain is?" Marks stated that Potter had done this with the OLD TOWNE plan, but he did not know. Smith: "Who will maintain that turn-a-round?" Marks: "There will be a homeowners association." "It will an all weather suface so it will be maintained for use at all times." Meridian Citv Hal Paae 4 Agenda 2 (Cont'd) Hearing - Catherine Park Subdivision rch 15. 1982 Fire Chief Welker questioned placement of fire hydrants, and stated that this is a dead end water line - Washington should be loop water line. Marks stated he had talked to the Fire Marshall who suggested that this be brought down to one of the center lots this could be adequate. This would be less than 300 feet on either side - the fire hydrant. Welker: "We need two fire hydrants - one on East State and one on Washington." Mayor questioned if this would be a public utility on a private drive. Marks stated he could give utility easement. Mayor: "Does anyone in the audience wish to make a comment regarding this hearing for preliminary plat Catherine Sub?" There was no response. "Hearing Closed." Kingsford: "I not sure I agree with that street being dedicated all the way down in light of it most likely will not ever be developed - I not sure that I wouldn't rather it remain a private lane." Brewer: "I did not realize that the property was tied up to the West. This is the problem that has happened to this property all the way along. This concept is beautiful for this property." The motion was made by Kingsford and seconded by Orton that the Catherine Park Subdivision preliminary plat be tabled. Motion Carried: Tolsma, yea; Orton, yea; Brewer, yea; Kingsford, yea Agenda HEARIPIG - Broadway Estates West Annexation 3 Mayor Glaisyer: "The Broadway Estates West Annexation Hearing is now open." Dan Wycherly, American Realty,and Jim Howard of J.J. Howard Engineers was present representing the Annexation request of Lorin Saunders Broadway Estates West. Wycherly: "We are proposing an annexation and rezone to "A" Residential of property located adjacent to IIth Street and Broadway." (Wycherly displayed map indicating the are) "Approximately ten (10) acres are involved in the project. Broadway Estates West will consist of Townhouse units and be in the price range of $45,000 to $50,000. Due to the economic times, we plan to do a very conservative phase development with the first phase consisting of four to eight units. You have a conceptual plan and we would like to emphasize that this is a conceptual plan and we do have plans for professional landscaping making it a very pleasant, family oriented, type of Subdivision - to make it a type of property that would improve areas that are adjoin- ing it. We plan to have common caress for playground and recreational areas. The property is contigious to the City of f~leridian and there is City water and sewer at adjoining property. We would also like to emphasize that we are anxious to develop this property in such a way as to meet the desire of the City of P"eridian for the growth and development of the community and make it a place where people will be proud to live as families." Councilman Orton: "Does this create an enclave with Broadway Estates?" Councilman Kingsford: "This is part of the City." Councilman Tolsma: "I have property that borders on the north side and a lot of the property owners that live on both sides of me are already displeased with the kids cutting back and forth across their yards for a shortcut. All residents that I have contacted are totally against this unless there was a possibility of a six foot high fence, or some other means of deterrent, that would run the full length east and west and also north and south on the west end." • Wycherly: - because we have the location of the schools over here it creates the cutting across the properties." r Hall _ ~,.~ 5~_`~__ _. March 1 (Agenda 3 (Cont'd) Broadway Estates West Annexation......... Tolsma: "Yes, they already have paths across there and if we put 102 units back there, there would be trenches. This was the comment that I got." Wycherly: "I don't forsee that as a problem - we could do that. It isn't a major item.." Kingsford: "The thing we are discussing is annexation and zoning - there are a lot of things when this comes up but I think it would be more advantageous when that does come up." J.J. Howard: "This is valuable to us in the planning sense to have any input, positive or negative, because it heops us plan in the future. If we are granted annexation we can come back with a design more suitable to the City." Mayor Glaisyer: "This is a Public hearing - is there anyone in the audience that wishes to make a comment on the Broadway Estates West Annexation?" Engineer Gary Smith: "blhat was the reason for the exception of the parcel in the northwest corner of the property? I was concerned about access back to that property." Wycherly: "It is owned by someone else that fronts on Pine Street." Mayor Glaisyer: "Any other questions from the audience?' There was no response. "If not, I will close the hearing." Motion Carried: Kingsford, yea; Brewer, yea; Orton, yea Tolsma, nay Agenda 4 HEARIiJG - Wallace Lovan Conditional Use for Golf Course Club House P1ayor Glaisyer: "Public Hearing is open fora Conditional Use Permit for Cherry Lane Rec. Golf Course Club House." Wallace Lovan: "I am representing the Cherry Lane Recreation Inc. which is known as the Golf Course. I am before you for a Conditional Use Permit to facilitate a club house for the golf course. This is coming about because the leaving of the neighborhood of the Real Estate Agency that had been leasing from the agency for three years nova - we will have a new agency and the agent wants to sell the clubhouse. The price for the existing clubhouse is just beyond what the golf course can afford - so therefor I am applying fora temporary clubhouse until such time a road and utilities are driven back where the final clubhouse will be built." Councilman Brewer: "First, you are not going to make a Plobile home Park out of this?" Lovan: "Absolutely not." Brewer: "Second, can you explain your procedure on setting the unit?" Lovan: "The procedure with the mobile home on the grounds would be properly planted so it would look nice. (Lovan displayed drawings) I will not settle for anything less - it will have a shake roof and a siding which will blend in with the rest of the neighborhood out there. It would be fully landscaped and standards that I could live with in operation of the golf course. There will be asphalt and grass around part of the clubhouse." Brewer: "It's my personal opinion that it is the only alternative for Wally and the City." t4ayor Glaisyer: Have you acquired the necessary signatures?" Lovan: "I think I have acquired the necessary signatures." Councilman Kingsford: "Is there any problem with hooking up to the utilities?" Lovan: "There is no problem with the input. I have talked faith Bruce and Earl, and I have talked with Idaho Power, etc." Kingsford: "I certainly don't have any problem and I know Wally will do a good job with it. Mayor Glaisyer: "This is a Public Ilearing - is there anyone in the audience that wishes to comment?" Bruce Cleveland, Vice President of the Homeowner's Association, Cherry Lane Village: "We would like to concur,besides the letter we have sent, we do agree with tdally's present situation and going with a Mobile Home we feel vaould cause no problem for our part of the development. We do supoort it." Mayor Glaisyer: "Any other comments from the public?" No response "Nearing closed" The P4otion was made by Kingsford and seconded by Brewer that 4dallace Lovan, dba Cherry Lane Recreation Inc., be granted a Conditional Use .Permit fora temporary Golf Course Club House with variances from the Codes and Ordinance. P1otion Carried: Brewer, yea; Orton, yea; Kingsford, yea; Tolsma, yea Agenda Reynold Schenck - Preliminary and Final Plat - LIFE STYLE TO~rlNHOUSES 5 Dan Green, Potter and Associates, was present representing Reynold Schenck's Life Style Townhouse proposal for Preliminary and Final platting. Green: "All City Ordinances have been met with the exception of a one (1) foot setback easement. 6Je would like to get a variance from East State Street." Schenck: "After the initial discussion last time we were here and the engineering was done, there is an irrigation ditch down the alley of the 5th Street side and the property line goes right down the middle. So therefor, we are proposing bringing the ditch inside our line, put in a culvert and bury it - but we have no problem with that. There is also a ditch that is to the west of our property line and to the concern of property owners. Our property line is to the east of that ditch. From our prior meeting we discussed covering it, screening - whatever needed - but since that ditch is to the west of our property we propose putting our back fence along there. That is the only two changes except requesting a one foot variance on that State Street side. We have a 19 foot setback rather than a 20 foot setback." Councilman Brewer: "Can you answer to Ada County Highway. Districts letter of requirements - dated PJovember 23, 1981?" Schenck: "With what they request, I have no problems at this time." Councilman Orton: "Basically, outside of the one foot variance, there is no hangup now is there?" Schenck:. "No sir - we're within one foot and I think what created that is that the property shifted from the irrigation ditch." Councilman Kingsford: "How does the density compare to the other areas. If I have this right it's 14.49 units per acre. What is the density surrounding there?" Schenck: "Across the street - going to the north - is a triplex - on the other side of the street and the other side of the alley, there is a triplex. Outside of that the rest of the homes are residential - one person has a rental unit at the back of the original residence. Once againk to reiterate, why we are doing this is because we have two lots originally. The reason we are building to sell is the neighbors have objection to rental units - they don't want rental units and by selling them they will take better care of the property. And, it better utilizes the two properties." City Clerk verified the certified mailing and stated that the residents within the 300 feet property line requested that the ditches be provided for. Mayor Glaisyer: "Who owns the property to the west of your property?" City Clerk stated that Vera Scott owns this property. Councilman Orton: "The ditch running on the west side - but outside your property line - does she use it?" City__Hall .7. ~ (larch 1 Agenda 5 (Cont'd) Reynold Schenck Life Style Townhouses...,..... Schenck: "The lady behind me does use it - it goes down along our property and drops under the road. It is not a very big ditch but important to those people to irrigate." Councilman brewer: "In regards to landscaping - are you going to grass with seed?" Schenck: "No, we sod. In the front there will be very little maintenance. We are trying to keep it maintenance free and "front porch" it - the back portion will be sodded." Brewer: "JJo sprinklers?" Schenck: "PJo sir." Councilman Kingsford: Does Cottage Home Addition have restrictive covenants? Is there any problem in this regard?" Schenck: "To my knowledge there isn't, sir." Kingsford: "Is there provision for garages?" Schenck: "There is single garages on all units.- They are large, single garages. Vern Schoen, Building Inspector: "I think taking consideration of half of the streets the density would be around 12." Earl Ward, Wastewater Supt: J1ake sure there are dedicated sewer easements for individual owners." Schenck: "r1v understanding is the sewer is coming frpm East 5th." Ward: "From the alley" Councilman Orton: "Your Final Plat would have to show a public utility easement." Ward: "Either that, or a Homeowners Association." Orton: "We don't want to own that - they, each one, has to have access, right?" Ward: "Right" Engineer, Gary Smith: "It appears there is some drainage problem, hopefully it will all come out when the street improvements are planned for Ada County Highway District. It looks like at the northeast corner of the development there is a hole - this could be a drainage problem." Schenck: "There is an old basement under the property and you can go swimming there - most of the time. That property sines slope into the south." Smith: "Your Engineer will prepare a plan for this?" Schenck: "Yes sir." Smith: There is a common area designation in the covenants, but I dint see them on the plat. Is there a common area on the plat?" Schenck: "That was set up to cover any and all possibilites. Common areas will be like driveways, etc. - there will be one driveway shared by two people - " Smith: "That will be called as common area on tf:e plat?" Scheck: "Yes sir." Councilman Kingsford: "So the driveways will be maintained by all property owners - not just the two that share them?" Schenck: "That's right." The Motion was made by Brewer and seconded by Orton to approve the Preliminary and Final. Plat of Reynold Schenck Life Style Townhouses dev elopment, Cottage Home Addition; that a one (1) foot setback easement variance be granted on the East State Street line; providing that the requirements of Ada County liighway District are met. Motion Carried: Brewer, yea; Orton, yea; Tolsma, yea; Kingsford, yea Agenda 6 Dean and Dorothy Rule - Input for BROOKLAWN ESTATES ANJJEXATIOfJ Dean Rule stated that they propose to build a ~4obile liome Subdivision in accordance with the zoning requirements of the City and County on Lot 6 West Lawn Sub. - the PJ 1/2 of the SW 1/~l of Section 12, Township 3N and 16J. They would need all City services. This will be built for an adult population - primarily for those retirement age or are retired. It will be restricted to double wide mobile homes, modular or other manufactured homes with shingle roofs and siding to the ground. They propose a density of 5 to 6 units per acre and the tract contains 8.42 acres. They are looking at Rose Park as a guide in planning the lots, the protective covenants and regulations. (Meridian Ci Agenda 6 (Cont'd) .8. P Input - Brooklawn Estates Annexation........... Councilman Kingsford stated that his concern is in regard to traffic on Pine and Linder because of the school. Dean Rule stated that they had a circular drive coming off of Pine Street in mind. Councilman Brewer: "My comments are somewhat along the same line that would be in the proximity to the railroad - and also usually the retirement age,individually, liked to be closer to shopping." Rule: "That could be true. But, it will be attractive when we get it done." Kingsford: "I think, just in passing, there really is a need for that type of development in Meridian." Rule: There is. We lived at Pose Park and this is what put this in our minds. People are there all the time trying to buy the lots and these are for sale - we are not going to try and rent them." Councilman Orton: "Approximately how many units would you like to put on the 8.3 acres?" Rule: "It hasn't gone to engineering but with the economics we need to get at least 48 to 50 out of it. There will be 50 foot streets going through." Brewer: "Properly done, I would encourage it." Kingsford: In Rose Park Circle, are these dedicated streets in there - and we own the utilities?" (Rule indicated yes) "I think it might be a very good venture." Rule: I think it would be good for the community myself." Brewer: "Rose Park is certainly a good example as to what can be done along those lines - very well maintained." Rule thanked the Mayor and Council for their input. We are interested in its growth and prosperity. At its general meeting of Y+iarch 2, 1982, the members of our organization voted-that we write to the City Council-endorsing a conditional use permit for a mobile home gol~" club house on the land north of the present Cherry Lane Golf Club.
