1 Catherine Park Final Plat
Jim Potter was present representing the request for Catherine Park Final Plat.
Potter: "We have received the comments from City Engineer and Water and Sewer Department
and we have made the necessary revisions to reflect those on the plans. We would ask
consideration on one item. On East Washington the staff requested that the 8" water
line be extended to the edge of the ditch. The alignment for that 8" water line
compared to the rest of East Washington is on the North side of centerline. In this
particular area, that property is beyond control by Mr. Marks. We are, as a matter
of information, in the process of working up a preliminary plat on Ruth Crow's property.
It would appear that particular extension of that water line in that area should be
pertinent to her development, since the alignment is on the North.
There was discussion and drawings made on the plat. (Tape on File)
Potter: "We also are extending Water and Sewer stubs to the 25' line on the West
side of the property line where Ruth Crow would plan her development."
The Motion was made by Orton and seconded by Brewer to approve Catherine Park Final
Plat as modified with the change in the water line discussed in this meeting.

2 LeRoy Edelson, Manager feridian Speedway
LeRoy Nelson, P•ianager Meridian Speedway was present requesting a variance for a
8 X 8 addition to the concession stands at the South end of the Speedway, to be
constructed the same way, and meeting the same codes as the variance granted last
year did.
P4ayor: "Vern, do you have any comments on it?"
Vern Schoen, Building Inspector: "Pdo objection, as long as the Council gives a
variance."
Mayor: "Roger, do you have any comments on it?"
Roger Welker, Fire Chief: "No, not as long as it stays within the fire code."
Councilman Brewer: "This is for popcorn sales?"
Nelson: "Popcorn and snowcones only."
Councilman Orton: "There wasa lot of discussion last year when we granted a variance
about the real tive safety of these stands. Was there any problems at all?"
Pdelson: "Pdo, none what-so-ever. We met all requests by the Health Department and
the Fire Department."
The Potion was made by Kingsford and seconded by Tolsma to approve the 8 x 8
concession stand with. variances to the building codes.

Attorney Wayne Crookston: "Yes, as long as you're pursuing the changes in the Comp. Plan."
The Motion was made by Kingsford and seconded by Brewer that the rules and provisions
of 50-9002 and all rules and provisions requiring that Ordinances be read on three

Carl H. Rathjen for their efforts and dedication to the Meridian Free Library District
and to our City." "THEREFORE, as Mayor of Meridian, I do hereby proclaim May 10, 1982
as Nancy S. Sage and Carl H. Rathjen Idaho Collection Day and urge all residents and
businessmen to join in our salute."

Earl Ward WasteWaterSup't reported that the surface well located on East 2nd is
now in operation.

Gary Smith, City Engineer, Presented bills to the Council on the Sewer Rehabilitation
Grant Project.
Smith: "The first bill is for Nay's Construction, submitting a bill for $15,650.24.
I would submit that .for your consideration, with my approval, for payment at 10% less
than the amount shown here. Earl (Ward) has checked all of these charges off and
everything is in accordance with what his contract calls for."
Orton: "Is this the final payment?"
Smith: "No, this will be pay estimate number one. Nay's is getting close to being
half done."
There was discussion on the work involved for the project by the contractor.

The Motion was made by Kingsford and seconded by Brewer to approve pay order number
one in the amount of $14,085.22, to Hay's Construction from the Sewer Rehabilitation
Grant Project.

Smith: "We have an invoice from Northwest Underground Surveys for $825.00 for TV
Inspection of the Sewer Lines. This is a grant eligible cost and goes along with
the work the contractor is doing."
Smith explained the advantages of using the TV Inspection system to locate the
underground Sewer Lines. (Tape on File)
The Motion was made by Kingsford and seconded by Tolsma that the bill to Northwest
Underground Surveys in the amount of $82.5.00 be approved from the Sewer Rehabilitation
Grant Project.
Plotion Carried: Kingsford, yea; Orton, yea; Brewer, yea; Tolsma, yea
Smith: "The time that Earl (Ward) and his people having been putting in on the
project up to 4-27-82 is $2,049.78. This is on their time card for this project.
It includes four employees. This is reimbursable."
Orton: "So in essence this is the City's bill to the Sewer Rehabilitation Grant
Project?"
Smith: "Right."
The Motion was made by Kingsford and seconded by Orton to approve the bill of
$2,049.78 for City employee services payable from the Sewer Rehabilitation Grant
Project.

services, engineering services, and inspection services, in the amount of $10,108.06.
This is Statement Number 4."
Councilman Kingsford: "Has anyone reviewed that with our original agreement with
JUB?"
Playor Glaisyer: "Yes, they are within line."
The Motion was made by Kingsford and seconded by Brewer to approve JUB Statement
(lumber 4, in the amount of $10,108.06, from the Sewer Rehabilitation Grant Project.

8 Request for Executive Session
City Attorney Wayne Crookston requested that the Council go into an Executive Session
to discuss a personeil matter.
The Plotion was made by Brewer and seconded by Orton to go into Executive Session.

The Council left the Chamber to go into Executive Session.
Mayor Glaisyer called the meeting back to order, after a Motion in the Executive
Session was carried to return to the meeting.
Mayor Glaisyer: "There has been a recent review of the Idaho Bar Association Ethic
Committee. They found that part-time public defender have the right to carry case
loads outside their particular jurisdiction. In event of that determination, I
see no reason why we should not officially inform our City Attorney that he has
the right to represent other clients outside our ,;urisdiction. There would be no
conflict of interest as I understand it."
The Motion was made by Kingsford and seconded by Orton to approve the Idaho Bar
Association determination of ethics on part-time prosecutors working outside City
jurisdiction.

Jim Potter, Potter & Associates, requested the feelings of the Council concerning
excluding or including all right-a-ways in the legal description of Quong Watkins
Annexation Application.
Mayor Glaisyer stated that this would have to be researched. (Tape on File)
Being there no other business to come before the Council, the Motion was made

concluded that it is the best interest of said City to annex to said City

The Northerly 30.00 feet of and Westerly 30.00 feet of the said Lot 6 of
Westlawn Subdivision is road right-of-way for West Pine Avenue and Linder Road,

and the State Tax Commission within 10 days following the effective date of

Tax Commission within 10 days following the effective date of this Ordinance.
Section 3. This Ordinance shall be in full force and effect from and after its
passage, approval and publication as required by law.
