Gene Tipton, President of the Meridian Spokes i+~torcycle Club, and Lee Young,
Vice President were present attempting to make the public aware that there is a
new motorcycle club in Meridian. Tipton explained the ideas of their club.
Their goal is to involve the community with motorcycle safety, functions to be
held at the Meridian Speec'way, working with b7r. Steve Garrett, Idaho iNOtorcycle
Safety Foundation of the State of Idaho, an attempt to change the motorcycle image
as there are over 60,000 motorcycles registered. in Iaaho with a great need of
safety education. Ie stated that the rodeo function will be strictly skill and
the events will be educational.
Tinton: "Fie would like to ask for support from the cammu~ity and see P"~ridian
being the "touching off point" for this function. We have been contacted by a
representative of the Idaho Motorcycle Club tvi.o has heard of our ideas and want to
consolidate some of their ideas with ours and through registration get an education
f_ornat for these young riders that are starting out. But we really need cormunity
involvement because evenlbody that rides a motorc,~cle anymore is part of a cor.Ernanity. "
"Ne have a program that we can put on by going around to the different clubs and
by trorking with the ca!annnity we can possibly save a lot of young peoples limbs or
lives. Thank you for the opportunity to speak to you a;:d. prresent our fu^.ction."

Chief of Police Doug Nichols stated that he had reviewed the transfer application
of Norman R. Hanson, ab3 !e SPUD HUT, 1646 Meridian Street. Beer License, to be
consumed upon the premise, is to be transferred from Janes Cash. Rescission
agre~nent attached.

Loveless: "Because of the one big open field on the northerly side. A gentlemen
wants to buy that piece if it bec~anes anne;ced and we can split off that tt~,ree (3)
acres. He guns the farm to the north and wants to maintain farming this. This
would have to transfer from P9einers to this other owner - if we became annexed and
can do the split. All we want to do is insure that we can transfer that grandfather
right for farming, he is renting this ground right nag and farming it and has told
Mr.iners that he would buy the property but he wants to be guaranteed that, he can
use it for farming."

Mayor Glaisyer: "Have you taken this through the Ada County Commissioners?"
Loveless: "That's why we are down here for annexation instead of going back to
the Ca~issioner's. It is on a D-1 Zone and they won't rezone."
Councilman Kingsford: "Ltiouldn't it be smart to just annex that portion that you
want in and leave the Earn ;round out?"
Loveless: "I think that canplicates the City's problem because we wrouldn't be
annexing all of the tFiener's property - we would be splitting it before the fact.
There is sane complication according to the Meiners who researched this before
coming to me to prepare tY:e documents."
Councilman Orton: "Isn't the mobile home on the grounds really the ,uestion?"
Loveless: "IQo, the mobile home exists behind the hane and their son, who is a
landscape architect with a firm in Boise, is going to take the mobile have out and
put in a single family home. We are not asking for any grandfather right on the
mobile home other than the time it takes z:or us to process this and have to get a
loan. The mobile home already has a septic system and it's own well separate from
the home out front. We would want some time because it is going to take time for
hun to get a loan processed for him to build a have there. That piece back there
with the mobile home caill be transferred to the son. Basically cae want to get rid
of that hayfield at the side of them -last year when I~^.r. Meiners hayed. he was
taken to the hospital as he is deathly alergic. They want to get rid of the farming
operation entirely.'°
Councilman Tolsma: "If this property is zoned "A" Residential and they sold it,
can they go ahead and farm it?"
City Clerk: "That is cahy the application for annexation was requested with a
"B" zone at the beginning. "B" zone allows keeping sane animals, etc."
Loveless: "The, maintain a calf as beef."
Kingsford: "*~n'here are we as far as water and sewer services from this property?"

Industrial Park."
Bruce Stuart, Water Sup't.: "Wa.ter rwzs up to 5th on Franklin'°
loveless: "The property behind this property (r~einers) and a 50 foot strip
to the South of it is in the City limits nag."(This was annexed approxi?*~ately 1976.)
Loveless designated the bounaary's on map and pointed out that the City limit that
fronts on Locust Grove amounts to only 50 feet.
Orton: "I would like to ask the owners -will the annexation really help you?
I,et :~~ go tYirough some of the problems we have had in the past and sane of the
conditions that have gore on annexations sirnxlar to this, in regard to water and
sewer. If we do it t~:is way, it may not help you at all. In the past one of
the conditions was there would not be any building until the water and sewer is
on. For example,. across the Freeway -the water and sewer extensions would have
to be made, the plat ca:roleted and filed and certain elements of the site work
canpleted, and they. we would issue you a building permit. Lb you see what I'm
getting at?'°
Meiners: "Our desire isn't to sukxiivide. The land use will remain essentially
as it is."
Orton: "So your intent is to act rid of that little piece of farmland and not
build on. it?"
irieiners: "I have a health problem to the extent that I can't handle the farm work.
The neighbor has to faun the area. We do not want to subdivide -someday we will
want to build to replace the Mobile Herne, otherwise we have no intention to subdivide."
Orton: "There is another way to describe this - to :Hake sure I am comunicating.
let's say we did annex it and you did subdivide it, you did sell off the piece,
evenrthing worked fine for a couple of years and you wanted to build ahouse -you
would have to cam in then for a variance for an individual sewer or water system.
Like I say we haven't....'°

Loveless: "This is what they told me when they first came in -they just want
the help on the paper work and legal work" "There is not very many people that
caant to rent or lease 3 acres. The neighbor desires to own this piece and fits
his needs better if he can take dean the fence and incorporate into the field
already around there. It is a separate, piece now."
There was discussion concerning Ada County regulations of splitting. (Tape on File)
Kingsford: "In order for this to be sold off you would have to go through a rer_.ular
platting procedure."
Loveless: "We understand that."
The request fran Ada County Highway District was discussed. There is a request
from ACY,D for a 33 foot right-of-way from the centerline of Locust Grove to the
parcel. If Meiners went to the platting procedure he would loose a eight (8)
foot frontage. They did not ask for improvement, just right-of-way.

Mayor Glaisyer: "Thi_s is a public hearing. Is there anyone in the audience
that wishes to comment concerning Meiners Tract Annexation?"
Gene Kindred questioned if the three acres were annexed into the City would it
:;lake the three acres contiguous to the City. 47ould it be acceptable to be taken
in if a purchaser or buyer would want to farm. Ploulci the three acres throw any
bearing on a later desire to annex the rest.
Councilman Kingsford stated that the person who wishes to purchase the 3 acres is
already contiguous to the City boundary at the back of his property.
There was no other comments from the public and :v'ayor Glaisyer closed the public
hearing.
Attorney Crookston stated that if they change aaners they loose their grandfather
rights. What they are asking for will have to be done by variance.
Councilman Orton stated that in the past the City has made annexations because
the ovmers had specific proposals or ideas to somewhere in the future do urban
type development - residential, commercial or industrial. "I hope I am never
involved where an annexation was primarily instigated to get around an Ada County
rule - no matter how bad the rule was." "You are trying to get rid of a piece
of land. and the Ada County zoning laws won't let you do it."
There was discussion concerning variance, title transfer or other methods of
transferring use of land, grandfather rights, etc. (Tape on file)

which may allay fanning.

East Pine and Five D4ile Creek City boundary.
Rick Orton: "I will be abstaining from this proposal."
N',ark Allen: "[Ve propose to subdivide this parcel which is approximately two (2)
acres, eight (8) lots, six (6) of which would be zero lot line duplexes - which
Ms. & Tfss. Stutzman also plan to build. The one lot has an existing here on it
and the eight lot would be a single family a'welling. We have copies of the

Allen displayed Preliminary Plat.
Allen: "The sewer line would be an extension from Catherine Park Subdivision,
located just to the north. The sewer line would extend down the west edge of
this property with the existing have belonging to ^;r. & i%rs. =~vezc~a and. then
turn and go east just on to Lot 7. We felt it wouldn't be reasonable to surface
this anyway although we would grant access in terms of an easement."
Mayor Glaisyer: "You've had sane problems doing these things haven't you Earl?"
Earl F9ard, [vasteSr'ater Supt' : "Yes sir. I would request that it ~,~~ould be -
doesn't necessarily have to be paved -but, the surface is almost mandatory - Ps
we would have to maintain and our prime concerns have been the access."
Allen: "Our other concern was ACIID's recommendation that we provide a frontage
road on the south edge of tree six (6D lots fronting on Pine Street. Apparently
ACID is asking for a separate road and one (1) access to Pine Street. That would
involve considerable expense to P4r. and Mrs. Stutzman and in .addition to that
there would only be three (3) driveways according to our proposals -these will be
zero lot line duplexes and three (3) entrances. There would be a dup'.ication of
the use. Pine is considered as a Collector although all the other parcels have
individual driveways onto Pine Street.
Councilman I:ingsford: "kihat kind of a duplex is this that one side of it has
34 feet and still has a sideyard setback?"
Allen displayed tentative plans and explained zero lot line and setbacks. (Tape
on file) Allen calculated 1344 sq. feet on each side. He stated that they will
comply with the City Ordinance on square footage requirer:ents. There would be
at least a single car garage, off-street parking for at least another car.
Councilman Tolsma: "The P.CI3' requirement for the frontage road would be for
the off-street parking."
Allen: "P~ did request a 30 foot right-of-way from the centerline (Fine St.)
and then we expect to be improving it with curb and gutter. Perhaps with the
30 feet there would be adequate parking space.`°
Gary 9nith, City Engineer: "I think on wllector streets ACF~ has in the past
had a policy that they didn't want residential backing out onto that because of
the traffic voles through there. I am more familiar with arterials whlch are
major thoroug]ifares a^.d. are more restrictive access. Pine is a collector, on
the right-of-way situation, and the reason for my continent for 40 feet is that
on to the east, at the Bews Industrial Park, they have a 40 foot rightrof-way on
the south side of the road. Pine existing up to this development, on the west
of this development, eggs platted as 40 feet. This was the reason I continued
on the 40 feet - I did not have AChD's caia±~nt at that time.
Allen: "At this point the rirhtrofw~ay is only 25 feet so they (AC.7~) did ask
for sane extension of that."
Smith: "Pine will eventually ao through to Eagle ^~oad - it will go through
Upland Industries Annexation. The amount of traffic that it is going to carry
fran town to Eagle Road is, in my mind, questionable right nag as far as volune.
From Locust Grove Road to Eagle Road I can see there could be more traffic than
£ram Locust Grove back to tovm."

and assiuned to be what was wanted running straight through on East Pine.
P11en stated there vaas no problem with a 40 foot right-of-way as long as there
was roar.fcr the buildings. There was still the concern of the separate frontage
road. He stated that they planned to file an application with Nampa-Meridian
Irrigation and Bureau of Reclamation for an easement along Five Mile Creek.

Mayor Glaisyer: "This is a Public Hearing. Is there anyone in the audience that
wishes to camtent?"
Jon Hvezda: "In the public hearing notification letter we received, it stated these
would be sold as condominiums - I heard you mention duplexes."
Mark Allen: "They will be sold as condominiums -each would be a separate parcel."
Vern Schoen, Bldg. Inspector stated that these would be "Townhouses" and that he
thought ACFID's c~enent was intended to finish the stree out with curb, nutters and
sidewalk rather than side street.
Earl Ward, Wastewater: "The all weather surface would be necessary'°
Gary Smith, City Engineer, stated that the sewer service for this property is
contingent on sewer line being installed down Cathy Lane. Potter & Associates had
informed him they would lacer the grade of the manhole in East State so this could
be extended to this property. The revised plans have not been studied yet and
Smith explained the grade set would depend on Catherine Park.
Mayor Glaisyer closed the Public tearing at this time.
There was more discussion concerning sewer grade and Engineer Srnith demonstrated
sewer grade and extension plan on map for the Council. (Tape on File)
Attorney Crrokston left the chamber to check on the rules cronstituting a Quorum.
Councilman Orton had abstained before the Hearing on Arnie Subdivision and
Counciln~z Brewer was absent. Councilman Kingsford moved that the Council go on
to other business in the meantime. iblsma seconded the Notion. Motion Carried

Brace Stuart, Mater Sup't., explained that any avner desiring water supply can
make application and sign an agreement with City Waterworks for the purpose of
obtaining sacieone else to put in the service.
Mayor Glaisyer: "Is there anyone from the public that wishes Ordinance 407 read
in it's entirety?" There was no response.
The Notion was made by Kingsford and seconded by Orton that the rules and provisions
of 50-9002 and all rules and provisions requiring that Ordinances be read on three
different days be dispensed with and that Ordinance Ntmiber 407 as read be passed
and approved.

3. Engineer Gary Smith, J-U-B I;T7GINEERS, INC., stated that Bob Sorcic, Ada County
Highway Department, had contacted him and indicated that the concept plan
that was submitted by Jim Potter shays a bike path on the west side of Five t7ile
Creek along Catherine Park Subdivision. Sorcic was wanting to ask for a seven (7)
foot wide easement south side of that Subdivision which would be Ir~t one (1},
and also a seven (7) foot wide easement along the north side of what would be
Arnie Subdivision - for a total of 14 feet for bike pathway.
There was discussion concerning the City's status on the bike pathways in this
area, from Pine to Fairview. Smith stated that Sorcic indicated that all bike
and pedestrian pathways would be maintained by the City Parks Department.
Councilman Orton stated that this reminded him of the issue that ACRD raised seven
years ago on drainage ponds -nay they are going around trying to find saneone to
give the ponds to -they wont maintain them, they are eye sores, terrible wasteful
caatutments of good land. As far as the Concept Plan (Old Tcx~me) , O_~•ton stated

it was: approved by the Council. He also stated that his vote at that time of
conceptual approval did not apply to anything specific.
Orton: "Before we start requiring additional right-of-way's for easement -- for
any purpose - I think we had better be real careful because they becorme weedpatches.
I don't think the Public Work's has a plan to take care of the, I don't and ACHD
apparently doesn't."
Counci]man ={ingsford stated that it was his understanding this caould be the
Eomeowners Association type of development in the Concept Plan. "If Catherine
Park want's to put a bikepath through, they would have to maintain it."
City Engineer Smith stated that he would report back to I+Ir. Sorcic.

Attorney Crookston entered the Chamber at this time and advised the Mayor and
Council that there is a QUORUf4. Arnie Subdivision Preliminary Plat was again
brought forward.
Mark Allen: We would like to go ahead and curb and gutter with three (3) access."
A11en also agreed with a 40 foot right-of-way from centerline of East Pine.
Allen: "T,ae would like to agree to surface the area along the south line of Lot 8
and the north line of Lots 1 through 6 - then attach that to the alley, but not
surface between East Pine and this alley {the west side). (Aller_ pointed out

The Nx>tion was made by Kingsford and seconded by Tolsma that the Council approve
ARNIE SUBDIVISIONd PRELL~LiNARY PLAT conditionable upon that they meet the requirements
of the City of Meridian Planning and Zoning, City Engineer, improve their side of
East Pine forty (40) feet from centerline, curb and gutter, and that they surface
the back of IAts one (1) through six (6) and south line of Lot 8 for sewer access.

Mark Allen requested a variance to begin construction on his van house before
Final approval.
Mayor Glaisyer stated that P11en should not be granted a variance to begin
construction until some more study has been completed between Potter (Potter & Assoc
and City Engineer Smith. The Mayor instructed that Mr. Allen be placed on the
Council meeting agenda for June 21, 1982.

City Engineer Gary Smith presented CONTRACT CHANGE ORDER NO. 1 1982 Sewerage Project
Residential WasteV:ater Service Line Rehabilitation.
Smith: "When we first stested the project the intent of the contract was to replace
the service line from the service tap in the street to the residence at it's
foundation. As they began to open these things up we found several other
problems existed with the Sewer lines, besides the residential service lines. In
many instances the length of pipe that was being replaced was different than the
length of pipe we had st?own on the plans - either the tap was not in the correct
place in the street or it was not in the correct place at the house.
The first iterl in tY:e Change Order deals with the additional length of pipe. The
bid amount that Nays Construction Company had for the Construction Contract,

the total linear footage of pipe shown on the bid documents divided into the amount
they did, $7.68/L.F. We set this amount for above or below. Second item, there
3as exploration work they had to do-in sane instances the location of the service
line at the house or the street didn't cane out where we thought it would be.
We negotiated with them (Nays) for a backhoe, operator and laborer and they charge
$50.00 per hour for any exploration wor,c they do. Third item - when they had to
reroute the service line from the house such as an obstruction in the. yard - a tree
or a strufture built over the service line. That meant they would have to expose
the sewer main in a new location, tap into it, put a new saddle on it and re-
connect tY:e service line. That was $200.00 each. Fourth item occurred when an
existing tap was exposed so they could install a saddle onto the pipe over the
existing hole that was tapped into the line - we negotiated a price of $100.00
for each one of those." "Those are the five itans beyond the scope of the contract.
Both Earl and I feel that the dollar values are well with reason."
Ward stated that there are 35 units completed out of 70 and on that about 50% of
those would have approximately an hour additional time. Fie felt ti:is was a very
fair price negotiation.
There was discussion concerning individual problems which brought about contract tune.

There was no reason to believe this wUUld go beyond the City Grant Budget.
The Notion was made by Kingsford and seconded by Tolsma to approve CHAPICn ORDER NO. 1,
1982 Sewerage Project Residential WasteTn'ater Service Line Rehabilitation, Nay's
Construction Company.

Engineer Smith stated that Kent Ba~~-ney had proposed splitting six (6) lots located
in Cherry Lane Village ,-~2, on Sea Island Court. "There are six lots now and bs. Barney
wants to utilize a zero lot line. In effect, he would be splitting the lots in half.
Ie proposed to locate a house on each one of the lots to start with and would, as he
built and later re-subdivided into a zero lot line, provide him with six more lot
line dwelling units for these six lots. His proposal was to buy the lots and
start construction on those,strategically locating the house, then file a Replat for
subdivision of these six lots to shwa the locations of these with respect to what's
left on the lot - So, he would be moving lots lines. He indicated it would be
higher density. I don't think there would be any problem as far as the process is
concerned but the fact we require a Public Hearing for a Replat, if he starts
construction on a single lot basis and then runs into a stumbling block on splitting
lots out - that could cresent a problem."
There was mention from the Council of the existing covenants, Homeo~mers Association,
and that a Replat process would be necessary. (Tape on File)
Smith stated he would inform Mr. Kent Barney of discussion.

Councilman Orton reported that he had been contacted regarding the planting of
flowers in the flag area of the north curve intersection. There was discussion
concerning the upkeep and the wage cost, even if it took six and eight hours a month.
Bruce Stuart, Public S4ork's, stated that this Spring his Department had raked the
bark back, put Visq_ueen down and the bark back again. They had spent approximately
tyro hours a week weeding that area last year. He stated that it was arranged now
to require very little maintenance. Orton stated if they decided to plant flowers
the maintenance would have to be budgeted next year but would find sow other rieans
for maintenance in the meantime.
Councilman Tolsma reported that he had received nu;nerous ca~laints concerning the
trash problem on windy days. Especially at Paul IGP and Smiths Food King.

Tolsnia stated that he had talked to the Sanitary Trash hauler, Mohammad, and he
reported that there are many persistent violators of the trash ordinance by not
closing their trash hopper and piling their trash in great airounts around the trash
hoppers. These people need a larger hopper because they are exceeding the lil-nit,
bring extra trash out of the building while he is loading -this costs the hauler
in manpower, landfill costs -both of which he is not reimbursed. Tolsma stated
the Mohammad is preparing a list now of persistent violators to present to the
Council.
There was discussion concerning handling this violation through the Police Department
or drafting a letter to inform the violators there is a process of reappraising
trash service, penalty, etc.
Eugene Kinnred stated that N~hammad is not obligated to pick up anything but the
container. If a business container does rot hold all of the trash and they put
it on the ground they should drive off and leave it -and the people are in violation.
There was more discussion concerning residential has unlirtited pickup but in an
approved container. It was the feeling of the Council that the public needed to
be informed, policed and then penalized.
City Clerk La4v'ana Niemann presented N^.ayyor Glaisyer and the Council the application
to arlend the Comprehensive Plan as originated by the Planning and Zoninc,
Conunission April 19, 1982 and the amendment of Library Po?.icies, change of the
Transportation Plan Map and Policy Diagram Map as proposed at the Public Fearing
held April 26, 1982. ?unen~meiit application on file with these minutes.
There being no other business to cane before the Council the v~tion was made by
iZingsford and seconded by Orton that the meeting be adjourned at 9:17 P."4.

OF MERIDIAN, ADA COUNTY, IDAEIO, BY AMENDING SECTION 5-105, APPLICATION

WHEREAS, the City Council and the Mayor of the City of Meridian,
Idaho, have concluded that it is in the best interest of said City to
amend Title V., Chapter 1, Section 5-105,
NOW, Tf1Ei2~'ORE, BE IT ORDAIIVID BY THE MAYOR OF THE CITY OF MERIDIAN
AND THE CITY COUNCIL OF THE CITY OF MERIDIAN, ADA COUNTY, IDAEiO,
Section 1. That the following Section 5-105 be amended and sha11
henceforth read as follows:
5-105 APPLICATION TO WATER SUPERINTII~IDENT FOR SERVICES:
Whenever any owner desires to obtain a supply of water from
the City Waterworks, he shall make application therefor in writing to the
superintendent of the waterworks and sign an agreement to be governed by
such rules and regulations not icu~onsistent with this chapter, as may be
prescribed by the Mayor and City Council for the control of the water
supply. Applicant must state the location, kind of building, and the
entire area of the ground to be supplied, and fully aril truly state the
purpose for which the water is to be used, and shall furnish a set of floor
plans showing all water uses. Whereupon, if the application is garanted,
the superintendent of the waterworks may be authorized to extend, at
the expense of the applicant and at no expense to the City, the
service pipe and meter tile,meter:yoke, meter the lid, curb stop
and any other fittings that are necessary .to install service to the
inside line of the curb at the point most convenient for supplying
the applicant. In cases where street paving is contanplated, the
abutting proper avners must either connect their premises with the
water mains before the trench is back filled or pay the cost of service
fran the main to curb if made thereafter.
Section 2. WHEREAS, there is an emergency therefor, which emergency
is declared to exist, this Ordinance shall take effect and be in force and
effect frcan and after its passage, approval and publication as required
by law.
PASSED by the City Council and approved by the Mayor of the City
of Meridian, Ada County, Idaho, this 17th day of May, 1982.
