Minutes of any prior meetings were dispensed with at this time.

1 John O'Connor; American Legion Baseball at Storey Park - Concession Stand Request
Mr. O'Connor stated that he is involved with Legion Baseball and that the club is
looking for ways to generate revenue. An obvious way would be with concessions.
These concession sales would be limited to Legion activities durng_ the baseball season.
There would be no sale of beer. Any revenues from the concessions would go to the
ball club, and hopefully start a funding source fora perment stand at the park.
Rick Orton stated that with the work completed last year at the park, the City is
open to allow the temporary concession stand.
PAayor Glaisyer questioned any problems on clean up.
O'Conner stated that clean up was no problem.
Bruce Stuart gave a positive report on the past clean up. He stated the only problem was
in the dug-outs themselves.
The Motion was made by Rick Orton and seconded by Bill Brewer that the Council approve
the request for the temporary concession stand at Storey Park and approve a vendors license
to the Legion in the amount of $25.00, for next year's season, this season being
exempt.

Item
2 Variance to Begin Building: Mark Allen - Arnie Subdivision
Mark Allen representing Arnie Subdivision was present to request a variance to begin
building on Lot 7 in Arnie Subdivision. He displayed maps.. of Arnie Subdivision to the
Council. He stated that they have received approval on the preliminary plat, and that
the construction of the utilities has been started.
Gary Smith, City Engineer questioned the placement of the sewer.
Allen stated the line°is to come thru Catherine Park to State Street, and then South to
the Centerline.
Smith pointed out that a5 of last Friday, there still is no easement for that sewer line.
Wayne Crookston, City Attorney: "I don't recommend the variance. It is a premature
approval."
Allen stated that he hoped to have the final plat before the Council in July.
Brewer: "You could build the most beautiful home in the world out there, but if you
can't get water and sewer to it, it is going to be worthless." I wouldn't feel right
letting Mr. Allen start building notknowing if he's going to get sewer and water out there:"
Allen stated that he is aware of the risks involved.
Tolsma: "They can't get an easement to go across Ruth Crow's property so consequently
nobody has water or sewer out there, right?"
Smith: "Sewer, right. Water will come in from Pine."
Allen stated that he would not begin construction until the easement is granted.
Crookston stated that until the final plat is approved there is no legal description as
to lot and block.
Crookston: "How can we be sure that it is that lot? I think it's very premature.' In
the County this would be a illegal subdivision."

The Motion was made by Brewer and seconded by Tolsma that the request for the Variance
to begin building at Arnie Subdivision be tabled until the next regular meeting in
hopes that the negotiations on the easement can be completed by that time.

Larry Bates - Water Bill
Larry Bates was present to protest the water billed to him at the War Eagle Saloon
when it was leased to P1r. Nelson and Mr. Denney. Bates stated that he felt that this
was not his expense.
Kingsford explained to him the City Ordinance that requires the owner of record be
responsible for the water bill.
Mr. Bates admitted that he was the owner of record at the time the bills were incurred.
Mr. Bates stated that he felt the water bill due should have been taken out of the
liquor license money that was refunded to Mr. PJelson and P1r. Denney.
There was much discussion concerning the billing. (Tape on file)
Bates stated that the money due the city had been taken out of the closing costs by
Pi®neer Title, and that they had mailed the check to the city.
1~layor Glaisyer pointed out that as of now, no monies have been received by the city
on this account, and he would call Pioneer Title and check on the funds.
There was more discussion. (Tape on file)

Pre-Termination Hearing - Water/Saver/Trash Delinquencies
Mayor Glaisyer read the TURN .OFF NOTICE to the public: "This is to inform you in
writing, if you choose to, you have the right to a pre-termination hearing, at 7:30 P.M.
June 21, 1982, before the Mayor and Council, to appear in person to be judged on facts
and defend the claim made by the City that your water, sewer and trash bill is
delinquent. You may retain counsel. This service will be discontinued June 24, 1982,
unless payment is received in FULL."
P1ayor Glaisyer: "Is there anyone here tonight that wishes to appear regarding your
Water, Sewer or Trash bill?"
Terry Woodward, 1535 E. 1st, was present to contest his billing.
There was much discussion concerning Mr. Woodward's billing. (Tape on file)
The htotion was made by Kingsford and seconded by Orton to accept the partial payment
of $100.00 from Terry Woodward and as much additional monies that he can turn up by
the .24th.

Mr. Woodward stated that he would bring a personal check into the City Office for $100.00
on June 22, 1982.
The Nbtion was made by Kingsford and seconded by Orton that delinquent water, sewer
and trash account users have their water turned off on June 24, 1982.

5 Second Amended Ordinance No. 377 - Locust Grove Industrial Park
Mayor Glaisyer read the Second Amended Ordinance No. 377 entitled:

SE 1/4, SW 1/4, and the SW 1/4, SW 1/4 of Section 8, T.3N., R.IE.,B.M., Ada County,
Idaho, and the S 1/2 of the NE 1/4 of the SW 1/4 and the SE 1/4 of the NW 1/4 of Section
8, T.3N., R.IE., B.N., Ada County, Idaho, TO THE CITY OF PIERIDIAN, WHICH PROPERTY IS
ADJACENT TO AND CONTIGUOUS TO THE CITY OF MERIDIAN, ADA COUNTY, IDAHO.
Mayor Glaisyer requested that Gary Smith, City Engineer give a briefing as to why
Ordinance No. 377 is being submitted for the second time.
Smith stated that the last description that was prepared by the applicant did not
include a sliver of ground from the 16 section line.
Mayor Glaisyer: "Is there anyone present tonight that wishes Second Amended Ordinance
No. 377 read in its entirety?"
There was no response.
The Motion was made by Kingsford and seconded by Tolsma that the rules and provisions
of 50-9002 and all rules and provisions requiring that Ordinances be read on three
different days be dispensed with and that Second Amended Ordinance No. 377 as read be
passed and approved.

6 Bills - HUD Project; Gary Smith, City Engineer
Gary Smith, City Engineer presented bills on 6 items payable from the HUD Project.
They were as follows:
1. City of peridian: Personnel time to work on the project $721.62 (Attached to Minutes)
2. Northwest Under round Surveys: Sewer Survey $262.50 (Attached to Minutes)
3. Nay's Construction: Estimate No. 2 $18,392.91 (Attached to P1inutes)
4. J-U-B Engineers Inc.: Statement No. 5; Interm billing for Engineering Services,
Inspection Services; Water Evaluation Services; $2,776.17 (Attached to Minutes)
5. Meridian Drug Store: Film; $7.14 (Attached to Minutes)
6. International Business Machine (IBM): Typewriter, for administrating forms and letters
HUD Grant B-81-DN-16-0001, Sewer Rehabilitation; $1,008.25 (Attached to Piinutes)
The total of the 6 items payable $23,168.53.
The ~1otion was made by Kingsford and seconded by Brewer to approve HUD,PROJECT'Bills-items
1 thru 6 (on file with these minutes) in the amount of $23,168.53, from the HUD GRANT
B-81-DfV-16-001, Sewer Rehabilitation Fund.

The ?Motion was made by Kingsford and seconded by Orton that necessary funds be trans-
ferred from the 25 Water/Sewer Inc~ne Account to HUD Block Cr t Account. All ea
Smith explained that the total HUD Grant was $120,000.00, an~to date we have sypent
$55,062.98. That includes the items that were approved at this meeting. We are limited
to $20,000.00 in the water. There are 21 services to be replaced which come very close
to the $20,000.00 figure.

~ Item 6 Cont'd: Gary Smith, City Engineer
Smith stated that to approve the Water Project, or at least to get it going, would
require a Public Hearing before the City Council. He suggested that the Public Hearing
be held the week of July 12th, so to allow ample time for the Notice of Hearing to
be published twice. Smith stated that time is of the essence. Based on this schedule,
construction could begin August 6th, and completed September lst. According td the
provisions of submiting the Grant for the Seniors' we must have obligations at 80%
by October lst, so we would be complete with our projects, as much as we can do,
by that time, without any problems.
Smith stated that only one Council member need be present at the time of the hearing,
to present the program to anyone that wanted to know what the project involved.
Councilman Bill Brewer volunteered to be present at the Public Hearing.
The Motion was made by Kingsford and seconded by Orton that the Public Hearing on the
HUD Amended Grant be held on July 12th, 1982, at 5:30 P.M., at the Meridian City Hall,
with Councilman Bill Brewer to be present.

Smith presented the request by Nay's Construction for an increased fee for the additional
lines to be replaced. There are about 70 lines that need to be replaced. This is
17 beyond the original 53 contracted.
Smith broke down all the costs of material and labor involved for line replacement.
He stated that he recommended the increase and felt the costs are justified.
Mayor Glaisyer questioned Smith as to the approximate additional cost for the 17
additional line to be replaced at the increased rate.
Smith stated it would be around $10,000.00. He stated that he felt this was a fair
cost.
There was discussion concerning the cost and the replacement of the lines. (Tape on File)
Smith stated that he felt Nay's was doing an outstanding job as' far as the quality of
work, and their ability to get along with the citizens who's yards they are working
in.
Smith mentioned that Nay's cost include the cost of replacing sod and shrubs also.
The Motion was made by Kingsford and seconded by Brewer to accept Nay's Construction
bid for the additional 17 services, continguent upon acceptance by HUD.

Smith explained that there is another part of the project that he and Earl Ward,
Wastewater Superintendent, have been discussing with Nay's Construction.
Smith went on to explain that there are 3 "Flush" Tanks in the City that should be
dug up. These "Flush" Tanks prohibit a camera from going up the line to discover
where a leak in the line may be. Smith stated that he had gotten a verbal OK from
Mr. Greeno (HUD) for this project.
Smith explained that they are requesting approval to negotiate with Hay's on at least
one, and see how the costs go on it. He stated that they would set a maximum amount
on it of $2,000.00, and watch him and see how it goes.
The Motion was made by Orton and seconded by Kingsford to approve pre-construction
of one man hole where there is a Flush tank by Nay's Construction.

7 Department Reports
Mayor Glaisyer called on each department head for any report they may have for the
Council.
Bruce Stuart, Water Department stated that there is a water line going thru a septic
tank at 137 E. Pine.
Mayor Glaisyer instructed Stuart to contact the owner and make them aware of this problem.
Mayor Glaisyer instructed all Department Heads that their department budgets for fiscal
year 1982-1983 are due prior to July 14th, 1982.
Rick Orton stated that he would like to alert the Council on a problem steming from
1969 that has been discovered. This concerns the Zoning of the Ross property on
East Fairview Avenue. It was zoned as "A" Residential and has never been rezoned.
Both Ross parcels are commercial. One parcel is a furniture store, and the other parcel
is a mobile home park.
Orton stated that he felt it was the Owner's responsibility to request a rezone on this
property, and that he wanted to alert the Council as to this problem.
Councilman Orton requested an Executive Session to discuss contractual obligations.
The Motion was made by Orton and seconded by Brewer to go into an Executive Session to
discuss a contractual matter.
Motion Carried: Kingsford, yea; Tolsma, yea; Orton, yea; Brewer, yea
Ray Sotero, Idaho Statesman,requested that the Mayor explain'Lontractual matters"
and cite the section from the Idaho Code of the Meeting Law under which
the Executive Session had been called.
Mayor Glaisyer requested that Wayne Crookston, City Attorney, advise on this matter.
Mayor Glaisyer cited section 67-2345 of the Idaho Code;. Executive Sessions - When
Authorized - Subsection (b) to consider the evaluation, dismissal or disciplin9 of,
or to hear complaints or charges brought against, a public officer, employee, staff
member or individual agent, or public school student;
The Council went into Executive Session. Mayor Glaisyer excused all Department Heads,
and anyone else that wished to leave at that time.
The Council returned to the Chamber at 10:07 with no action being taken in the Executive
Session.
Being there no other business to come before the Council:

Idaho, TO THE CITY OF MERIDIAN, WHICH PROPERTY IS ADJACENT TO AND CONTIGUOUS

WHEREAS, the City Council and the Mayor of the City of Meridian have
concluded that it is in the best interest of said City to annex to the said

Section 2. That the City Clerk shall cause one (1) copy of the legal
description and map which shall plainly and clearly designate the boundaries
as altered, to be filed with the Ada County Recorder, Ada County Assessor, and
the State Tax Commission within ten (10) days following the effective date of
this ordinance.
Section 3. The above-described property is annexed to the City of Meridian
subject to the following requirements: 1) the Preliminary Plats answer to the
questions of traffic, landscaping, sewer and water connections and design
review; and 2) no variances for interim septic tank and field drains will be
allowed; and 3) that the period from January 28, 1980, until the time the
building permit is issued shall be no longer than two (2) years, and if it is
longer, deannexation proceedings may begin.
Section 4. This Ordinance shall be in full force and effect from and
after its passage, approval and publication as required by law.
PASSED by the City Council and approve by the Mayor of the City of
