The meeting was called to order by f4ayor Joseph Glaisyer at 7:32 P.M.

Tom Turco, Central District Health; Re: Restaurant Grading
Tom Turco, Central District Health Department, explained to the Council the procedure
for Restaurant Grading, and presented them with a copy of the CDHD fee schedule on
grading. He stated that in February of 1982, the Health Department had adopted a grading
ordinance that will be used district wide. Turco showed examples of the grade cards
that CDFID would be using. Turco explained that CDHD has a similar arrangement with
Garden City where CDHD is enforcing a grading ordinance, and the City has dropped it's
fees. Turco stated that the fee was intended to provide monies for the CDHD to enforce
the grading ordinance. Turco explained the advantages of having a grading ordinance
district wide.
Turco: "The first of July the bills for the City of Meridian came due for the next year.
We will be providing a grading ordinance for the District Health Department, as part
of this new fee schedule. I don't know if you people want us to prepare the bills for
the next year for your restaurants, it's what ever you want to do."
h1ayor Glaisyer: "I would advise the Council to endorse that the State do their own
billing." "I see no reason-that now. that they have their own fee schedule that we let
them do the processing themsehevs."
Councilman Kingsford: "I would certainly go along with that."
Turco: "I might add the State of Idaho is adopting new food regulations which will
have in it the new grading .ordinance."
Councilman Orton: "Does this increase or decrease the fees that we have now?"
Turco: "As far as the City of Meridian, it's a decrease.in the charges to the restrauant
operators."
The Motion was made by Kingsford. and seconded by Orton to adopt the State's fee schedule
and amend the City of Meridian's Ordinance 369 to comply. on restaurant grading.

PUBLIC HEARING - Irene Morrison, Conditional Use for Beauty Salon, 1531 Tana Drive
Jim Kennedy was present representing the request fora Conditional Use Permit for a
Beauty Shop located at 1531 Tana Drive, Meridian, Idaho. F1r. Kennedy explained that
his wife has been operating the Beauty Shop for a number of years at this location,
and that they are in the process of selling their home. The buyer would like to continue
to operate the Shop in the same location.
h1ayor Glaisyer: "LalJana, (City Clerk), have all the conditions been met? All the public
notices, and all the neighbors been contacted?"
LaWana Niemann, City Clerk: "Yes they have. All the residents have been notified,
signatures obtained."

iiayor Glaisyer: "This is a Public Hearing. I will now open the Hearing for any
Public comment or questions. Is there anyone present tonight that wishes to speak
on the request for the Conditional Use Permit, by Irene Morrison, fora beauty salon
at 1531 Tana Drive?"
There were none.
Mayor Glaisyer: "Being there no Public response, I will close the Public Hearing."
Mayor Glaisyer: "Are there any questions or comments from the Council at this time?"
Councilman Kingsford: "How are youcharged for the sewer and water hookups? Did you just
have it gone residence when you had. the Shop there in the past?"
Jim Kennedy: "We have always paid... double fee."
Kingsford: "To be in compliance with what we have done with everyone else, there would
probably be an additional hookup fee." "This would be on the Shop."
Orton: "Did they pay it before?"
LaWana Niemann: "They didn't pay it before, but they should have. Ode are charging it
now." "They have been informed of this fee." "It's $700.00."
The Plotion was made by Orton that the Conditional Use Permit fora Beauty Salon, one
chair operation,all codes to be met;with a like existing sign be approved, with the
understanding that the additional hookup fee must be paid.
The Plotion was seconded by Kingsford.
There was discussion by the City Attorney and Council concerning Findings of Fact and
Conclusions of Law. (Tape on File)
Wayne Crodkston, Citq'Attorney: "As of'July 1, 1982, there i•s a statute in the Law that
requires the City Council to make Findings of Facts and Conclusions of Law on all
applicatons.pertaining to zoning.and'annexation, and things of that nature. So the
Findings of Facts and Conclusions of Law is prepared for circulation among the Council
members for their input after the Public Hearing, and the Ordinance prepared. Then the
Council would adopt the Findings of Facts and Conclusions of Law, and then pass or
deny whatever action."
The second to the Motion was withdrawn by Councilman Kingsford.
The Motion was amended by Councilman Orton.
Thef~iotion was made by Orton and seconded by Kingsford requesting the findings
of Facts and Conclusions of Law be prepared, along with the Ordinance, for consideration
at the next City Council Meeting July 19, 1962.

There was more discussion concerning the procedure of the Findings of Facts and
Conclusions of Law. (Tape on File)
It YldS concluded that the Findings of Facts and Conclusions of Law procedure could not
be streamlined,. and could not be prepared until after the Public Bearing before the
Council, because of the input from the Public. The input from the Public hearing would
be a great consideration in preparing the Findings of facts and Conclusions of Law.
It was determined that the Findings of Facts and Conclusions of Law need only
be done at the Council level, and did not need to go back, or be done at the Planning
and Zoning level. The recommendations of the Findings of Facts and Conclusions of
Law are only considered at the Council level, and are only adopted at the Council level.

Item #2 Cont'd, Conditional Use Permit, Public Hearing .
Mr. Kennedy questioned if the new procedure requiring Findings of Facts and Conclusions
of Law had to be followed, since they had applied for the Conditional Use Permit before
the statute in the law went into effect.
Wayne Crookston explained that this is a procedural change in the law and would become
effective to all things pending.

3 Public Hearing - First Church of Christ; Locust Grove, East Pine Annexation
Piike Anderson was present representing the request by the First Church of Christ for
annexation of their property located at Locust Grove and East Pine into the City of
Meridian, to be zoned "D" Industrial.
Anderson: "!de purchased this property in 1977, prior to the Comprehensive Plan, after
which we found it was probably not the best place to build a Church." "6<!e were advised
by the Planning and Zoning that yes; we could build a Church there, but it would probably
be in an industrial area. lJe then proceeded to find another piece, which we did buy
out on Cherry Lane. tJow we end up property rich and cash poor." "ode can't build a
Church building until we sell the property. To sell the property, which is contiguous
to the City, immediately the first question that comes up to a purchaser is, is it
in the City?, and we have had to say no. It is in agreement with the Comprehensive Plan."
"4;e would ask that the property be annexed into the City for the purpose of selling it."
Mayor Glaisyer: "This is a Public Hearing for the annexation of the First Church of
Christ property located at Locust Grove and East Pine. I will now open the Public
Hearing for comment either pro or con from the public concerning this annexation."
There was no public response.
Mayor Glaisyer: "There being no Public response, I will now close the Public Hearing."

The Motion was made by brewer to approve the First Church of Christ Annexation with "D"
Industrial Zoning.
Kingsford: "Fill, we have the same thing, Findings of Facts and Conculsions of Law here."
Brewer: "That's right." "We have to back clear uo again." "Ok, back up then."
The Motion was made by Brewer and seconded by Orton to direct the City P,ttorney to prepare
the Findings of Fact and Conclusions of Law in reference to the Annexation of the first
Church of Christ property, and direct the Ordinance to be prepared.

4 ileadow View #2 - Square Footage Requirement Variance
Tom birch was present representing Sherwood and Roberts the owners of Pleadow View ,#2.
Birch: "We would like to propose to the City Council that a change of square footage
size be allowed on the unit dwelling size." "Ile would like this so we can afford to
build some house that people can get into." "In doing so, we would also require some
stricter energy guidelines." "ldhat we would propose to do, is reduce the minimum
square footage of the homes by 100 square feet." "900 FP?t would be the minimum size."
"We would also propose that the architectural control c~tanitte be allowed to assign
the lots. As it stands now, the lots are assigned and it is set to which lot has
1,000 square feet, and which has 1,300 square feet. People that have tried to build
houses or design houses have found some specific examples where that does not work, or
makes it very difficult to comply with that and build on that lot, making it somewhat
unbuildable."

Birch: "Also, it is our understanding that as it stands, evehy lot has to have a
two car garage." "What we would like to propose, is that we have a minimun of 70% with
two car garage." "It would be the duty of the Architecutural Control Committee to
assign that 70% two car garage, 30% on odd lots and different lots to have single cars."
Mayor Glaisyer: "Have you discussed anything with the neighbors out there?"
Birch: "We sent out the required notices."
Dan Cada, President of Energy Saving Homes, Inc. addressed the cost of the homes.
Cada stated that the average cost of the homes was $55,000 and that they (Energy Saving
Homes) has 9 homes in the Meadow View #2 Subdivison pre-sold. Cada stated that they
expected to build between 20 and 40 homes within the next 90 days.
Kingsford: "Ordinance Number 383, we have a City Ordinance that paragraph 7 says
"If an owner or owners of a Subdivison desire to have this section apply to their
Subdivison, they shall come before the City Council with an amended plat showing each
lot and the minimum size house that can be built thereon clearly shown so they would
have to come before the Council vaith an amended plat, or we would have to grant a
vaiance to this Ordinance."
Birch: "I think that is what we were asking. That is why we were asking fora variance,
so that we could sign that mix. "
Mayor Glaisyer: "Vern, (Vern Schoen; Building Inspector) do you have any comments
at this time?"
Schoen: "No comments."
Orton: "Then you would be asking for three variances? For the reduction on the mimimun
square footage, a variance on the two car garage requirement, and you would be
asking fora variance on the geographical designation."
Birch: "That is correct."
P1ayor Glaisyer: "Gary, (Gary Smith; City Engineer) do you have any comments to make
at this time?"
Smith: "No Mr. Mayor, I don't."
Mayor called for any other comments from the City Department Heads.
There were non.
1ayor Glaisyer: "Wayne, (Wayne Crookston; City Attorney) do you have any comments to
make at this time?"
Crookston: "I'm not quite sure of this procedure they have gone through. You require
them to send out notices within 300 feet?"
City Clerk Niemann: "Certified mailing and public notices."
Crookston: "Again, I think it's one of those deals that has to have Findings of Facts
and Conclusions of Law, buys that's up to the Council."
Mayor Glaisyer: "Is there anyone in the audience that wishes to make comment as to this
variance request?"

Dale 6abcock: "The registered letter that we got addresses the change of lot size.
I guess that is one of my concerns. It does not talk about change of house size.
This particular subdivision has all ready been decreased in size once." "I'm concerned
about my property value being that I adjoin them." "h1y recommendation would be not
to do that."
Joe Simmnich: "I own property North of this subdivision, and I am concerned whether
or not that these houses will be grouped, small houses in one area, and larger ones
in another since there will be no designation."
Kingsford: "I think that is something that I would like to see before it be adopted too."
Gene Kindred: "I am in the area of this also, and I think that there is an Ordinance
to go by, and it's been plated, and surely all those lots will take the size house that
is was intended to be built on them. I am very opposed to decreasing the sizes of the
houses in the City of Meridian. I don't think those smaller houses will be to desirable
especially in our neighborhood. I think we should go by the Ordinance and not a
variance."
Gordon Leishmann: "I have the Sheri Lynn Subdivision and I am faced with somewhat the
same problem as Mr. Cada. I have built eight houses in there in the last three months,
I have seven of them sold, but I can not build and sell a house over 1,200 square feet,
I can't find any buyers for it." "I have lost sells where people want to pick a house
and a lot together." "I am just basically here tonight to see how they do, because I
plan to come in and ask fora variance to house size also."
Dave Healy: "We are buying one of the lots out in Meadow View." "The way the house
sizes are now it makes it affordable for us." "In this day and age, anything higher
in square footage than that puts it out of range for the middle income individual."
"The reduced house size provides people an opportunity."
Steve Michales: "I am from Capital Plumbing. I do some of the plumbing in the area
here. I think that we should give Dan (Cada) every consideration that we can. He is
trying to put together a product that the public can use, also jobs for the local
ecomony."
Mayor Glaisyer: "Are there any more comments or questions from the Public?"
There was no response. "Dan (Cada) would you like to step forward and address some of
the questions that were raised?"
Cada explained that the reason that they are asking for a variance to lot designation
is so that they can get a good mix throughout the neighborhood. "Our only chance to
build a quality home, to build an energy efficient home, is to lower that square footage."
"TJe want to build something that people can be proud of."
Councilman Kingsford questioned Vern Schoen, City Building Inspector, on what the water
table at Meadav View #2 was.
Schoen: "It runs about 17 inches."
Councilician Orton: "I would like to find a way to support these requests to get the
housing market moving again i.n Nlesidian, it is a big part of our econcxciy."
Counci]r.~7 Kingsford: "We have two or three subdivisions that I can think of, that
were approved prior to our having any r+inimaan square foot sizes. Those builders could
build anything in there that they would want. No building is taking place there either."
"It bothers me to throw it open entirely to a smaller house, when in .fact there are
areas i.r: N~ridian where they can build that don't have those square foot requirements.°'
"There are places ir..~9eridian where they can build 900 feet or less, and they are not
building."

Councilman Brewer: "I don't feel that just because they aren't doing it one place
really has anything to do with it." "These harries certainly aren't low income homes.'°
"I think that the name of the Canpany -Energy Saving Eares - is a good description."
Megan Morgan: "I am representing Energy Saving Homes." "I think the fact that we
have 9 signed ernest monies tonight and several more on the board speaks for itself.
There is finally a quality product, one that ansvers the energy problem that the
entire nation is faced with. That product was only released to the public less than a
month ago." "The product srzaks for itself." "The people are willing to buy. You
have 700 vacant and sitting lots in Mleridian, not being used because the product, number
one is rot there, and number tcvo, your size limitations. Quality must be the traderoff
for the reduction of size." "Until now, the product has not been available that answers
the markets' needs."
:{ingsford: "But t':en, how do you guaraz:tee quality?"
t~iorgan: "The closest thing short of a law, or ordinance, is a covenance. If you will
look through the amended covenance that we have drawn up, you will see that the energy
requirements are stricter .than any that I am aware of on record."
Brewer: '+If I remember right, that's the very thing we were dying to do; a trac]eroff
of reduced square footage for quality."
Counci]man Tolsma questioned the Consumer Protection clause that states the hares are
covered by a 10 year hammer warranty.
Cada explained the haneaaner warranty program in detail. (Tape on File}
Birch: "I don't want to mislead the Council on this. These are Dan's (Cada) Energy
Efficient Fares. They are the meriber of the IIcuse Council, which is every bit of what
he said it is, there is the possiblity that some of the lots may be sold to sane people
that are not under that. 6Ve are prepared to require a warranty, a written carranty
program, on those properties too." "The way things are going now, our intention is
to try to have Dan (Cada) build out the subdivision.'°
The ~btion tugs made by Orton to grant a variance to Meadow Vieva #2, allowing the
minimrur: square footage on each unit to be cropped 100 square feet.
Crookston: "I think that we are in the area of Findings of Fact and Concl:asions of Law
on ills." "The other problem that I have is the notice that says "lot sizes"."
LaWana Niemann, City Clerk: '°The notice speaks of the square footage requirements
ordinance that speaks of the homes alone."
There was discussion concerning the wording of the notice. (Tape on File)
Crookston: "I think that the notice is probably defective."
Orton: '"What is the solution to that problem?"
Crookston: "Go back and re-notice it."
Brewer: "[~'ny was this form used begin with La[nTana?"
Niemann: "I just used [vayne's (Crookston) form. It is in the sane subdivision. [+hien
they (.Meadow View #2) came in in Feb. of 1981, Wayne did a Public Notice for the
square footage requirements on each lot. It wasn't changing the lot sizes, it was .

Niemann, Cont'd: changing the square footage requirements we always speak of
as being that Ordinance that states so many will be so many square feet -the ha^.~zs
not the lots. This is the one we did, and I just worded it the very same way."
Orton: "I still can't believe that there is anything productive or useful to be done
in readvertising the subdivision. Therefore I would like ny t~tion to stand, and see
if I can get a second."
The Motion was seconded by Brewer.
Crookston: "We still have the problem with the Findings of Fact and Conclusions of
Law. Unless you want to hold a special meeting, it is going to be at least until your
next meeting until you can act."
Kingsford: "P7e are not talking about a zoning or a conditional use. As I understand
that law, it only applied to a changing of the zone of the land."
Crookston: "It's under the Local Use Planning Act which refers to variances.°'
Isayor Glaisyer: "Variances in zoning, or building?"
Crookston: "I think that you would probably have the same problem whether it is
zoning or anything. You are acting in aquasi-judicial fashion, whether it's a zoning
question, or o7hether it's somebody coning ii1 to put - in a fruit stand."
Al Tikker: "You are still going to get the saner people from the subdivision that are
here tonight that are going to come back again. The others if they cared would be here
tonight."
Brewer: "i~.e definitely want to have things right." "There must be a way to expedite
things. These people want to build nine homies. They should be building, and not
waiting for the snow to fly." "I hate to see us spoil the stu~mer going through possibly
uneeded routines." "Is there any way Wayne, do you have material here gnat you could
make reference to, to know r'or sure one way or the other as to this having reprieve
to the variance itself?"
Crookston: "Yes.''
Brewer: "I would like to ask for him (Crookston) to have that privilege."
Crookston was excused from the Chamber for research purposes.
Mayor Glaisyer: '°Let's go on to some other things while Wayne is researching this."

Statement ATO. 6, from J-U-B Engineers, Inc. for Nud Project was presented in the amount
of $556.04. This was an Interim billing for administrative services, engineering
services, and inspection services provided in connection with The City of P4eridian
Community DeveloFxnent Block Grant Sewer Services Line Fehabilitation Project, Grant
D7o. B-81-DN-16-0001.
The Motion was made by Kingsford and seconded by Tolsma to approve the J-U-B Engineers
billing, Statement No. 6, in the amount of $556.04, payable from the A[~Z) Grant
B-81~N-16-001, Sewer Rehabilitation Fund.

The Meeting was called back to order by INayor Glaisyer at 8:52 P.M.
Item #4 Cont'd - Meadow View #2, Square Footage Variance .
Mayor Glaisyer asked Attorney Crookston to report on his findings.
Crookston: "Since we do not have a zoning ordinance, the ordinances that we do have
that pertain to this, have to be the ordinances that govern zoning and lot sizes, the
coverage on those lots. I think what you are doing is granting a variance fran those
ordinances, so I think that you would have to have the new requirement for Findings of
Fact and Convulsions of Law. You are making a change in those ordinances."
Brewer: "I feel canfortable with the Motion and the second."
Mayor Glaisyer: "The Motion has beer. made and seconded to grant a variance to have
each house located in Pdeadow View #2 reduced by 100 square feet."
Motion Carried: Tolsma, yea; Orton, yea; Brewer, yea; Kingsford, Nay
Brewer questioned Cada on if he could build the 9 proposed hares without having to
elude to the other two variances requested at this tics. "What we would like to see you
do is get out there and build the nine bevies and prove yourself, and then cane back
for the other two variances if that's possible."
Cade explained. that out of the nine homes, only one has a one car garage. "AS far as
the mix, using the same percentages but being able to designate both the constmer and
we feel fits best, we need this." "About half of these are on properly designated lots."
Orton: "I.ow many homes do you intend to build one car garages on?"
Cade: "tide are asking for not to exceed 30~ one car garage." "So far that number is
high. Out of nine sales, we have one one car garage."
The Motion was made by Orton and seconded by Brewer to grant a variance from the two
car garage ordinance in Meadow View #2 Subdivision, and that no cmre than 30~ of the
hares will have a one car garage.

The Motion was made by Orton and seconded by Brewer to allow a variance to the geographical
designation of the houses in Meadow Vievr #2 Subdivision.

6 Albert Blaser - Input Regarding V7est Pine Property
Mr. Albert Blaser was present requesting the Council's comments on his property located
at Vest Pine along the RXR Tracks. Mr. Blaser is asking Ada County for Industrial
Zoning on his 47+ acres. He stated that he has a buyer for this property that wishes
to bring sane new industry into the valley. Mr. Blaser stated tYzat he was not at
liberty at this time to divulge who the buyers were. "I am at liberty to tell you that
they will have in the neighborhood of 100 to 120 employees." "This will create sane
jobs."

Blaser: "I have a cost of what it will cost to bring water to the property, and to
bring sewer to the property. We are ready, willing, and able to do that at our
expense." "I have a letter of cacmtitment here, that you may view."
There was discussion concerning the property. (Tape on File)
Mr. Blaser stated that he is not asking for annexation. He has requested the change
of zoning to Industrial from Ada County. Blaser explained that Ada County stated
that if the people of Meridian would go for it, they would go for it.
Blaser: '°I am asking for a letter or sane acknowledgement of approaal so that I can
go to zoning (County Zoning) with tl-,is assurance." "This is vrhat the County ask
that I do." "They want to know if the people of Meridian would welcome a new industry
comming in here."
The Motion urns made by Kingsford and seconded by Tolsma that the Council authorize
the Mayor to send a letter to Ada County Zoning recam~ending the zone change to
Industrial, and that no user of the property be offensive or obnoxious to the cacraunity
and/or the treatment facility.

Council Orton discussed the possibly of allowing, on a demonstration basis, the constructior.
of houses that take into effect the cost saving measures presented by the U.S. Departrz!exit
of Housing and Urban Develoanent in cooperation with the tdational Association of Home
Builders. Orton explained sane of these cost saving measures, and stated that they :gay
or may rot require a variance to tY:e 1982 Building Codes. (Tape on File)
Vern Schoen, Building Inspector, cited sane of his findings on the subject.

Schoen: "The problem that I have with this is the inspections. S?hen you cut a niece of
wood, it has to be treated. There is no cvay that I can be there to watch that all pieces
of wood that are cut be treated." "It takes a special type of nail, which could be
checked possible, although a galvanized rail now all you see is the head, and I doubt
that you could tell much difference." "The other thing is the vx~od foundation."
Orton: "If the Council would allow a demonstration project, I only intend to work in
the areas recommended."

Steve IJlichales, Capital P7.u*ibing', :gas asked by the Mayor to comment on the polybutylene
pipe. biichales stated this type of pipe vroulcl not be approved by the State Plumbing
Board, as they have not adopted polybutylene pipe in their State Pltrrbing Code.

Orton discussed the advantages of. using the plastic pipe in same areas of Meridian
where pitting in the pipes is a problem. (Tape on File)
Steve Michales stated that he would be glad to sit down with Councilman Ortor. and
discuss this problem. ;`2ichales offered to go to the State Plumbing Board with Orton

Councilman Orton requested perntission fran the Council to pursue this matter, for tcyo
cases. that he knew of. (Tape on File)
Kingsford suggested that Orton get some type of waver of libility fran the Pumbing Board,
then bring it back to the Council for the go ahead. (Tape on File)
Dan Carla commented on the all weather caood foundations. (Tape on File)
Carla requested to come before the Council in August and pursue the all weather wood
foundations. Carla cited several associations that accept the all weather wood foundation.
Carla stated that the wood foundation would not require a variance. (Tape on File)
Being there no other business to cane before the Council .
The Motion was made by Kingsford and seconded by Tolsma that the meeting be adjourned
at 9:35 P.M.
