Agenda Ted Gwin, State of Idaho Transportation CITY OF hERIDIAN TRANSPORTATION PLAN MAP 1 Ted Gwin, from the State of Idaho Transporation, was present to answer questions that the Council might have concerning the Meridian Transporation Plan P4ap. Mayor Glaisyer: "In view of the year 2000 Transportation Plan Map that we are currently trying to adopt, .we are concerned about funding for the Eagle Road Interchange, and also for the Pleridian-Kung proposed changes, if they are inside the rural area or outside. How would that effect funding for the City of feridian?" Gwin: "State Highway 69 from Kuna to the heridian City limits is on Federal Aid Secondary Funding System. According to Federal regulations secondary funds can not be used for constuction within the Urban area. State Highway 69 within the Urban area would have to be funded with Urban funds. Eagle Interchange, as far as the Interstate system, can either be funded with private donation, should the Quong development go through, or it could be funded with Interstate funds." "The Findings of Fact and Conclusions were read at the Meridian Planning & Zoning regular meeting held September 13, 1982 in full." "I will read you the Piotion that was made at that meeting." "The fiotion was made and seconded by the Meridian Planning & Zoning Commission that the Commission recommed to the City Council that they adopt the Commission's recommended changes to the Pleridian Comprehensive Plan, and these amendments be delivered to the City Council for their action." "It was a unanimous vote." There was no response. Meridian City Council Meeting 2. September 20 1982 Agenda 3 AMBROSE ANNEXATION, Cont'd . The Motion was made by Kingsford and seconded by Tolsma that the rules and provisions of 50-9002 and all rules and provisions requiring that Ordinances be read on three different days be dispensed with and that Ordinance Number 414 as read be passed and approved. Motion Carried: Kingsford, vea; Tolsma. yea; Brewer, yea; Agenda 4 STEVE NESPIITN - Storage Yard for Vehicles Within City Limits Mayor Glai<<~er• "Mr. PJesmith,you have received a letter from the City Attorney that-your storage yard for vehicles is not in compliance.+wth zoning." (Letter on file with these minutes) "Would you like to make a comment on this?" Nesmith: "This has been there for quite some time. I was not aware that it was not zoned correctly for what I am using it for." "What is the objection df me using this property this way?" Playor Glaisyer refered to the City Attorney's letter stating that the property is zoned "C" Commercial and this zoning cannot allow an automobile wrecking yard nor a storage and impound yard. (Tape on file, City Clerk's Office) "You have the right to apply for a change in zoning or fora Conditional Use or Variance." Nesmith: "It is not going to be used for a wrecking yard." "I repossess cars for banks, and they usually have me store them fora few days while they are taking care of the paper- work." "I have never had more than 10 vehicles at one time, and this has always been a car lot, as far as I know." There was discussion concering the necessary steps to obtain a Conditional Use Permit or a Variance for this property. (Tape on File; City Clerk's Office) City Attorney, Wayne Crookston: "He would have to have a Conditional Use Permit, or a Zone Change." Nesmith: "This letter is the first I have known that I have been using it incorrectly, even though I have been using the property for 5 or 6 years now." Mayor Glaisyer: "We have had some complaints, that is the reason that it came up." iVesmith questioned the possibility of the property having Grandfather rights. Playor Glaisyer suggested that Nesmith check into the possibility of Grandfather rights, and if not pick up a Conditional Use Permit applibaton for the property. The Piotion was made by Kingsford and seconded by Tolsma to approve of a stay of action by the City Attorney, in the case of h1r. PJesmith's storage yard for vehicles, for a period of 60 days, in which time P9r. PJesmith is to make application fora Conditional Use Permit. Motion Carried: Kingsford, yea; Tolsma, yea; Brewer, yea; (Agenda 5 DEBRA COPE - Petition Regarding Obnoxious Weeds around Linder Elementary School Debra Cope presented the Council with a petition for the removal of the weeds around Linder Elementary School. (Petition on file with these Minutes) Cope stated that there is a safety concern for the Children. Cope also explained that there have been several attempts to contact the developer on the problem with no acceptable response. (Tape on File in City Clerk's Office) Mayor Glaisyer instructed Wayne Crookston, City Attorney, to draft a letter to the developer (Nu-Pacific Const., Portland, Oregon) concerning this problem. Councilman Kingsford suggested that the letter elude to the fact that this is an on-going problem, and steps should be taken to control it, such as spraying, and that spraying should be on an on-going basis. i Meridian City Council Meeting 3. September 20 1982 Agenda 5 DEBRA COPE - VdEED PROBLEM, Cont'd . Cope questioned on when results could be expected. Crookston:r;:"We usually give them 10 days after receiving the letter." Mayor Glaisyer thanked Mrs. Cope for her time. Agenda 6 f4ERIDIAN PARK - Request for Variance on Square Footage Requirements Allen Anderson was present representing the request fora 100 square foot reduction per house, and the ability to exchange some of the lot sizes in Meridian Park. There was discussion amoung the Council Members as to whether a variance could be given without a Public Hearing. (Tape on File, City Clerks Office) Anderson explained that time is- a great factor, as several lots are sold and the buyers' are waiting to begin building now. City Attorney tdaye Crookston was asked for his advice on this matter. Crookston read from Ordinance Number 383, section 7, which states that one hearing must be held on the request for square footage reductions. (Ordinance on File with these Minutes) A new plat must also be submitted. There was discussion concerning the interpretation of Ordinance Number 383. (Tape on File City Clerk's Office) Crookston explained his interpretation of the Ordinance. (Tape on File, City Clerk's Office) Crookston: "I think that before you change anything, you have to have a hearing." "That would be regardless if it is to be recorded or not to be recorded." There was much discussion. (Tape on File, City Clerk's Office) The Motion was made by Brewer that Peridian Park Subdivision have the ability to swap house square footage, on the pink lots, lot descriptions to be designated in the minutes, not to change the density of the entire project, with a 5 lot maximum stipulation. Councilman Tolsma: "Is this a legal variance?" Crookston: "You cannot grant a variance on a Public Flearing requirement unless you change the ordinance." P-iotion died for lack of a second. Agenda 7 CLYDE DEh1PSEY - Renew Conditional Use for Snack Bar (1680 W. Pine) Clyde Dempsey was present representing his request for renewal of his Conditional Use Permit for a snack bar at 1680 W. Pine. The Conditional Use Permit was granted March 16, 1981 for a period of 15 months. There was discussion concerning ~empsey's refusal to pay $130.80 due the City for City Services. (Tape on File, City Clerk's Office) For. Dempsey does have City Sewer Service from the Snack Bar. Earl Ward, Wastewater Sup't.: "The Sewer hookup inspection was for the residence only, not on the snack bar." Dempsey explained that the residence is on a septic tank at this time. "The only reason that I went this route ~vith the City was to try to meet the Health Department's requirements. in order to get the Conditional Use Permit.'.' There was much discussion concerning the sewer and water services to the snack bar. (Tape on File, City Clerk's Office) i Meridian Cit.v Council Meeting 4. September 20, 1 Agenda 7 CLYDE DEMPSEY; Conditional Use Permit Renewal - Snack Bar, Cont'd . Councilman Kingsford: "During the discussion that we had some 15 months ago, you said that if there was any problem .out there from the school, that you would just close the thing up yourself." (Minutes from Plarch 16, 1982 on file in City Clerk's Office) "Are you aware of the complaints that the school has had about you?" Dempsey: "No, I am not." Kingsford stated that ahe has been a smoking problem with the students there, that there has been vandalism to the cars in the parking lot around the snack bar. There was discussion concerning the problems surrounding the snack bar. Councilman Kingsford also mentioned the litter problem around the snack bar. Dempsey Presented 2 of his employees that explained the cleanup procedure that is done every day. (Tape on File, Gity Clerk's Office) Police Chief Doug Nichols stated that there is a problem with students loitering during school hours on the snack bar property. This is private property, which prevents the resource officer from intervemi,ng. Dempsey stated that he will work with the Police Department and with the City on any problems. The Motion was made by Kingsford and seconded by Brewer not to extend the Conditional Use Permit on the Clyde Dempsey snack bar. Motion Carried: Kingsford, yea; Tolsma, yea; Brewer, yea; Agenda 8 TOhitM RKS - DISCUSSION on Water-Sewer Hookup and Illegal Water Line hir. Piarks was unable to attend because of a previous commintment. Earl Ward, Wastewater Supt stated that the hookup fees for the sewer have not be paid. The second residence is not hookedup to the City Sewer. Bruce Stuart, Water Dept. explained that there are two trailers in the Catherine Park Subdivision. One is on a meter and the other is hooked up by a pipe from .the first trailer. The second hookup was never approved. Gary Smith, City Engineer state that he felt there was a another problem to be considered with is that Arnie Subdivision will hookup to City Sewer through the Catherine Park. There was discussion concerning the illegal water line and the failure of Marks to pay sewer hookup fees. (Tape on File, City Clerk's Office) The Plotion was made by Kingsford and secondec by Tolsma that the City Attorney send notice to tor. Piarks that hookup fees must be paid within 10 days or water services will cease, and that the illegal water hookup to the second residence must terminate immediately. Motion Carried: Kingsford, yea; Tolsma, yea; Brewer, yea; Agenda 10 Ah1ENDED ORDINANCE N0. 411 Mayor Glaisyer read Amended Ordinance No. 411 entitled AN ORDINANCE MAKING AN APPROPRIATION OF MONEY FOR ALL THE NECESSARY EXPENSES AND LIABILITIES OF THE CITY OF h1ERIDIAN, ADA COUNTY, IDAHO, FOR THE FISCAL YEAR COMMENCING THE FIRST DAY OF OCTOBER, 1982, AND ENDING THE THIRTIETH DAY OF SEPTEMBER, 1983, THIS ORDINANCE BEING KNOWN AS THE At1NUAL APPROPRIATION BILL, AND DECLARING AN EMERGENCY. Last Fall we were inundated with black widow spiders, snakes, bats, ants and other creeping insects. I believe many of these things crawl from the weed field in to the school area. Many students were bitten by spiders, There is also a fear by parents and teachers that undesirables may 6e lurking and hidino in the weeds. We would certainly appreciate some action on this matter, It seems to me that the owner of the property should be responsible for keeping hls land clear of weeds. This situation is a health hazard as well as being an eyesore to the entire area. Our school grounds lend to the beauti- fication of Meridian however, the weeds do not. CODE AND THE UNIFORM BUILDING CODE BOOK OF STANDARDS. WHEREAS, the City Council and the Mayor-of the City of Meridian have concluded that it is iri`the best interest of said City .to amend Title 2, Chapter 1, Section 2-101 by reapealing the present Section 2-101 and adopt- ing a new Section 2-101 to be entitled Adoption of the Uniform Building Code and the Uniform Building Code Book of Standards. NOW, THEREFORE, BE IT ORDAINED BY THEMAYOR AND CITY COUNCIL OF THE :::: CITY OF MERIDIAN, ADA COUNTY, IDAHO: Section 1. That Title 2, Chapter 1, shall be amended by the repeal of Section 2-101 thereof and the adoption of a new Section 2-101 to be entitled ADOPTION OF THE UNIFORM BUILDING CODE AND THE UNIFORM BUILDING CODE BOOK OF STANDARDS and th read as follows: 2-101: ~ ADOPTION OF THE UNIFORM BUILDING CODE AND THE UNIFORM BUILD- ING CODE BOOK OF STANDARDS: There is hereby adopted by the City of Meridian for the purposes of establishing rules and regulations for the construction, alteration, removal, demolition, equipment, use and occupancy, location:.and maintenance of buildings and structures, including permits and penalties, that certain buildingcode known as the UNIFORM BUILDING CODE, 1962 EDITION, of which notless than three copies have been and now are filed in the Officeof the Clerk ofthe City of Meridian, and the same are hereby adopted and incorporated as fully as if set out at length herein, and from the date on which this Ordinance shall take effect, -. the provisions thereof shall be controlling over the construction of all buildings and other structures therein contained within the corporate limits of the City. There is also hereby adopted the Uniform Building Code Book of Standards, three copies of wfiich have been and now are filed in'ahe Office oithe Clerk of the City of Meridian; provided, however, that the following exceptions shall apply to the Uniform Building Code Book of Standards: "Regardless of the provisions of the Uniform Building Code Book of Standards, the City of Meridian shall not allow gravel to be used for foundations in. the construction of any building within the City of Meridian.
