Dough Nichols Minutes of the previous meeting were approved as read. Agenda 1 BSU Agreement for the Old Sewer Plant - James D. Felton, School of Technology Jim Felton presented a design review plan of upgrading the old wastewater facility located on N.ld. 8th Street. Felton stated that since the last meeting their (BSU) surveyor has taken the legal description, located three separate pins, squared off based on existing property lines. There was discussion concerning relocating the building concept so as to square off the remaining park concept. There was much discussion concerning expansion in the future. Kent Krohn, LKT Architects, was also present to consider the Council's proposal to gain a greater square footage in the park area. Krohn stated this could be done. Mayor Glaisyer requested Felton run some sketches relocating the building to see if they would have enough room and then meet again. The extension of N.ld. 8th was discussed. Felton thanked the Council and left the Chamber. Agenda plobile Home Parks 2 Mobile Home Park owners and managers Agnes Hoff, Cherry Lane Mobile Home Park; Dorothy Snider, 4lheel Inn P1obile Planor and Keith Freairan, Embassy Mobile Park were present. Freedman stated that he felt that the trash and sewer charges were unfair and parks should not be charged for empty. spaces, or unoccupied mobile homes, as no service is being received. The representatives also requested a Senior Citizens discount There was much discussion concerning a solution. The Mayor and City Council explained to the representatives the basis now used to charge Plobile Home Parks. The rate structure is set up so that the lower water users are higher per thousand gallons than they are for Mobile Home Parks. They are on discount already. The figure, for example, was that the sewer bill for the Embassy should run on a low month eight to nine hundred dollars if paying $1.10 per thousand - which other residential pay - rather than the $620.00 a month they are now paying. Thus explaining the discount they are now receiving. Williams stated that the 141 spaces in Embassy paid roughly $9.25 ner unit for all services - water, sewer and trash. If they paid as a resident the cost would be over $11.00 per unit. freedman stated that he was not aware of the rate difference and thanked the Council, leaving the chamber at this time. 3""" Pre-termination Hearing - 6later/Sewer/Trash Delinquencies Mayor Glaisyer opened the hearing and read the TURN OFF NOTICE: Mayor: "This is to inform you in writing of your right to a pre-termination hearing Monday, January 5th, 1981 at 7:30 p.m. before the Tdayor and Council, to appear in per- son with retained counsel to be judged on facts and defend the claim made by the City that your water, sewer and trash bill is delinquent. This service will be discontinued unless payment is received in full." M1ayor: Is there anyone in the audience that wishes to come before this pre-termination hearing?" There was no response. Playor: "Delinquent users are hereby informed that they may appeal or have the decision of the City reviewed by the Fourth Judicial District Court, Pursuant to Idaho Code .: • Meridian City Hall - Council .2. January 5, 1981 "Even though they appeal, the water will be shut off" The Motion was made by Orton and "seconded by Kingsford that due to their failure to pay their water bill or to present any valid reason why the bill has not been paid, delinquent services shall be turned off on January 8th, 1981. Motion Carried: Williams, yea; Kingsford, yea; Brewer, yea; Orton, yea Mayor: "The Hearing is now closed." Agenda 4 Other Business Vernon Cairns was present to request water hook-up only on North Linder Road (north of Glennfield Manor) which property is not in the City. Cairns stated that he is building a new home and that since the water line runs by there he would prefer to hook on rather than dig a well. Cairns questioned having to pay both the water and sewer connection fee in order to 'just get the water'. The cost of a water and sewer connection would be double fee. He stated that he already has a septic system by County specifications and Wastewater Supt. Earl Ward stated that it would require crossing Five Mile Creek to get to this property - not an easy job to hook on sewer. Attorney Crookston stated that under the City Bonding Ordinance there would have to be double rate charge totaling 31,660.00. Cairns stated that he would most likely drill his own well for less than that and thanked the Council before leaving the chamber. Agenda 5 Mayor Glaisyer read Ordinance No. 383 entitled: AN ORDINANCE REPEALING SECTION 9-615, TITLE IX, CHAPTER 6, REVISED AND COMPILED ORDINANCES OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO, ENTITLED RESIDENTIAL DEVELOPMENT, EPIERGENCY PNTERIM MORATORIUM, AND PROVIDING A NEW SECTION 9-615 TO BE ENTITLED RESIDENTIAL HOUSING STANDARDS. The Mayor called for anyone wishing Ordinance 383 read in its entirety. Orton and Kingsford questioned the new procedure of minimum housing requirements. Attorney Crookston summarized: A. PJo houses may be constructed which are less than 999 square feet; B. Ten percent (10%) of the houses in a residential development may be between 1000 and 1099 sq. feet; C. Twenty percent (20%) of the houses in a residential development may be between 1100 and 1199 sq. feet; D. Forty percent (40%) of the houses in a residential development may be between 1200 and 1299 sq. feet; and E. Thirty percent (30%) of the houses in a residential development may be larger than 1300 square feet. Crookston: "This Ordinance does not apply to any residential subdivision that was platted without housing minimum square footage - in other words; all of those that were platted prior to the 1350, are still in that ball park. Those that were platted with 1350 sq. foot will have this procedure to come back in, have a hearing and mark on their plat which lots are going to be which minimum house sized - and likewise for any new platting." "This Ordinance is in effect until changed." Kingsford: "One in particular, like Bethavin - they adjusted their restrictive covenants to read 'whatever the City's minimum is' ~ now they would automatically be able to come in and change, and specify those lots - is that correct?" Crookston: "In that particular instance they could before you sign the final plat - there needs to be a hearing whereby they say "Lot 1, Block 1' for example, is going to fall under the 30% over 1300 - 'Lot 2 is going to fall under 10% of 1000 to 1100'. The reason for the hearing is because some of those people already have lots sold and the people that own those lots, whether they are living there or not, should have the opportunity to know if the house next to them is going to have any substantial change in square footage requirements.'° The Motion was made by Williams and seconded by Kingsford that Ordinance No. 383 be approved with the rules and provisions of 50-9002 and all rules and privisions requiring that ordinances be read on three different days, be dispensed with. January 5 1981 Mayor Glaisyer read Amended Ordinance No. 362 entitled: AN ORDINANCE ANNEXING AND ZONING CERTAIN REAL PROPERTY WHICH IS DESCRIBED AS FOLLOWS: SW 1/4 of the SW 1/4, PART OF THE N41 1/4 AND NE 1/4 OF THE SW 1/4, NE 1/4 OF THE SW 1/4, NE 1/4 OF THE SW 1/4, AND SE 1/4 OF THE SW 1/4, ALL IN SECTION 13, T. 3N., R. 1W., B.M., ADA COUNTY, IDAHO, TO THE CITY OF PMERIDIAN, WHICH PROPERTY IS ADJACENT AND CONTIGUOUS TO THE CITY OF MERIDIAN, ADA COUNTY, IDAHO. The Mayor called for anyone requesting Amended Ordinance No. 362 to be read in full. There was no response. The PMotion was made by Kingsford and seconded by Orton that the rules and provisions of 50-9002 and all rules and provisions requiring that ordinances be read on three different days, be dispensed with and that Amended Ordinance Number 362, as read, be passed and approved. Motion Carried: Williams, yea; Kingsford, yea; Brewer, yea; Orton, yea. agenda 6 Addition and Remodling of City Hall Building Following discussion: Mayor Glaisyer: "The City will put this out for bid - we have the bid specs and plans." The Motion was made by Williams and seconded by Kingsford to advertise for bids for the proposed addition to City Hall. Motion Carried: Williams, ,yea; Kingsford, yea; Brewer, yea; Orton, yea 4genda 7 Point of View - Contract for Bus Benches Patrick Quinn explained the general idea. of providing the City of Meridian with bus benches. The benches will be placed and maintained by Point of View which sell advertising space on the benches and pay the City of Meridian $20.00 for each bench per year - providing each bench carries a paid advertisement. They have arrived at approximately 40 benches. Quinn stated that the contract drawn up for the City of Meridian is just about the same as the City of Boise. Jurisdiction"is the City's. Kingsford stated that Planning and Zoning are working on an Ordinance that relates to off-site signs or proposals and this matter should be taken to the Commission for their input. Quinn will be contacted for Planning and Zoning input. 8 Bills Bills were read. The Motion was made by Kingsford and seconded by Brewer that the bills be approved. Motion Carried: Williams, yea; Kingsford, yea; Brewer, yea; Orton, yea. 9 Department Reports: Brewer: "Our Senior Citizens have accepted the revised contract (park property to be deeded for Senior Center) and the simplified legal description is needed." Southwest three acres of the existing park. Crookston stated that all he needed was the description of the park property. Mayor Glaisyer set a work session for legal advise at Attorney Crookstons office 4:00 P. M., Friday, Jan. 9th, regarding an agreement of Developer's Intent by Quong- Watkins Properties (Regional Shopping Center). WHEREAS, the City Council and the Mayor of the City of Meridian, Idaho have concluded that it is in the best interest of said City to repeal Section 9-615, Title IX, Chapter 6, Revised and Compiled 6rdinances of the City of Meridian, Ada County, Idaho, which section relates to a residential moratorium which was to have lapsed 120 days after its. enactment but was included in the Revised and Compiled Ordinances of the City of Meridian, Ada County, Idaho, and replace said Section with a new Section 9-615 to be entitled Residential Housing Standards. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR OF THE CITY OF MERIDIAN AND THE CITY COUNCIL OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO, Section 1. That Section 9-615 shall be and hereby is repealed. Section 2. That the following Section 9-615 is hereby adopted and shall read as follows: 9-615 RESIDENTIAL HOUSING STANDARDS: 1) All new residential housing built in the City of Meridian shall comply with the most recent edition of the bepartment of Housing and Urban Development Minimum property standards, the Uniform Building Code, standards of the County of Ada, and the State of Idaho regulatory agencies and the Ordinances, Resolutions and policies of the City of Meridian. 2) All new residential housing developments in the City of Meridian shall be designed to insure compatability with adjacent existing and/or proposed developments. 3) There shall be dispersed among all new residential developments houses of varying sizes and the following schedule shall set the percentages and ac- companying sizes that shall exist in all new residential develooments, it being understood that the below schedule is a minimum schedule and houses of larger sizes may occupy a larger percentage than as set forth below: A. No houses may be constructed which are less than 999 square feet; B. Ten percent (10%) of the houses in a residential development may be between 1000 and 1099 square feet; _ C. Twenty percent (20%) of the houses in a residential development. development-may be between 1100 and 1199 square feet; _. __ D. Forty percent (40%) of the houses in a residential development may .- be between 1200 ahd 1299 square feet; E. Thirty percent (30%) of the houses in a residential development~~ay be larger than 1300 square feet. 4) All houses below the 1300 square foot size shall be interspersed uniformly throughout the entire development. 5) All new residential housing developments in Meridian shall be subject to design review to insure that the proposed housing units are within an established area of community housing need as defined by the Meridian City Housing Plan which includes the HUD Housing Inventory and Housing Goals and the objectives of the Meridian Comprehensive Plan. ~~ • 6) All new residential housing development plats shall have the individual lots marked showing the minimum size house that will be constructed thereon and no plat shall be recorded henceforth without such indication clearly shown thereon. 7) That, prior to the enactment of this Ordinance, most residential devel- opments and plats were approved by the City of Meridian with a minimum housing size of 1350 square feet being contained in the restrictive covenants of the subdivision. This Section shall not have the effect of removing that 1350 square foot restric- tion. If an owner or owners of a subdivision desire to have this section apply to their subdivision, they shall come before the City Council with an amended plat show- ing each lot and the minimum size house that can be built thereon clearly shown. Said change in the plat shall not be considered as a new platting for purposes of Platting procedure and only the City Council need act on such request, but one hearing must be held on such request within fifteen (15) days prior to notice being published in the official City newspaper and with notice being forwarded by certi- fied mail return receipt requested to all property owners within 300 feet of the subdivision. 8) This Section shall not apply to any residential housing development that was not initially restricted to a minimum house size. Section 3. WHEREAS, there is an emergency therefor, which emergency is declared to exist, this Ordinance shall take effect and be in force and effect from and after its passage, approval and publication as required by law.
