Glaisyer at 11x36 A.M., January l~l, 1981 Councilmen present: Richard Williams; Grant Kingsford; Bill Brewery Rick Orton lr, Others present: Max Boesiger;R.D, Bischoff;Douglas Burnett;Jm Byers~Chuck Peck; Terry Smith;Paul Quong;Lee Stucker;Steve Gratton;Ray Sotero; Coenraad Abas;Paul O15on;Rich Terrell Mayor Glaisyer; "This is a special City Council meeting to consider the agreement by Quong-4Jatkins Properties and also an agreement with. Boise State University. First we will contend with the "Developers Agreement" by Quong-Watkins ~ our City Attorney will not be present today, he is i'n court and it is his recommendation that the Council accent in short form the proposal that was presented to you." "Not the long form..Wayne has no problem with the short form." "Questions from the Council?" Orton: "It does take into account the language we talked about last Friday - and Wayne didn't have any further comments after that?" Mayor: "He has agreed with this" Brewer: "Mr. Mayor, I make. the F1otion that we approve the Agreement of Developer's Intent between Quong-Watkins Properties and the City of Meridian" Orton: "Second" Mayor: "The F1otion has been made and seconded to approve the Agreement of Developer's Intent by Quong-4Jatkins Properties Inc." No response "Motion Carries" Ftayor: "The next item on the agenda is the agreement with the Idaho State Board of Education, Boise State University. The agreement specifically states that the City will deed over the property with the condition that the property not used for education purposes, that the title will revert back to the City of Meridian." "The State will build a classroom, which also can be used by the City. They will fence and landscape it and water will only pass through the facility, The City will have ingress and egress to the property." "P.ttorney Crookston has drafted an agreement, Dick and Rick have met with the architects and revised the site plan to change the building location" Kingsford: "Does it give any kind of specifications in regard to landscaping, both the back section and their basic agreement on doing the City park?" Williams: "Not specifically at this time, but I think they havebeen very cooperative in the past. I personally, with Jim Felton and the people there, have no doubt that they will live up and probably exceed what they originally told us." Kingsford: "I don`t think this will be a problem either but there has been a couple of other places that seemed like that they had good intentions - I would almost like to have that in writing." Williams: "They will give us in writing, the class that they have in this program starting the 19th, and all the people that teach it have said verbally that they will do it. I guess we can get a letter of agreement between them." "If we sign this agreement today I will deliver that over to the people this afternoon and make mention to that fact and ask fora letter agreement." Brewer: "Has it not been the contention from the beginning that it would be up to the City to support the park project, as far as financially?" Williams: "The materials" "They will furnish us design review - they have to, the EPA Grant wont allow them to do otherwise." Orton: "It was hard, from the sheet they brought in earlier, to make a distinction between what they would do in the initial construction or what they wouldn't do. In talking to the architect, I asked him in his subsequent plans to make a better delineation, perhaps just leave the stuff that they wouldn`t do off." Williams: "The reason for this agreement now, if we could, is that there is going to be a meeting with the State Board of Education tomorrow.. I do agree to not sign the warranty deed until the State Board of Education accepts the agreement." i • Special Meetin- Meridian City Council .2. January 14, 1981 Williams: "I would so move that we sign the agreement with Boise State University, with the Idaho State Board of Education, and not transfer the warranty deed over for the property until the State Board has approved the agreement." Kingsford: "Second" Mayor: "There has been a Motion made and seconded to approve the signing of an agreement with the Idaho State Board of Education, BSU, and to withhold the signature on the warranty deed until the Idaho State Board of Education has signed the agreement." All in favor?" Williams ,yea; Kingsford, yea; Brewer, yea; Orton, yea. Playor: "Opposed?" No Response "Motion Carries" Williams: "I will, Mr. Mayor, ask for a letter stating specifically what they (BUS) will do as far as landscaping on the proposed park." Kingsford: "Very good". The Motion was made by Brewer and seconded by Kingsford that the special meeting be adjourned at 11:45 A.M. Williams, yea; Kingsford, yea;Brewer, yea; Orton, yea. Motion Carried. Meeting adjourned.
