Motion Carried: Williams, yea; Kingsford, yea; Orton, yea; Brewer, •yea Agenda Senior Citizens Land Agreement 2 Annie Jones, Chairman of the Meridian Senior Citizens Board of Directors: "Mr. Mayor, City Councilmen, the agreement that the City Attorney drew up has been accepted by we of the Board and Mr. Elwin Grout, the man we have to look forward to for building money has also agreed to this contract. This one, this time, I don't believe any changes were made." Mayor: "Thank you, Annie" Brewer: "As Annie stated, the City Attorney and their Board have arrived at this acceptable agreement through proper negotiations. lde do have a legal description, the three acres in the southwest corner of the new City Dark, prepared by our City Engineer. I think all the proper steps have been taken." Mayor: "Any questions from the Council?" Orton: "I would like to bring up that this ground is covered under the Parks' Department restriction for recreational use, The next step is to ask them to remove that restriction on that three acres in lieu of some other site." Mayor: "Any other comments from the Council?" Williams: "Just happy to see this happen" The Motion was made by Brewer and seconded by Williams that the Council approve the land lease agreement between the City of P•leridian and Meridian Senior Citizens. Motion Carried: Williams, yea; Kingsford, yea; Brewer, yea; Orton, yea Brewer: "I would like to make it clear, in behalf of the Senior Citizens, that the acquisition of this land does now put the Senior Citizens in a better light in the respect to being able to obtain government grants. They are in the planning stage of an annual fund raising event that will be carried off and in the hopes that this will bring about a private donation cause that may be a snowballing effect. The official signing of the document we would like to have take place tomorrow and have the news media take some pictures of the Mayor and the Senior Citizens." Agenda 3 Loren Foss - Hearing on Rocky Mountain Meat Sewer Charge Loren Ross: "Mr. Mayor, City Councilmen, you probably know in reviewing some of your notes, I don't feel in my position that being charged for sewer equipment on the building that we lease to Rocky Mountain Meat. Due to legal advise that we have had there doesn't seem to be any strong wording that this is a valid charge - it is more in relation to new hookup opposed to existing hookup, and this would be our position at this point." Mayor: "Mr. Ross, what was your original occupany in the building?" Ross: "Furniture business" Mayor: "What is the use now?" Ross: "Meat business" "Retail, I should say" Williams: "With this the use has changed substantially, both water consumption and the waste that is required to be treated by the plant and I think it would be our interpretation of the ordinance that the building should be assessed at its highest and best use, of which it could be at. In this case there were substantial changes made an City Hall :3; February 2, 1981 in the use of the building and inn the sewage being treated. I think the Board of Appraisers backed up the feelings of Bruce (Public Work`s) and Earl (Wastewater) that this was an equitable rate." Ross: "Does my monthly fee have anything to do with this?" "I pay for my volume, doesn't that mean anything?" Williams: "You pay for the volume, that is the monthly charge. But also, to treat that type of waste we have to enforce certain expenses, the monthly expenses are for the operation and maintenance not for the capital expenditures that we as the City have incurred." Ross; "That applies to all businesses as opposed to ,just new structure?" Williams: "That applies to virtually any business that has substantial change in the use of the building - then we have the ability to come back in and assess that at the highest use." Ross: "Is there any place in the ordinance that would state that once I pay this fee that I will not be billed again upon another occupany? If there is, I can't find it" Williams: "If the use changes substantial" Ross: "Right now we are talking about three (3) Hookups - suppose I go back to a one (1)?" Or I go back to a two (2)?" Williams: "You have paid for the highest use of the building as used" Ross: 'Your position is that I am duty bound to pay this, is that correct?" Williams: "This is our interpretation and I think this is what the Board of Equalization has said" P1ayor: "The Board recommended that you pay it and it is now for the Council's action, if the Council want`s to overrule they can do so." "Is that right Counselor?" Crookston: "That`s correct" Orton: "Is the fee that you are objecting to, the sewer hookup fee - the $1200?" Ross: "Tt's been reduced to $800.00 - giving me credit for the $400.00 that I paid at one time." "Yes, that is my objection" Mayor: "Any other questions from the Council?" Williams: "Just one regarding reduction of fees as opposed as to what our bonds say we can do." Crookston: "That would be different" "I think I have reviewed these ordinances to quite a degree and they are fairly clear in that the City Council appoints the Board of Appraisers - the Board of Appraisers has basically two responsibilities, set the initial charges - whether they be on a monthly basis, whether they are industrial cost control recovery, inspection fees, permanent fees, etc. Then they are to review those, and the equivalency rates every year by the 20th of August. They are also to stand as a board of review to hear complaints and set rates that do not fall within aiexact schedule that is set out in the ordinances, you may have a business that doesn't fall within the enumerated schedule and they have the responsibility to set those fees. They also have the responsibility under the industrial cost recovery portion of the ordinance to review each of those industries or users that falls in that classification. The Board is supposed to take a look at the charges, or raise, on a annual basis, which I think they have done. The Board of Appraisers are to adjust, or charge or make certain that charges are closely as possible equal to all similar type users. I would assume the closest equivalent to Rocky Mountain Meat sq. footage would be Meridian Meat and Sausage - so their rates should be similar. The ordinance is designed to take into consideration changes of uses." Kingsford: "So you are saying that the Board of Appraisers have the responsibility to review, .for example Cherry Plaza, changes that go in there?" Crookston: "Right, besides the annual review'''' Ross: "Why were ~erotadvised of these fees until six months after we negotiated the lease?" "Is that a normal routine of business to not let a businessman know what these fees are at the time lie is trying to negotiate his costs?" Mayor: "To answer your question, Loren, I hope it is not a procedure and it seems to me that this was hushed through so that you could get your tenants in there to get them started." Orton: "The lease was signed way ahead of when a conditional use and a building permit were required and that is when our mechanism goes into action. The ordinance does pretty much stand on its own, its highly technical and sometimes hard to understand and interpret, but sq, footage requirements for sewer .and water hookups are explained in this ordinance. But our mechanism does not swing into action until we get a building application - T don''t consider this our fault. I did think our primary conversation did mention hookup fees." Mayor: "The application date was 5.23.80 and the meter date installed was 6.4.80" "So there was eleven days between application and installation" Ross: "I was not advised of my hookup fee until November" "I think there is some erroneous things when people work with it every day - if I had been advised that there was a sewer ordinance at that time it's not hard to read. I don't work with sewer and water every day - those that do should have some answers available." Mayor: "You have a good point" :..., ridian City Hall .~. February 2, 1981 Orton: "I think I consider this a uniform application - a consistant application of our waterworks" The Motion was made by Orton and seconded by Brewer that the Council that the application for water and sewer hookup stand as recommended by the Board of Appraisers for Rocky Mountain Pleat. Plotion Carried: .Williams, yea; Kingsford, yea; Brewer, ,yea; Orton, yea Agenda 4 There was discussion concerning methods of informing applicants of charges before installation. Meadow View No. 2 - Ken Montee Montee: "The purpose as to why I am here this eveninn is to request approval of the souare footage basis on our lots in Meadow View and c~et a clarification on part of the ordinance. The ordinance states that these units be designated per lot and we would like to know if there is any consideration given to switching one lot to another once that designation is named." Mayor: "How are we going to administer that?" "Are you going to bring in a plat every time you do this?"' Plontee: "I don`t know how we can do it - weve got about five builders that have actually signed earnest money and some of them are "'subject to" clarification of this ordinance, the question has come up that if they get a build ,job fora certain sized house,and they only have so many lots and a buyer would like to have another lot. what could we do? The ordinance states so many lots are a certain percentage of square footage and we thought possibly we could come in and the building department could change lots "to such and such" - the building department cou}d monitor that. Kingsford: "louldn't this end up being in your restrictive covenants - which lot and block to be which size?" Montee: "At this time we have not redrafted the restrictive covenants because we do not know how they are going to be drafted." "Originally we were lust going to draft them 10% of the lots would be 1,000 square feet, 20% 1,100 - then we have to designate each lot building restrictions." Mayor: "I think vahat you are talking about for example, you have one lot with 1,000 square foot, the builder comes in and wants to change that - now if he's going to upgrade that square footage higher, my interpretation is that he can go ahead and do that." "But you can't go down." Williams: My biggest conern, people would 6e buying specific lots knowing what would be next to them, and if someone had a 1300 sq. foot lot and had bought those lots under that premise - if that premise changed in the middle,I would be concerned about that Mayor: "The other thing too is that you have to have a public hearing on that."' "If you want tq upgrade, fine." Montee: "Then the square footage for so many lots could not be monitored ,lust by once that many lots, or when building permits are issued couldn't you say "no more 1,000 sq. footage lots?" Mayor: "If you have a public hearino and people want to look at your plat - if you amend the plat every time you want to make a change there is no sense having public input on it." "When you bring in your plat, like you are bringing in now, you have to have one public hearing - and that is put on record for the building permit." "When you come in for permits the building inspector can check off the lots." There was much discussion concerning a buyer that has a plan not fitting proposed lot and switching, the function of a public hearing and how the subdivision relates to the surrounding property. Mayor Glaisyer read from the Ordinance No. 383 Said change in the plat shall not be considered as a new platting for purposes of Platting procedure and only the City Council need act on such request" Montee stated that he felt the building inspector could control the change of sa. footage. Kingsford stated that he could see that the Gity would 6e caught in the crossfire "If the people-who live adjacent to lot change db not come to hearing they are going to show up later questioning the City"s amepdng something" "If it doesn't require an amendment, just actigp of the Council, then there wouldn't be notice for mailing --I'-d be disturbed if I was next door to the one that originally wds gging to be 1,300 and ends up 1100." Plontee; "T guess our problem is we have builders ready to build as soon as we know what we can do here. If we have to ga through a public hearing, re-recording plat, we are looking at a longer time frame -, my understanding was that this would go on Meridian City Hall .5. Februarv 2 1981 record in your office, in the building department, all lots designated what they can build on it. Playor: "The building permits will show what the lots are going to be, and I hope we are not going back to the replatting process." Crookston: "The differential is that new housing developments, someone that comes in now and starts their platting process have to have that marking on their plat - and that will have to be recorded on their plat. Montee has already been through the plat so he does not have to go through the platting procedure but from the time this ordinance was adopted (Jan.5.81) any new platting with square footage requirements would go right on the plat." Mayor: "Does Ken have to have a public hearing?" Crookston: "Yes" Montee: "In a standard situation, if a subdivision wants to change sauare footages - you change covenants? "We need to find out what we have to do" "We were going to ask you to adopt this (indicating map on display with percentage lots) with the request that we could chanoe one lot to another. If that's not acceptable we are asking you to adopt this". Kingsford: "To adopt this, the way I understand, the ordinance does not require a public hearing?" Crookston: "They are putting a change on this plat - for Council purposes he has to have a public hearing - and give notification by mail to people 300 feet around." "He does not have to go through platting purposes. Anew developer coming in putting the square footage on the plat would be part of the process we go through, or he could stay with the 1350 foot standard." Crookston: "Let me state my thinking why this is in there." "This is in there to provide for the situation where the developer decides he wants to go with reduced sq. footage, but he's already sold lots. Well, the individual that has already purchased in there - he has got to have notice that next door he`s going to have a a 1000 sq. foot next to his 2400 sq. foot home. He has got to have notice that this is going to be changed - if you don"t provide him notice he is being denied due process rights. "Same as if there was a zone change in there or a conditional use." lilliams: "This is a new subdivision and there has not been anything built in there" "my question is - we obviously cannot give approval but does anyone see any objection that Ken may work on before the public hearing?" "I've looked at this since December and I personally do not have any objections to it." Roy Bryan in the Council Chamber stated that he just sold 28 lots in there and the builders are ready to go in a week. The homes range from 1,000, some 1400 and 1500. The Mayor stated that the 1400-1500 would be no problem - they could start building tomorrow. Williams stated that if they are above 1350 sq. feet now they could come in tomorrow morning and get building permits. Bryan stated the zero lot lines are running from 1,000 to 1,400 but mainly the ones in now are running 1150 to 1350. Crookston stated they can go up in sq. footage but not 'substitute. Bryan stated sometimes then get. right down to a narrow lot and cannot figure out a plan that will go on that lot. Mayor: "My suggestion to the Council is this - I think we have done a good ,job of working with the builders ,I think we have come down to somethine thats reasonable for both of us, I think we should stand by what we have already adopted as an ordinance and approve this on contention of a oublic hearing, go ahead and get the verifiations out, the public hearing and get them started." Kingsford: "Ken, wasn't Dart of those lots, zero lot line lots, under 1350 if they were approved you could get building Hermits on those, whatever they were originally approved for on Final plat." The City Clerk was instructed to publish for hearing regarding Meadow View No. 2 for percentage sq. footage lot changes. The Mayor thanked hSr. Montee and Montee left the chamber at this time. Benda police Officer Step Grade Salary 5 Brewer: "Sgt. Nichols, in your opinion is Officer Estes and Officer Williston deserving of a step in grade?" Sgt. Nichols: "Yes, they are." ~1't011: "Howmuch are these step in grade ra ises?" Brewer: "Eioht percent." leridi_an Cit~Hall 6 February ? 1981 Orton: "Step in grade process came before I came nn the Council - I don't really understand it. How does this work?" Brewer: "It's designed and acceptable in all the areas around the state, whereby a man puts a degree of time in a certain. step he has then earned a 8% stepping grade, to pass onto the next one. It is a training process that is acceptable and used throughout the northwest." Orton: "Is it in any way related to performance nn the job - I mean, could these step and grade pays go to somebody who isn't performing?" Brewer: "Definitely No, that is why I addressed Sgt. Nichols the way I did, a man has to improve a~~d earn it - and show his work." The Motion was made by Brewer and seconded by Kingsford to approve the step and grade wage increases for Officer Estes and Officer Williston, Meridian Police Dept. Motion Carried: Williams, yea; Kingsford, yea; Orton, yea; Brewer, yea 3enda 6 Bills were read. The Motion was made by Kingsford and seconded by Orton that the bills be approved. Motion Carried: Williams, yea; Kingsford, yea; Brewer, yea; Orton, yea 3enda ~ Phil Harper - Sheri-Lynn Subdivision Harper: "Mr. Mayor, City Council" "I have a copy of map to display and a copy of restrictive covenants. The top item on page 2 is a change of restrictive covenants (c) Minimum housing size." Mayor: "You know what you have to do - you have to have a public hearing." Harper: "Yes" "I have one question on the public hearing. I don't have anybody within 300 feet within the City limits." Kingsford: "Then you haven't sold any of your lots?" Harper: "No, other than lots in Meridian Park" Attorney Crookston: "Somebody owns property around there within 300 feet. They don't have to be in the City - they should have input." Harper: "I think there is probably two, plus the subdivision, there's two brothers - one of the brothers I bought this property from - that would run up 300 feet to the north and west. West there would be property owned by Jim Stubblefield, I think." The public hearing was discussed and the City Clerk was instructed to publish for hearing February 26, 1981. Pete Cope Well Drilling Settlement Attorney Crookston advised the Council to approve settlement to Pete Cooe 4~1e11 Drilling. The Motion was made by Orton and seconded by Brewer to approve a settlement with Pete Cope Well Drilling in the amount of $2,500 out of Sewer and Water Enterprise Fund. Motion Carried: Williams, yea; Kingsford, yea; Orton, yea; Brewer, ,yea Engineering: Engineer Gary Smith, J-U-B Engineers, Inc., explained bill from C. Wright Construction Co., Inc. for installing a gate, built about 350 feet of road, constructed steps and a platform. This pertains to construction of the access road from the treatment plant out to Five Mile Creek so that the sampling could be made. They still have work to do such as road grading and compacting. Smith recommended that 20% of $4,132.00 be retained and that the City pay $3;305.60 until work is done. The Motion was made by Williams and seconded by Kingsford to pay 80%, or $3,305.60 and retain 20%, $826.40 to C. 4Jright Construction Co., Inc., Sewage Treatment Plant and to have those funds transferred to the Construction account. Williams: "There will be a public hearing on Wednesday, Feb. 4th, at 7:30 at the Maple Grove Elementary School, regarding I-84 interchange study. I'm making the Council aware of this and hope that they can disseminate this information to the general public if they want input into this study." Mayor: "Anybody from the audience wish to state anything to the Council?"
