at 7:35 P.M.

1 Mr. Lind, Representing Stinker Station - located on South Pleridian/Kuna Rd.
President of Council Williams: "Is Mr. Lind present?" There was no response

Dan Golden was present to request a variancefora six foot fence on his double
frontage lot located 2644 Rebecca Way, Sunnybrook Farms Subdivision.
Golden: "We would like this variance to allow a six foot fence around the back yard
and out to the sidewalk."
Wi.l.liams, addressing Bldg. Inspector: "Vern, do you have any comment?"
Vern Schoen: "We always have problems with fences on corner lots. One location
in Cherry Lane Village had a six foot fence and no permit - I made them cut it down.
If we allow these we just as well amend the Ordinance to allow all six foot fences."
Williams: "It appears on Mr. Gold en's drawing that there is not going to be any
obstruction."
Kingsford: "This is a double frontage lot."
Williams: "The only problem I see is that he is building over an easement."
Schoen: "Fence Ordinance allows this." "But if you do allow, you are going to
have a lot of them come in for that."
Brewer: "What would be wrong with this if they don't affect the sight angle
anymore than .this gentlemen's?"
Schoen: "I would like to see the fence ordinance changed so that everybody could
build right out to the front."
Kingsford: "This is an unusual situation though - I hate to see six foot fences,
but then heis~talking about a backyard and a double frontage lot - I don't think we
would have many."
Williams: "Looks to be about 70 to 80 feet -"
Golden: "I have measured 75 feet from where I would like to put the fence"
Williams: "Back from where the radius starts?"
Schoen: "'Chat's more than what your ordinance calls for."
Golden displayed a photograph to the Council to give them an idea where the fence
would be located.
Chief of Police Nichols: "I was out there today and there would be no visual
obstruction."
Brewer: "I think the circumstance is peculiar enough in this instance that the
City should be able to allow it."
The Motion was made by Kingsford and seconded by Brewer that the Fence Variance
be granted to Dan and Vickie Golden, 2644 Rebecca Way, Sunnybrook Farms Subdivision,
as outlined in their request outline."
Motion Carried: Kingsford, yea; Brewer, yea; Orton, yea
Williams: "Golden's do have the necessary signatures on file."
Brewer: "As this fence goes up if you have anyone 1n the area come to you and
wants to know why you are doing it - why you are able to do it - I would like you
to make it known why you were given t:he privilege."
Golden: "Yes sir, I wia.l."

Agenda Milton Subdivision Preliminary Plat - 1304, 1312 and 1316 2 1/2 Street

Dick Fischer: "I am with Potter and Associates and Mr. Milton was unable to attend.
The reason for this Preliminary Plat is that this property is in an Estate,
they tried to sell the property as a whole and it didn't se11.~They would like to
make a lot around the single family residence, Lot 3-- Lot 1 around where the duplex
is and Lot 2 the vacant lot in the back which is undeveloped. Owners of this
property are not going to develop this in any way - just want to split it and sell it.
The comments that were put forth by Councilmen on this - the sewer line is in the
back 130 feet, we've shown an easement back there, a 10 foot easement and this could
be whatever the Council would desire - if they would like it wider. The one question
that was brought up about the fences by Mr. Orton - that has been taken care of and
the existing fence lines are going to be used and quick claims are going to be granted
from everyone involved. There has been a lot of problems out in that area and we
uncovered an awful. lot. As far as doing any roadwork on 2 1/2 Street or on 4th Street
- 2 1/2 Street would be done under a LID at a later date according to ACHD and they
have a statement in there that"prior to development of Lot 2 ACHD shall review and
approve the Lot access and development plan and this restriction will be delineated
on the plat". As far as what Mr. Williams said about the property already being
subdivided once - the whole block has been subdivided, this is no different than the
Subdivision to the North of it. It's basically like Olive-Dale Subdivision - this
was part of this block to begin with. I feel we have gone all courses that we
possibly can on it. As far as the water line on 4th Street that Cary Smith
brought up, we feel that that should be extended when a developer goes in and does
the development on the street. Planning & Zoning has put a restriction upon this
property saying that there will be no structures or building without going back
through them and back through you people, so it's covered in that area."
Orton: "If you do some development in the future, you have a choice of either not
platting that large lot or platting again, is that correct?"
Fischer: "Anything that will be done to that lot is to go through the Planning and
Zoning again. Anew plat would obviously have to be filed. This is a Preliminary
Plat and there is a Final Plat definit$y being filed - I didn't draw anything up
on a Final Plat until we got approval of the Preliminary Plat. But there is every
intention of Filing a Final Plat on this property."
Kingsford: "What advantage in having I.ot 2 involved in the platting process -
I think I would rather see it be unplatted, and plat hots 1 and 3."
Fischer: "lf you plat Lots 1 and 3 you are creating Lot 2. He owns the whole
parcel, we are replatting to make three lots."
F':ischer: "As to the concern of the Fire Department, we are not changing anything
that is already in existence out there. When Lot 2 ever does get replatted then
there would have to be new configuration for the streets, access, etc."
Kingsford: "Is a L0 foot easement enough for the sewer?"
Earl iJard: "Too small - this is not a good location and would have to have a
16 foot easement."
Fire Chief Welker: "We have done this before without proper easements, street
dedication - all we are doing is compounding the problems existing there without
having that back lot platted. Everything needs to be handled in one basket."
Fischer: "We rre dedicating 30 feet on Third Street and we are dedicating 30 feet
on 2 i/2 Street."
Kingsford: "Is that what ACHD asked for?"
Fischer: "Yes"
There was much discussion concerning future development.
Vern Schoen, Bldg. Inspector: "One split doesn't have to be platted and if has
street frontage can get a building permit legally. This one does not have street
frontage - it has access but no frontage"
Kingsford: "I appreciate Dick's (Williams) concern that we don't have the personnel
to research everything that this body, or Planning and Zoning, has done before
building permits are issued. if you use a manner of standard procedure, look at it
and catch that, I wouldn't be too uncomfortable with it."
Schoen: "It's a standard procedure for a multiple unit anywhere. In other cases I
have told them this has to go through Planning and Zoning."

Kingsford: "What I'm questioning is would you catch the stipulation that this
has to go through Planning and Zoning before any building:
Schoen: "Oh yes - there wouldn't be any problem there."
Orton: "This is currently a platted lot, as a whole, and by doing what they are
requesting here we aren't really changing our status with them at all but they
will be able to market these two lots individually. This open piece has the same
status now as it would after we do this thing - frankly, a platted lot in the City
of Meridian zoned A Residential."
The Motion was made by Ortonand seconded by Brewer that Milton Subdivision
Preliminary Plat be approved subject to property line agreements and that no
development of any kind, or building of any kind, take place on Lot 2 until
brought back to the Planning and Zoning Commission and the City Council; and
with the stipulation that the ten (10) foot utility be changed to sixteen (16) feet.

Urban Sewer Boundary Map
There was discussion concerning potential development area, specifically the
Warmington Mall Proposal (Paul Quong), ].orated SE corner of Franklin and Eagle Rd.
This area is not included in the Urban Sewer Boundary Map.
President of Council Williams: If Mr. Quong is able to come in and is ready to ge
I think that the Council, as in the past with situations like that, can work very
quickly to accomplish the goals."
The Motion was made by Kingsford and seconded by Brewer that the Council approve
the Urban Sewer Service Planning Area as Commencing at the corner of Black Cat and
Ustick Road going South along Black Cat Road to Ten Mile Drain, along Ten Mile Drain
to Linder Road, South to Overland Road, Easterly along Overland to City Limits and south
along City Limits, going straight East to the present City Limits of Meridian Greens,
around Meridian Greens the southern most City Limits, then straight east to Locust
Grove, then straight north to Franklin, then east midsection line between Locust
Grove and Eagle Road, then straight north to Ustick and back to the beginning.

Rick Jarvis, Ada Planning Association: ~'As you know I gave you a draft of policies
for Ada County Domestic Waste Treatment Management Plan with procedures for
amending that 201 Boundary. We would like you to read those over and we would like
to discuss this with you at the Council meeting May 18th."

Senior Citizens Housing Project Input - John Trowbridge
Trowbridge was present representing Halbeth Management & Conculting Services
and stated that Hal Hogan had been approved as a HUD Coordinator, HUD has approved
a project in Ada County and they felt Meridian has the facilities to allowa
Senior Citizens project. Trowbridge stated that they had looked at three properties
John Tromburg (East of 2 1/2 Street); Lembke property (King & Meridian St) and
Art Moore, (East Pine). This project would need high density zoning. There is
$914,000 allocated for a project in Ada County.
It was the feeling of the Council that Trowbridge should contact the Senior Citizens
President, Elizabeth Ryan and work with that group.

Ag~nda HUD Community Block Grant Workshop - Coeur d'Alene, Idaho
The Motion was made by Brewer and seconded by Orton that the City incur all
reasonable expenses to enable Councilman Grant Kingsford to attend the
HUD Community Block Grant Workshop in Coeur d'Alene, Idaho on May 7th and 8th, 1981.

Agenda Ordinance 11388 - Linder Industrial Park Annexation

President of Council Richard Williams read Ordinance 11388.
The Motion was made to adopt Ordinance No. 388 and then Motion withdrawn. Motion
Carried. Ordinance No. 388 Linder Industrial. Park to be read with the addition
of Zoning classification at the May 18, 1981 regular meeting.

9 Cherry Lane Recreation, Inc. Letter regarding infringements on City property
i.e. golf course property.
The letter from Manager Wally Lovan was discussed. (Letter on File with these minutes)
Supposedly there is a resurvey taking place at this time.
Attorney Crookston was instructed to contact City Engineer Gary Smith, who was not
present at this meeting.
The Council felt that J-U-B Engineers, Inc. should meet this on their time.

Councilman Brewer stated that the property on the westerly boundary of Sunnybrook
Farms had several trailers, tent or camp type trailers. He requested that this
be investigated.
Councilman Kingsford reported that there are weekly garage sales taking place
on the recently annexed J.M.K. Properties, corner of Franklin and Linder. The
legality is to be investigated.
President of Council Williams announced that the Mayor's Prayer Breakfast will be
held at 6:45 A.M. Tuesday, May 5th at O.J.'s Restaurant.
There being no other business to come before the Council the Motion was made by
Kingsford and seconded by Orton that the meeting be adjourned at 8:45 P,M.

Dear Joe,
Regarding our conversation of infringements on City property i.e.
golf course property.
The property at 1870 Incline Way, owned by Mr. Ron LaFever and
nox up for reaale~ appears to be infringing on golf course property.
This infrongement is by a tree and a line of irrigation sprinkler
header approximately 8~ into the fairway.
The property at 3920 Sugar Creek Drive owned by Mr. Michael
Bolan also appears to be infringing on golf course property.
This infringement is by afence-shrubs on golf course property.
Fie at the ~#olP Course welcome everday usage~of golf course property
common with golf course living. However, some infringements are
determental to continuity of play (out of bound stakes) and to the
maintenance of the course with the larger golf course equipment.
Fla feel the city should cheRkinto this matter.
