Councilmen Present: Richard Williams; Grant Kingsford; Bill Brewer; Rick Orton Jr. Others Prewent: Earl Ward; Roger Welker; Gary Smith; Vern Schoen; Bruce Stuart; Jim Potter; Ray Sotero; Coenraad Abas; Kathy Williams; Steve Gratton. Minutes of the previous meeting held September 21, 1981 approved as read. Agenda 1 Franklin Condominium - Jim Kane dba Valley Contractors Jim Potter, Potter and Associates, was present to represent the. proposal of converting a 4-Plex, located Block 5, Lot 11, Franklin Square to Condominiums. Certified Mailing and Notice of Public Hearings were initiated in June, 1981. Proposal was tabled August 3, 1981 and then deferred to September 21 and present meeting. Potter: "The Plat of Franklin Condo's was tabled for negotiations with tir. Schoen, Bldg. Inspector, regarding modifications to the structure." (Potter displayed drawings of the existing structure and explained modifications) Tape on file. "We see no problem with complying with the review comments from City Engineer Gary Smith, as far as complying with State Law. I question item number 3 which indicates we ought to identify with space with unit (parking), normally that's held in common". Smith, City Engineer: "This should be shown on the declaration." Schoen, Bldg. Inspector: "This is one of the better four-plexes and I think one that can be accepted." Mayor: "Questions from the Council?" Rick Orton: "The last time we talked the big question was in regard to the variance to the code - extending the wall through the roof? Potter: "Yes" Orton: "So this get's over that problem - with complying?" Potter: "Yes" Kingsford: "Was there some question about the floor being common as well?" Potter: "The crawl space - Yes it is." Williams: "The hook-up problems have been resolved?" Potter: "There are individual hookups." Williams: "Sewer?" Potter: "Yes" Stuart, Public tdorks." Some of them I checked but I can't remember what I found out. Some of those are not - with the sprinkler system, there are only two meters in to- gether." Potter: "I talked to the plumbing Contractor and of course Jim Kane himself, and they have assured me that they were all separate." Stuart: "They may have hooked the sprinkler system to two of them - without a check valve,could be cross connected." Potter: "That certainly can be corrected if that's the case." Ward, Waste4dater Sup't.: "Did you decide on a common interim for the sewer?" Potter: "That will be covered in the restrictive covenants". Orton: "What action does this (Proposal) require?" Playor: "Approve the conversion I think." Potter: "This was sent to you with the recommendation to deny until the Codes were met" Orton: "Your next step would be to get a building permit approved?" Potter: "Correct" Schoen: "Re-Platting" Orton: "I see, you need the final plat to come through" Potter: "And protective covenants--you will have a chance to review those, plus his declaration in sales material." Williams: "Which comes first - the approval to go ahead and have this brought forward as final plat or for construction to start." Potter: "I think we would prefer to have the Preliminary and be able to proceed with Final platting." Attorney Crookston: "I think you have to have your plat first." Meridian Cit Hall .2. October 5, 1981 Agenda 1 (Cont'd) Franklin Condo's...... Mayor Glaisyer: "If you don't have anything further go ahead with your platting." Potter: Do we need action since we are appealing Planning and Zoning decision - their conditional recommendations?" "We would like some evidence of approval before we go on." llliams: "There's no recommendation of denial though - all they said was recommending denial until project was brought into compliance with the City Codes. So, if you bring it into compliance with the City Code that would let it go through." Potter: "Fine, if you'are satisfied." Orton: Vern do you have anymore questions about this?" Schoen: (Indicates no) Potter leaves the chamber at this time. Agenda Wayne Forrey, J-U-B Engineers, Inc., was present to bring the Council up to date 2 on the HUD Grant that the City has received. Forrey presented a pamphlet entitled CITY OF MERIDIAN COMMUNITY DEVELOPMENT BLOCK GRANT U.S. DEPT. OF HOUSING AND URBAN DEVELOPMENT SERVICE LINE REHABILITATION PROJECT GRANT N0. B-81-DN-16-0001 September 1981. Forrey questioned if the Council thought this pamphlet was adequate to describe the project. He stated that he had rewritten the pamphlet so that it would not be top'techrhical. Forrey: "We are going to have each of the homeowners to sign a form stipulating that the contractor can enter upon his property and perform the work. I don't know exactly the liability and how that is going to fall into place - if they would want to sign a release to the City of any liability and put it on the shoulders of the contractor -and when we get to that stage we should sit down with the City Attorney and work those kind of things out." Councilman Orton: "I would prefer to see us avoid that liability - that we owe a $500 rose bush, etc. In my opinion it would be much better to find a way to have the individuals do the actual contracting with the contractor." Forrey: "We discussed that briefly at the last Council meeting, among the Council, and I think we pretty much realized that one contractor would be cost saving. But we can change the approach at any time.. I'm not so sure it would help from a liability standpoint - it would add cost to administration going that way." Mayor: "The contractor will have to provide liability to the City" Forrey: "Yes, a licensed public works contractor. That is your normal procedure." Any other input from the Council on that?" Kingsford: "This is basically what we went over with you .last time?" Forrey indicates yes. Williams: "Ply question is, do we even need to reference the City Ordinance on the discharge of ground water. I don't want to sound vae're using that like a hammer over their heads." (referring to pamplet on file with these minutes) Forrey: "It might be a little heavy handed." Williams: "What we want to do is correct the problem but I don't want to say "if you don't do this we may impose a fee on you" because I don't think that is the intent of the City." Brewer: "Why could it not be mentioned "but not hold a liability" in there?" "I think we should address the problem." Williams: "The volume of ground vrater is the reason tae're doing this." Mayor: "You may go back in a year and charge people if their not going to clean them up - if we can't keep infilitration down." Williams: "Well,I guess we can leave that in there (pamphlet) as an "out" if we get a low response from people." Forrey: "Does your ordinance file an imposition of a fee? If it's determined that they have a problem?" Crookston, Attorney: "I can't recall at this time." Forrey: "I will give you a call tomorrow - this is just a draft form and I would like to get the answer before we print it up.° What I would like to do is send this pamphlet through the mail to each of those residents, about 70 that we know have a leaky service line but we don't know if their low-moderate income. But reading this we can always follova up with them and determine that." Forrey presented the Mayor and Council a brief form that could be used for these residents to certify that their 1981 combined family income will be no greater than $20,800.00. (On file with these minutes) Forrey: "This form might be acceptable and they may be willing to sign it. If Meridian City Hall Agenda 2 (Cont'd) HUD Community Block Grant...... LaWana could take the calls as they come in, make a list, and I would follow up with those people to find out if they are eligible and explain it." Williams: "Should we send these out with the Brochure." There was discussion concerning sending the questionnaire on income with pamphlet and it was decided to handle this at the time of signing a release and enabling the answering of questions. Forrey: "We did make the draw-down and there is 510,000 in the Idaho First National Bank as of the 30th of September (1981) and as the Council instructed, I went ahead a made the J-U-B bill concurrent to the 30th to close out the fiscal year. The City accounts now can be reimbursed from the HUD money." enda Forrey reported on the meeting with the Senior Citizens. Liaison Bill Brewer 3 and about 30 Senior Citizens attended. Forrey stated the next step would be to schedule public meetings to solicit ideas to go after a HUD Grant for a Senior Citizens Center. The City would have to make the application. Forrey has donated his time on behalf of J-U-B Engineers, Inc. to give assistance. Councilman ~~!illiams expressed appreciation of J-U-B donating this time and effort on behalf of the Senior Citizens. There was discussion concerning public meetings and hearings. (Tape on file) Forrey stated by December they should have their meetings out of the way. Councilman Brewer stressed keeping everything open giving everyone a chance to be heard in order not to jeopardize the application for this Grant. October 5, 1981 Agenda DEPARTMENT REPORTS: 6 Fire Chief Welker requested approval to send two (2) QRU Volunteers to Bend, Oregon fora Training Officers School. The Motion was made by Kingsford and seconded by Brewer to approve $300.00 to be allowed for two QRU peronnel to attend a Training Officers School in Bend, Oregon. Motion Carried: Brewer, yea; Kingsford, yea; Williams, yea; Orton, yea Attorney Crookston: "The first part of September the City of Meridian received a claim pursuant to the Idaho Tort Claims Act by 4lilliam Creek, arising out of an arrest made by the Meridian Police Department. I have investigated it and recommend denial of the claim." The Plotion was made by Williams and seconded by Kingsford that the claim filed against the City of Meridian Police Department by William Creek be denied. Motion Carried: Brewer, yea; Williams, yea; Orton, yea; Kingsford, yea Agenda American Arbitration Association Inc. - DVY Construction 7 Attorney Crookston presented a bill for $900.00 from the American Arbitration Association Tnc. stating that the first bill for $1,880.00 was in error. He recommended that this bill be paid and that the payment be mailed from his office. The Motion was made by Williams and seconded by Kingsford that the American Arbitration Association, Inc.,advance arbitrators compensation in regard to DVY Construction Co., Inc. be paid $900.00 and that the funds be transferred from the General;Fund to the Construction Account for payment. Motion Carried: Kingsford, yea; Williams, yea; Orton, yea; Brewer, yea Agenda 8 OTHER BUSINESS: Councilman Brewer reported on the meeting with the Senior Citizens the previous week. He stated that the outcome of the meeting was a definite feeling they should make application for the HUD Grant. They have decided to solicit donations from the community prior to the application. Councilman Orton reported that next summer the Highway Department will be paving Meridian Street from the Railroad track to Cherry Lane. He stated that there was some water line wank planned in Meridian Street but not this year. Another project had priority because the Public Works were not aware they were going to do this this year. Orton questioned the Council as to changing priorities and if they should consider doing this project first, or do both projects and use reserve money or forget about the Meridian Street project for several years. He recommended doing this project alone or in addition and estimated the cost apx. $24,000. It was the feeling of the Council to have the Meridian Street Water project take priority to prevent having to tear up the new lay-over top. Councilman Williams reported that the Pacific Northwest Pollution Control Convention will be held in Portland October 21st and our Plant is in the running for "Plant of the Year". WasteHlater Superintendent Earl Ward is to represent the City of Meridian. The Motion was made by Orton and seconded by Brewer to approve Wastewater Superintendent Ward's attendance to the Pacific Northwest Pollution Control Convention in Portland, Oregon on October 21, 1981, which has been budgeted for $400.00. Councilman Williams thanked Public Work's Superintendent Bruce Stuart publicly for his help and working with Earl Ward to find infiltration of basically clear water running through the sewer lines. lilliams stated that over the last six weeks Earl and Bruce have located over 300,000 gallons per day saving for the Plant. SPECIFICALLY TABLE III THEREOF, ENTITLED SCHEDULE OF WATER USE FEES, INCREASING BY NINE PERCENT (9%) WATER USE FEES. WHEREAS, the City Council and the Mayor of the City of Meridian have concluded that it is in the best interest of said City to amend TITLE 5, CHAPTER 1, by the revision of Section 5-131 entitled Monthly Rates, specifically Table III of said Section entitled Schedule of Water Use Fees, increasing by nine percent (9%) water rates charged City water users effective October 1, 1981. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR ANO CITY COUNCIL OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO: Section 1. That Title 5, Chapter 1, Departments, Water System, be and the same hereby is amended by the revision of Table III, Schedule of Water Use Fees, fo Section 5-131, which Table III shall read as follows: TABLE III Schedule of .Water Use Fees A non-resident user shall be double the rate of a similar user who is entirely within the corporated limits of the City. The minimum for multiple building developments shall be the amount that is greater as determined from Table II and Table III according to gallons consumed, 1 unit minimum $3.00 for 1,000 gallons or Table III, whichever is greater, 2 to 75 units $3.00 multiplied by the number of units or volume of use, Table III, whichever is greater, 75 units and above $225.00 or Table III, whichever is greater.
